Fir Avenue, Fergus Falls, MN November 8, 2016 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, November 8, 2016, at the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, Roger Froemming and John Lindquist present. Approval of Agenda Chair Rogness called for approval of the Board agenda. Motion by Lindquist, second by Johnson and unanimously carried to approve the Board of Commissioners Agenda of November 8, 2016, with the following addition: Discussion Regarding Otter Tail County Coroner Position Consent Agenda Motion by Froemming, second by Johnson and unanimously carried to approve Consent Agenda items as follows: 1. November 1, 2016, Board of Commissioners' Meeting Minutes 2. Warrants/Bills for November 8, 2016 (Exhibit A) 3. Human Services Bills & Claims 4. Approval of Equipment Donation to Battle Lake, Henning, and New York Mills 5. Approval of LG240B Application for Bingo and Raffle Event by the Re-Use-It Thrift Store of Perham on Dec. 4, 2016, at The Cactus 6. Approve 3 payments to Lake Region Healthcare for Expenses Incurred under M.S. 609.35 7. Approve a County Credit Card with a $500 30-Day Limit for Social Worker Leland Potter Closed to the Public At 9:35 a.m., Chair Rogness declared the Board meeting closed to the public for purposes of discussing labor negotiation strategies regarding the four (4) Law Enforcement Union and GST Union contracts. · Present were all five seated Commissioners, County Attorney, County Administrator, Human Resources Director and Board Secretary. At 10:12 a.m., Chair Rogness declared the meeting recessed for a short break. 2017 Solid Waste Fees The Board of Commissioners' meeting was reconvened in open session at 10:15 a.m. Solid Waste Director, Mike Hanan, and Assistant Solid Waste Director, Zach Fjestad, presented the proposed 2017 Solid Waste Fee. Schedule. Discussion took place regarding the fees for disposal of mixed municipal waste, demolition debris and electronics, and the residential and commercial service fee rate. Motion by Huebsch, second by Johnson and unanimously carried to approve the 2017 Solid Waste Fee Schedule as presented by the Solid Waste Director and attached as Exhibit B. City of Fergus Falls Landfill Motion by Huebsch, second by Johnson and unanimously carried to set the City of Fergus Falls Landfill Operating Permit Public Hearing at 7:00 p.m. on Monday, December 19, 2016, at the Government Services Center in Fergus Falls, MN. OTC Board of Commissioners' Minutes November 8, 2016 Page 2 Otter Tail County Coroner Position Sheriff Brian Schlueter reported that Dr. Gregory Smith is resigning his Coroner position effective January 1, 2017. Discussion followed regarding options to fill the position. Commissioners requested that Sheriff Schlueter reach out to Lake Region Health Care and other providers to collaborate on a solution for coroner services for our region. Environmental Impact Statement {EIS) for Prosperity Hills Bill Kalar, Land & Resource Director, provided the Environmental Quality Board (EQB) rules regarding a decision on the need for an EIS under M.S. 4410.1700. He reported that the comment period for the Environmental Assessment Worksheet (EAW) for Prosperity Hills ended on November 2, 2016. The County Board, acting as the Responsible Government Unit (RGU), must make a decision regarding the need for an EIS by December 2, 2016. Motion by Johnson, second by Lindquist and unanimously carried to set the Decision for an EIS for Prosperity Hills on the County Board Agenda at 1 :DO p.m. on Tuesday, November 22, 2016. Lake Street Discussion Attorney Reid Brandborg spoke to the Board, on behalf of the Jereme Tysdal family, in opposition of Otter Tail County Resolution No. 2016 -58. The resolution provides for location markers to show the public the right-of-way limits for Lake Street in Midway Park. The markers are necessary to protect the public's access on this cartway and avoid trespassing on adjacent properties. Mr. Brandborg requested that the middle of the cartway be marked for movement, leaving a right-of-way buffer on both sides. Lengthy discussion took place regarding the obstructions on the south side of the cartway including trees, septic systems, etc. Mr. Brandborg's opinion is that nothing will be accomplished by marking the cartway and requested that the Board reconsider that decision. No action was offered. Commissioner Johnson indicated that Mr. Tysdal could pay for a topographical survey and the Board could then consider a delineated path to the lake with 20' buffers on both sides. Chemical Dependency/Detox Report Human Services Supervisor Margaret Williams submitted the 2015 Annual Chemical Health Unit Report, including the number of clients served in various treatment programs. Discussion took place regarding closure of detox facilities, transportation costs; complexities of mental health and drug addiction issues, and the potential for model of care legislative changes. Commissioners requested statistics on Otter Tail County detoxification services. The County Board will be touring the Catholic Charities and CARE facility buildings while analyzing potential uses for the buildings. Adult Mental Health Grant Contract Motion by Lindquist, second by Johnson and unanimously carried to authorize the appropriate County Officials' signatures to execute the Adult Mental Health Grant Contract between the Department of Human Services (OHS) and the County of Otter Tail as submitted by the Human Services Director. Ditch Systems County Ditch 44: Ditch Inspector Kevin Fellbaum reported that Ditch 44 was cleaned in order to provide relief from high water for residents on Round Lake. The Round Lake Association has requested a permanent weir structure be placed in the channel so the rock structure cannot be manipulated. Motion by Johnson, second by Huebsch and unanimously carried to authorize that a concrete weir be created and placed at the DNR recommended Ordinary High Water Level (OHWL) of 1325.9. County Ditch 64: OTC Board of Commissioners' Minutes November 8, 2016 Page 3 The US Fish & Wildlife Service indicated that hunters have reported sink holes on the USFWS parcel in Section 21 of Orwell Township. Motion by Johnson, second by Lindiuist and unanimously carried that the County repair the holes located on the corner of 125th Ave and 190 Street, to the level of safe passage across the property and put County Ditch 64 on the list for Redetermination of Benefits. Because there are no funds available for County Ditch 64 and a Redetermination of Benefits to assess property owners will take too long, a motion was offered by Johnson, seconded by Huebsch and unanimously carried to authorize the USFWS to repair these sink holes as described above on their property in Orwell Township. County Ditch 70: Mr. Fellbaum showed the Board a video of the failed tile north of CR 117 in Ditch 70. Motion by Johnson, second by Lindquist and unanimously carried to authorize replacement of 8 inch tile from the wetland sough of CR 117 to the wetland on the north of the road (about 1,300' of tile). An estimate of $15,000 to $25,000 was provided for the work. Commissioners suggested plowing in the tile next to the current pipe and abandoning the failed tile to reduce cost. County Ditch 25: Ditch Inspector Fellbaum briefed the Board regarding work that has been completed recently in County Ditch 25. Revised Tuition Assistance Agreement Motion by Johnson, second by Lindquist and unanimously carried to approve a revised Tuition Assistance Agreement for Corey Uhrich, changing the cost for the classes from $300 per day to $575.00 per day. Winter Snow Removal Expenses Rick West, Public Works Director, submitted Otter Tail County winter snow expenses from 2009 through 2016. The average seasonal cost for this period was reported as $1,077,137.70. NACO Annual Membership Fees Motion by Johnson, second by Froemming, and carried with Lindquist opposed, to approve the National Association of Counties (NACO) 2017 membership dues in the amount of $1,146.00. County Board Schedule Change Motion by Johnson, second by Huebsch and unanimously carried to change the start time of the November 22, 2016 County Board Agenda from 9:30 a.m. to Noon.
