Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, October 3, 2000 at 9:30 a.m.
at the Otter Tail County Courthouse with · Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Dennis Mosher, and Malcolm Lee present.
Approval of Agenda
Motion by Lee, second by Froemming, to approve the County Board agenda of October 3, 2000
with changes as presented. Motion carried.
Approval of Minutes
Motion by Nelson, second by Mosher, to approve the County Board minutes of September 26,
2000 with the following correction: Under Planning Commission Recommendations, Conditional
· Use Permit request of James Briks, Commissioner Mosher was in favor of the motion, not opposed
as reflected in the September 26th minutes. Motion carried. · .

Canvassing Board
Motion by Nelson, second by Mosher, to appoint Commissioner Roger Froemming and
Commissioner Malcolm Lee to the Otter Tail County Canvassing Board for the Tuesday,
November 7, 2000 State General Election. Motion carried.
WesMin Resource Conservation and Development Council
WesMin RC&D Vice-President, Norm Fjestad, introduced WesMin RC&D Coordinator, Dean
Schmidt and Program Specialist, Amy Shogren. Mr. Schmidt presented several brochures and a
slide presentation regarding the history, vision, and mission of the WesMin RC&D. Mr. Schmidt
works with a 14-County area and coordinates many projects with local entities as well as
individuals. RC&D projects that benefit Otter Tail County include the Pomme de Terre River
Watershed, the erosion project on Otter Tail Lake, and the grant writing process for the restrooms
at the Phelps Mill Park. Program Specialist, Amy Shogren, presented information regarding the
Pomme de Terre River Watershed and ·requested more involvement from Otter Tail County
because a very large portion of the watershed is in Otter Tail County (128,830 acres). There are
opportunities for grant funding as the Pomme de Terre is a tributary of the Minnesota River which
is receiving a lot of focus right now. The next meeting is Monday, October 30th at 9:30 a.m. afthe
Soils Lab in Morris. Ms. Shogren invited the County Commissioners to attend.

Ditch System No. 4 Q
At the September 26, 2000 County Board Meeting the Board authorized proceeding with the clean
out of Ditch No. 4 and redetermination of benefits for landowners in the ditch system. Motion by
Froemming, second by Lee, to approve the following Ditch Viewers for the Ditch System No. 4
redetermination of benefits: Rod Brause, Howard Goese, and Richard Bergquist. A 4th Ditch
Viewer to be determined will accompany the aforementioned Ditch Viewers for training purposes.
Motion carried.
Motion by Froemming, second by Nelson, to award to the lowest bidder, Duane Moench of
Wadena, the clean out project of Ditch System No. 4 in the amount of $42,500 as recommended
by the Ditch Inspector. The Ditch Inspector stated that the value of benefits for Ditch System No. 4
will be greater than the cost of this project. Motion carried.
Conservation Projects
WOTSWCD Director, Brad Mergens, introduced discussion regarding conservation projects
completed in the fall of the year to prevent soil erosion. The problem is the timeline because work
cannot progress until after the crops are off the field. If the project needs a Conditional Use
Permit, the timeline for appearing before the Planning Commission prevents projects from being
completed as the weather becomes too cold. The purpose of these projects is to conserve and
benefit the land and the permitting process and timelines create a difficult situation. County
Attorney, David Hauser, stated that the Board can authorize exemptions from the permitting
process in the ordinance and the Board is currently amending the Shoreland Management
Ordinance. Mr. Mergens stated that review of the projects by the Land & Resource Department r'\
would not be a problem. Commissioners referred this issue to the Planning Commission for a W
recommendation.
Residential Marker Assessments
GIS Coordinator, Sherri Leabo, reported that the residential markers have been installed and
legislation has been passed to allow the County to assess residents for the cost of the markers.
The proposed special assessment per address is $22.50. The County Attorney noted that the
process requires notification. Since the County knows the exact cost, the notice will be written to
satisfy both Public Hearing requirements pursuant to the statute. Mr. Hauser and Bob Block will
work together to supply notice to residents regarding the proposed assessments and Public
Hearing.
Approval to Pay Bills
Motion by Mosher, second by Nelson, to approve payment of bills per Attachment A of these
minutes. Motion carried.
Final Payments
Motion by Lee, second by Froemming, to approve final payment per estimate no. 9 in the amount
of $72,112.28 payable to Central Specialties, Inc. as final payment for completion of the CSAH No.
74 project, S.A.P. 56-674-01 as recommended by the Highway Engineer. Motion carried.
Motion by Lee, second by Mosher, to approve payment in the amount of $59,016.50 payable to
Foltz buildings, Inc. for completion of a 60' x 120' storage building as recommended by the Q
Highway Engineer. Motion carried.

Pomme de Terre Joint Powers Board
Chair Partmann appointed Commissioner Mosher to the Pomme de Terre Joint Powers Board.
Perham Resource Recovery Facility
Solid Waste Director, Mike Hanan, reported that he received an• updated draft contract from the
City of Perham since last Tuesday's County Board meeting. Many issues have been resolved in
the contract language; however, some policy issues need to be addressed. The issue of liability
for City default is unresolved. The initial draft contract received from the City of Perham included
language that made the City 100% liable in cases of City default. The latest draft contract passes
through that liability to the counties. Last week, commissioners decided that the City of Perham
should take 8% of the debt service risk for uncontrollable circumstances. Lengthy discussion took
place regarding the types of situations that would be considered uncontrollable circumstances.
Chair Partmann stated that the 8% liability was intended only for the unforeseen circumstances.
Mr. Hanan did not make a recommendation; however, stated that he has a hard time agreeing to
8% liability if the reason for default is the City of Perham's fault. Discussion regarding the
monitoring of the facility operations and the proposed operator, Barlow Group took place. City of
Perham Administrator, Bob Louiseau, stated that the facility would be monitored through monthly
,operations reports, meetings, and physical inspections; however, had not planned to bring in a
specialist in the field unless a particular problem warranted that need. The second issue
.discussed was the pass through liability for the spot market waste of approximately 2,800 tons that
would not be contracted for delivery. In the worst case scenario whereby none of the waste is
obtained, the counties would pay their share of the 2,800 tons. In the case of Otter Tail County,
the share would be approximately 40%. Discussion regarding the extra waste followed.
Commissioners were not opposed to the City of Perham finding a waste source for the 2,800 tons
and expressed dissatisfaction with paying for waste that is not delivered. The issue of how waste
delivered is paid for was discussed. Commissioners suggested balancing quarterly to pay for
waste delivered rather than annually as stated in the City's latest draft contract. The following
issues will be researched further and discussed further at the next County Board meeting:
1) Liability for City default
2) Limited damages for the City of Perham of $100,000
3) Process of payment of solid waste delivered
Chair Partmann requested that the Solid Waste Director provide pros and cons for the major
issues relative to the Perham Resource Recovery Facility.
Budget Discussion
Chair Partmann expressed concern about the budget process relative to the EOT Museum request
for funding. She suggested the possibility of setting aside funds similar to a grant situation
whereby non-mandated services that service the County could lobby for the funding. A policy
would need to be developed. The matter will be discussed at the next County Board meeting.
Adjournment
At 12:25 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
