MINUTES OF THE
OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, August 1, 2000, at 9:32 a.m. at
the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Lee, second by Nelson, to approve the County Board agenda of August 1, 2000, with
the following additions:
Tiny Holm -Ditch Issues at 1 :00 p.m.
Karen Lundin -MCIT Dividend Announcement at 10:50 a.m.
Discussion -Solid Waste Issues
Discussion -Office Decorating Policy
Request for Closed Session -Attorney-Client Privilege
Discussion -Letter from Newton Town Board
Motion carried.
Approval of Minutes
Motion by Froemming, second by Mosher, to approve the County Board minutes of July 25, 2000,
as mailed. Motion carried.
Otter Tail River Watershed Project Agreement
Land & Resource Director, Bill Kalar, reported that last year, Otter Tail County entered into an
agreement to facilitate projects in the Otter Tail River Watershed with Challenge Grant funds. He
reported that $100,000 has been designated for different projects. He discussed two projects
reshaping highly eroded banks on Lake Lida and Otter Tail Lake and requested formal approval to
proceed.
Motion by Lee, second by Mosher to authorize the Chair's signature to execute a mutual
agreement between Becker County, Becker SWCD, Otter Tail County, East and West Otter Tail
SWCD's, Wilkin County and Wilkin SWCD for cooperation in the conservation of natural resources
in the Otter Tail River Watershed. Wilkin County will serve as fiscal agent. Motion carried.
Extension Request on Conditional Use Permit #5728
Mr. Kalar received a letter from John Walsh requesting an extension of one year on his CUP.
Motion by Mosher, second by Froemming, to approve an extension on CUP #5728 for John Walsh
until 8/17/2001 as requested. This is for a town home development in Clitherall Township. Motion
carried.
Discussion -Proposed Shoreland Management Ordinance Revisions
Mr. Kalar provided a handout with proposed Shoreland Management Ordinance revisions dated
7/14/00 recommended by the Planning Commission. Mr. Kalar reviewed all proposed changes
with discussion regarding the following recommendations:

111.4.B. Lot Area and Setback Requirement: "Backlots of no less than 5,000 square ft. may be
created if they are legally joined to a lakeshore parcel within 200 feet of the backlot, and contain
permanent restrictions against residential construction. Commissioner Lee was not in favor of this
change and further stated that by deleting this requirement altogether, you would be creating more
non-buildable area. General discussion followed.
IV.3 Shoreland Alterations: Wetland acreage lost as a result of a topographical alteration must
be replaced in accordance with the provisions of the Wetlands Conservation Act and within the
boundaries of the property or the minor watershed upon which the wetland acreage was located.
Discussion took place regarding state minor watershed maps and a suggestion that distance and
miles could be used instead of the maps.
IV.10.i Subdivision Provisions: Lakes, rivers wa~or oornsos and marsh areas and such other
information as location of 100 year flooEI 13laiA areas the ordinary high water level or highest known
water elevation and contours at vertical intervals of not more than 10 ft. or five fl. in bluff impact
zones and on steep slopes. All elevation data shall be mean-sea level or some other assumed
workable datum. Commissioner Lee requested that the County Attorney research as to whether or
not the County's SMO complies with federal flood plain regulations for purposes of flood insurance.
The County Attorney will establish a date and time for the public hearing for the recommended
revisions of the SMO.
Recess and Reconvene

At 10:35 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of n
Commissioners recessed for a short break. The meeting was reconvened at 10:40 a.m. with all "w
commissioners present.
4-H Update
Extension Educators, Steve Handegaard and Donna Geiser, updated the board regarding the
recent West and East Otter Tail County Fairs. They emphasized that the fairs provide
opportunities for educational and social growth as well as promoting family relationships. There
were 1,100 4-H livestock projects and over 3,000 non-livestock projects at the fairs this year. Work
will continue to prepare 4-H'ers for the state fair.
Year 2000 MCIT Dividend
Human Resource Coordinator, Karen Lundin, reported that the County will receive a dividend this
year in the amount of $329,697 attributed to good performance for our workers' compensation and
property and casualty insurance. Ms. Lundin reported a 59% decrease in premiums compared to
1999.
Speed Zone Study -CSAH No. 9
Highway Engineer, Rick West, reported that the MnDOT conducted a speed zone study on CSAH
No. 9 from the intersection of CSAH 20 to a point approximately. 220 feet west, as requested by
resolution from the County Board. MnDOT did not recommend a reduced speed limit; however,
recommended installing a pedestrian warning sign and increased enforcement in the area. Motion
by Lee, second by Froemming, to support the MnDOT recommendation to leave the speed as
posted on CSAH No. 9 with additional recommendations followed by Otter Tail County. Motion Q
carried.

Commissioner Nelson offered the following and moved its adoption:
Premise Permit
Otter Tail County Resolution No. 2000 -36
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the Perham Lions Club, Perham, MN, has made an application to the Gambling
Control Board for a premise permit to conduct lawful gambling at Pair A Dice Resort, in Pine Lake
Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a
premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the Perham Lions Club, Perham, MN, at Pair A Dice Resort, in Pine
Lake Township of Otter Tail County;
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by Perham Lions Club, Perham, MN, at Pair A
Dice Resort, in Pine Lake Township of Otter Tail County, provided the applicant meets all the
necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the
Township of Pine Lake by sending them a copy of this resolution.
Commissioner Froemming seconded the resolution and, upon being put to vote, was unanimously
adopted.

Payment Approval Q
Assessor, Bob Moe, requested payment for lobbyist services regarding proposed utility legislation. ·· ·
Motion by Nelson, second by Lee, to approve payment to the Goodhue Co. Auditor, in the amount
of $319.20, for Otter Tail County's share for maintaining the Utility Coalition for the period of July 1,
2000 through December 31, 2000. Motion carried.
Approval to Pay Bills
Motion by Froemming, second by Nelson, to approve payment of bills per Attachment A of these
minutes. Motion carried.
Solid Waste Discussion
Commissioner Lee reported that Becker County is hauling garbage to Fargo paying $25 per ton
with a new contract with a hauler charging $1.35 per mile. They are spending approximately $40
per ton. Discussion followed. Chair Partmann suggested that this information be researched
further before a decision is made regarding the incinerators located in Otter Tail County.
Office Decorations
Commissioner Lee, on behalf of the Budget Committee, requested that the Building Committee
draft a policy for office decorations.
Recess & Reconvene
At 11 :34 a.m., Chair Partmann recessed the meeting of the Otter Tail County Board of
Commissioners for a short committee meeting and lunch break. The meeting was reconvened at
1:00 p.m.
Ditch Issues
Ditch Inspector, Tiny Holm, discussed with the Board several ditch issues as follows.
Ditch No. 29: Mr. Holm reported that a meeting was held regarding clean out of Ditch No. 29.
After the meeting, several calls were received from concerned lakeshore owners on Rush Lake
that a clean out of the ditch could cause damage for some lakeshore owners. Lengthy discussion
followed. Mr. Holm will research issues further.
Ditch No. 70: Mr. Holm requested approval to allow draining directly into Ditch No. 70 rather than
directly into Sewell Lake. The land is part of the ditch system. The County Attorney stated that if
they are benefited property owners, they can drain into the lake. However, the property owners
would prefer to drain directly into the ditch system. The Ditch Inspector and County Attorney will
research this issue further.
Ditch No. 5: Mr. Holm updated the Board on Ditch No. 5 in Henning. The culvert has been
cleaned out. The plan is to put a Clemson Leveler in this culvert to keep it cleaned out.
Ditch No. 63: Mr. Holm questioned if the WOTSWCD engineer's study can be used for this ditch or
is the County required to have its own engineer's study completed? The County Attorney will
research the statute.
Ditch No. 41: Mr. Holm reported that the cement culvert south of the railroad tracks and south of a
wetland is caving in and there is a need to put in a larger culvert. This would allow water to go out
and filter into a slough. Mr. Hauser questioned what was initially designed, as that would

determine the size of the culvert that can be installed at this time. Mr. Holm will research this issue
and report back to the Board.
August 8, 2000 Meeting Location Changed
The Otter Tail County Human Services Board and Board of Commissioners will meet at the Otter
Tail County office in New York Mills next week beginning at the regularly scheduled time of
9:30 a.m.

Adjournment
At 1 :40 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation involving the acquisition of
property on Highway 4 as authorized by attorney-client privilege, M.S. 471.705 Subd 1d. Present
were all seated commissioners, the County Attorney, County Coordinator, Recording Secretary,
and Highway Engineer.
At 1 :51 p.m., upon conclusion of the closed session, Chair Partmann declared the meeting of the
Otter Tail County Board of Commissioners adjourned until Tuesday, August 8, 2000 in New York
Mills.
