OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, June 6, 2000 at 9:35 a.m. at
the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Lee, second by Froemming, to approve the County Board agenda of June 6, 2000,
amended as follows:
10:25 a.m. -Ditch Inspector, Tiny Holm -Ditch No. 25
10:30 a.m. -Treasurer, Steve Andrews -Request for Forgiveness of Penalty
Building Committee Meeting at 1 :00 p.m.
Motion carried.
Approval of Minutes
Motion by Nelson, second by Mosher, to approve the County Board minutes of May 23, 2000, as
mailed. Motion carried.
Discussion -Abatement Policy
Property owner, Jennifer Smestad, explained that she had purchased seasonal property. She
received her tax statement late and inquired. She was told that it was late because the property
was being reclassified from seasonal to farm/homestead. Because the difference between the
seasonal classification and homestead classification did not amount to over $50, no abatement
was possible. Ms. Smestad expressed concern with this policy and questioned whether $50 is the
appropriate number. County Attorney, David Hauser, requested that she officially request an
abatement with the Treasurer's office.
Planning Commission Recommendations
Conditional Use Permit -James Briks:
Corenia Kollasch Walz, attorney representing Mr. Briks, reported that she recently received
information that Mr. Briks was taken to the emergency room and because his situation is unknown,
she requested a continuance in consideration of this CUP on Otter Tail Lake. She noted that
Mr. Briks would appreciate an opportunity to address the issue with the County Board and to show
pictures of the proposal. Chair Partmann agreed with a continuance and informed Ms. Walz to
reschedule when possible.

Motion by Mosher, second by Nelson, to approve the reappointment of Donn Siems to a 4-year
term, effective July 1, 2000, on the Otter Tail Water Management District Board. Motion carried.
Motion by Froemming, second by Nelson, to approve the reappointment of Janice Palan, HRA
Board Member, to a 5-year term, effective August 1, 2000, on the Otter Tail County HRA Board.
Motion carried.

Exemption from Lawful Gambling Permits
The St. Lawrence Church, Perham, MN, has submitted an application to the Gambling Control
Board for an exempt lawful gambling permit, for an event scheduled on Sunday, August 6, 2000 at
the St. Lawrence Church. No action was taken.
The St. James Church, Maine, MN, has submitted an application to the Gambling Control Board for
an exempt lawful gambling permit, for an event scheduled on Sunday, September 10, 2000 at the
St. James Church. No action was taken.
Economic Development Tax Abatement Policy
Mr. Stein provided copies of the Otter Tail County Policy on Economic Development Tax
Abatements (adopted 9/8/98) and corresponding Minnesota Statutes for review.
Request for Forgiveness of Interest
Mr. Stein reported that Gary and Michelle Kurtz have requested an abatement of accumulated
interest in the amount of $54.09. Discussion followed. Motion by Nelson, second by Lee, to deny
the request of forgiveness of interest for Gary and Michelle Kurtz as there was no error on the part
of the county. Motion carried.
Payment Approval
Motion by Lee, second by Nelson, to approve payment, in the amount of $390.00, to Widseth,
Smith, Nolting, and Associates Inc. for the following environmental clean-up services provided:

Discussion -Abatement Policy
After going to the Treasurer's office as requested, Jennifer Smestad, reported that there is not an
official abatement request form and that her request for abatement was denied because the
request was less than $50. Treasurer, Steve Andrews stated that on 02/27/91, the County Board
approved a policy for the three tax offices to administer the abatement policies and if the taxpayer
doesn't receive satisfaction, their next step is to appeal to the County Board. Mr. Hauser stated
that if the property was incorrectly classified, we should refund the difference. Commissioner
Mosher noted that it appears the law has changed relative to abatement in these situations;
therefore, there should be a change in the county's policy. Motion by Lee, second by Mosher, to
correct this error, refund the money due, look at the current policy and revise if needed. Motion
carried.
Bid Award -S.A.P. 56-615-16 & Etc.
After previously advertising for bids, Highway Engineer, Rick West, opened the following bids at
1:00 p.m. on Wednesday, May 17, 2000 for S.A.P. 56-615-16 & Etc:

Motion by Mosher, second by Lee, to award S.A.P. 56-615-16 & Etc. to Central Specialties as the 0
low bidder at a bid price of $1,334,952.49. Motion carried.
Contract Approval -CSAH No. 24
Motion by Lee, second by Froemming, to authorize the Highway Engineer to enter into an
agreement between the Otter Tail County Highway Department and Braun-lntertec for soil
investigations work on the CSAH No. 24 reconstruction project west of Erhard. Motion carried.
Approval to Pay Bills
Motion by Lee, second by Froemming, to approve payment of bills per Attachment A of these
minutes, which includes the following lodging payment:
Normandy Inn Patrol Sergeants, Michael Brown & Marlys Adams
Motion carried.
Requests for Forgiveness of Penalty and Interest
On behalf of Hedahls Auto Parts, Treasurer, Steve Andrews, requested forgiveness of penalty and
interest for taxes due May 15, 2000. The payment was incorrectly sent to a PO Box and
consequently was not received on time. Motion by Portmann, second by Lee, to deny the request
for forgiveness of penalty and interest because the late payment was not the result of a county
error. Motion carried.
Chair Portmann acknowledged correspondence from Timothy Nietzke requesting forgiveness of
penalty and interest, in the amount of $18.58. Motion by Lee, second by Mosher, to deny Q
forgiveness of penalty and interest in the amount of $18.58 as requested by Timothy Nietzke
because the error occurred with the US Postal Service, not Otter Tail County.
Ditch No. 25
Ditch Inspector, Tiny Holm, reported that he has received the engineer's study for Ditch System
No. 25 and, the next step is to appoint the Ditch Viewers. A viewer's report will be completed and
then a public hearing date would be established. Motion by Lee, second by Froemming, to appoint
the following experienced Ditch Viewers for the Ditch No. 25 project in Edna Township:
Howard Goese, Rod Brause, and Richard Bergquist. Motion carried.
Mr. Holm provided a handout showing per diems for Ditch Viewers in other counties. The previous
compensation for Ditch Viewers in Otter Tail County was $50 per day established in 1995. Ditch
Viewers must attend three meetings per year in addition to the work required for individual ditch
systems. Chair Portmann referred Mr. Holm to the Personnel Committee and requested that he
return to the board in two weeks.
Public Health Department Recommendations
Public Health Director, Diane Thorson, presented two recommendations relative to restructuring of
the department.
1) Dental Program: The county has received state funding for purchasing dental equipment and
then can collect the Veden Funding of $50,000. Ms. Thorson presented the need to hire a full
time Portable Clinic Coordinator to work with inventory of equipment, scheduling clinics,
appointments, billings, advertising, etc for the dental program. Motion by Lee, second by
Mosher, to authorize the Public Health Director to hire a full-time Portable Dental Clinic
Coordinator for a period of one year with guaranteed funding and after one year, the position is
sunset based on grant dollar availability. Motion carried.

Q 2) Management Proposal: Ms. Thorson reported that she met with the Advisory Committee to
discuss the management positions within the Public Health Department. Because of being
unsure of what revenues are going to be, the Advisory Committee recommended reducing a
management position and during this restructuring situation, bring in outside consultation for
assistance in the restructuring of the programs and department. Motion by Lee, second by
Mosher, to authorize the Public Health Director to request that an outside consultant assists
the department during this restructuring and the motion further authorizes a management
position lay off. Motion carried.

Telephone System
County Coordinator, Larry Krohn, provided an expanded listing of phone numbers to be placed in
the upcoming phonebooks, which will set-up the county listings to accommodate eventual direct-in-
dial phone numbers. In order to proceed to an upgraded phone system, Mr. Krohn requested that
the lines and billings be streamlined to one company to prepare for a consultant to look at the total
system. He recommended that the county switch trunk lines for both local and long distance
service to Otter Tail Telcom with approximate savings of $200 per month from current charges.
Motion by Lee, second by Nelson, to approve changing the local and long distance phone service
to Otter Tail Telcom as recommended by the County Coordinator.
Closed to the Public
At 11 :00 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of Veterans
Service Officer, Jourdan Sullivan, pursuant to M.S. §471.705 Subd. 1 d (d). All seated
commissioners were present except Chair Partmann. A summary of performance conclusions will
be provided at the next regular board meeting.
Adjournment
Upon conclusion of the closed session, at 11 :40 a.m., Vice-Chair Froemming declared the meeting
of the Otter Tail County Board of Commissioners adjourned until Tuesday, June 13, 2000.
