HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/04/20000 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Ot;!er Tail County Courthouse Cominissioners' Room, Floor 1-B Tuesday, January 4, 2000 9:30 a.m. Statutory Meeting -Call to Order Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened Tuesday, January 4, 2000 at 9:32 a.m. at the Otter Tail County Courthouse with Commissioners Syd Nelson, Malcolm Lee, Roger Froemming, and Virginia Partmann present. Year 2000 Otter Tail County Board Chair Selected County Board Clerk, Larry Krohn, requested nominations for the year 2000 Otter Tail County Board Chair. Motion by Lee, second by Froemming, and unanimously carried to elect Commissioner Virginia Partmann as the Otter Tail County Board Chair for year 2000. Year 2000 Otter Tail County Board Vice-Chair Selected County Board Clerk, Larry Krohn, requested nominations for the year 2000 Otter Tail County Board Vice-Chair. Motion by Partmann, second by Nelson, and unanimously carried to elect Commissioner Roger Froemming as the Otter Tail County Board Vice-Chair for year 2000. Approval of Agenda Commissioner Virginia Partmann assumed the chair and called for approval of the agenda. Motion by Lee, second by Froemming, and unanimously carried to approve the County Board agenda of January 4, 2000 as mailed. Approval of Minutes Motion by Nelson, second by Froemming, and unanimously carried to approve the County Board minutes of December 28, 1999 as mailed. Insurance Policy Renewal 2000 Motion by Lee, second by Froemming, and unanimously carried to authorize payment to Minnesota Counties Insurance Trust in the amount of $238,467.00 for Liability/Property & Casualty and $182,978.00 for Workers Compensation renewal policies. Approval to Pay Annual Appropriations Motion by Froemming, second by Nelsor:i, and unanimously carried to authorize payment of the following 2000 annual appropriations: · Otter Tail Country Tourism Association West Otter Tail Fair Association East Otter Tail Fair Association West Central MN Initiative Fund $ 5,000. $12,000. $12,000. $15,212. Request for Corrections -December 14, 1999 Minutes The following corrections were requested by the Land & Resource Director: Otter Tail County Board of Commissioners January 4, 2000 Page 2 Page 5 -currently reads: • Conditional Use Permit -Michael Musten: Q Motion by Nelson, second by Froemming, and unanimously carried to approve a Conditional Use Permit to expand a garage on Rush Lake (Sec. 5, Twp. 135, R. 39, Rush Lake Township, Lake No. 56-243) with conditions as recommended by the Planning Commission. instead of "expand a garage", should read "relocate a swale and lower an ice ridge". Page 6 -currently reads: Conditional Use Permit -Donald & Suzanne Tirk: Land & Resource Director, Bill Kalar, noted that this Conditional Use Permit request is to keep a retaining wall built beyond the zoning setback distance. Donald Tirk spoke on behalf of the application request. Mr. Tirk explained that he built the wall; however, didn't know that he needed a permit other than the site permit to build the wall. An after-the-fact permit fee was assessed. Mr. Tirk requested a compromise proposal that wold help to accommodate their disabled daughter. Discussion followed. Builder, Steve Christianson spoke on behalf of the applicant and requested a refund to the applicant of the difference between the regular permit fee and the after-the-fact permit fee. instead of "beyond the zoning setback distance", should read "within the structure setback distance". Page 6 -currently reads: Conditional Use Permit -"Corner Store"/Gregory J. Stich & Joanne M. Stich: Motion by Froemming, second by Partmann, and unanimously carried to approve a Conditional Use Permit for a new permit to cover the proposed lot line changes to separate the commercial property from the homeowner properties on Otter Tail Lake (Sec. 32, Twp. 134, R. 40, Amor Township, Lake No. 56-242). instead of "for a new permit to cover the proposed lot line changes to separate the commercial property from the homeowner properties", should read "to allow the existing business to continue on proposed parcel C (separates the commercial property from the residential properties)". Motion by Nelson, second by Froemming to approve the above requested clarifications/changes to the December 14, 1999 minutes. Discussion took place regarding Michael Musten's CUP and the clarification requested relative to reducing the ice ridge. Land & Resource Director, Bill Kalar, explained that this CUP is for relocating a swale and lowering an ice ridge approximately one foot which was approved by the Planning Commission with the condition to follow the engineer's plan. The applicant's original request was to reduce the ice ridge more than one foot. Chair Partmann called for a vote. Motion carried with Lee opposed. Otter Tail County Board of Commissioners January 4, 2000 Page4 After consideration, a motion was offered by Nelson, seconded by Froemming, and unanimously carried to award bids for publishing and printing for the year 2000 as presented above and 0 recommended by the County Auditor. Pocket Gopher Bounty (M.S. 348.13) Otter Tail County Resolution No. 2000 -01 Upon motion made by Lee, seconded by Froemming and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that The sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County for every pocket gopher killed in said County during the year 2000 in cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED further that said payment of such County shall be made by the County Auditor upon certificates executed by the Chairman and/or Clerk of the Town Board of said Township setting forth that the township had issued and delivered to each claimant a payment for at least seventy cents ($.70) for each pocket gopher so killed. CXlO=,__ __ (/ 0 I OARD OF COMMISSIONERS Attest: ~ ~ Larry Kr hn'.ieri< a Partmann, County Board Chair Tax Forfeited Land Sale Apportionment Otter Tail County Resolution No. 2000 -02 Upon motion made by Lee, seconded by Nelson, and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in Minnesota Statute 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant to Minnesota Statute 282.08 and WHEREAS, Minnesota Statute 282.08(4)(b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments, and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and U,-·-- recreational areas, and WHEREAS, Otter Tail County has a park and recreational area, which would benefit by such an apportionment. r Otter Tail County Board of Commissioners January 4, 2000 Page 5 · NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from ,the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds to be disbursed according to law. In 1999 the cost to publish the Delinquent Tax List was $17,924.28. There were approximately 720 parcels published for a per parcel cost of $24.89. County Board of Equalization Dates Motion by Lee, seconded by Froemming, and unanimously carried to convene the County Board of Equalization on Wednesday, June 14, 2000, at 9:00 a.m. and to reconvene the County Board of Equalization for final action on Tuesday, June 27, 2000, pursuant to Minnesota Statute 274.14. Red River Valley Development Association Reappointment Motion by Froemming, second by Nelson, and unanimously carried to authorize the reappointment of Daniel Roehl as a three-year representative on the Board of Directors of the Red River Valley Development Association effective January 1, 2000. Request for Reduction in Retainage -S.A.P. 56-682-05TB Motion by Nelson, second by Froemming, and unanimously carried to approve a 2.5% retainage on CSAH 82 reconstruction project (S.A.P. 56-682-05TB) as recommended by the Highway Engineer. Mark Sand & Gravel had requested a reduction in retainage from 5% to 1 %. Consultant Services Contract -S.P. 56-624-09 Motion by Lee, second by Nelson, and unanimously carried to authorize the appropriate county officials' signatures to execute an agreement between the County of Otter Tail and Interstate Engineering for consultant services on the CSAH 24 Reconstruction project from Erhard west to CSAH 21 on an hourly basis not to exceed $10,000. Approval of Amendment for Resolution No. 99 -55 Motion by Lee, second by Nelson, and unanimously carried to amend Otter Tail County Resolution No. 99 -55 by striking the grant amount of $39,857.00 and substituting $34,730.00 to the original resolution adopted October 12, 1999, for the construction of County Bridge No. 56J07 (S.A.P. 56-635-29) over the Star Lake/Dead Lake Channel. Approval of Installation of Culvert on Ditch No. 21 Ditch Inspector, Tiny Holm, reported that the OCTA Snowmobile Association presented a request to install a culvert on Ditch No. 21. The culvert will be used as a control structure and installed at the elevation set by the DNR.
