OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, May 16, 2000 at 9:30 a.m. at
the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Froemming, second by Lee, to approve the County Board agenda of May 16, 2000,
amended as follows:
11 :35 a.m. -Personnel Committee Meeting
Motion carried.
Approval of Minutes
Motion by Lee, second by Mosher, to approve the County Board minutes of May 9, 2000, as
mailed. Motion carried.
GIS Department Staffing
,GIS Coordinator, Bob Block, reported on the GIS Department's 'salary over budget by 5-7%. He
noted that this is due to an increase in houses being built and extra trouble-shooting work as the
residential markers are being placed, which creates a temporary increase in work load. He
requested a transfer of funds and additional staff time.
Motion by Lee, second by Mosher, to transfer funds, in the amount of $26,000, from the GIS
Capital Improvement Fund to the GIS Operating Fund. The funds were originally budgeted for a
file server and will be used for additional salaries as needed. Motion carried.
Motion by Lee, second by Froemming, to authorize the GIS Coordinator to proceed with hiring,
through the Coordinator's office, for a GIS temporary secretarial support position, not to exceed
three months. Motion carried.
Motion by Nelson, second by Lee, to authorize an amendment to raise the maximum salary in the
DVC contracts from $1,300 per month to $1,500 per month for a period of three months. Motion
carried.
Correspondence Acknowledged
Chair Partmann acknowledged correspondence received regarding privatized development of
correctional facilities, a letter from property owner, Sherry Helmeke, letter of thanks to Veterans
Service Officer, Tom Figliuzzi, and letter from the Vice President of Public Affairs regarding a home
sales program.
Renewal of Contracts -Detention Facility
Jail Administrator, Gary Waskosky, requested approval of two contracts; 1) to continue the jail
kitchen contract, and 2) to continue the State ICWC program.

Motion by Mosher, second by Nelson, to authorize the Chair's signature to execute an amendment
and extension of the Detention Facility Food Service Contract between the County of Otter Tail
and Best, Inc. for the period of July 1, 2000 through June 30, 2001 to provide food services to the
county's detention facility at the following rates:

Motion by Lee, second by Froemming, to authorize the Chair's signature to execute an
amendment to the current contract between the DOC and the County of Otter Tail Detention
Facility for the state inmate ICWC program. The current program includes seven inmates at $50
per day with an increased number of inmates for the next fiscal period. Motion carried.

Motion by Nelson, second by Mosher to award the bid for a storage building to be built at the
Highway Garage No. 1 location to the low bidder, Foltz Buildings, Inc. of Detroit Lakes, MN, in the
amount of $55,428. Motion carried.
Motion by Lee, second by Mosher, to transfer $10,000 from the Sheriffs Department Fund to the
Highway Department Capital Improvement Fund for partial payment of the cold storage building.

Motion carried. Mr. Morris also plans to transfer $15,000 from Criminal Forfeiture funds to the
Highway Department for the building.
Approval of Agreement -Tank Removals
Motion by Lee, second by Froemming, to authorize the Chair's signature to execute an agreement
between the Otter Tail County Highway Department and Widseth Smith Nolting (WSN) for
engineering services related to the removal of six above-ground storage tanks at Vining, Perham,
Battle Lake, and Pelican Rapids at an estimated cost of $5,661 to $6,516. Motion carried.
Approval to Pay Bills
Motion by Nelson, second by Mosher, to approve payment of bills per Attachment A of these
minutes which include the following lodging payments:
Best Western Kelly Inn Patrol Sergeants, Ross Gullickson & Steve Brandner
Holiday Inn -Mpls. North Detention Facility Team Leaders, Janice Aaberg,
Geralyn Lyseng, and Richard Akerman

Approval of Contract -Otter Trail Riders Trail Association
Motion by Nelson, second by Froemming, to authorize the Chair's signature to execute a contract
between the County of Otter Tail and Otter Trail Riders Trail Association for maintenance of
snowmobile trails. The funding is from the state of Minnesota with Otter Tail County acting as the
fiscal agent. Motion carried.

Underage Liquor Sales Fine
Motion by Lee, second by Nelson, to concur with the recommendation of the following fines
established by the County Attorney for underage sale of liquor:
first offense -$200 second offense -$300 and education corrfponent
Motion carried.
Request for Temporary Conditional Use Permit/
Ted Bellmore, Last Resort Owner, requested a temporary Conditional Use Permit to operate a 3.2
and set-up establishment and rent three cabins for the summer season. Mr. Bellmore stated that
he was not aware that the previous owner had not renewed his Conditional Use Permit and the
earliest he could be scheduled with the Planning Commission was June 21 st• Lengthy discussion
followed. The County Attorney will research the ordinance language and County Board's statutory
authority relative to this issue and report back to the board at the next scheduled meeting.
Planning Commission Recommendations
Conditional Use Permit -Gorman Township:
Motion by Nelson, second by Froemming, to approve a Conditional Use Permit to replace a
deficient bridge no. 1476 located at 425th Avenue over the Otter Tail River (Sec. 34, Twp. 137N, ·o
R. 39W, Gorman Township, No. 56-OTR) as presented. Motion carried.

Motion by Mosher, second by Froemming, to approve a Conditional Use Permit to fill an area south
of existing barn for a new freestall barn and holding barn on North Turtle Lake (Sec. 34, Twp. 133,
R. 41, Sverdrup Township, No. 379) as presented. Motion carried.
Conditional Use Permit -Shayne Fox:
Motion by Mosher, second by Lee, to uphold the denial of the Planning Commission for a
Conditional Use Permit to place washed sand and boulders on the lakeshore on East Lost Lake
(Sec. 1, Twp. 133N, R. 41 W, Sverdrup Township, no. 56-378). Motion carried.
Preliminary Plat & Conditional Use Permit
"Labrador Beach'1/ Bruce & Marsha Qvammen:
Motion by Lee, second by Froemming, to approve a Conditional Use Permit for the Preliminary Plat
of "Labrador Beach" consisting of 10 single family residential lots and a Conditional Use Permit to
construct a road to service the proposed plat near Franklin Lake (Sec. 27 & 34, Twp. 137, R. 42,
Dunn Township, No. 759) with conditions as recommended by the Planning Commission. Motion
carried.
Conditional Use Permit -Kraig Ketter:
Motion by Nelson, second by Lee, to approve a Conditional Use Permit to take 9 feet off the top of
a hill and fill in a low spot near Scalp Lake (Sec. 7, Twp. 137, R. 40, Hobart Township, no. 56-358)
with conditions as recommended by the Planning Commission. Motion carried.
0 Conditional Use Permit -Richard Guffy:

Motion by Froemming, second by Lee, to uphold the denial of the Planning Commission for a
Conditional Use Permit to construct 3 retaining walls on Walker Lake (Sec. 2, Twp. 134, R. 40,
Amor Township, no. 56-310). In addition to the reasons cited by the Planning Commission, the
County Board cited a third reason for denial that one proposed retaining wall ,is below the OHWL.
Motion carried.
Conditional Use Permit -Jane Vie:
Motion by Froemming, second by Mosher, to approve a Conditional Use Permit to put in a
miniature golf course near Otter Tail Lake (Sec. 32, Twp. 134, R. 40, Amor Township, no. 56-242)
with conditions as recommended by the Planning Commission. Motion carried.
Conditional Use Permit -Ross & Katherine Johnson:
Motion by Nelson, second by Mosher, to remove an ice ridge located approximately 50' to 60' from
the Ordinary High Water Level on Big McDonald Lake (Sec. 20, Twp. 136, Edna Township,
no. 56-386) with conditions as recommended by the Planning Commission. Motion carried with
Partmann and Lee opposed.
Conditional Use Permit -William & Darlene Jostad:
Motion by Froemming, second by Lee, to uphold the denial of the Planning Commission for a
Conditional Use Permit for easier access to Marion Lake (Sec. 6, Twp. 135 R. 39, Rush Lake
Township, no. 56-243). Motion carried.
Conditional Use Permit -Larry & Holly Sonmor:
· Motion by Mosher, second by Nelson, to approve a Conditional Use Permit to build 750' of
driveway 2" high -12' wide and put in culvert near Unnamed Lake (Sec. 10, Twp. 131, R. 42,

Tumuli Township, no. 596) with conditions as recommended by the Planning Commission. Motion 0
carried. •
Conditional Use Permit -John & Mary Sontag:
Motion by Nelson, second by Lee, to approve a Conditional Use Permit to add fill needed to cover
footings on property located near Scalp Lake (Sec. 7, Twp. 137, R. 40, Hobart Township,
no. 56-358) with conditions as recommended by the Planning Commission. Motion carried.
Conditional Use Permit -Donald & Suzanne Tirk:
Motion by Lee, second by Mosher, to approve a Conditional Use Permit for the revised plan dated
April 5, 2000, on Pelican Lake (Sec. 1, Twp. 137, R. 43, Scambler Township, no. 56-786) as
recommended by the Planning Commission. Motion carried.
Home Health Care Services Contract
Motion by Lee, second by Nelson, to authorize the Chair's signature to execute a Purchase of
Service Agreement between the County of Otter Tail and Viking Land Home Health Inc. for a
period of July 1, 2000 to June 30, 2001 for home health care services subject to the approval of
the County Attorney. Motion carried.
Recess & Reconvene
At 11 :45 a.m., Chair Portmann recessed the meeting of the Otter Tail County Board of
Commissioners for a Personnel Committee Meeting. The Board of Commissioners' meeting was
reconvened at 12:16 p.m.
Home Health Care Transition Plan Update
County Coordinator, Larry Krohn, reported that Department of Public Health employees that are
being laid off have accumulated sick leave balances and, according to the county's personnel
policy, they have the option to use a percentage of the sick leave toward continued health
insurance or cash out a percentage as a severance payment. However, employees that work less
than 30 hours per week (not eligible for insurance benefits) and been employed with the county
less than 10 years, have no options for use of their accumulated sick leave. A 25% pay out of
accumulated sick leave for Public Health employees affected by the termination of the home health
care program was recommended. Discussion followed.
Motion by Lee, second by Portmann, to offer a 25% pay out of accumulated sick leave to Public
Health employees affected by the termination of the home health care program. Motion carried
with Mosher and Froemming opposed because of concern that this may not be enough for the
employees.
Adjournment
At 12:30 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, May 23, 2000.
