Approval of Agenda Motion by Nelson, second by Mosher, to approve the County Board agenda of July 18, 2000, with the following additions: Motion carried. Tiny Holm -Ditch No. 25 Discussion at 11 :50 a.m. Proposed SMO Revisions under Bill Kalar Personnel Committee Meeting Approval of Minutes Motion by Lee, second by Froemming, to approve the County Board minutes of July 11, 2000, as mailed. Motion carried. Economic Development Strategy Update West Central Initiative EDA Planning Specialist, Mike Schreiner, provided copies of the Comprehensive Economic Development Strategy (CEDS) and requested approval in support of the CEDS. Commissioner Nelson offered the following and moved its adoption: Resolution in Support of 2000 Comprehensive Economic Devlopment Strategy for West Central Minnesota Otter Tail County Resolution No. 2000 -32 WHEREAS, The West Central Minnesota Initiative Fund has prepared a Comprehensive Economic Development Strategy (CEDS) for the region containing Becker, Clay, Douglas, Grant, Otter Tail, Pope, Stevens, Traverse, and Wilkin Counties of Minnesota (west central Minnesota); and WHEREAS, The CEDS contains analysis, economic data, economic development projects, and goals and objectives for the betterment of the region; and WHEREAS, Availability of an approved CEDS and related annual updates are a condition for qualifying for grants for local economic development projects from the Economic Development Administration of the U.S. Department of Commerce; and NOW, THEREFORE, BE IT RESOLVED, That the Board of County Commissioners of Otter Tail County, Minnesota, approves the 2000 Comprehensive Economic Development Strategy for west central Minnesota. They briefed the board regarding several programs being administered by West Central Initiative to improve the quality of communities as they relate to families and children. The programs include Rural Help Network, Picture It Painted, Transportation, and WesMN.net. 4-H & Ag Update Extension Educator, Angela Berge, briefed the board on 4-H Clothing Day and other 4-H events in conjunction with the county fair. Educator, Doug Holen, discussed the current agriculture situation, upcoming feedlot regulations, and information regarding genetically modified organisms. CSAH No 30 -Lake Olaf Water Elevation Rick West, Highway Engineer, reported that a portion of CSAH No. 30 roadway needs to be raised Q because water is on the roadway. He requested approval to proceed with the project. Motion by ·." Lee, second by Froemming, to proceed with the CSAH No. 30 project to raise the grade because of flooding conditions. Motion carried. Project Update Mr. West reviewed the county's current construction and design projects. Commissioner Lee offered the following and moved its adoption: Speed Zone Study Request A Segment of CSAH No. 31 Otter Tail County Resolution No. 2000 -33 WHEREAS, a group of residents have requested that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on the segment of County State Aid Highway No. 31 from CSAH No. 20 south 3.1 miles to T.H. No. 59 AND, WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by the Minnesota Department of Transportation to determine the need for a reduced o· .. speed zone, if any , BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. 0 0 0 OTC Board of Commissioners' Minutes July 18, 2000 Page 3 Commissioner Froemming seconded the resolution and, upon being put to vote, was unanimously adopted. Dated: 7 -~ S ~ 'J...M-0 Attest: L~ ~ Larry Kro, Cerk Commissioner Mosher offered the following and moved its adoption: Speed Zone Study Request A Segment of CSAH No. 82 Otter Tail County Resolution No. 2000 -34 WHEREAS, the Otter Tail County Engineer has made a request that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit of 45 mph on the segment of County State Aid Highway No. 82 from the current 45 mph speed limit boundary to a point approximately 200 feet south of the DeLagoon Park entrance AND, WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. OTC Board of Commissioners' Minutes July 18, 2000 Page4 Mowing Contracts Q Motion by Nelson, second by Mosher, to authorize the Chair's signature to execute the following mowing contracts for the period of June 1, 2000 to September 30, 2001 contingent upon the approval of the County Attorney: · Duane Larson Clitherall, MN Steve's Road Maintenance Vergas, MN Orlin Johnson Henning, MN Area G Area A Area J License Approval $13,531.42 $15,755.24 $13,971.10 Motion by Froemming, second by Lee, to approve the following application for license: Joseph Koep Koep's Clitherall Corner 21136 County Highway 5 Clitherall, MN Motion carried Tobacco Commissioner Froemming offered the following and moved its adoption: Premise Permit Otter Tail County Resolution No. 2000 -35 WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Amor West Side Supper Club, in Amor Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at the Amor West Side Supper Club, in Amor Township of Otter Tail County; 0 NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at the Amor Q West Side Supper Club, in Amor Township of Otter Tail County, provided the applicant meets all · the necessary criteria for the licenses and permits as required by the Gambling Control Board. 0 0 () .• J, ,. Planning Commission Recommendations Conditional Use Permit -Leaf Lake Partnership: Motion by Froemming, second by Lee, to approve a Conditional Use Permit to park a 15' travel trailer on the property and place 2 bunkbeds in the utility building with conditions as recommended by the Planning Commission. The property is described as Part of Government Lot 2, Section 23 of Leaf Lake Township; East Leaf Lake (56-116). Motion carried. Conditional Use Permit -Rush Lake Township Motion by Froemming, second by Nelson, to approve a Conditional Use Permit to rebuild a township road with conditions as recommended by the Planning Commission. The propery is described as Rush Lake Township Road -44?1h Ave (Buchanan Lake Public Access), Section 35 of Rush Lake Township; Buchanan Lake (56-209). Motion carried. Conditional Use Permit-Steven & Grace H. Maje: Motion by Mosher, second by Nelson, to approve a Conditional Use Permit, as presented, to utilize a studio for photographic portraits under the business name of Northern Star Studio. The property is described as Pt. of GL 7 & of GL 8, Section 19 of Leaf Mountain Township; Spitzer Lake (56-160). Motion carried. Conditional Use Permit -David Ward: Motion by Lee, second by Nelson, to approve a Conditional Use Permit to add fill for a driveway with conditions as recommended by the Planning Commission. The property is described as Lot 10, Block 3, Woodland Acres in Section 36 of Candor Township; Loon Lake (56-523). Motion carried. Conditional Use Permit -Rose Ridge Resort/Roland & Barbara Olson: Motion by Nelson, second by Lee, to approve a Conditional Use Permit to divide property into two separate tax parcels with conditions as recommended by the Planning Commission. Motion by Froemming, second by Lee, to approve a Conditional Use Permit to build a 14' x 30' addition on existing residence as presented. Conditional Use Permit -Jane R. Magnuson/Edward R. Bergum: Motion by Froemming, second by Nelson, to approve a Conditional Use Permit to build a 48' x 60' building for a countertop shop with conditions as recommended by the Planning Commission. The property is described as Pt Gov Loi 5 Known as Lot 17 of Unrecorded Platt Rainbow Lake Retreat, Section 26 of Otter Tail Township; Pickeral Lake (56-204). Motion carried. Conditional Use Permit -Gary D. Holthusen: Motion by Lee, second by Froemming, to approve a Conditional Use Permit to construct a private road with the permit valid for 2 years instead of 1 year and with all conditions as recommended by the Planning Commission. The property is described as GL 3 Ex Maplehurst & Ex Tr 4.35 Ac & Tri Tr in SE Cor of 25' and Tr in Lot 3 W & NWL Y of Lot 31 Maplehurst (4.35 Ac), Section 26 of Lida Township; Lake Lida (56-747). Motion carried. Preliminary Plat -Duane & Mary Loll/Loll's Lakeshore: Motion by Froemming, second by Lee, to approve the Preliminary Plat of "Loll's Lakeshore" consisting of 4 single family residential lots as recommended by the Planning Commission. The property is described as Part of Lot 7 & 8, Section 12 of Maine Township; Pickerel Lake (56-475). Motion carried. Conditional Use Permit #5764 -Bette Bensch et al % Margaret Hult: Land & Resource Director, Bill Kalar, reported that this Conditional Use Permit was issued in March of 2000 to create an access path to the property and according to the permit the access path was to be no wider than 8'. Mr. Kalar inspected this in May and found that a 14' -17' wide top was placed. He notified the owners that a change needed to be made. Les Bensch, on behalf of the owners, cited concerns regarding a top of 8' and reported that the contractor has reduced the top to 11' -13'. Mr. Bensch stated that the applicants are in compliance with the DNR and Army Corp of Engineers and that the contractor would have a very difficult time putting in a road less than 10'. Mr. Bensch requested that the County Board approve the road "as is" and then modify the current permit. Chair Partmann directed this request back to the Planning Commission. She requested that the Planning Commission view the road and give the County Board a recommendation with reasons. Commissioner Froemming will also view the road. 0 Extension of Conditional Use Permit #5720 -Dunn Township: Motion by Lee, second by Froemming, to authorize an extension of Conditional Use Permit #5720 Q to 9/1/00 for reshouldering of East Lake Lizzie Road. Motion carried. 0 0 Ditch No. 25 OTC Board of Commissioners' Minutes July 18, 2000 Page 7 Ditch Inspector, Tiny Holm, expressed concern regarding a ditch that has a plugged culvert. Eighty-seven beavers have been taken out of this ditch and now the dams need to be removed. Mr. Holm requested a Public Hearing to explain the expenses to the surrounding landowners. Commissioners requested that Tiny schedule the Public Hearing. Taxes Due -Postmark Valid County Attorney, David Hauser, reported that there is a provision in the law for mailing tax payments whereby if the payment is mailed by the due date, the payment is considered timely. The postmark is proof; however, private postage meters are not considered evidence. Viking Valley Hunt Club The County Attorney researched the complaints brought forth at the last County Board meeting regarding Viking Valley Hunt Club. He stated that the county has no control over noise, only control 1000' from the lake. Mr. Bensch is willing to meet with the concerned surrounding landowners. Chair Partmann requested that the County Attorney send letters to Mr. Newton and Mr. Illa regarding the issue(s). Transfer of Funds for AS400 Computer System Motion by Lee, second by Froemming, to authorize a transfer of $120,000 from the Capital Improvement Fund to the MIS Operating Fund for upgrading the AS400 computer system and for some network equipment.
