HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/21/20000 0 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, March 21, 2000 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 21, 2000, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present. Approval of Agenda Motion by Froemming, second by Nelson, and unanimously carried to approve the County Board agenda of March 21, 2000, with the following additions: Appointment -West Central MN Housing Partnership Board Appointment -Otter Tail County Water Plan Committee Approval of Minutes Motion by Froemming, second by Mosher, and unanimously carried to approve the County Board minutes of March 14, 2000, as mailed. Years of Service Certificates Employees' Committee President, Pauline Fitch, introduced the members of the Employees' Committee. The committee members presented "Years of Service Certificates" to thank employees for their work in the county. Awards were presented for employees working 5, 10, 15, 20, 25, and 30 years. Chair Partmann thanked the committee and employees for their excellent work. Request for Forgiveness of Penalty On behalf of Property Owner, George Colman!, Treasurer, Steve Andrews, requested forgiveness of penalty for parcel no. 52-000-15-0094-000 in Pine Lake Township. Mr. Andrews stated that the second half tax due was postmarked late so it was sent back; however, it was sent back to the wrong address. As a result of that error,· an additional $32.16 in penalty was accrued. The request is for forgiveness of the additional amount. Motion by Nelson, second by Mosher, and unanimously carried to forgive the additional penalty of $32.16 for parcel no. 52-000-15-0094-000 owned by George Colman! because of county error. Appointment -WCMN Housing Partnership Motion by Partmann, second by Lee, and unanimously carried to appoint Mr. Mark McNalley, Executive Director of Habitat for Humanity in Fergus Falls, to serve as Otter Tail County's representative to the West Central Minnesota Housing Partnership Board of Director. Appointment -Otter Tail County Water Plan Committee . Motion by Nelson, second by Froemming, and unanimously carried to appoint Shelley Becklund, East Otter Tail County Soil and Water Conservation District Manager, to the Otter Tail County Water Plan Committee. Otter Tail County Flexible Work Hours Guidelines Motion by Lee, second by Mosher and unanimously carried to approve the Otter Tail County Flexible Work Hours Guidelines as follows and as recommended by the Labor Management Committee: Otter Tail County Board of Commissioners Minutes March 21, 2000 Page2 Employee work hours are structured so as to provide for the efficient, effective and responsive provision of County government services. At the same time, these work hours must meet applicable state and federal r'\ regulations, ensure internal equity and consistency among employees, provide a framework for pay 'w administration and reflect the County's desire to provide a competitively structured work environment. When considering flexible work hours, the following criteria should be considered. a) Does the request diminish the service to the public? b) Does it have a negative effect on the other employees in the unit or department? c) Are the work hours covered? d) Does covering for an employee allow others in the department to get their own work done? e) Does a request for flexible work hours disrupt the flow of work in the unit or department? f) Can the request be met under other programs such as the Family Medical Leave Act? Amend LAN Electronic Communication and Internet Policy Motion by Mosher, second by Froemming, and unanimously carried to remove the following language from the Otter Tail County LAN Electronic Communication and Internet Policy as recommended by the County Attorney and the Computer Steering Committee: "Because the e-mail and Internet systems are not secure, employees should not send any data classified as not public (private or confidential data on individuals or non-public or protected non-public data not on Q individuals) over the e-mail or Internet systems unless the data is encrypted or encoded." ·· · The amended policy is attached to these minutes as Attachment B. Liquor License Applications Motion by Lee, second by Froemming, and unanimously carried to approve the following applications for license: Allen Floyd Chase Chase's Ethel Beach Resort & Rest. Battle Lake, MN 56515 Marilyn Ann Heit Wee Villa Lodge Fergus Falls, MN 56537 Gail Suko Ye Olde Schoolhouse Erhard, MN 56534 Renewal of Consumption & Display Permit Renewal of Consumption & Display Permit Renewal of Consumption & Display Permit Request for Forgiveness of Penalty Auditor, Wayne Stein, presented a request for forgiveness of penalty for Property Owners, Kent and Sharon Aland, for parcel no. 16-000-99-0832-000. Mr. Stein stated that the property had been purchased in February of 1999 and recorded the same month. He read a letter from Mr. & Mrs. Aland requesting forgiveness of penalty because they had not received the tax statements or late tax notices. Mr. Stein Q stated that the tax statement and late notices had been sent to the address on record when the property document was recorded; however, the mail was returned to the county with no forwarding address. 0 0 0 Otter Tail County Board of Commissioners Minutes March 21, 2000 Page 3 Motion by Lee, second by Mosher, and unanimously carried to deny the request of Kent and Sharon Aland for the forgiveness of accrued penalty, interest and cost, in the amount of $46.28, which has accrued on parcel 16-000-99-0832-000 as of March 31, 2000. Driver's License Duplicate Accessing Fee Mr. Stein explained that with new technology using the driver's license camera, the county can pull up pictures from driver's licenses already in the system. If a citizen has lost their driver's license, the license can be pulled up on system with the picture so an identification can be made on that basis rather than requiring two forms of identification such as birth certificate and social security card. Discussion followed regarding an appropriate fee for this service. Motion by Lee, second by Froemming, and unanimously carried to approve a fee of $2.00 when accessing the state driver's license system for identification purposes when processing a duplicate license application effective April 1, 2000. Tax Forfeited Sites Mr. Stein reported that he has received two quotations for clean up on all three tax forfeited sites. Two quotes for each site meet the requirements for reimbursement through the state Petrofund. Mr. Stein asked whether or not the County Commissioners wanted him to pursue additional bids. Commissioners noted that two quotes per site should be sufficient as long as the quotations are reasonable. Proposed Feedlot Regulation Discussion Extension Educator, Bill Saumer, and state officials from the University of Minnesota and Minnesota Pollution Control Agency, discussed the proposed feedlot regulations. Don Hauge, MPCA Control Specialist, provided the Proposed Permanent Rules Relating to Animal Feedlots and Storage, Transportation, and Utilization of Animal Manure dated March 13, 2000, and corresponding funding information for Year 2000 and 2001. Mr. Hauge stated that the proposed revised rules will be more applicable to the current conditions in operating livestock farms. Discussion is taking place at the legislature related to feedlot regulations and what should be included in the regulations. Mr. Hauge stated that the proposed rules are more specific and clear than the existing rules, not necessarily more prohibitive. The Delegated County Program was discussed. If the county took over the feedlot program, the permits would be issued based on state regulations. Chair Portmann expressed concern regarding the money the county would need to run a feedlot permitting program. Lengthy discussion took place regarding the $43,950 funding provided by the state if Otter Tail County had a feedlot permit program. The grant requires either a cash or in-kind match from the county. Chair Portmann expressed concern that a match was not possible for Otter Tail County especially with levy limits that prohibit counties from levying more funds locally. Approval of Final Payment -C.P. 98:20PU Motion by Lee, second by Froemming, and unanimously carried to approve final payment per estimate no. 3, in the amount of $4,720.30, payable to Riley Bros. Construction Inc. for box culvert, grading, aggregate base & bituminous surfacing for C.P. 98:20PU as recommended by the Highway Engineer. The Chair reconvened the meeting at 11: 17 a.m. Planning Commission Recommendations Conditional Use Permit -Blair Raph: Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit to operate a lawn care business out of his residence (Sec. 29, Twp. 134, R. 42, Friberg Township, Lake No. 56-711, West Red River) with the following conditions: 1. The hours of operation be 8:00 a.m. to 5:00 p.m. 2. A maximum of 2-3/4 ton trucks and 1-16 ft., 6,000-lb. capacity trailer (business related) be stored onsite. Conditional Use Permit -Bette Bench et al: Motion by Froemming, second by Nelson, and unanimously carried to approve a Conditional Use Permit to build up existing road that is the only access to the property on Twin Lake (Sec. 19, Twp. 134, R. 40, Amor Township, Lake No. 56-382) with conditions as recommended by the Planning Commission. Conditional Use Permit -Lake Lizzie Shores: Motion by Lee, second by Froemming, and unanimously carried to build a new house and garage on the property of Christopher & Kimberly Guck on Lake Lizzie (Sec. 28, Twp. 137N, R. 42W, Dunn Township, Lake No. 56-760) with conditions as recommended by the Planning Commission. Preliminary Plat & Conditional Use Permit -"Oppegard Estates 2nd Addition": Motion by Froemming, second by Mosher, and unanimously carried to approve the Preliminary Plat of "Oppegard Estates 2nd Addition" consisting of 4 single family residential lots and a Conditional Use Permit to Q construct a road to service the plat on East Leaf Lake (Sec. 25, Twp. 134N, R. 38, Leaf Lake Township, · Lake No. 56-116) with conditions as recommended by the Planning Commission. Preliminary Plat -"Maet-Boh Development": Motion by Mosher, second by Nelson, and unanimously carried to approve the Preliminary Plat of "Maet- Boh Development" consisting of 6 commercial lots. The property is described as Pt S½ NW¼, Section 4 of Clitherall Township, nonshoreland area with conditions as recommended by the Planning Commission. Conditional Use Permit -Monte Berend: Motion by Lee, second by Nelson, and unanimously carried to approve a Conditional Use Permit to prepare a site for dwelling construction on West Spirit Lake (Sec. 8, Twp. 134N, R41W, Dora Township, Lake No. 56-502) with conditions as recommended by the Planning Commission. East Otter Tail Agriculture Position Land & Resource Director, Bill Kalar, reported that the current 50% FTE ag inspector position in East Otter Tail County will soon be vacant Discussion followed. Motion by Lee, second by Mosher, and unanimously carried to approve filling the vacant ½ time ag position with a full time, seasonal position to assist the current full time Ag & Ditch Inspector. County Attorney, Jennifer Lessinger Solid Waste Director, Mike Hanan 0 () 0 0 Otter Tail County Board of Commissioners Minutes March 21, 2000 Page 7 SW Public Information Office, Marie Tysdal HHW Regional Program Manager, Dave Stadum Soil Digitizing Contribution Agreement GIS Employee, Brian Armstrong, reported that the soil digitize book in paper form has been approved and will be published next month. The next step is to digitize these maps. After several meetings and not wanting to wait 10-15 years to digitize the maps, a decision was made that Otter Tail County would move ahead and pay for the cost to complete this project sooner. The total cost of the project is $105,000 with the United States Dept. of Ag NRCS paying half of this cost. That brings the county cost to $51,800. Discussion followed. Motion by Froemming, second by Mosher, and unanimously carried to authorize the Chair's signature to execute a Contribution Agreement between the County of Otter Tail and the Wisconsin Natural Resources Conservation Service of the United States Department of Agriculture for soil digitizing map(s) as described above subject to the approval of the County Attorney and added language for penalty if the project is not completed by December 31, 2000 as stated in the agreement. Recess & Reconvene At 11 :45 a.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The Chair reconvened the meeting at 1 :00 p.m. Closed to the Public At 1 :00 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Solid Waste Director, Mike Hanan, pursuant to M.S. §471.705 Subd. 1d(d). At 1:30 p.m., upon conclusion of Mr. Hanan's performance evaluation, the meeting continued in closed session for the purpose of evaluating the performance of Land & Resource Director, Bill Kalar, pursuant to the aforementioned statute. All five seated commissioners were present for both evaluations. A summary of performance conclusions will be provided at the next regular board meeting. At 2:00 p.m., the meeting continued in closed session for purposes of discussing labor negotiation strategies with the county's collective bargaining units. All five seated commissioners were present as well as the County Attorney, County Coordinator, and Recording Secretary. Meeting Opened to the Public Adjournment At 2:10 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners reconvened in open session. Discussion followed. The county faces the challenge of making maximum use of the benefits of such tools, meeting legal requirements for access to information, and providing adequate protection for proprietary information. This policy governs access to and the appropriate use of the county LAN at all hours of the day. Employees access to and use of the county LAN is intended for business-related purposes. Limited and reasonable use of these tools for occasional employee personal purpose that does not result in any additional costs or loss of time or resources for their intended business purpose is permitted. The County electronic mail system (e-mail) including the equipment upon which information is sent, received and stored, and all communications and messages within that system are County property. Department Head Responsibility. Department heads are responsible for ensuring the appropriate use of all electronic tools, including e-mail and internet access through training, supervising, coaching and taking disciplinary action, when necessary. Department Heads shall use this policy as a framework for issuing their own departmental policies. Employee Responsibility: County employees are responsible for appropriate use of e-mail and Internet access. They are expected to adhere to the highest ethical standards when conducting county business. Violations of this policy may result in disciplinary action. Appropriate Use: County employees need to use good judgment in Internet access and e-mail use. They are expected to ensure that e-mail messages are appropriate in both the types of e-mail messages created and the tone and content of those messages. Employee use of e-mail and the Internet must be able to withstand public scrutiny without embarrassment to the department or the County of Otter Tail. Inappropriate Use: Examples of inappropriate use of the county LAN include, but are not limited to: • Illegal Activities • Wagering, betting or selling • Harassment and discrimination • Fund-raising for any purpose unless County approved • Commercial activities, e.g. personal for-profit business activities • Promotion of political or religious positions or activities • Receipt, storage or transmission of offensive, racist, sexist, obscene or pornographic information • Downloading software (including games, wallpaper and screen savers) from the Internet unless approved by the department head and LAN Administrator • Disabling of anti-virus program • Subscribing to other browsers The traditional communication rules of reasonableness, respect, courtesy, common sense and legal requirements also apply to electronic communication. For example, actions that are considered illegal such as gambling and harassment are not up to the discretion of individual departments or individual employees. These actions break the law whether the behavior is conducted on e-mail or by another means of communication, and they may subject the employee to disciplinary action up to and including discharge. Otter Tail County Board of Commissioners Minutes March 21, 2000 Attachment B, Page 2 Inappropriate Material, Notify Department Head: Employees should be aware that they might receive 0 inappropriate and unsolicited e-mail messages. Any such messages should be reported immediately to the employee's department head. It is realized that an employee may inadvertently come across inappropriate material or data. A mistake such as this is normal in the use of the Internet and should be brought to the attention of the department head immediately. Failure to do so could result in disciplinary action. Unauthorized Uses: County owned property or services including the e-mail system may not be used for political activities, fund-raising, campaigning for elected office, union organizing activities, or solicitation or discouragement of employees for union membership. Disks: No disk or software, including screen savers, may be loaded onto any County computer without first having approval of the department head or her designee. Any disk that is to be loaded onto a county computer must first be scanned for viruses. Viruses: If at any time a virus is detected, whether it is on a disk or a hard drive, an employee must immediately notify the department head or his designee who in turn must immediately notify the LAN administrator. System Security: The LAN administrator is responsible for establishing policies regarding password management, encryption, monitoring access and the like, and for communicating those policies to county employees. Monitoring: Electronic communication devices such as telephones, facsimile machines, pagers, county e-n mail systems and Internet access are County property. Like other County resources, they are intended to Vi/iii,I be used for County business and other county-sanctioned activities. All legal methods may be utilized to monitor the use of the county LAN at the time of use, during routine post-use audits and during investigations. Government Data Practices: Data that the County maintains electronically is government data and, as such, is subject to classification and access under the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13. Employees should understand that electronic data is not completely secure. For example, e-mail messages can be altered by a recipient and retransmitted as if from the original sender, or data can be illegally accessed. They should also understand that e-mail messages and Internet transactions, including those they delete or erase from their own files, may be backed up or recorded and stored centrally for system security and investigative purposes. They may be retrieved and viewed by someone else with proper authority at a later date. It is the user's responsibility to use care in communicating information not meant for public viewing. Record Retention Schedule: Record retention schedules are the same regardless of the medium used to create or store the record. See Minnesota Statute §138.17. As a result, some e-mail messages may be official records of the County and must be retained in accordance with the department's record retention schedule appropriate for the type, nature and content of the record. Improper disposal may subject the employee and the department to legal sanctions and other administrative or legal consequences.
