Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, March 7, 2000, at 9:30 a.m. at
the Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair;
Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the County Board
agenda of March 7, 2000, amended as follows:

minutes of February 22, 2000, as mailed.
Correction to February 15, 2000, Minutes
Motion by Froemming, second by Mosher, and unanimously carried to amend the February 15,
2000, minutes relative to Judicial Ditch No. 2 as follows:

Motion by Froemming, second by Mosher, and unanimously carried to appoint Commissioner
Dennis Mosher to the Judicial Ditch No. 2 Committee. This corporate ditch is a joint ditch between
Wilkin and Otter Tail County.

Otter Tail Soil & Water Conservation Districts Year End Review
Several SWCD employees showed a slide presentation regarding the organization's 1999 activities
and accomplishments. District Managers, Brad Mergens and Shelley Becklund, reviewed many
programs including Cost Share Program, installation of terrace and erosion control structures,
surface water monitoring, monitoring of ground water by way of installed wells throughout the
county, Best Management Practices and education programs. Discussion followed regarding
cattle still occupying lakes and rivers and the livestock exclusion program. East Otter Tail fact
sheets were provided.

Resolution for Otter Tail County 9-1-1 System
Otter Tail County Resolution No. 2000 -10
Motion by Commissioner Lee, seconded by Commissioner Mosher to adopt the following
resolution:
WHEREAS, Otter Tail County installed 9-1-1 service in compliance with state law which requires
that each county of the state implement 9-1-1 Emergency Telephone Service by December 15,
1986;and
WHEREAS, The Otter Tail County 9-1-1 Planning Committee developed the Otter Tail County
9-1-1 Plan to meet the requirement of those public service agencies whose services will be
available by dialing 9-1-1; and
WHEREAS, The 9-1-1 Planning Committee has recommended modifying the 9-1-1 County Plan to
add network based (tandem) Automatic Number Identification (ANI), Automatic Location
Identification (ALI), and Selective Routing (SR) to Otter Tail County. Selective Routing will be
added so that 9-1-1 calls from the following exchange offices will be answered at the appropriate
9-1-1 Public Safety Answering Point:

NOW, THEREFORE, BE IT RESOLVED, That the Board of Commissioners of Otter Tail County,
State of Minnesota, endorse the report of the County 9-1-1 Committee, and
BE IT FURTHER RESOLVED, That the Board of Commissioners intends to add network (tandem)
based Automatic Number Identification (ANI), Automatic Location Identification (ALI) and Selective
Routing (SR) to the Otter Tail County 9-1-1 System. Selective Routing will be added so that 9-1-1
calls from the aforementioned exchanges located in rural Otter Tail County will be routed to the
appropriate 9-1-1 Public Safety Answering Point which is capable of processing selectively routed
calls; and
BE IT FURTHER RESOLVED, That the Board of Commissioners intends to modify the 9-1-1
contracts with the State of Minnesota and respective telephone companies to implement the
approved changes to the 9-1-1 system and hereby authorizes Sheriff Gary A. Nelson to sign such
agreements on behalf of the County; and

Upon a motion by Lee, second by Froemming and unanimously carried, the Otter Tail County 0 Board of Commissioners adopts the following resolution:

WHEREAS, under the provisions of M.S. Section 86B.105 the sheriff of each county is required to
carry out the provision of Chapter 86B and the Boat and Water Safety Rules, hereinafter referred
to as the "Minn. Rules," promulgated by the Commissioner of Natural Resources, including patrol,
enforcement, search and rescue, watercraft inspection, waterway marking and accident
investigation, all hereinafter referred to as the "Sheriff's Duties"; and
WHEREAS, in connection with the Sheriff's Duties M.S. Section 86B.701 provides that the County
submit to the Commissioner of Natural Resources a budget to carry out the Sheriff's Duties; and
WHEREAS; M.S. Section 86B. 701 and the Minn. Rules provide for the allocation of funds by the
Commissioner to the County based on certain criteria and conclusions to assist the funding of the
Sheriff's Duties; and
WHEREAS, the County has submitted a proposed budget to the State.
NOW, THEREFORE, BE IT RESOLVED, that the County of Otter Tail accepts the 2000 Annual
County Boat and Water Safety Agreement and the amount of payment as stated above for the
activities stated in Chapter 86B and further allowable expenses in "Allowable Expenditures Under
the Boat and Water Safety Program" as designated in said agreement.
BE IT FURTHER RESOLVED, that the appropriate Otter Tail County officials' are authorized to
sign said agreement.

WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the Perham Athletic Association, Perham, MN, has made an application to the
Gambling Control Board for a premise permit to conduct lawful gambling at Woody's Blue Horizon,
in Rush Lake Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a
premise permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the permits; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the Perham Athletic Association, Perham, MN, at Woody's Blue
Horizon, in Rush Lake Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Perham Athletic Association, Perham, MN,
at Woody's Blue Horizon, in Rush Lake Township of Otter Tail County, provided the applicant
meets all the necessary criteria for the licenses and permits as required by the Gambling Control
Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the
Township of Rush Lake by sending them a copy of this resolution. ·

Upon a motion by Mosher, second by Lee and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution:

Authorization for Exemption from Lawful Gambling License
The Pelican Rapids Chapter of Ducks Unlimited has submitted an application for exemption from
lawful gambling license to the Minnesota Gambling Control Board for an event scheduled on
April 14, 2000 at the Blue Water Sports Bar. No action was taken to prohibit the activity.
Request for Abatement of Penalty & Interest
Auditor, Wayne Stein, and Assessor, Bob Moe, reported on the request for abatement of accrued
penalty, interest, and cost on parcel no. 76-000-99-0793-000, in the amount of $97.51, from the
Otter Tail Wadena Community Action Council. The Action Council acquired the property on
June 16, 1998, from the City of Pelican Rapids. The property would be exempt from taxes
because of the non-profit status and use of the property, however the request for exemption
application was not filed timely. Lengthy discussion followed.
Motion by Nelson, second by Lee, and unanimously carried to authorize an abatement of accrued
penalty, interest, and cost on parcel no. 76-000-99-0793-000, in the amount of $97.51, because
the property would have been exempt had the application process been followed. This is not a
policy decision, rather a decision in an extenuating circumstance. This property was originally tax
forfeited.

Land & Resource Director, Bill Kalar, reported that an engineer's estimate of $13,000 has been
received to determine the original grade for County Ditch No. 4. Commissioners agreed that a
public hearing should be held to explain the cost to property owners.

Upon a motion by Lee, second by Froemming and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, Clifford L. Keller is the fee owner of the following lands:
W1/2 NW1/4 Section 15 Township 132N Range 44W
AND WHEREAS, the undersigned, Clifford L. Keller, has an interest in the land pursuantto:
X Drainage Easement for ditch, tile line or other drainage system which runs
through the Replacement Wetland as part of Ditch #64 established October 15,
1917, and was recorded in Book J, page 492 of the Minutes of the County Board
of Commissioners in the Office of the County Auditor for Otter Tail County.
which document is dated 19 November 1917, and was recorded on 19 November 1917, in the
Office of the County Recorder for Otter Tail County, in Miscellaneous Book _§_,_page 81, as
document No. 168541 ; and
WHEREAS, the fee owner or Landowner as defined in Minn. Rules part 8420.0110, subd. 29
intends to restore or create a Replacement Wetland under Minn. Stat. Sec. 103G.222 and Minn.
Rules part 8420.0530 or Minn. Rules part 8420.0740, upon the land described above.
NOW, THEREFORE, BE it RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the agreement, declarations, and covenants and consents to the creation or
restoration of the Replacement Wetland and authorizes the appropriate county officials' signatures
to execute the agreement.

Eminent Domain Proceedings
Highway Engineer, Rick West, requested authority to proceed with eminent domain proceedings
relative to the CSAH 4 reconstruction project. The County Attorney advised the County Board of a
legal process that could be used to streamline the eminent domain proceedings and eliminate a
delay in the project because roads are a public purpose.
Motion by Lee, second by Froemming, and unanimously carried to authorize the Highway Engineer
to proceed with the eminent domain proceedings as recommended by the County Attorney.

Approval of Remodeling & Furniture for Judge's Chamber
Motion by Froemming, second by Mosher, and unanimously carried to approve the purchase of
,two vehicles for the Social Services Department purchased through the State Contract, in the
amount of $30,473.00. The expenditure was approved by the Capital Improvement Committee.
Motion by Froemming, second by Mosher, and carried with Partmann opposed, to approve
payment in the amount of $43,000, for remodeling and furniture for a new Judge's Chamber for the
Seventh Judicial District. The expenditure was approved by the Capital Improvement Committee.
Request from Employees' Committee
Motion by Lee, second by Froemming, and unanimously carried to approve the placement of one
candy vending machine and one pop vending machine in the North entry of the Courthouse.
Lakes Country Service Cooperative Annual Membership
Motion by Lee, second by Mosher, and unanimously carried to approve payment, in the amount of
$250, for Otter Tail County's year 2000 annual membership fee for purchasing services.
Agreement with Blue Cross Blue Shield
Motion by Mosher, second by Lee, and unanimously carried to authorize the Chair's signature to
execute a Termination Agreement between BCBSM and Otter Tail County for the claims run-out
period for 1999.
Discussion -Home Health Care
Discussion took place regarding the county's Home Health Care program. The County
Coordinator provided a fact sheet with common questions and answers regarding home health
care. Discussion took place regarding cost, reimbursement rates, private providers, etc.
Commissioner Mosher stressed that a decision has not been made to cancel the county's program.
More information and research needs to be shared and discussed. Concern was expressed for
clientele and employees as well as competing with private industry. A desire to invite employees
to an informational meeting to share the facts of the program and the possibility of a "job fair" was
expressed.
Competition within the County
Chair Partmann expressed concern with competition within Otter Tail County relative to the
proposed DNR building. Lengthy discussion followed.
MN Department of Natural Resources Regional Office
Otter Tail County Resolution No. 2000 -15
Upon a motion by Commissioner Nelson, second by Commissioner Froemming, and carried with
Commissioner Lee abstaining, the Otter Tail County Board of Commissioners adopts the following
resolution:
WHEREAS, the Minnesota Department of Natural Resources maintains a regional office in Otter
Tail County; and

WHEREAS, Otter Tail County contains more lakes than any other county in the state of Minnesota;
and Q
WHEREAS, a great deal of the activities of the Department of Natural Resources are related to
these water resources; and
WHEREAS, the proper care and management of these resources are critical to the local economy.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the Otter Tail County Board of
Commissioners supports and encourages the Legislature to maintain these regional offices in the
best possible location within Otter Tail County.

Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A. Anderson, the undersigned, a
Registered Land Surveyor in and for the State of Minnesota, declares as follows:
1. That the plat of PELICAN BAY SHORES dated July 8, 1958 and filed on July 25, 1958 in the office of the County
Recorder, Otter Tail County, Minnesota, in Book N of Plats, Page 137, was prepared by Carl J. Nedberge, Land
Surveyor, Minnesota Registration No. 3277, deceased.
2. That said plat contains the following omissions to wit:
