HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/22/2000MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, February 22, 2000 9:30 a.m. Call to Order \ The Otter Tail County Human Services Board convened Tuesday, February 22, 2000 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Syd Nelson, Malcolm Lee, Dennis Mosher, and Roger Froemming present. Approval of Agenda Motion by Lee, second by Froemming, and unanimously carried to approve the Human Services Board agenda of February 22, 2000, as presented: Approval of Minutes Motion by Nelson, second by Mosher, and unanimously carried to approve the Human Services Board minutes of February 8, 2000, as presented. Resolution Supporting the 2000 Minnesota Legislature Proposed Bill Identified as H.F. No. 2533 and Companion Bill S.F. No. 2613. Also Identified as the County Q Probation Officer Salary Reimbursement Bill Otter Tail County Resolution No. 2000 -08 Upon a motion by Commissioner Lee, second by Commissioner Mosher and unanimously carried, the Otter Tail County Human Services Board adopts the following resolution: WHEREAS, the Otter Tail County Human Service Board has reviewed and discussed the proposed County Probation Officer Salary Reimbursement bill; and WHEREAS, Otter Tail County has not received a full 50% state reimbursement for salaries and benefits of its County Probation Officer's since 1996. In fact, Otter Tail County only received reimbursement of 44.97% in 1998 and 48.4% in 1997; and WHEREAS, this reimbursement shortfall results in the use of county tax dollars, which are subject to State imposed Levy Limits, being used to pay these unreimbursed costs, compounding the counties budgeting process. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Human Service Board supports the proposed County Probation Officer Salary Reimbursement bill that would require the Minnesota Department of Corrections to reimburse the County a full 50% of County Probation Officer salaries and benefits each year. ·o Adopted this 22nd day of February, 2000. ~ Otter Tail County Board of Commissioners February 22, 2000 Page 2 Dated: To 9.M'A IL/1 2-0:x2 OTTER TAIL COUNTY HUMAN SERVICES BOARD Attest: /4,ulr ~ Larry Kron, Clerk By: ~ Virgini ortmann, Human Services Board Chair Roger· Froemming, Human Services Board Vice-Chair Purchase of Service Agreements for Family Planning Public Health Director, Diane Thorson, reported that Mid-state and Otter Tail County Public Health applied for family planning grant dollars. Mid-state is the grant recipient, grant funds are sent to the Public Health Department, and the Public Health Department purchases services. Motion by Nelson, second by Froemming, and unanimously carried to authorize the appropriate county officials' signature(s) to execute the following Purchase of Service Agreements for family planning: Otter Tail Wadena Community Action Council Fergus Falls Medical Group $48,062 serving approx. 300 people $3,110 for Depo-Provera Injections Meals by Wheels Rate Increase Request Ms. Thorson reported that the Meals by Wheels Program of Fergus Falls has contracted for home delivered meals at $4.00 per meal. They are requesting an amended contract to increase the rate to $4.25 per meal. Ms. Thorson will return to the Human Services Board after the Human Services Director further researches the issue, as the increase would also affect his department. Minnesota Breast and Cervical Cancer Control Program (MBCCCP) Motion by Lee, second by Nelson, and unanimously carried to authorize the Chair's signature to execute the MBCCCP grant agreement between the Minnesota Department of Health and Otter Tail County Public Health for FY2000 that provides funding of $6,000 for outreach to a specific group of women. Health Promotion Activities Ms. Thorson reported that, based upon the recommendation of the CHS Advisory Committee, the Public Health Department will not continue to do cholesterol screenings, but will focus more on diabetes testing as well as outreach and education to encourage people to see their health professional. Management Objectives by Program Area Human Services Director, John Dinsmore, provided a handout entitled "Management Objectives by Program Area". Mr. Dinsmore reviewed the Vision and Mission Statement and the goals for the various programs. Discussion followed. Commissioner Lee requested information on how new trends in Social Services have impacted Otter Tail County funding. Correction -Nutrition Services Contract Q Motion by Froemming, second by Lee, and unanimously carried to authorize a correction in the Contract between the County of Otter Tail and Nutrition Service Inc. for year 2000 to amend the per meal cost from $3.30 per meal to $3.39 per meal. 0 • • Otter Tail County Board of Commissioners February 22, 2000 Page 3 Purchase of Service Agreement Extension 1 · , . Motion by Nelson, second by Lee, and unanimously carried to authorize the Chair's signature to ~ execute a new contract to renew the Purchase of Service Agreement between the FFRTC and Otter Tail County Social Services for day training and habilitation services for developmentally disabled at North Country Options for the period of April 1, 2000 through June 30, 2000. Otter Tail Family Services Collaborative Mr. Dinsmore provided the School Based Mental Health Outreach Team Project Proposal. This Mental Health Outreach Team would work throughout the county at school districts. The cost per position is $45,000 with a total cost of $430,000 annually. The Family Services Collaborative group will present this proposal to the Director group and request full funding for the MH team from LCTS dollars for the first and second year. The third year, special education dollars will be earned through the Fergus Falls Special Education Cooperative and the request will include 52% of the third year of funding from that agency. Discussion continued regarding how long funding is available and looking forward to develop a process to measure results from this proposed program. Approval to Pay Bills Motion by Nelson, second by Lee, and unanimously carried to approve Human Services bills and claims as presented. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 22, 2000 at 10:54 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming, Vice-Chair; Syd Nelson, Malcolm Lee, and Dennis Mosher present. Approval of Agenda Motion by Nelson, second by Froemming, and unanimously carried to approve the County Board agenda of February 22, 2000, with the following additions: Appointment on Board of Adjustment Auditor, Wayne Stein -11 :25 a.m. Capital Improvement Committee Meeting Approval of Minutes Motion by Mosher, second by Froemming, and unanimously carried to approve the County Board minutes of February 15, 2000, as presented. Discussion -Septic System Bill Steinhoff, owner of Oak Lodge Resort on Lake Lida, stressed the importance of proper installation and inspection of .septic systems. He purchased Oak Lodge Resort in 1975 and received a certificate, at that time, that the septic system was up to code. He later discovered that the system was not up to code and that pollution was occurring because of an improperly installed septic system. Mr. Steinhoffs concern is that there are other resorts unknowingly polluting the lakes similar to his experience. Mr. Steinhoff noted that the lakes are so important in Otter Tail County and that we need to keep them clean. The tourism industry is a very valuable resource for our county. Commissioner Lee noted that the State Health Department had jurisdiction over resorts back in 1975 and that was a problem that has been corrected. Chair Partmann thanked Mr. Steinhoff for appearing and reminding the board of the importance of the environment, lakes, and tourism industry. Motion by Nelson, second by Lee, and unanimously carried to approve final payment, in the Q amount of $89,564.37, payable to Central Specialties, Inc. for completion of bituminous leveling ,, and wearing course, aggregate shouldering, and topsoil for S.A.P. 56-614-12 & Etc. per estimate No. 6. Bid Summary & Recommendation for Award After advertising for bids, Highway Engineer Rick West, opened the following bids at 1 :00 p.m. on February 9, 2000, for S.A.P. 56-657-05 & Etc: Mark Sand & Gravel Acquisition Co. Fergus Falls, MN Central Specialties, Inc. Alexandria, MN Tri-City Paving, Inc. Little Falls, MN $995,321.65 $1,047,093.35 $1,196,376.30 Motion by Froemming, second by Mosher, and unanimously carried to accept the low bid of Mark Sand & Gravel Acquisition Co., in the amount of $995,321.65, as recommended by the Highway Engineer. Agreement between Otter Tail County and Becker County S.A.P. 56-623-09 -Otter Tail County S.A.P. 03-602-03 -Becker County Motion by Lee, second by Froemming, and unanimously carried to authorize the Chair's signature to execute an agreement between Otter Tail County and Becker County for bituminous overlay of Otter Tail County CSAH No. 23 and Becker County CSAH No. 2. This motion is subject to the approval of the County Attorney. Bituminous Overlay on CSAH No. 80 from the West Junction of TH No. 10 East to CSAH No. 34/51 in Perham Project No. S.A.P. No. 56-680-04 Otter Tail County Resolution No. 2000 -09 Upon a motion by Nelson, second by Mosher and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Mn/DOT is constructing a bituminous overlay project on TH No. 10 from Perham East under Mn/DOT Project No. S.P. No. 5606-39, AND WHEREAS, Otter Tail County is constructing a bituminous overlay on CSAH No. 80. from the West Junction of TH No. 10 East to CSAH No. 34/51 in Perham under Otter Tail County Project No. S.A.P. 56-680-04, AND 0 0 Otter Tail County Board of Commissioners February 22, 2000 Page 5 WHEREAS, it would be financially advantageous to construct both projects under one contract and 0 . si~ce Mn/DOT has the larger amount of construction work, it will generate the most competitive bid · prices. 0 0 NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County is requesting that Otter Tail County Project No. S.A.P. 56-680-04 be included and made part of Mn/DOT Project No. S.P. 5606-39 and that Mn/DOT provide construction engineering/contract administration services and act as an agent for Otter Tail County in the construction of Otter Tail County Project No. S.A.P. 56-680-04 with Otter Tail County reimbursing Mn/DOT for all costs associated with Project S.A.P. 56-680-04. Dated: ~ ]1 2cco COUNTY BOARD OF COMMISSIONERS Solid Waste Transfer Services Agreement Motion by Nelson, second by Froemming, and unanimously carried to authorize the Chair's signature to approve a Solid Waste Transfer Services Agreement between the County of Otter Tail and Steve's Sanitation for transportation services effective April 1, 2000. · Request for Forgiveness of Penalty, Interest, and Cost Wayne Stein, County Auditor, presented a request from the Otter Tail-Wadena Community Action Council, Inc. for the forgiveness of penalty, interest, and cost in the amount of $97.51. Discussion followed. Action was deferred and further research requested. Application for Exemption from Lawful Gambling License. The Maidens of the Prairie to Lakes Ducks Unlimited will be submitting an application for authorization for an exemption from lawful gambling license for an event that will be held at the Peak Supper Club on April 25, 2000. No action was taken. Application for Liquor License Motion by Froemming, second by Mosher, and unanimously carried to approve the following application for license: Thomas Lorine Peak Supper Club Clitherall, MN Renewal of Consumption and Display Permit Appointment -Board of Adjustment Motion by Mosher, second by Nelson, and unanimously carried to appoint Richard Steven Schierer to the Otter Tail County Board of Adjustment to replace Jon Everts effective immediately. Otter Tail County Board of Commissioners February 22, 2000 Page6 Discussion -Feedlot Resolution .. Commissioners discussed the proposed feedlot resolution from Clearwater County. New feedlot n rules have been criticized by farmers. Commissioners stressed an importance for the language to 'Viii be fully understood before the rules are adopted. Commissioners requested that this matter be referred to Extension Educator, Steve Handegaard for further research and facts relative to the new feedlot rules and those facts be presented to the board before action is taken.
