Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, April 4, 2000, at 9:30 a.m. at
the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the County Board
agenda of April 4, 2000, amended as follows:
Ag/Ditch Inspector Tiny Holm -County Ditch No. 64
Approval of Minutes
Motion by Nelson, second by Mosher, and unanimously carried to approve the County Board
minutes of March 28, 2000, as mailed.
Request for Approval -County Ditch No. 64 Project
Tiny Holm, Ag/Ditch Inspector, reported that Tom Lee has made a request for diversion of an
existing pipe that would create a wetland on County Ditch No 64. Cost of the project will be paid
by the SGS and Landowner, Tom Lee, with no cost assessed to the ditch system.
Motion by Mosher, second by Nelson, and carried with Lee abstaining, to approve the diversion of
existing pipe on County Ditch No. 64 as requested.
Closed to the Public
At 9:38 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners closed to the public, for the purpose of discussing the Perham Project Contracts,
as authorized by attorney-client privilege pursuant to M.S. 471.705 Subd. 1d. Present were all five
seated commissioners, David Hauser, County Attorney; Larry Krohn, County Coordinator;
Mike Hanan, Solid Waste Director; and Ardell Bolles, Recording Secretary.
At 10:30 a.m., Chair Partmann continued the closed session for purposes of discussing labor
negotiation strategies for the county's three Sheriff Department bargaining units, with the
aforementioned individuals present.

Al 10:46 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners open to the public.

Motion by Froemming, second by Lee, and unanimously carried to authorize the sale of the
following described gravel pit, as recommended by the County Engineer, with the bid opening to
be scheduled on May 2, 2000:
Beginning at a point 800 feet west and 33 feet south of the Northeast corner of
the Southwest Quarter (SE1/4) of Section 28, Township 131N, Range 36W,
running thence due West 217.8 feet: thence due South 350 feet; thence due
East 100 feet; thence in a straight line in a northeasterly direction 386.6 feet to
the point of beginning, and containing 1 1/3 acres, more or less.

Mr. Stein reported that he spoke with Peter Bratch, Department of Commerce, regarding not
awarding the bid to the low bidder. Bratch stated that documentation and information should be
sent to the PetroFund. The worst case scenario would be that reimbursement would be in the
amount of the low bid, leaving approximately $530. Since Widseth Smith and Nolting are the low
bid for the New York Mills site, and they are familiar with all three sites, they could possibly
investigate the Rothsay site at the same time for less cost than they had quoted.

Approval to Purchase Election Equipment
Mr. Stein requested approval on purchasing the precinct ballot counters that the Commissioners
had viewed last November. Mr. Stein reported that he has budgeted $49,166 for election
equipment. The cost of 10 units would be $46,595.50, for 12 units the cost would be $55,264.60,
and for 14 units the cost is $63,933.70. Mr. Stein would like to purchase 12 units since this
enhances the existing system. He reported that he could transfer $6,100 from the motor vehicle
and auditor's budgets to cover the additional cost.
Motion by Lee, second by Froemming, and unanimously carried to purchase 12 precinct ballot
counters (ES&S Model 100 Systems) at the cost of $55,264.60.
Contract Approval -S.A.P. 56-657-05 & Etc.
Motion by Nelson, second by Mosher, and unanimously carried to authorize the Chair's signature
to execute.a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Co. for
CSAH 57, 81, & 65, S.A.P. 56-657-05 & Etc., as recommended by the Highway Engineer.
Contract Approval -S.A.P. 56-601-39 & Etc.
Motion by Froemming, second by Lee and unanimously carried to authorize the Chair's signature
to execute a contract between the County of Otter Tail and Asphalt Surface Technologies Corp.
AKA ASTECH Corp. of St. Cloud, MN, for countywide seal coat project S.A.P. 56-601-39 & Etc., as
recommended by the Highway Engineer.
Contract Approval -Hot Mix Bituminous Material
Motion by Nelson, second by Mosher, and unanimously carried to authorize the Chair's signature
to execute a contract between the County of Otter Tail and Wadena Asphalt, Inc. of Wadena MN,
for the 2000 construction season, contingent upon the County Attorney's approval.

Motion by Froemming, second by Mosher, and unanimously carried to meet at 11 :30 a.m. in the
Commissioners' room at the County Courthouse in Fergus Falls, MN, on April 25, 2000, and from
there proceed to view the premises as described in Resolution No. 2000-18 at 2:00 p.m.
COUNTY STATE AID HIGHWAY NO. 4 RIGHT OF WAY ACQUISITION
Project No. S.P. 56-604-09 -Parcel No.24
Otter Tail County Resolution No. 2000 -18
Upon a motion by Froemming, seconded by Mosher, and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
WHEREAS, Otter Tail County proposes to reconstruct and improve County State Aid Highway
No. 4, located from TH 59, East 4.15 miles to CSAH No.31, located in Sections 11, 12, 13, and 14
ofTl36N-R43W, and Sections 7, 8, 9, 16, 17, and 18 ofT136N-R32W; and
WHEREAS, the reason for the construction of this segment of County State Aid Highway No. 4 is
due to the existing highway's poor condition, the unsafe intersection at TH 59, and the need for the
replacement of a culvert between Lake Lizzie and Lake Lida, and
WHEREAS, this improvement is necessary to provide for the safety of the traveling public, and
WHEREAS, Otter Tail County has a right to acquire the right of way after an award of damages
has been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; and
WHEREAS, all necessary additional highway right of way has been acquired for the reconstruction
except a tract owned by Judith A. Corona of Albuquerque, NM, John R. Armstrong of Brooklyn
Park, MN and Mary J. Armstrong of Hugo, MN.
A strip of land over and across the following described tract:
The West 240 feet of Government Lot 7 of Section 9, Township 136 North of Range
42 West of the Fifth Principal Meridian, which lies North of the centerline of the main
traveled highway (County or State Aid Road No. Four (4) as said highway is located at
the date hereof, reserving forever all rights of flowage caused by any dam now or
hereafter built or maintained upon Section Nine (9) of Township 136 North, of Range
42 West, or upon Section Twelve (12) of Township 136 North, of Range 43 West, or
at any point in or on the Pelican River downstream from Lake Lizzie, upon which Lake
Lizzie the lands hereby conveyed border.

Due to the reconstruction and realignment of County State Aid Highway No. 4 under Project No. Q
S.P. 56-604-09, said strip being all that part of the above described tract, to be retained for CSAH
No. 4 right-of-way recorded as Parcel No. 24 on Page 5 of 6 of CSAH No.4 RM/ Plat No. 8.

NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners
hereby authorizes the acquisition of the requested right-of-way as described above pursuant to
Minnesota Statute, Section 163.12, and to take title and possession of that land after an award of
damages has been filed with the County Auditor in accordance with Minnesota Statute,
Section 163.12.

Approval to Pay Bills
Motion by Nelson, second by Lee, and unanimously carried to approve payment of bills per

Local Board of Reviews
Bob Moe, County Assessor, presented an informational handout of dates, times, and areas for the
2000 Boards of Review. Mr. Moe reported that Assessment Notices have been sent out to county
residents.
Request for Authorization to Advertise
Motion by Lee, second by Nelson, and unanimously carried to authorize the Assessor to advertise
for a Senior Appraiser position upon receipt of a resignation letter. This would allow Mr. Moe to
hire a new appraiser and provide training before the retirement of the current Senior Appraiser.
Contract Approval -Solid Waste Transfer Services
Motion by Lee, second by Froemming, and unanimously carried to authorize the Chair's signature
to execute a contract between the County of Otter Tail and Waste Management of Alexandria for
solid waste transfer services that were bid at an earlier date.

Governing Board Resolution for Dental Clinic Funding
Otter Tail County Resolution No. 2000 -19
Upon a motion by Lee, second by Mosher, and unanimously carried to, the Otter Tail Board of
Commissioners adopts the following resolution:
WHEREAS, Otter Tail County applies for a Community Health Center grant from the Office of
Rural Health and Primary Care of the Minnesota Department of Health, and
WHEREAS, Otter Tail County certifies that ii will comply with the requirement of the Community
Health Center Program, including the requirement in Minnesota Statutes 144.1486, subdivision 8,
and
BE IT RESOLVED, that Otter Tail County will enter into a grant contract with the State of
Minnesota if the application is successful.
BE IT FURTHER RESOLVED, that the County Board Chair or Human Services Board Chair is
hereby authorized to execute contracts and certifications as required to implement the
organization's participation in Minnesota Community Health Center Program.

County Ditch No. 25
County Attorney, David Hauser, reported that he had received a corrected petition submitted to
enlarge a culvert on County Ditch No. 25.
Motion by Nelson, second by Mosher, and unanimously carried to accept the corrected petition to
enlarge a culvert on County Ditch 25.
Ratification of Highway Maintenance Labor Contract
Motion by Lee, second by Froemming, and unanimously carried to authorize the Chair's signature
to ratify a Labor Agreement between Otter Tail County of the State of Minnesota and the American
Federation of State, County and Municipal Employees, AFL-CIO, Local Union No. 1830 for the
period of 1/1/200 through 12/31/2000.
Authorization of Study
Motion by Mosher, second by Froemming, and unanimously carried to authorize the County
Coordinator's Office to proceed with a market study of the Sheriff Department to compare salaries
with surrounding counties' salaries.

be provided at the next regular board meeting.
Recess and Reconvene
At 12 noon, Chair Portmann declared the meeting of the Otter Tail County Board of
Commissioners recessed. The meeting will reconvene at 7:00 p.m. at the Parkers Prairie City Hall
for purposes of discussing County Drainage System No. 4 at a Public Informational Meeting.
Public Informational Meeting -County Drainage System No. 4.
The Otter Tail County Board of Commissioners convened Tuesday April 4th, 2000, at 7:00 p.m. at
the City Hall in Parkers Prairie with Commissioners Roger Froemming, Vice-Chair; Malcolm Lee,
and Syd Nelson present.
Other county staff in attendance: David Hauser, County Attorney; Bill Kalar, Land and Resource
Director; Tiny Holm, Ditch Inspector; and Wayne Stein, County Auditor.
The purposes of the public informational meeting were as follows:

to review the petition for the repair of County Drainage System No. 4,
to identify problems and concerns regarding County Drainage System No. 4 as it now
exists,
to discuss the process which must be undertaken to repair a drainage system,
to provide general information and to answer as best as possible questions and concerns
from those in attendance, and
to determine by general consent if the affected landowners wish to continue with the
process to repair the drainage system.
Tiny Holm, Ditch Inspector, provided a general history of County Drainage System No. 4 and then
opened the meeting for comments, suggestions, concerns, and questions from the thirteen
individuals in attendance. The following is a general summary of the discussion:
1. County Drainage System No. 4 was established in 1901.
2. The original drainage system as established included 1,760 acres of which 990 acres
were considered to have benefited by the drainage system.
3. The total dollar benefit assigned to these benefited acres was $4,438.
4. The DNR has indicated that approximately 15,000 acres are in the present watershed.
Many of these acres may benefit from County Drainage System No. 4 if ii was properly
functioning.
5. It was noted that the cost of an Engineer's Study would be approximately $13,000 and the
cost to re-determine the benefits of the drainage system would be approximately $4,000.
6. The need to re-determine the benefits of the drainage systems was discussed. It was
noted that a re-determination is necessary because lands other than those included in the
. original ditch system will benefit from the repaired ditch and the only way for those lands to
share in the cost of the repair is if a re-determination of benefits is completed. It was also
noted the existing dollar benefit of County Drainage System No. 4 is outdated and a re-
determination will reflect a benefit amount that reflects current value.
7. Concerns were raised regarding existing wetlands within the existing ditch system.

8. Questions were raised as to how the costs of the project would be divided amongst the r\
benefited landowners. They were informed that during the re-determination of benefits, \,jiJI
ditch viewers would review each 40-acre tract and determine how that tract is benefited by
the drainage system. The various categories of land classifications were explained and at
what level each category is considered to have benefited from a properly functioning ditch
system.
9. It was noted that the area affected by the nonfunctioning drainage system is expanding
and landowners are experiencing problems because of the systems inability to move the
water. For example water in basements.
1 O. An opinion was expressed that stated that the entire system from bottom to top should be
included in the repair.
11. It was noted that the culvert on Highway No. 136 might be a part of the problem.
12. Lawsuits might happen if the drainage system is not repaired.
13. It was noted that the ditch is worthless unless it is repaired.
14. Beavers are a problem now and will continue to be a problem even after the drainage
systems are repaired.
15. A question was asked if the project could be stopped if, after the engineer's study was
completed, the overall project cost was found to be excessive. It was noted that it would
be possible to stop the project, but the costs incurred to that point would be assessable
costs.
16. Questions were raised regarding the DNR's position regarding a repair to the drainage
system. It was noted that they would assist with determining the original depth of the
drainage system, as any repair cannot exceed the depths of the original drainage system.
17. It was noted that the Wetlands Conservation Act might have an affect on this repair Q
project.
18. It was noted that there are no Federal, State, or County funds available for this project
other than dollars that would be raised by an assessment against the benefited properties.
19. It was pointed out that it should be understood that this is not an abandoned drainage
system.
With no additional public comments, questions, suggestions, or concerns being shared Tiny Holm,
Ditch Inspector, informed the group that the County Board of Commissioners would take this
discussion under consideration, would make their decision, and act upon the petition for repair at a
future board meeting. It was noted that the general opinion of those in attendance was that the
drainage system should be repaired. If the County Board of Commissioners, as Ditch Authority,
supports this position, the next step will be the appointment of a qualified engineer to examine the
drainage system and to prepare and file a report with the Ditch Authority. Upon completion and
receipt of this report, a hearing would be held to discuss the nature and cost of the repair work.
At 7:53 p.m., with no additional discussion, the public informational meeting and meeting of the
Otter Tail County Board of Commissioners was declared adjourned until Tuesday, May 11, 2000.
