Call to Order
The Otter Tail County Board of Commissioners convened at 9:33 a.m. Tuesday, December 13, 2016, at
the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness. Chair;
Doug Huebsch, Vice-Chair; Wayne Johnson, Roger Froemming and John Lindquist present.
Approval of Agenda
Chair Rogness called for approval of the Board agenda. Motion by Froemming, second by Johnson and
unanimously carried to approve the Board of Commissioners Agenda of December 13, 2016, with the
following additions/modifications:

Justice Building Project
Terry Hoff, Facilities Operations Manager, reported that bids were accepted for the Otter Tail County
Correctional Facility Holding Cells and Elevator Addition remodel project. Discussion followed regarding
base bids, soft costs and contingencies, timeline for completion and owner's representative (project
manager). Motion by Lindquist, second by Huebsch and unanimously carried to establish the Justice
Building project budget at $1,350,000 and to authorize the appropriate County Officials' signatures to
execute the contract for the project with TF Powers of Fargo, ND, at a Base Bid of $1,149,000. Motion by
Froemming, second by Lindquist and unanimously carried to hire Marlin Hoff as the County's Owner's
Representative and to authorize the appropriate County Officials' signatures to execute a contract between
the County of Otter Tail and Marlin Hoff effective January 1, 2017.
E911 Addressing
Brian Armstrong, Land Services Director, briefed the Board on proposed revisions to the Enhanced 911
Ordinance. Discussion took place regarding E911 signs that are removed and not replaced, the cost of
replacing the signs and countywide long term replacement needs.

Public Meeting
At 10:15 a.m., Chairman Rogness opened the County Board meeting for public comments regarding a
permit application for the WB Stone, Inc. Dairy Farm expansion located at 56459 Elmwood Rd, Henning,
MN. The public meeting is being held according to M.S. 116.07, Subd. 7(1). The MN Pollution Control
Agency (MPCA) is responsible for issuing a permit for the dairy operation. The County provides a local
forum for the public to express their opinions regarding the project. No one from the public was present
and no written comments were received on the proposed project. Anthony Anderson is purchasing this
dairy operation and stated that the operation will be under an Interim Permit while working to improve the
feedlot storage. Commissioners expressed their support of dairy agriculture which is a core component of
Otter Tail County's economy. The public meeting was closed at 10:19 a.m.
Coordinator on Aging Position
Public Health Director Diane Thorson reported that the Coordinator on Aging position is funded partially by
the Federal Aging Grant. Motion by Froemming, second by Johnson and unanimously carried to authorize
the Public Health Director to sign the contract between the County of Otter Tail and the Land of the
Dancing Sky Area Agency on Aging which provides $27,725 for the position. The County's cost for the
program is $64,002.
Environmental Health Fees
Motion by Huebsch, second by Johnson and unanimously carried to confirm that the Environmental Health
Services Program Fees for CY2017 will be the same as established on March 22, 2016, under Otter Tail
County Resolution No. 2016-17.
Consultant Grant Contract Amendment
The Public Health Director briefed the Board on a pilot project to utilize the RelayHealth record for persons
with disabilities to pilot standards for health information exchange for long term services and support. The
consultant currently working on the project is no longer available. The Department of Human Services
(OHS) has requested that Otter Tail County contract with an independent contractor to complete the work
on this project. Motion by Huebsch, second by Johnson and unanimously carried to authorize the .
appropriate County Officials' signatures to amend the contract with OHS to accept individual funding and
authorize a contract between the County of Otter Tail and Linden Tech Advisors, an independent
contractor. Project completion is the end of March 2018.
A RESOLUTION IN SUPPORT OF THE GOVERNOR'S TASK FORCE
ON MENTAL HEALTH'S FINAL REPORT
DATED NOVEMBER 15, 2016
Otter Tail County Resolution No. 2016 -67
WHEREAS, Governor Dayton issued an Executive Order on April 27, 2016 creating the Governor's Task
Force on Mental Health created to advise the Governor and Legislature on mental health system
improvements within the State of Minnesota, and;
WHEREAS, more than 200,000 adults and 75,000 children in Minnesota live with a major mental illness,
and;
WHEREAS, the Task Force and five Formulation Teams convened public meetings from July 11, 2016
through November 7, 2016 and developed nine comprehensive recommendations and approximately 77
strategies/areas of focus to design, implement, and sustain a full continuum of mental health services
throughout Minnesota, and;

WHEREAS, the full report's comprehensive recommendations were guided by 29 principles and informed
by other inclusive reports -especially the Substance Abuse and Mental Health Services Administration's
(SAMHSA) Recovery Oriented Systems of Care Resource Guide, Minnesota State Colleges and
Universities' Gearing Up for Action: Mental Health Workforce Plan for Minnesota , the United States
Department of Health and Human Services' (HHS) Mental Health and Substance Use Disorder Parity Task
Force , and the Minnesota Housing Finance Agency's (MHFA) Minnesota Housing 2017 Affordable
Housing Plan -to ensure collaborative implementation of proposed solutions, and;
WHEREAS, as one of 87 county units of government within the State of Minnesota responsible to ensure
that a range of mental health services and supports are accessible, affordable and available to the
residents of our county, it is imperative that the "Strengthen Governance of Minnesota's Mental Health
System" recommendation to convene a mental health governance workgroup secures comprehensive and
complete participation of county representatives, and;
WHEREAS, we acknowledge the importance and value of each of the nine recommendations and the
associated areas of focus or developed strategies, we fully support the Report's two short term
recommendations, i.e., "Implement Short-Term Improvements to Acute Care Capacity and Level-Of-Care
Transitions" and "Implement Short-Tenm Improvements to Crisis Response", and the 18 short-term
strategies and one long-term strategy associated with these two recommendations, and;
WHEREAS, we recognize that successful implementation of these comprehensive recommendations and
strategies will require the close collaboration and cooperation of the State of Minnesota's Executive,
Legislative and Judicial branches of state government.
NOW THEREFORE BE IT RESOLVED THAT: Otter Tail County, by this resolution, supports the proposed
recommendations and strategies of this report and encourages Governor Mark Dayton and the Minnesota
State Legislature to pledge sufficient State resources needed to successfully implement the
recommendations set forth in this report.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Froemming, duly

Recess & Reconvene
At 10:45 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board meeting was reconvened at 10:50 a.m.
Lake Street Discussion
The Highway Department submitted photographs showing the surveyed lot lines for the public road
(access to Otter Tail Lake) known as Lake Street in the Midway Plat. Anderson Surveying has
prepared a certificate of survey for the road showing the encroachments that have occurred in the
right of way. Discussion followed.
Boat & Water Grant
Motion by Huebsch, second by Johnson and unanimously carried to authorize the appropriate County
Officials' signatures to execute the 2016 Federal Boating Safety Supplemental Equipment Grant
Agreement between the County of Otter Tail and MN DNR, in the amount of $5,074. These grant
dollars will be used to update equipment.
ACCEPTING DEDICATED DONATION TO SUPPORT SEARCH AND RESCUE
FOR THE SHERIFF'S OFFICE
Otter Tail County Resolution No. 2016 -69
WHEREAS, Dawn's Photography has offered to donate funds in the amount of two hundred ninety-seven
dollars and fifty cents ($297.50) to the County of Otter Tail on behalf of the Otter Tail County Sheriff's
Office to assist in the Search and Rescue program.
WHEREAS, Minnesota Statute 465.03 requires a county to accept the gift by resolution expressed in terms
prescribed by the donor in full; and,
WHEREAS, acceptance of the funds in accordance with the donor's terms is in the best interest of the
County of Otter Tail.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners does accept
the above-described funds from Dawn's Photography and extends its grateful appreciation.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Froemming, duly

ACCEPTING DEDICATED DONATION TO SUPPORT SEARCH AND RESCUE
FOR THE SHERIFF'S OFFICE
Otter Tail County Resolution No. 2016 -70
WHEREAS, Keith and Melissa Rogal have offered to donate funds in the amount of fifty dollars ($50.00) to
the County of Otter Tail on behalf of the Otter Tail County Sheriff's Office to assist in the Search and
Rescue program.
WHEREAS, Minnesota Statute 465.03 requires a county to accept the gift by resolution expressed in terms
prescribed by the donor in full; and,
WHEREAS, acceptance of the funds in accordance with the donor's terms is in the best interest of the
County of Otter Tail.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners does accept

Government Services Technical (GSTI Unit Labor Agreement
Motion by Lindquist, second by Johnson and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Labor Agreement between the County of Otter Tail and Minnesota
Teamsters Public and Law Enforcement Employees' Union, Local No. 320, for the GST Unit as submitted
by the Human Resources Director. The term of the Labor Agreement is January 1, 2017 through
December 31, 2019.
Recess & Reconvene
At 11 :28 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for committee meetings and lunch break. The Board meeting was reconvened at 1 :25 p.m.
Final Plat -Kvare's Beauty Bay South 3rd Addition
Motion by Froemming, second by Huebsch and carried with Johnson abstaining, to approve the Final Plat
of Charles C and Barbara J Kvare titled "Kvare's Beauty Bay South 3rd Addition" located in Section 18 of
Dunn Township; non-shoreland property.

One Watershed, One Plan -Red Eye River
Bill Kalar, Land & Resource Director, presented a map showing nine watersheds in Otter Tail County.
Instead of a water plan that follows county borders, the State is moving towards planning on a watershed
basis where all Local Government Units (LGUs) within the watershed would be involved in the planning
process and ultimately, in making decisions on the local projects needed within that watershed. This would
replace the County Water Plan. Motion by Lindquist, second by Johnson and unanimously carried to
authorize the Land & Resource Director to proceed with One Watershed, One Plan implementation for the
Red Eye River Watershed.
Association of MN Counties (AMC) Updates
Commissioners recently attended the Annual AMC meeting. They provided updates on the follow topics:
Housing & Economic Development, Broadband -Nobles County, Regulations -Moral Courage and Ethical
Behavior, Comprehensive Planning, Clean Water and Buffer Strips, and Human Trafficking.
Agreement with Bond Trust Services Corporation
Motion by Johnson, second by Froemming and unanimously carried to authorize the Auditor-Treasurer's
signature to execute the "Agreement Relating to Paying Agency, Registrar and Transfer Agency" which
outlines the duties and responsibilities of Bond Trust Services Corporation as they relate to the County's
$6,675,000 General Obligation Capital Improvement Refunding Bonds, Series 2016A.
REQUEST TO REPURCHASE TAX FORFEITED PROPERTY
Otter Tail County Resolution No. 2016 -71
Commissioner Froemming introduced the following resolution and moved its adoption:
RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, that;
WHEREAS, George Lorentz, owner, had made application to repurchase the following legally described
parcel:
Parcel No. 67-000-99-0067-001
Deer Creek Baker's Addition
East 65' of West 111 '9.5" of Lot 4 Block 2
Said property having forfeited to the State of Minnesota on the 26th day of August, 2016, for nonpayment of
the 2008, 2009, 2015 and 2016 property taxes; and
WHEREAS, an application to repurchase the above described property was timely submitted on Monday,
December 5, 2016; and
WHEREAS, the sum of $693.01 represents the aggregate of all delinquent and current taxes, penalties,
costs, assessments, and fees as of November 30, 2016, that would have been due and payable had the
above described parcel not forfeited to the State of Minnesota; and
WHEREAS, the applicant has submitted with his repurchase application a postal money order in the
amount of $693.01; and
WHEREAS, the applicant has requested that the Otter Tail County Board of Commissioners consider his
application to repurchase the above-described parcel and has requested that the Otter Tail County Board
of Commissioner approves the applicant's request to repurchase the above-described property; and
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the repurchase of the above-described property.

BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners hereby finds that the
repurchase will promote and best serve the public interest, and that it will relieve any undue hardship which
may have resulted from the forfeiture.

PREMISE PERMIT -FERGUS FALLS HOCKEY ASSOCIATION
Otter Tail County Resolution No. 2016 -68
Commissioner Froemming introduced the following resolution and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and
permits for the conduct of lawful gambling lies with the Minnesota Gambling Control board; and
WHEREAS, the Fergus Falls Hockey Association, Fergus Falls, MN, has made an application to the
Gambling Control Board for the purpose of conducting lawful gambling at the Ice Hole Bar, located straight
out from the Lake Lida Access in Lida Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial
premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners
approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by Fergus Falls Hockey Association, Fergus Falls, MN, at the Ice Hole Bar, located
straight out from the Lake Lida Access in Lida Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the Fergus Falls Hockey Association, Fergus Falls, MN, at the
ice Hole Bar, located straight out from the Lake Lida Access in Lida Township of Otter Tail County,
provided the applicant meets all the necessary criteria for the licenses and permits as required by the
Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Lida by sending them a copy of this resolution.

Ditch Inspector Kevin Fellbaum reported that property owners on Head Lake requested that the outlet of
the Lake be restored similar to the work that was completed on Round Lake to deal with high water. A
redetermination of benefits has been completed and there are adequate dollars in this Ditch Fund. Motion
by Johnson, second by Huebsch and unanimously carried to authorize cleaning out a portion of Ditch 44
as presented, and building a rock weir at ttie outlet of Head Lake to the Ordinary High Water (OHW) level.
Estimated cost of the project is $4,000 -$8,000.
Continuous Improvement Request
Human Resources Director Nicole Hansen explained the need for new continuous improvement leaders
and applicable training. Motion by Johnson, second by Huebsch and unanimously carried to authorize
Heather Sandeen from the Association of Minnesota Counties (AMC) to facilitate a training session for
continuous improvement leaders on Tuesday, February 7, 2017. Estimated cost of the training is $900.00
to be paid out of the Commissioners' Contingency Fund. Commissioners requested that training funds, in
the future, be added to the Administration Budget.
SPONSORING AGENCY
Otter Tail County Resolution No. 2016 -72
Commissioner Johnson introduced the following resolution and moved its adoption:
BE IT RESOLVED THAT: Otter Tail County agrees to act as sponsoring agency for a "Transpor:tation
Alternatives" project identified as City of Vergas Multiuse Path Project and has reviewed and approved the
project as proposed. Sponsorship includes a willingness to secure and guarantee the local share of costs
associated with this project and responsibility for seeing this project through to its completion, with
compliance of all applicable laws, rules and regulations.
BE IT FURTHER RESOLVED.THAT: Richard K. West, P.E., Count Engineer is hereby authorized to act
as agent on behalf of this sponsoring agency.

AGREEMENT TO MAINTAIN FACILITY
Otter Tail County Resolution No. 2016 -73
Commissioner Johnson introduced the following resolution and moved its adoption:
WHEREAS: The Federal Highway Administration (FHWA) requires that states agree to operate and
maintain facilities constructed with federal transportation funds for the useful life of the improvement and
not change the use of right of way or property ownership acquired without prior approval from the FHWA;
and
WHEREAS: Transportation Alternatives projects receive funding; and
WHEREAS: the Minnesota Department of Transportation (Mn/DOT) has determine that for projects
implemented with alternative funds, this requirement should be applied to the project proposer; and
WHEREAS: Otter Tail County is the sponsoring agency for the Transportation Alternatives project
identified as City of Vergas Multiuse Path Project.
THEREFORE BE IT RESOLVED THAT: the sponsoring agency hereby agrees to assume full
responsibility for the operation and maintenance of property and facilities related to the aforementioned
Transportation Alternatives project.

Officials' signatures to execute Amendment No. 1 to the Engineering Services Agreement between the
County of Otter Tail and Interstate Engineering, Inc. for replacement of an existing structure over Spruce
Creek in Eastern Township, as presented by the Public Works Director.

Motion by Lindquist, second by Johnson and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Engineering Services Agreement between the County of Otter Tail and
