County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming; Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present. Approval of Agenda Motion by Nelson, second by Lee, to approve the County Board agenda of May 2, 2000, amended as follows: 10:00 a.m. -Budget Committee Meeting Canceled/Capital Improvement Committee Scheduled 1 :25 p.m. -Mike Schultz Long-Range Committee Appointments Employees' Committee Issues Motion carried. Approval of Minutes Motion by Lee, ·second by Froemming, to approve the County Board minutes of April 25, 2000, as presented. Motion carried. Liquor License Applications Motion by Nelson, second by Mosher, to approve the following applications for license: Roger Vie Lakeside Market RR 2 Box270 Battle Lake, MN Eleanor Solien Waterfront Groceries RR 3 Box 225 \ Pelican Rapids, MN (Formerly Pelican Beach Resort) Motion carried. Payment Approvals Tobacco License Tobacco License Motion by Lee, second by Froemming, to approve final payment, in the amount of $1,226.50, to Central Door and Hardware for the Otter Tail County Courthouse Remodeling Project as requested . and approved by E&V Consultants and Construction Managers. Motion carried. Motion by Mosher, second by Lee, to approve payment, in the amount of $11,248.00, to Delzer Construction, Inc., for tile repair to County Drainage System No. 37. The amount represents 95% of the total invoice amount of $11,840.00. Tiny Holm, Ditch Inspector, has reviewed the billing and has requested payment in the amount of $11,248.00. Motion carried. OTC Board of Commissioners' Minutes May 2, 2000 Page 2 • Bid Opening/Award -Eastern Township Gravel Pit After previously advertising for bids to purchase a gravel pit in Eastern Township, Viola Manderud Q of the Auditor's office opened the following bids received by 5 p.m. on Monday, May 1, 2000: Joyce Ahlers etal Steve & Lola Jensen Check received for $25 -accepted as the 5% bid bond Total Bid -$500.00 Check received for $50 -accepted as the 5% bid bond Total Bid -$1,000.00 Motion by Froemming, second by Nelson, to authorize the sale of the following described parcel to Steve & Lola Jensen, in the amount of $1,000.00 and accept the bid bond of $50, contingent upon the County Auditor verifying the intent of the total bid price as $1,000.00: Beginning at a point 800 feet west and 33 feet south of the Northeast corner of the Southeast Quarter (SE¼) of Section 28, Township 131N, Range 36W, running thence due West 217.8 feet: thence due South 350 feet; thence due East 100 feet; thence in a straight line in a northeasterly direction 386.6 feet to the point of beginning, and containing 1 1/3 acres, more or less. Motion carried. Long-Range Committee Appointments Motion by Mosher, second by Nelson, to appoint Robert Ehlert of Battle Lake (representing the third district) to the Long-Range Planning Committee. Motion carried. Motion by Partmann, second by Nelson, to appoint Ann Nelson of Fergus Falls (representing the Fifth District) to the Long-Range Planning Committee. Motion carried. Human Services & County Board Agenda Schedule Change Motion by Lee, second by Froemming, to change the August 8, 2000, Human Services agenda to begin at 9:00 a.m. rather than the previously scheduled 9:30 a.m. to allow time for Commissioners to attend the employees' picnic in New York Mills. Motion carried. Correspondence Acknowledged Letter from Rural Minnesota CEP requesting an appointment, preferably from the private business sector, for an at-large opening on its Board of Directors. Legislative Correspondence regarding transportation funding. Recess and Reconvene At 10:00 a.m., Chair Partmann recessed the meeting of the Otter Tail County Board of Commissioners for a Capital Improvement Committee meeting. The County Board meeting was reconvened at 10:20 a.m. Commissioner Lee offered the following resolution and moved its adoption: Snowmobile Grant-In-Aid Trail Systems Resolution Otter Tail County Resolution No. 2000-28 WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and Q 0 . . 0 0 0 .• OTC Board of Commissioners' Minutes May 2, 2000 Page 3 .WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for Otter Country Trail Association and proposed extensions of Grant- In-Aid Trails with the aforementioned condition. Commissioner Mosher seconded the resolution and, upon being put to vote, was unanimously adopted. Dated: 4ar i clCOtJ BOARD OF COMMISSIONERS Attest~~ LarryKro, Ciel< ia Portmann, County Board Chair OCTA Snowmobile Club President, Duane Rose, reported that a trail extension from Clitherall to Vining is being planned. He also reviewed several concerns regarding the blacktopping of the Central Lakes Trails, increased insurance costs because of year around use of the trails, and concerns with unauthorized motorized vehicles causing maintenance problems on the trails. Home Health Care Program Motion by Nelson, second by Lee, to phase out Otter Tail County's Home Health Care program in an orderly manner as private providers are now offering home health care service. Motion carried with Commissioners Froemming and Mosher opposed. Motion by Nelson, second by Lee, to terminate the contract for the Assisted Living program at River View Heights between the Housing and Redevelopment Authority and Otter Tail County Public Health Department. Motion carried with Commissioners Froemming and Mosher opposed. Motion by Nelson, second by Lee, to proceed with the termination of the Home Health Care program and the Assisted Living program by July 1, 2000. Motion carried with Commissioners Froemming and Mosher opposed. Approval to Pay Bills Motion by Froemming, second by Nelson, to approve payment of bills per Attachment A of these minutes which includes the following lodging payment: Radisson Hotel Duluth Harborview Patrol Sergeant, Brian Schlueter Motion carried. Right of Way Acquisition -Parcel No. 24, SP 56-604-09 Motion by Lee, second by Nelson, to award $686.31 to the owners of parcel no. 24 of the CSAH No. 4 highway project for acquisition of the property under M.S. 163.12 as requested by the Highway Engineer. Motion carried. The award will be filed with the County Auditor's office. . Commissioner Lee requested that the Highway Engineer check on the placement of a culvert by the driveway of this property. OTC Board of Commissioners' Minutes May 2, 2000 Page 4 • Final Payment -Installation of Rural Addressing Intersection Signs and Posts Motion by Lee, second by Mosher, to approve final payment to H. & R. Construction, in the amount Q of $3,000, for completion of Installation of Rural Addressing Intersection Signs and Posts. Motion carried. Otter Tail County Fair Association Request Highway Engineer, Rick West, presented a request from the Fair Association that the Highway Department blacktop 3 approaches to the fairgrounds, two on County Road #82 and one on Highway #21 O along with the blacktop project soon to take place on County Road #82. The Fair Association is requesting the county to split the cost ($9,842) of blacktopping the entrances. Chair Partmann called for a motion. Motion by Mosher to table the request until information is obtained from the east side of the county and then withdrawn. Motion by Lee, second by Nelson, to deny the request of the Fair Association to pay for half of the cost to blacktop entrances to the fairgrounds in Fergus Falls because of a lack of funds. Motion carried with Nelson opposed. Highway Contracts Motion by Lee, second by Mosher, to authorize the Chair's signature to execute a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Co. for WOT County Seasonal Supply of Hot Mix Bituminous Material contingent upon the approval of the County Attorney. Motion carried. Motion by Lee, second by Froemming, to authorize the Chair's signature to execute a contract between the County of Otter Tail and AAA Striping Service Co. for year 2000 traffic marking, C.P. 00:TM, contingent upon the approval of the County Attorney. Motion carried. Motion by Lee, second by Nelson, to authorize the Chair's signature to execute a contract between the County of Otter Tail and Central Specialties, Inc. for S.A.P. 56-623-09 & Etc. which includes bituminous overlay of OTC CSAH No. 23, CSAH No. 41, and CSAH No. 80 and Becker County CSAH No. 2 contingent upon the approval of the County Attorney. Motion carried. Transportation Funding Commissioners requested that the Highway Engineer send a letter to the legislators urging positive action on transportation funding during this legislative session. Recess & Reconvene At 11 :29 a.m., Chair Partmann recessed the meeting of the Otter Tail County Board of Commissioners for lunch break and a Land & Resource Committee meeting. At 1 :30 p.m., Chair Partmann reconvened the meeting of the Otter Tail County Board of Commissioners. Manufactured Home Change -Ten Mile Lake Resort Q Mike Schultz of Ten Mile Lake Resort, discussed with the County Board that he purchased a new manufactured home to replace a manufactured home at his resort; however, he didn't know that he needed a permit. He put in a new sewer system in the trailer park last year. The old manufactured home was 60' x 12'; the new one is 70' x 14'. Not realizing he needed a site and Conditional Use Permit, Mr. Schultz rented the new manufactured home effective May 1 z!h for the summer. He is unable to get on the Planning Commission agenda before May 1z!h. Discussion followed. Motion by Mosher, second by Lee, to authorize a temporary site permit for 60 days, for this circumstance, Q and allow the new manufactured home to be placed on the site contingent upon completing the Conditional Use Permit process and that the septic system meets requirements for the increase in 0 0 0 OTC Board of Commissioners' Minutes May 2, 2000 Page 5 size. If Mr. Schultz would fail to obtain a CUP, the manufactured home must be removed. Motion carried. Proposed Shoreland Management Ordinance Amendments Land & Resource Director, Bill Kalar, presented proposed SMO amendments recommended by the Planning Commission. Mr. Kalar and commissioners reviewed each proposed change. Commissioners requested that Mr. Kalar take the following proposed changes back to the Planning Commission for further consideration and discussion: Sec. 111, 4B (Lot Area and Setback Requirements): The language "legally joined to a lakeshore parcel within 200 feet of the backlot" was discussed regarding the concept of creating substandard backlots for non-residential use. Sec. IV, 2 (Sanitation Standards): (Add language requiring an on-site sewage system be brought into compliance with standards prior to transfer of ownership). Discussion took place regarding this requirement in shoreland areas only or if the requirement should be countywide and/or if the requirement should be an issue left with the sellers and buyers of property. Sec. IV, 3 (Shoreland Alterations): Definition of minor watershed was suggested.
