HomeMy WebLinkAboutBoard of Commissioners - Minutes - 07/11/20000 0 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, July 11, 2000 9:30 a.m. Call to Order The Otter Tail County Human Services Board convened Tuesday, July 11, 2000, at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present. Election of Officers -Human Services Board Chair Partmann called for nominations for FY2001 Human Services Board Chairperson. Motion by Nelson, second by Lee, with Froemming abstaining, to elect Commissioner Roger Froemming as the Human Services Board Chair for FY2001. Motion carried. Ms. Partmann called for nominations for Human Services Vice-Chair. Motion by Lee, second by Partmann, with Mosher abstaining, to elect Commissioner Dennis Mosher as Human Services Board Vice-Chair for FY2001. Motion carried. Approval of Agenda Chairman Froemming assumed the chair and entertained a motion for approval of the agenda. Motion by Lee, second by Nelson, to approve the Human Services Board agenda of July 11, 2000, as presented. Motion carried. Approval of Minutes Motion by Mosher, second by Lee, to approve the Human Services Board minutes of June 27, 2000, as mailed. Motion carried. Department of Corrections Grant Contract Motion by Lee, second by Partmann, to authorize the appropriate county officials' signatures to execute a grant agreement between the Minnesota Department of Corrections and the County of Otter Tail for Otter Tail County's Juvenile Restitution Program ($2,000), Caseload/Workload Reduction program ($125,332), and Remote Electronic Monitoring program ($14,500) for FY2001. Motion carried Adolescent Chemical Dependency Program Court Services Director, Chuck Kitzman reported that $11,983 of the Caseload/Workload Reduction grant is additional funding that must be used for a new program. A proposal has been received from Lakeland Mental Health Center. The program, Keys to lnnervisions, is a structured multi-system adolescent chemical dependency program involving a trained facilitator, videos, and training materials, to identify and reduce risk factors and build in protective factors for youth and the adults who have influence over them. LMHC has also received a grant from Dakota/Heartland Foundation. The county's adolescent CD program will enhance that program and allow LMHC to hire a specialist in the field. Motion by Nelson, second by Partmann, to authorize $11,983 from the Caseload/Workload Reduction grant to fund the Adolescent Chemical Dependency program as proposed by LMHC and to authorize contracting with LMHC to provide the services. Motion carried. OTC Board of Commissioners' Minutes July 11, 2000 Page2 Juvenile Out-of-Home Placement Funds O Mr. Kitzman reported that for FY2000, Otter Tail County received over $241,000 for juvenile placement funds. Because of the Redwing Facility legislation, Otter Tail County will receive $182,660 for juvenile placement funds for FY2001, which is a reduction of $60,000. It is not likely that the Red Wing per diem split with the state will offset the lost revenue for Otter Tail County. Commissioners suggested that the county's legislators be made aware that the Red Wing legislation does not benefit most kids in rural counties. This legislation was sunset for one year; therefore, will come up again next year. Medica Confidentiality Agreement Motion by Lee, second by Mosher, to authorize the Public Health Director's signature to execute the Medica Confidentiality Agreement between Medica Health Plan and the County of Otter Tail which relates to well child visits. Motion carried. Hardenberg Property Ms. Thorson reported that she has viewed the Hardenberg property in Dalton and corresponded with the owner. She told the owner that the burned building must be torn down and the debris removed from the property according to county ordinance. Lengthy discussion followed and pictures of the building were provided. Motion by Partmann, second by Lee, with Mosher abstaining, to proceed with demolition of the burned building on the Hardenberg property in Dalton after following the legal process for notification to the owner and/or other procedures legally necessary before demolition occurs. Motion carried. Lutheran Social Services Contract at Bancroft Site Ms. Thorson requested approval of a contract with Lutheran Social Services to provide public health nurse consultation at the Bancroft site. Discussion followed. Commissioner Partmann requested that the county wait until after the Public Health Department reorganization before entering into new contracts. School Health Aid Contracts Motion by Lee, second by Partmann, to renew school health aid contracts between the County of Otter Tail and the Pelican Rapids and Battle Lake school districts, to authorize a staffing pattern change in the Pelican Rapids district, and not to renew the contract with the New York Mills school district. These agreements are sunset after the 2000-2001 school year. Motion carried. Social Services Agency Goals and Objectives Human Services Director, John Dinsmore, presented a quarterly report including agency goals and objectives and criteria to determine program effectiveness. Home Health Care Contracts Motion by Partmann, second by Lee, to authorize the appropriate county officials' signatures to execute the following Home Care Purchase of Service Agreements for the period of July 1, 2000 to June 30, 2001 subject to the approval of the County Attorney: Motion carried. Greater Staples Hospital CARE Center and Home Care New Dimensions Home Health Care, Inc. 0 0 0 OTC Board of Commissioners' Minutes July 11, 2000 Page 3 Welfare-to-Work Local Intervention Funds Mr. Dinsmore briefed the commissioners on legislative action relative to TANF (Temporary Assistance to Needy Families) reserve dollars. These funds will be allocated to local intervention funds and home visiting funds to more effectively serve hard-to-employ MFIP participants who are expected to reach their 60-month lifetime benefit. The home visiting funds for individuals with incomes under 200% of poverty could be incorporated into the collaborative home visiting program. Target date to begin the home visiting program is January 1, 2001. Lake County Community Resources LCCR operates a toll free "800" information and referral help line. Mr. Dinsmore reported that 90% of the "patch through" calls from January 1, 2000 through May 31, 2000 were transferred to Social Services. He recommended funding $1,500 to defray LCCR's current costs. Motion by Nelson, second by Mosher, to allocate $1,500 to LCCR to cover costs for the program until such time as Otter Tail County operates a toll free 800 number. The funding source for this expenditure is from the projected $5,200 unexpended phone budget from the current Human Services budget. Motion carried. Bills & Claims Motion by Nelson, second by Mosher, to approve the Human Services bills and claims as presented. Motion carried. Motion carried. OTC Board of Commissioners' Minutes July 11, 2000 Page4 Forgiveness of Penalty Request Q Discussion took place regarding the forgiveness of penalty request from Timothy Nietzke. This request had been previously denied as the postmark from the St. Cloud office was May 16th. Chair Partmann read a letter written by Mr. Nietzke stating that he had delivered the payment to the Wadena post office on May 15th . In favor of the "common sense" approach, a motion was offered by Nelson and seconded by Froemming, to forgive the penalty assessed to this family parcel (Timothy Nietzke, Trustee). Discussion took place regarding other situations that may be similar. Motion and second were withdrawn. Motion by Froemming, second by Lee, to support the original motion to deny the request at the June 6, 2000, County Board meeting. Motion carried. Chair Partmann requested that the County Attorney write Mr. Nietzke regarding the County Board's decision. Payment Approval -Tax Forfeited Properties Motion by Lee, second by Froemming, to approve payment, in the total amount of $7,262.49, to Widseth Smith Nolting & Associates, Inc. for the following services: New York Mills -Initial Site Assessment Newton Township -Initial Site Assessment Rothsay -Initial Site Assessment Motion carried. $2,552.82 $2,494.99 $2,214.68 Commissioner Mosher offered the following resolution and moved its adoption: Conveyance of Tax Forfeited Property 0 Otter Tail County Resolution No. 2000 -31 WHEREAS, The County Board of Commissioners of the County of Otter Tail, State of Minnesota, Q desires to convey to the City of Battle Lake a certain parcel of land that forfeited to the State of · Minnesota on August 28, 1998 for the non-payment of payable 1994 property taxes, and 0 0 0 OTC Board of Commissioners' Minutes July 11, 2000 Page 5 WHEREAS, Said parcel of land by this resolution is being classified by the County Board of Commissioners of the County of Otter Tail as non-conservation lands as provided in Minnesota Statutes 282.01, and WHEREAS, The City of Battle Lake, by a resolution dated June 13, 2000 and by a letter dated June 14, 2000 has indicated a desire to acquire the following described non-buildable sub- standard tax forfeited parcel for public use as green space and for utility purposes: 63-000-99-0391-000 Moen's Second Addition -Battle Lake Lot 6, Block 1 WHEREAS, The size and shape of the above described parcel is such that development of the above described lot would be extremely limited and difficult, and WHEREAS, It has been determined that the conveyance of the above described parcel to the City of Battle Lake would provide the best use of this parcel by facilitating the City of Battle Lakes need for a green space area and to accommodate necessary utility easements. NOW, THEREFORE, BE IT RESOLVED That the Otter Tail County Board of Commissioners hereby certifies that the above described parcel of land has been examined and complies with the provision of Minnesota Statutes 85.012, 92.461, 282.01 Subd. 8 and 282.018 and other applicable statutes that require the withholding of tax forfeited lands from conveyance. BE IT FURTHER RESOLVED That the Otter Tail County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the conveyance of the above described tax forfeited parcel to the City of Battle Lake. Commissioner Froemming seconded the resolution and, upon being put to vote, was unanimously adopted. Dated:_~~"", .... <\"iil'-~L8=-i1,_2.oco=~---ARD OF COMMISSIONERS Attest: /4,p,11. ~ Larry Krdhn, ~ Viking Valley Hunt Club Property Owner, Bill Newton presented a petition with 38 signatures opposing the skeet and trap shooting and resulting noise from the Viking Valley Hunt Club. Chair Partmann read the petition and a letter from Larry Illa regarding the noise and other problems for area residents. County Attorney, David Hauser, stated that the Shoreland Management Ordinance is the only zoning that the county has which regulates 1000' from a lake. The Viking Valley Hunt Club has a permit to operate a private hunt club and the shooting portion of the business is beyond the 1000'. Gun clubs are excluded from the Minnesota Noise Pollution Control standards. Land & Resource Director, Bill Kalar, stated that the Viking Valley Hunt Club was granted a Conditional Use Permit in 1989 to operate a private hunting club which differs from a shooting range. It appears that the shooting portion is located over 1000' from the lake and would then be out of the county's OTC Board of Commissioners' Minutes July 11, 2000 Page 6 jurisdiction. Mr. Les Bensch, owner of the hunt club, submitted a letter detailing the history of the Q club and stating his position regarding noise levels. Further discussion took place regarding hours of operation. The County Attorney will research the issue further. Reclassification Motion by Lee, second by Mosher, to approve a reclassification of the position of Administrative Assistant in the Veterans Service Office from compensation Grade 10 to a Grade 11, effective February 1, 2000, as recommended by DMG/Maximus. The new title for this position is Office Manager/Transportation Supervisor. Motion carried. Otter Tail County Economic Development Tax Abatement Policy Motion by Mosher, second by Lee, to adopt the following change in the Otter Tail County Policy on Economic Development Tax Abatements, originally adopted on 9/8/98, under section 17 as follows: "17. The County will generally limit its relief to a deferral of taxes with an abatement of interest and penalties which would otherwise apply, with the taxes to be paid in a period of time not longer than twice the length of the period of deferral." This change is effective 7/11/00. Motion carried.
