Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 19, 2000 at
2:05 p.m. at the City Hall in Parkers Prairie with Commissioners Virginia Partmann, Chair; Roger
Froemming, Vice-Chair; Syd Nelson, and Malcolm Lee present. Commissioner Dennis Mosher
was absent.
Approval of Agenda
Motion by Lee, second by Froemming, to approve the County Board agenda of September 19,
2000 with the following addition:
Perham Resource Recovery Facility Discussion -3:45 p.m.
Maplewood Bike Path/Central Lakes Trails
Motion carried.
Approval of Minutes
Motion by Nelson, second by Froemming, to approve the County Board minutes of September 12,
2000 as mailed. Motion carried.
Approval to Pay Bills
Motion by Lee, second by Nelson, to approve payment of bills per Attachment A of these minutes.
Motion carried.
C.P. 00:35 -City of Dent
Motion by Nelson, second by Lee, to authorize the Chair's signature to execute a contract between
the County of Otter Tail and Houge Inc. of Detroit Lakes, MN for C.P. 00:35, Street Drainage
Improvements in the City of Dent contingent upon the approval of the County Attorney. Motion
carried.
Phelps Mill Bridge
Rick West, Highway Engineer, reported that at the annual meeting of Maine Township, the Town
Board requested assistance in determining options for the restoration, replacement, or
abandonment of the Phelps Mill Bridge which is under their jurisdiction. The Bridge was closed to
traffic lastyear because of structural concerns. Motion by Lee, second by Froemming, to authorize
the Chair's signature to execute an agreement between the County of Otter Tail (acting as an
agent for Maine Township) and Interstate Engineering for completion of an analysis of the Phelps
Mill Bridge and options available including funding options. The analysis work is approved notto
exceed $5,000 and Maine Township is responsible for the cost. Motion carried.
Final Payment -Rural Addressing Residential Markers
·Mr. West reported that the rural addressing house number signs have been installed throughout
Otter Tail County and the project is complete. Motion by Lee, second by Nelson, to approve the
final payment of $64,847.53 to H & R Construction for completion of the Rural E-911 Addressing
Residential Markers project. Total project amount was $435,832.65. This cost will be charged
back to homeowners according to recent legislative action. Motion carried.

Motion by Lee, second by Froemming, to request the Highway Engineer to send a letter of thanks Q
to H & R Construction for their great performance on this job not only installing signs but also
answering questions by the public regarding the project. Motion carried.
Professional Services Agreement for Aerial Photography
Motion by Nelson, second by Lee, to authorize the Chair's signature to execute an agreement
between the County of Otter Tail and Markhurd for aerial photography services, in the amount of
$12,650, for the CSAH No. 52 project. This aerial photography will be used for design purposes
and is digitized. Motion carried.
MnDOT Recommendation -CSAH No. 82
Motion by Partmann, second by Lee, to accept the recommendation of the Minnesota Department
of Transportation to keep the 45 mph speed limit as currently posted on CSAH No. 82 south of
Fergus Falls and not extend that speed limit because of the middle turn lane. Motion carried.
Petition to Reduce Speed
Mr. West acknowledged receipt of a petition submitted by Cal Monroe requesting a reduction in
speed to 35 mph from CSAH No. 31 east to Crystal Hills Road. This request will be considered
next spring because of the CSAH No. 4 reconstruction project currently underway.
Maplewood Bike Path
Commissioner Lee introduced discussion regarding the proposed bike path between Pelican
Rapids and Maplewood state. park. Otter Tail County is the sponsor only for this project because ,,
of population. The Trail Group working to move the project forward is having problems acquiring •
land. Lengthy discussion followed regarding abandonment of land, federal and local funding
received, and Otter Tail County's past practice of sponsoring these types of projects only and not
becoming involved with acquisition of property or funds, maintenance or construction of trails.
County Coordinator, Larry Krohn, discussed key issues relative to the Central Lakes Trail acquired
differently because it is a abandoned railway. Discussion followed.
Recess & Reconvene
At 3:00 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners recessed for a tour of Parkers Prairie. The meeting was reconvened at 3:50 p.m.
Perham Resource Recovery Facility Discussion
County Attorney, David Hauser, provided several letters recently written regarding the Perham
Resource Recovery Facility both from representatives of the Perham City Council and Otter Tail
County. The issue of the City of Perham accepting some. risk was discussed. If the City of
Perham gives liability back to the county that would preclude any risk the City would be accepting.
In the proposed contract, the County would be liable for any reason (defined as uncontrollable
circumstances); however, in the Letter of Intent, the County would be liable only if the County
defaults in some manner. Questions regarding responsibility after the 20-year term of the contract,
tipping fee, responsibility for solid waste supply, etc. were discussed .. Commissioner Nelson stated
his opinion that the County should be the spoke and guarantee 32 tpd and landfill the rest of the
County's solid waste. Chair Partmann requested that Mr. Hauser talk to State officials to obtain
advise on Resource Recovery Facility contracts. Q

TIF District Public Hearing
On Monday, October 2, 2000 at 5:30 p.m., the Fergus Falls Port Authority will conduct a public
hearing on the Modification of Tax Increment Financing District No. I 1-12 (a housing district). The
proposed modification will be located on approximately 2.8 acres in Block 1, Westgate Addition.
The modification to Tax Increment Financing District No. I 1-12 will assist in the development of a
28-unit general occupancy, market rate apartment building. If the modification is approved, tax
iricrement will be used to fund the costs of property acquisition and site improvements.

Resolution Waiving the Thirty Day Notification Period Pursuant to Minnesota Statutes,
Section 469.175, Subdivision 2-Tax Increment Financing District No. 11-12
Otter Tail County Resolution No. 2000 -40
WHEREAS, the Fergus Falls Port Authority is considering the modification of Tax Increment
Financing District No. 11-12; a_nd
WHEREAS, Minnesota Statutes, Section 469.175, Subdivision 2 requires that the Otter Tail
County Bo_ard of Commissioners_ shall be provided notice of the proposed modification and an
estimate of the fiscal and economic implications of the proposed modification at least thirty days
before the public hearing required by Minnesota Statutes, Section 469.175, Subdivision 2; and
WHEREAS, Otter Tail County is in receipt of the Fiscal and Economic Implication for Tax
Increment Financing District No. I 1°12 proposed to be modified by the Fergus Falls Port Authority;
and
WHEREAS, the Fergus Falls Port Authority has requested a waiver of Otter Tail County's thirty-day
comment period as provided by Minnesota Statutes, Section 469.175, Subdivision 2; and
WHEREAS, the Otter Tail County Board of Commissioners desires to waive the thirty-day
notification requirement in order to expedite the Port Authority's modification of Tax Increment
Financing District No. 11-12.

NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners 0

Commissioner Nelson seconded the resolution and, upon being put to vote, was unanimously
adopted.

NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the repurchase of the above described tax forfeited property and finds that the
repurchase is in the best public interest and that it will relieve any undue hardship resulting from
the forfeiture.
Commissioner Nelson seconded the resolution and, upon being put to vote, was unanimously
adopted.

Motion by Nelson, second by Froemming, to approve the Preliminary Plat of "Silver Lake Prairie
Lane" consisting of 4 single family residential lots and a Conditional Use Permit to construct a road
and upgrade an existing driveway to service the plat with conditions as recommended by the
Planing Commission. Bill Kalar, Land & Resource Director, stated that any changes in the
construction of the road from County specifications would require a variance. The property is
described as Part of Government Lot 2, Section 7 of Gorman Township; Silver Lake (56-224).

Conditional Use Permit -Char-Mac Resort:
Motion by Nelson, second by Froemming, to approve a Conditional Use Permit to attach a 24' x 24'

Motion by Froemming, second .by Lee, to approve a Conditional Use Permit to expand .the dining
room to the east, 20' x 45' with conditions as recommended by the Planning Commission. The

Conditional Use Permit -Michael & Tracy Sheldon:
Motion by Lee, second by Nelson, to table the Conditional Use Permit request of Michael & Tracy

Conditional Use Permit -Otter Tail County Highway Department:
Motion by Lee, second by Froemming, to approve a Conditional Use Permit to conduct a grade
raise and resurface an existing County Highway with conditions as recommended by the Planning
Commission. The property is located on CSAH No. 30 from a point 3,685 ft. North of 430th St,
thence along CSAH No. 30 to a point 5,493.5 ft. North of 430th Street, Section 13 of Norwegian
Grove Township, Lake Olaf (56-950). Motion carried.

Correspondence Acknowledged
Chair· Partmann acknowledged a letter received from Mr. Illa concerning sound and shooting
relative to the Viking Valley Hunt Club. The letter was referred to Mr. Kalar to investigate or refer
to the appropriate department/entity regarding the debris situation and shooting allegedly occurring
within the shoreland area.
Commissioner Nelson offered the following and moved its adoption:
OCTOBER 2000 AMENDMENT TO THE
OTTER TAIL COUNTY FLEXIBLE BENEFITS PLAN
Otter Tail County Resolution No. 2000 -42
WHEREAS, Otter Tail County (the "Employer") provides employees with an opportunity to pay for
certain employee welfare benefits on a pre-tax basis through the above mentioned Plan (the
"Plan"); and
WHEREAS, the Employer considers is desirable and in the best interests of the Plan to make the
following amendment to the Plan;
NOW, THEREFORE, pursuant to the authority reserved in the Plan to allow amendments to the
Plan, the Plan is amended as follows:
Effective October 1, 2000, the provisions of the Plan governing a Participant's ability to revoke a
benefit election and make a new benefit election during the Plan Year shall be administered in
compliance with the Final and proposed Cafeteria Plan Regulations issued March 23, 2000, which
are summarized as follows:
CHANGE IN STATUS RULES
Events
The following Change in Status events, when they result in an eligibility change for underlying
welfare benefits, shall be recognized under the Plan:
. • Legal marital status change (marriage, divorce, death of spouse, legal separation and
annulment)
• Change in number of tax dependents (birth, placement for or adoption, death)
• Employment Status Change for employee, spouse or dependent (employment
termination or commencement, strike or lockout, unpaid leave of absence, change in
worksite)
• Dependent satisfies or fails to satisfy eligibility requirements (age, student status,
marriage)
• Residence change of employee, spouse, or dependent
• Commencement or termination of adoption proceedings for adoption assistance.
Consistency Conditions
Further, the election modification on account of any of the status changes must be consistent with
that status change. Where the status change makes an employee, spouse or dependent eligible
for coverage, the election modification permitted is to add the newly eligible individual or increase
the deduction for the coverage. Where the status change makes an employee, spouse or
dependent ineligible for the underlying welfare benefit coverage (divorce, legal separation,

annulment or death of the employee's spouse or dependent), the election modification permitted is
to drop the coverage for that individual. If the employee, spouse or dependent becomes eligible
for coverage under a family member's plan due to open enrollment, or a change in marital or
employment status, the affected individuals must actually elect that coverage in order to drop
coverage under this Plan.
Consistency Exceptions
• Where the status change in marital status, disability and life insurance coverages may
be increased or decreased.
• When the status change is loss of dependent status, an election modification to allow a
participant to pay COBRA continuation premiums on a pre-tax basis may be made.
Change in Cost or Coverage
If a cost increase is "significant", a participant may increase the Plan election or revoke his or her
election and make a new election for coverage under a similar welfare benefit plan. If welfare
benefit plan coverage•is "significantly curtailed" a participant may revoke his or her election and
make a new election for coverage under a similar benefit plan. Too meet the "significant
curtailment" standard, there must be an "overall reduction in coverage" resulting in reduced
coverage to participants in general under the welfare benefit plan. If a new option is added to the
welfare benefit plan or if an option is eliminated from the welfare benefit plan, participants may
make new elections, corresponding to the change, under this Plan. Dependent care spending
account elections shall be administered according to these rules. Health care spending account
elections shall not eligible for modification under these rules, in accordance with the Proposed
· Regulations.
Miscellaneous
The Employer reserves the right to automatically initiate changes to participants' elections where
an insignificant change in cost occurs or where the Plan is required to follow a judgment, decree or
order that mandates coverage for an employee's dependent. A participant who gains Medicare or
Medicaid coverage shall be allowed to drop or reduce an election amount; an employee or
participant who loses Medicare or Medicaid coverage shall be allowed to begin or increase
coverage. Employees rehired within 30 days of their most recent termination of employment shall
have their most recent election amounts automatically reinstated. Employees rehired more than
30 days after their most recent termination of employment shall be allowed to make new elections
under the Plan as new hires.
THESE RULES shall hereby supercede and replace the election change rules of the Plan effective
for status events that occur on and after October 1, 2000. These rules are intended to comply with
the Final and Proposed Cafeteria Plan Regulations issued on March 23, 2000. In the event that
these rules are ambiguous for any particular situation, the Final and Proposed Cafeteria Plan
Regulations shall be the decisive authority for administration of the Plan.
Commissioner Lee seconded the resolution and, upon being put to vote, was unanimously
adopted.

posting/hiring process for a Medical Director position for the Detention Facility (grade 22 as

At 5:25 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners recessed until 7:00 p.m. September 19, 2000 at the City Hall in Parkers Prairie
where they will convene for purposes of the County Drainage System No. 4 Public Hearing.
Public Hearing
County Drainage System No. 4
The Otter Tail County Board of Commissioners reconvened, as the County Drainage Ditch
Authority, at the City Hall in Parkers Prairie, MN at 7:00 p.m. on Tuesday, September 19, 2000, for
the purpose of further considering a petition for the improvement of County Drainage System No.
4, for examining the Engineer's Preliminary Survey Report, for hearing the report of the
Commissioner of Natural Resources on the preliminary plan and to receive comments from those
who were in attendance at the public hearing.

0 Virginia Partmann, Chair, addressed the order that the meeting would follow and then called upon
David Hauser, Attorney, for opening remarks. David Hauser, Attorney, noted the following:

the engineer's preliminary report has been completed, has been presented to the drainage Q
authority and will be reviewed at this hearing,
the Department of Natural Resources has submitted a letter concerning the proposed project,
the members of the County Board serve as the County Drainage Authority,
the County does not own the drainage system,
a petition for the repair had been received and an informal meeting regarding the petition had
been held last spring at which time it was decided to proceed with a preliminary engineer's
report,
the Drainage Authority must decide whether or not to proceed with the repair project, and
a re-determination of benefits will need to be completed to properly reflect the properties
benefited by the drainage systems and to properly reflect present day values.
Tiny Holm, Ag/Ditch Inspector, provided the following information relative to County Drainage
System No. 4:
the drainage system was established on December 3, 1901,
the drainage system at that time benefited 990 acres,
the total benefits assigned when the drainage system was established totaled $4,438.00, and
the present day watershed in the immediate area affected by the drainage system contains
approximately 15,700 acres.
At this time Tiny Holm, Ag/Ditch Inspector, introduced Damon Devillers, an Engineer with Interstate
Engineering, Inc., who reviewed the engineer's preliminary survey report, discussed the work they (")
had completed, explained the present condition of the drainage system, noted problem areas W
within the system, discussed establishing the gradeline, the elevation of various culverts and
answered questions from those in attendance. It shall be noted for the purpose of the minutes as
reference only that a copy of the engineer's preliminary survey report is on file with the Otter Tail
County Auditor's office.
Tiny Holm provided the following information for consideration by those in attendance:
1. the letter from Julie A. Aadland, Hydrologist with the Department of Natural Resources, in
which they note that they have reviewed the engineer's preliminary survey report, the
protected waters and their request that the repair be completed in a manner that has the
least impact on the Wing River.
2. an estimate for the repair work from Moench Excavating in the amount of $42,500 and
3. an estimate for the repair work from MBC Drainage Inc. in the amount of $42,875.
Tiny Holm also noted that the engineer's preliminary survey report cost approximately $13,000 and
a re-determination of benefits for the drainage systems would cost approximately $6,000 to
$8,000. An estimated total cost for the repair project, therefore, would be approximately $64,000.
The following is a brief summary of the questions, comments and discussion that occurred with
those in attendance at the public hearing:
1. the elevation of the various culverts,

crossing,
7. how would the drainage system be fixed (from the top down or from the bottom up),
8. would their be an ongoing maintenance assessment to be the system functional in the future,
9. the affect upon existing wetlands and
10. the width and slope of the drainage system.
After a period of questions and discussion, Virginia Partmann, Chair, asked how many individuals
were interested in continuing with the repair project. By a show of hands it appeared that the
majority of those in attendance would like to have County Drainage System No. 4 repaired.
Virginia Partmann, Chair, noted that no decision would be made at this hearing, but that the
Drainage Authority would consider the information received at this hearing and would make their
decision on Tuesday, September 26, 2000.
Adjournment
Hearing no further questions, comments or discussion, Virginia Partmann, Chair, thanked
everyone in attendance for their participation and then adjourned the meeting at 7:55 p.m. until
Tuesday, September 26, 2000.
