Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 5, 2000 at
9:33 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Nelson, second by Lee, to approve the County Board agenda of September 5, 2000 with
the following additions:
VSO, Jourdan Sullivan at 10:50 a.m. -State Grant Resolution
Safety & Emergency Services Director, Tim Hunt-11 :15 a.m. -Retirement Announcement
Land & Resource Director, Bill Kalar -CUP Extension Request
Personnel Committee Meeting -11 :45 a.m.
Perham Incinerator Discussion -2:00 p.m.
Closed Session -Pending Litigation
Motion carried.
Approval of Minutes
Motion by Mosher, second by Froemming, to approve the County Board minutes of August 22,
2000 as mailed. Motion carried.
Gravel Pit Regulations
Chair Partmann requested that the County Attorney research applicable laws relative to gravel pits
and responsibility to .restore the pits after the gravel has been excavated. The information should
then be shared with the Planning Commission and a recommendation made to the County Board.
Ditch No. 25 Public Hearing
Ditch Inspector, Tiny Holm, reported that Ditch No. 25 flows into Big McDonald Lake, then down
into Star Lake. This Ditch Hearing is relative to a set of culverts the township wants to install under
a township road that services cabins on the north side of Big McDonald Lake. The Township is
requesting to install two 18" culverts where there is currently one 20" culvert. The Township will
pay for all costs so there will be no additional cost to landowners. The County Attorney reported
that the County has an Engineer's report showing that this project can be completed as requested.
Edna Township Board member, Keith Brakke, spoke in favor of the project and reported that this
road is scheduled to be tarred on Thursday of this week. Jerry Lowe, resident on North Shore of
Big McDonald Lake, also spoke in favor of the project because the road is highly traveled and
services the Public Access. He stated that a benefit of increased values on these affected lots, in
his opinion, is not warranted. No further comment was offered; therefore, at 9:44 a.m., Chair
Partmann closed the Public Hearing for Ditch No. 25. A motion was then offered by Nelson,
seconded by Lee, to approve the installation of two 18" culverts to replace one 20" culvert in the
Ditch No. 25 system on Big McDonald Drive N road. Motion carried.
Approval to Pay Bills
Motion by Nelson, second by Froemming, to approve payment of bills per Attachment A of these
minutes. Motion carried.

Closed to the Public Q
At 9:47 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation involving the acquisition of
property on Highway 4 as authorized by attorney-client privilege, M.S. 471.705 Subd 1d. Present
were all seated commissioners, the County Attorney, County Coordinator, Recording Secretary,
and Highway Engineer.
Meeting Opened to the Public
EQT History Museum
At 10:00 a.m., Chair Partmann opened the meeting to the public and resumed discussion of the
scheduled agenda items. EQT History Museum Director, Lina Belar, updated the Board regarding
the museum. The museum celebrated its second anniversary, has received many state grants,
and serves as an education resource for tourists and community residents. Board President,
Trisha Hammond, presented activities and award information from history researched at the
museum and stressed the museum's educational value. She requested the County Board's
financial support. Commissioner Nelson recommended to the Budget Committee that the 2001
budget include $3,000 for the EQT Historical Museum and $7,000 be budgeted for year 2002 for
the museum.
Approval of Final Plats
Motion by Mosher, second by Lee, to approve the final plat of Sylte Estates, a nine lot subdivision,
located on Long Lake (Sec. 16, Twp. 132, R. 41, Lake No. 56-428). Motion carried.
Motion by Nelson, second by Lee, to approve the final plat of Buchanan Oaks (Sec. 35, Twp.
135N, R. 39W, Rush Lake Township). Motion carried.
Conditional Use Permit Extension Request
Motion by Mosher, second by Lee, to extend CUP #5779 granted to Merle Johansen on North
Turtle Lake to October 1, 2000. Motion carried.
CSAH No. 72 & County Highway 145
· Highway Engineer, Rick West, reported that because of lack of records, exact highway right of
ways on CSAH No. 72 and County Highway 145 are not known. Mr. West requested that the
County solicit quotations from land surveyors to define the County's right of ways in these
locations. Motion by Nelson, second by Froemming, to proceed with soliciting quotations from
surveyors for. this project as presented. Motion carried.
MN Chapter Project of the Year Transportation Award
Mr. West reported that the Otter Tail County Highway department has been selected to receive the
"Project of the Year -Transportation Award" for the implementation of a countywide street
numbering and addressing system. The County Board congratulated everyone involved in the
E-911 addressing project on this honor. GIS and Highway employees involved with the project will
make a presentation at the American Public Works Association annual conference and award
ceremony scheduled for November 16th.

Additional Payment Approval -Joint Ditch No. 2 0
Motion by Lee, second by Mosher, to approve an additional payment to Wilkin County, in the
amount of $5,202.69, for services provided to Wilkin/Otter Tail Joint Ditch No. 2. Otter Tail County

was previously billed for 33.5% of the total cost incurred and the correct percentage for Otter Tail
County's share of the ditch system is 47.5%. Motion carried.
Tax Increment Financing District Public Hearing
The City of Perham has scheduled a public hearing at 7:00 p.m. on Monday, October 9, 2000 to
consider the establishment of TIF District No. 2-16. This is a housing district and will enable the
City of Perham to facilitate construction of two four-plexes.

Motion by Lee, second by Froemming, to approve the following application for license:

State Primary Election Canvassing Board.
Chair Partmann and Commissioner Lee will serve on the Otter Tail County Canvassing Board for
the Tuesday, September 12, 2000 State Primary Election. The Canvassing Board will meet at
10:00 a.m. on Friday, September 15, 2000 in the Auditor's office.
State Audit Letter
Motion by Mosher, second by Nelson, to authorize the signatures of the Chair of the County Board,
County Auditor, and County Coordinator, on the management representation letter for the audit of
the County's general purpose financial statements for the year ended December 31, 1999. Motion
carried.
Grant Application Request
VSO Jourdan Sullivan requested approval of a resolution authorizing application for an annual
state grant from the MN Department of Veterans Affairs in the amount of $6,000. He stated that
the grant dollars would be used for office upgrade including a new printer, fax machine, and hard
mount cell phone for the VSO van. Commissioner Nelson offered the following and moved its

Local Government Resolution
Otter Tail County Resolution No. 2000 -37
BE IT RESOLVED that CVSO, Jourdan Sullivan, act as the legal sponsor for project(s) contained
in the County Veterans Service Officers Grant Application submitted on August 30, 2000 and that
the County Veterans Service Officer is hereby authorized to receive grant funds from the•
Minnesota Department of Veterans Affairs for funding of this project on behalf of Otter Tail Coul)ty.

County Assessor Reappointment
Motion by Lee, second by Froemming, to reappoint Bob Moe as the Otter Tail County Assessor
effective for a 4-year term (01/01/2001 through 12/31/2004). Motion carried.
Green Acres Discussion
Commissioners noted that the public has questions about Green Acres including why the County is
adopting the law at this time. Mr. Moe explained that the law has been in effect since the 1960's
and now that so much development is occurring, the law has come to the forefront statewide. The
MN Department of Revenue has been urging Otter Tail County to institute the law. Sales of
properties show a need to implement Green Acres because valuations are becoming a problem.
Chair Partmann requested that Mr. Moe make a Q & A brochure available for the public regarding
the Green Acres law.
Safety & Emergency Services Director -Retirement Announcement
Tim Hunt, Safety & Emergency Services Director, announced his retirement effective October 6,
2000. He cited increased demands on his personal life and a desire to travel as a reason to
reorder priorities. Motion by Lee, second by Mosher, to accept Mr. Hunt's resignation and thank
him for his successful years of employment and implementation of the County's safety program.
Motion carried.
Letter Acknowledged
Chair Partmann acknowledged receipt of a letter from the Otter Tail Lakes Property Owners
Association regarding weeds on our lakes. The County Attorney will clarify the intent of the letter
and respond.
Closed to the Public
At 11 :26 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of MIS Director,
Tim Brand, pursuant to M.S. §471.705 Subd. 1d(d). At 12:00 p.m., upon conclusion of Mr. Brand's
performance evaluation, Chair Partmann declared the meeting recessed for lunch break. After
lunch break and committee meetings, at 1 :30 p.m., the Otter Tail County Board of Commissioners'
meeting was reconvened in closed session for the purpose of evaluating the performance of
Physical Plant Manager, Rick Sytsma, pursuant to M.S. §471.705 Subd. 1d(d). All five seated
commissioners were present for both evaluations. A summary of performance conclusions will be
provided at the next regular board meeting.
Perham Incinerator Discussion
At 2:10 p.m., upon conclusion of Mr. Sytsma's performance evaluation, Chair Partmann declared

Perham Incinerator. Solid Waste Director, Mike Hanan, reported that draft contract issues were
discussed with the City of Perham last week. He stated that direction is needed from the Board
regarding policy issues. Mr. Hauser reviewed the main portions of the draft contract. The
proposed contract is a 20-year contract, contains a guarantee of acceptable w13ste amount, and a
potential for the tipping fee to be higher than $48 per ton. If ash disposal is included in tipping fee,
it may not be enough to cover the County's cost. Mr. Louiseau reported that the metal fee was
supposed to be included in the tipping fee and was inadvertently omitted. He stated that the City
has a contract with the Barlow Group for operating the facility for 10 years with two 5-year options.
Financially, the debt service amount will be fixed, there will be a capital expenditure repair budget,
and an administrative fee for the City of Perham of 1 % of all other fees. Currently, this figure would
be approximately $61,000. If the facility processes more than 36,000 tons per year, 25% goes to
the operator, 25% goes to the City of Perham, and 50% goes to the counties enterprise fund. If
additional steam sales become a reality, the distribution is proposed to be the same as the bonus
formula. Lengthy discussion took place regarding the City of Perham's lack of risk. Chair
Partmann stated that if the City of Perham receives revenues from this project administratively,
they also must take a percentage of the risk if something goes wrong, (i.e.) losing a permit to
operate. Lengthy discussion took place regarding the amount of waste required per day. The
previous projected amount of waste was 100 tpd, now the proposed figure is 112 tpd.
Mr. Louiseau will provide further information to the County Board so the issue can be discussed
further at their next regular Board meeting. He stated that the City of Perham has scheduled a
special meeting on September 14, 2000 to consider waste contracts.
Truth-in-Taxation Waiver
County Coordinator, Larry Krohn, reported that the Board of Government Innovation and
Cooperation may give authority to counties to exempt specific rules. In the past, the only way Otter
Tail County has contacted taxpayers is by mail and the postage is a large part of the cost in the
truth-in-taxation process. He suggested that the County apply for a waiver from the the truth-in-
taxation process and use the savings that would have been spent on postage to establish a
County website where budget information for taxpayers could be accessed. The County could
offer to link the site with other local government units for increased access to information. Mr.
Krohn stated that the MIS Computer Steering Committee and the County Auditor would work on
this process. Motion by Lee, second by Mosher, to authorize the MIS Computer Steering
Committee to proceed with the waiver application as described and use the funds saved if the
waiver is approved to establish a County website. Motion carried.
Market Survey for Law Enforcement
Motion by Lee, second by Froemming, to authorize the County Coordinator to proceed with an
agreement with DMG, not to exceed $3,500, to perform a market survey for specific law
enforcement job classifications as previously negotiated. Motion carried.
"Conserving Wooded Areas in Developing Communities"
Motion by Lee, second by Froemming, to send the book entitled "Conserving wooded Areas in
Developing Communities" to all members of the Otter Tail County Planning Commission and the
Board of Adjustment to emphasize the importance of conserving trees in their deliberations.
