Call to Order
The OtterTail County Board of Commissioners convened Tuesday, October 17, 2000 at 9:36 a.m.
at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Dennis Mosher, and Malcolm Lee present.
Approval of Agenda
Motion by Nelson, second by Mosher, to approve the County Board agenda of October 17, 2000
· with additions as follows:

Approval of Minutes
Motion by Froemming, second by Lee, to approve the County Board minutes of October 10, 2000
as mailed. Motion carried.
Ag Update
Extension Educator, Doug Holen, reported that farmers in Otter Tail County are pleased with the
yields of beets, corn, potatoes, and small grains. He attended a regional Minnesota Pollution
Control Agency (MPCA) meeting last month regarding feedlot regulations. Extension will learn
about the regulations and then bring the information back to the producers. The regulations
contain three categories based on animal units. The MPCA will encourage farmers to register their
feedlot, which will be necessary to be eligible for cost share funds, if the feedlot is in non-
compliance with the new regulations. The first meeting regarding the Chapter 7020 feedlot
:regulations is scheduled for December 7, 2000 to be held in Fergus Falls in the morning and New
York Mills in the afternoon. Mr. Holen noted that a list of feedlots is being developed by the MPCA
and a copy should be available soon.
Mercury Reduction Discussion
Solid Waste Public Information and Education Officer, Marie Tysdal, provided information
regarding health concerns and hazards associated with mercury. Otter Tail County has formed a
partnership with the City of Fergus Falls and Otter Tail Power to reduce the mercury that gets into
our waste stream and potentially emitted into the environment from our incinerators. Ms. Tysdal
provided an extensive list of products that contain mercury. Mercury can be disposed of at the
Household Hazardous Waste center at the Recycling Center in Fergus Falls or at the mobile
collections that are held throughout the County. On October 261\ the partnership will exchange
mercury thermometers for the digital thermometers. The solid waste joint powers counties need
education so they don't put mercury-containing devices into their garbage which ends up at
incinerators in Otter Tail County. The partnership is also conducting a survey with businesses
regarding the use and disposal of mercury containing devices. The City of Fergus Falls may
consider a ban of the sale of mercury thermometers at retail centers in Fergus Falls.

Non-Mandated Services Q
Accountant, Mitzi Pederson, provided a list of non-mandated services funded by Otter Tail County.
The total current funding for these services is $205,904, which is 1.49% of the total tax levy. Chair
Portmann asked other board members if they wanted the County to have a policy for non-
mandated services. She recommended considering $10,000 for next year for a "challenge grant".
Discussion followed. By general consensus, commissioners agreed to put $10,000 in the 2001
budget for non-mandated services in the form of a Challenge Grant. Motion by Nelson, second by
Froemming, to give the EQT Historical Museum $3,000 from this year's budget. Discussion
followed. Motion carried with Nelson, Mosher, and Froemming in favor and Partmann and Lee
opposed. Motion by Partmann, second by Lee, to require the EQT Historical Museum to come
back to the board and report on exactly what the $3,000 will be used for as the use should benefit
the entire County. Motion carried.
Approval to Pay Bills
Motion by Nelson, second by Lee, to approve payment of bills per Attachment A of these minutes
which include the following lodging payments:

Motion carried.
Ditch System No. 4
Ditch Inspector, Tiny Holm, raised the issue of whether or not Ditch No. 4 should be cleaned out at
this point. According to law, the County cannot charge the total watershed without a public
notification. Only those people on the Ditch System from 1901 were notified. The County could
wait to do the clean out until after the redetermination of benefits is completed. The County could
do the repair and assess those landowners from 1901 for the engineer's study (approx. $13,000)
and the clean out (approx. $44,000). Then the redetermination of benefits would be done to
include everyone and the cost would be assessed the complete system. If other repairs are
needed later, the landowners on the complete system would be notified and assessed. If the
repair is postponed, the clean out will not take place until next fall. Commissioners requested
another Public Hearing on this issue to further clarify the issues. Assistant County Attorney,
Jennifer Lessinger, will research notification requirements to hold another public hearing and set
up the date and time.
Request for Forgiveness of Penalty
Treasurer, Steve Andrews, requested forgiveness of penalty on behalf of John 0. Nord for parcel
no. 32-000-99-0387-000. The property was purchased in February and the individual did not
receive the tax statement. The tax statement was sent to the latest owner of record as the address
change was not completed before the cutoff date to send out tax statements. Motion by Lee,
second by Mosher, to forgive the penalty of $47.92 for parcel no. 32-000-99-0387-000 because the

individual did not receive his tax statement. Motion failed with Nelson, Partmann, and Froemming
opposed and Lee and Mosher in favor.
Motion by Nelson, second by Froemming, to deny the request for forgiveness of penalty of $47.92
for parcel no. 32-000-99-0387-000 because it was not due to County error. Motion carried with
Lee opposed.
GIS Clerk Position
Motion by Lee, second by Mosher, to approve compensation grade 7 as recommended by DMG
for the GIS Clerk Position and authorize the GIS Department to proceed with posting and .hiring for
the position. Motion carried.
Planning Commission Recommendations
Conditional Use Permit -Peter Doll et al:
Motion by Nelson, second by Lee, to approve a Conditional Use Permit for a cluster development
on Parcel H of GL 2 as presented. The property is described as Parcel H of GL 2 (4.74 Ac)
Section 15 of Rush Lake Township; Boedigheimer Lake (56-212), GD. Motion carried.
Preliminary Plat -"OakView Country Estates:
Motion by Lee, second by Mosher, to approve the revised plan for the Preliminary Plat of ''OakView
Country Estates" consisting of. 16 residential lots as presented at the Planning Commission
meeting of October 11, 2000. The property is described as Pt. of NW¼ of SW¼, SE¼ of SW¼,
SW¼ of SE¼ & Government Lot 3, Section 20 of Aurdal Township; non-shoreland & Otter Tail
River (56-OTR), AG. Motion carried.
Conditional Use Permit -Brent V. Jongeward:
Motion by Lee, second by Froemming, to approve a Conditional Use Permit to fill in for driveway
and lawn between garage and roadway with conditions as recommended by the Planning
Commission. The property is described as Lot H in Pt. of Gov. Lot 4, Section 27 of Lida Township;
Lake Lida (56-747), GD. Motion carried. ·
Conditional Use Permit -Lake Region Recreational Center:
Motion by Froemming, second by Lee, to approve a Conditional Use Permit to reduce erosion on
the bank as presented. The property is described as Lots 1 & 2, Block 1, Blain Heights, Section 29
of Otter Tail Township; Otter Tail Lake (56-242) GD. Motion carried.
Conditional'Use Permit -Curtis & Donna Mark:
Motion by Mosher, second by Nelson, to approve a Condition~!. Use Permit for an after-the-fact
request of 50 yards of class 5 gravel for a parking area with conditions as recommended by the
Planning Commission. The property is described as survey lots of GL 5 & 6 called Lots 17 & 18,
Section 33 of Tordenskjold Township; Stalker Lake (56-437), RD. Motion carried.
Conditional Use Permit -Tom W. Hanson:
Motion by Lee, second by Mosher, to approve a Conditional Use Permit to include the re-furbishing
and sales of boats, motors, and· trailers with conditions as recommended by the Planning
Commission. The property is described as Pt SE ¼ NW ¼ (4.76 Ac), Section 1 of Scambler
Township; Pelican Lake (56-786), GD. Motion carried.

Otter Tail County Planning Commission
Commissioner Nelson reported that he attended a recent Planning Commission meeting and was
overwhelmed by the expertise and good questions and concern shown by every single member on
the commission and on behalf of the County Board would like to thank them for their service.
Motion by Nelson, second by Mosher, to send a letter of appreciation to the Planning Commission
for their hard work and service to the County. Motion carried.
Proposed Shoreland Management Ordinance Amendments
Motion by Lee, second by Nelson, to enact the following Shoreland Management Ordinance
(SMO) amendments as recommended by the Planning Commission effective January 1, 2001:

II. DEFINITIONS
42. Lot Width: The shortest distance between lot lines as measured on a line most parallel to
the lake shore at the legal building setback lffie and not being less than the required lake frontage.
43. Manufactured Home: A structure, transportable in 1 or more sections, which in the traveling
mode, is 8-1/2 body ft. or more in width or 40 body ft. or more in length, or when erected onsite, is ~399
or more square ft. and which is built on a permanent chassis and designed to be used as a dwelling with or
without a permanent foundation. (This includes "park models" that meet this definition.)
53. Recreational Camping Unit (RCU): A relocatable single-family dwelling unit, less than 40
ft. in length, and less than 399 square feet when erected on site, including, but not limited to tents, motor
homes and travel trailers.
57. Setback: The minimum horizontal distance between a structure, sewage treatment system

B. The minimum area and lot widths of residential lots without water frontage, i.e.
backlots, must be doubled. Backlots of no less than 5,000 square ft. may be created if they are
legally joined to a lakeshore parcel within 200 feet of the backlot and contain permanent restrictions
against residential construction. Such nonresidential backlots must be created by subdivision plat in
such a manner as to allow for orderly attachment to lakeshore parcels and with appropriate
restrictive covenants. The final plat will not be accepted unless it identifies the lakeshore parcel to
which each new lot shall be penmanently attached. The surface area of backlots physically
separated from lakeshore lots cannot be included for purposes of the impervious surface limitation
contained in Section IV.8.B.
IV. GENERAL REQUIREMENTS
2. Sanitation Standards:
The sanitation standards for this Ordinance are set forth in the Sanitation Code of Otter Tail
County, which is incorporated herein by reference, an official copy of which is on file for use and
examination by the public in the office of the County Auditor. Any lot with a dwelling unit shall have an
approved method of sewage disposal.
3. Shoreland Alterations:
Vegetative alterations and excavations or grading and filling necessary for the construction of
structures and sewage treatment systems under validly issued permits for these facilities are exempt from
the vegetative alteration standards in this subpart and separate permit requirements for grading and filling.
However, the grading and filling conditions of this subpart must be met for issuance of permits for structures
and sewage treatment systems. Alterations of vegetation and topography must prevent erosion into public
waters, fix nutrients, preserve shoreland aesthetics, preserve historic values, prevent bank slumping and
protect fish and wildlife habitat. Wetland acreage lost as a result of a topographical alteration must be
replaced in accordance with the provisions of the Wetlands Conservation Act and within the boundaries of
the property or the minor watershed upon which the wetland acreage was located.
B. No grading, filling or alteration of existing topography, including retaining walls, shall
be performed in the shore impact zone, bluff impact zone or a wetland, in any amount; or elsewhere
in the shoreland area in excess of W 20 cubic yards per year, unless a Conditional Use Permit or a
Grade/Fill Permit has been obtained pursuant to this Ordinance, prior to any earth being moved (the
property owner is legally responsible for all surface. water drainage that may occur). All work
involving less than W 20 cubic yards per year shall be performed between April 15th and September
1st of any year, unless otherwise authorized by a Permit.

Cluster Developments:
A. General:

have been in operation continuously since October 15, 1971 may continue to operate the number,
type and size of dwelling units which were in operation on October 15, 1971. Any change will
require that the owner obtain a Conditional Use Permit which will authorize a specific number, type
and size of dwelling units.
All owners of Fesorts, RV 13arl<s, FAaAYfastureEI home 13arl<s and saA=113~roun8s cluster
developments which have opened since October 15, 1971, must have a Conditional Use Permit
which specifies the number, type and size of dwelling units which they are authorized to operate.
Any change in number, type or size of dwelling units requires a new Conditional Use Permit.
When applicable, all resorts, RV 13aFks, recreational camping areas manufactured home
parks and campgrounds must also receive a license from the Minnesota Department of Public
Health.

A. A Site Permit shall be obtained prior to erecting or installing a new structure or
altering any structure or part thereof. A Site Permit shall also be obtained prior to moving a
structure. The applicant, for a Site Permit, shall file fli& an application which shall include a scale
drawing of Ri&-the proposal in the office of the Administrative Officer and pay a fee as determined in
the Fee Schedule. The Administrative Officer may require an onsite inspection prior to issuing such
a permit. The applicant shall notify the Administrative Officer once the building footings have been
constructed for an inspection. Prior to these inspections. the applicant shall stake out all lot lines
and road right-of-ways.
C. A recreational camping unit. for dwelling purposes. may be placed on a lot, without a
Site Permit on a temporary basis not to exceed 22 days per year, however. all setback§ aRa siae
yaFti FSEllaliFemeRts shall be complied with and no sewer, water. or electrical connections shall be
allowed.
2. Administrative Officer:
D. May issue "Grade/Fill Permits" for grading and filling projects of not more than 300
cubic yards. or for conservation projects approved by a Soil and Water Conservation District. The
Administrative Officer may require an on-site inspection prior to issuing such a permit. Within three
days of completion, the applicant for a Grade/Fill Permit must notify the Administrative Officer that
the project is ready for inspection.
3. Conditional Use Permits:
C. Within 3 days of making an application for a Conditional Use Permit. the applicant
shall stake the lot lines. road right-of-ways and area under construction in such a way as to
demonstrate the area to be topographically altered or the location of a proposed structure and post
his name and address in a clearly visible location on the property.

H. Within 3 days of making an application for a variance the applicant shall stake the lot
lines. road right-of-ways. and area under consideration and post his name and address in a clearly
visible location on the property.

This Ordinance as amended shall be in full force and effect on and after May 1, 1997
January 1. 2001.
Discussion took place regarding excluding livestock from GD and RD lakes. This issue was
referred to the Planning Commission for a recommendation for amendment change. The County
Board noted that the Resort Associations should be notified regarding proposed SMO changes.
