OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, February 15, 2000 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 15, 2000 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Roger Froemming, Vice-Chair; and Dennis Mosher present. Commissioners Malcolm Lee and Syd Nelson were absent. Approval of Agenda Motion by Froemming, second by Mosher, and unanimously carried to approve the County Board agenda of February 15, 2000, as presented. Approval of Minutes Motion by Froemming, second by Mosher, and unanimously carried to approve the County Board minutes of February 8, 2000, as mailed. Payment Approval Motion by Mosher, second by Froemming, and unanimously carried to approve payment to Widseth Smith Nolting and Associates, Inc, in the amount of $1,604.50, for environmental services provided during the period of December 26, 1999, and January 22, 2000, at three tax forfeited sites. Premise Permit Otter Tail County Resolution No. 2000 -07 Upon a motion by Froemming, second by Mosher and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Fergus Falls Hockey Association, Fergus Falls, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Graystone Lodge, in Everts Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and (.) WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Fergus Falls Hockey Association, Fergus Falls, MN at the Graystone Lodge, in Everts Township of Otter Tail County. Otter Tail County Board of Commissioners February 15, 2000 Page 2 • • NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Fergus Falls Hockey Association, Fergus Q Falls, MN at the Graystone Lodge, in Everts Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURHTER RESOLVED, that notice of this application and approval shall be provided to the Township of Everts by sending them a copy of this resolution. Adopted this 15th day of February, 2000. After completion of committee meetings, the Chair reconvened the meeting at 10:24 a.m. Approval to Award Purchase of Recycling Packer Solid Waste Director, Mike Hanan, and Recycling Center Manager, Rick Denzel, presented two quotes for a recycling packer as follows: Ken Saurer Garbage Service Sanitation Products 20 yard Heil Packer $75.00 17 yard Leach Sanicruiser $15,000.00 Winch Recondition by seller: Pumps/Hoses Pumps, Hoses, Floor, Control Arms Pressure Check Cylinders, 30-day Warranty Painted White $25.00 Winch Transportation $500.00 Sand Blasted & Painted White Installation $3,000.00 Installation & Transportation Add. Mr. Hanan and Mr. Denzel recommended the 17-yard Packer from Sanitation Products because the Leach brand packer is a higher quality packer and the quotation includes reconditioning and a 30-day warranty. Motion by Froemming, second by Mosher, and unanimously carried to approve the purchase of a 17-yard Leach Sanicruiser recycling packer from Sanitation Products, in the amount of $15,000, as recommended by the Solid Waste Director. Conditional Use Permit Application (Gast) Attorney, Richard Henderson, on behalf of Darrel and Marlene Gast, requested reconsideration of the Gast Conditional Use Permit application (Sec. 14, Twp. 134, R. 40, Otter Tail Lake, 56-242). County Attorney, David Hauser, stated that the County Board may reconsider the application; however, reconsideration is not a requirement. The applicant is entitled to submit another CUP application through the regular procedures that would assure the proper notice requirements. The Chair did not re-open the matter for reconsideration of the application. Planning Commission Recommendations Land & Resource Director, Bill Kalar, reported that the Planning Commission began review of the shoreland ordinance at their February 9th meeting. After further review by the Planning Commission, each recommendation for change or clarification will be reviewed by the County Board. The Planning Commission suggested that the Subdivision Controls Ordinance needs to be reviewed also, particularly the section regarding roads and how roads are constructed in a development. Mr. Kalar provided copies of the Environmental Assessment Worksheet_ (EAW) on the Preliminary Plat of "West Silent Lake". The EAW has been mailed to.the Environmental Quality Board with public comment period ending March 22, 2000. Mr. Kalar reviewed the process to determine the need for an Environmental Impact Statement (EIS). Ditch No. 4 Ditch Inspector, Tiny Holm, reported that the petition for repair of Ditch No. 4 has been accepted. The petition did not require spouse signatures relative to ownership as previously determined. Discussion took place regarding redetermination of benefits, cost of an engineering report, and the need for a public hearing. Motion by Mosher, second by Froemming, and unanimously carried to authorize the Ditch Inspector to proceed with the required process to repair Ditch No. 4. A public hearing will be set upon receipt of an engineer's estimate. Judicial Ditch No. 2 Motion by Froemming, second by Mosher, and unanimously carried to appoint Commissioner Dennis Mosher to the Judicial Ditch No. 2 Committee. This corporate ditch is a joint ditch between Wilkin and Otter Tail County. Approval to Pay Bills Motion by Froemming, second by Mosher, and unanimously carried to approve payment of bills per Attachment A of these minutes which includes the following lodging payment: Double Tree Park Place Hotel Recorder, Wendy Metcalf Otter Tail County Board of Commissioners February 15, 2000 Page 4 Reclassification Request Motion by Mosher, second by Froemming, and unanimously carried to approve the reclassification 0 of Social Services Account Clerk positions to Social Services Account Technician positions with an • increase from DMG grade 10 to DMG grade 11. This position was originally reviewed through the Merit System, then submitted to DMG. Correspondence Acknowledged Chair Partmann acknowledged receipt of a letter from Dr. Mark Olmsted that expressed a concern relative to the number of deputies available in Otter Tail County to cover the whole county and a request that the state fund more county law enforcement officers in our area. 4-H Update Extension Educator, Steve Handegaard, briefed the board on 4-H Project Day, the new Otter Tail County Plat Book, and the interview process to fill the open Ag Educator position. Adjournment At 11 :24 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, February 22, 2000.
