Fir Avenue, Fergus Falls, MN August 23, 2016 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 8:35 a.m. Tuesday, August 23, 2016, at the Government Services Center fn Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners Agenda of August 23, 2016 with the following addition: Junkyards within Lakeshore Areas Consent Agenda Motion by Johnson, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: 1. August 16, 2016 Board of Commissioners' Meeting Minutes 2. Warrants/BIiis for August 23, 2016 (Exhibit A) 3. Human Services Bills & Claims 4. Approval of Final Payment to Anderson Brothers Construction for 2016 County Wide Crack Seal Project Elections Emergency Plan Emergency Manager, Patrick Waletzko, reported that under 2016 Minn. Laws, Chapter 161, Sec. 3, counties are required to develop a local elections emergency plan and submit it to the Minnesota Secretary of State's Office. Motion by Johnson, second by Lindquist, and unanimously carried to adopt the Otter Tail County Election Emergency Plan dated August 23, 2016 which utilizes the model plan provided by the Secretary of State's Office and meets statutory requirements. This plan will be forwarded to the State by September 1, 2016. Adyisory Committee Appointment Motion by Johnson, second by Froemming, and unanimously carried to approve the following appointments to the Central Minnesota Emergency Management Advisory Committee (CM EMAC) .-to represent Otter Tail County and serve a term commencing September 1, 2016: OTC Emergency Manager, Patrick Waletzko OTC Chief Deputy, Barry Fitzgibbons (alternate) 2016 Emergency Management Performance Grant Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute the 2016 EMPG (No. A-EMPG-2016-OTTERCO-059) and accept the grant, in the amount of $37,196.00 which also requires matching County dollars. Grant dollars will be used for CodeRed, training exercises, conferences and upgrades to the incident management trailers. County Ditch No. 70 Motion by Lindquist, second by Froemming, and unanimously carried to approve the following easement payment related to County Ditch No. 70: Todd A. & Michelle C. Rohrer Ditch No. 70 Temporary Easement $205.00 OTC Board of Commissioners' Minutes August 23, 2016 Page2 . Issuance of County Credit Cards Motion by Huebsch, second by Johnson, and unanimously carried to approve the issuance of the following County Credit Cards as requested: Jacob E. McKnlte, Asst. Attorney Jake J. Thomason, Asst Attorney Rick Denzel, Recycling Center Manager 30 Day Limit of $1,000.00 30 Day Limit of$1,000.00 30 Day Limit of $1,000.00 canvassing Board Motion by Huebsch, second by Lindquist, and unanimously carried to appoint Commissioner Froemming and Commissioner Johnson to the County Canvassing Board for the November-8, 2016 State General Election. Proposed Star Lake casino and Hotel Deveiopment County Attorney, David Hauser, submitted a document from the MN Environmental Quality Board (EQB) titied "Quick Reference: Environmental Assessment Worksheet" which sites the relevant rule and corresponding flow chart. Lengthy discussion took place regarding the Responsible Governmental Unit (RGU) for the EAW process. Motion by Johnson, second by Froemming, and unanimously carried for Otter Tail County to accept the RGU designation for the expected Voluntary EAW process with the understanding that this jurisdiction will only apply to areas of County and/or State responsibility and not to the fourteen (14) acres of federal trust land. RESOLUTION CALLING FOR A PUBLIC HEARING ON PROPOSED PROPERTY TAX ABATEMENTS FOR THUMPER POND RESORT LLC Otter Tall County Resoiution No. 201& -46 WHEREAS, Minnesota Statutes, Sections 469.1812 through 469.1815, both inclusive (the "Act"), authorize the Otter Tail County, Minnesota (the "County"), upon satisfaction of certain conditions, to grant an abatement of all or a part of the taxes levied by the County on certain property; and WHEREAS, the County has received a request, from Thumper Pond Resort LLC (the "Company") a Minnesota Corporation whose mailing address is 300 Thumper Lodge Road, Ottertail, Minnesota 56571 owning property located In the County, that the County grant an abatement of property taxes on the following parcel of land owned by the Company: 74-000-11-0012-005 WHEREAS, the Act requires the County to hold a Public Hearing prior to adoption of a resolution granting any property tax abatements. NOW THEREFORE, BE IT RESOLVED by the County Board of Otter Tail County, Minnesota, as follows: 1. Hearing -A Public Hearing on the consideration of granting a property tax abatement to the Company as requested will be held at the time and place set forth In the Notice of Hearing attached hereto as Exhibit 8 and hereby made a part hereof. 2. Notice -The County Clerk is hereby authorized and directed to cause notice of said Hearing in substantially the form attached hereto as Exhibit B to be given one publication in a newspaper of general circulation in the County at least ten (10) days but not more than thirty (30) days before the Hearing. The newspaper must be one of general interest and readership In the County, and must be published at least once per week. Adult Mental Health Grant Amendment Motion by Johnson, second by Froemming,· and unanimously carried to authorize the appropriate County officials' signatures to execute the CY 2016 Adult Mental Health Grant Amendment allocating additional funding of $28,330.00 to Otter Tail County as Fiscal Host for the BCOW AMH Initiative. These funds will be used for an outstanding bill owed to State Operated Services. Recess and Reconvene At 9:21 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:28 a.m. Storage of Vehicles In Shoreland Areas Discussion took place regarding vehicles parked/stored in shoreland areas. Neighbors are concerned about some areas surrounding our lakes becoming junkyards. This is regulated under the Shoreland Management Ordinance (SMO) and specific situations will be reviewed. Job Exchange The Job Exchange Work Group submitted a Job Exchange Pilot Program Q & A. Human Resource Director, Nicole Hansen, explained that this is a County driven project that is a voluntary and temporary assignment and exchange of two employees from different departments to alternate duties. This will begin with a Pilot Project beginning early 2017. Purchase of Drone for Law Enforcement lieutenant Greg Seim and representatives from West Central Emergency Medical Services (EMS) showed an Unmanned Arial Vehicle (Drone) and explained its use to the Commissioners. Drones have been used for many situations including structural integrity assessment to assure safety for first responders in manmade and natural disasters, search and rescue operations. detecting wildfires, assisting firefighters by surveying burning buildings, hazardous material Incidents, lost or missing persons and flood and risk assessments. A special grant was provided by the West Central MN EMS Board of Directors to purchase this newest technology. OTC Board of Commissioners' Minutes August23,2016 Page4 Drone Continued: Motion by Johnson, second by Lindquist, and unanimously carried to authorize the Sheriff's Office to purchase a grant-funded Drone through the West Central MN EMS. West Central EMS will pay for the Drone. Otter Tail County is responsible for maintenance and training estimated at $3,000 per year. Lieutenant Seim presented his training program and will draft a policy regarding the use of the Drone. Dog Bite Hearings Discussion took place regarding the Dog Bite Hearing process which includes following State Statute and implementing the precautions outlined in the County's Animal Health and Controls Ordinance. Chairman Rogness requested that the County Attorney return to the Board with written clarification of the process. Continuation of Ditch No. 30 Public Hearing The innial Ditch No. 30 Redetermination of Benefits Public Hearing was held June 20, 2016 with a reported ditch system total benefrt of $748,131.68. Ditch hearings· were continued to review several· property assessment appeals .. Motion by Huebsch, second by Johnson, and unanimously carried accept the final Ditch No. 30 Redetermination of Benefits with a total benefit of $6TT,235.08 and Amended Ditch Viewers' Report as submitted by the· Ditch Inspector. The County Attorney will draft an Order for the Redetermination of Benefrts. Park•na Soace Lease -First Lutheran Church Motion by Froemming, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures lo execute a Parking Space Lease between the County of Otter Tail and First Lutheran Church for the period of April 1, 2016 through April 1, 2019. Otter Tail County will lease twenty (20) parking stalls at an annual rent of $4,680.00. Highway Prolects Deer Creek Township-S.A.P. 056-599-059: Motion by Froemming, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures on a Highway Construction Contract between the Coun~ of Otter Tail and Korby Contracting Co. Inc. for removal of Bridge No. L0944. The bridge is on 5301 Ave over the Leaf River northwest of Deer Creek, MN. Engineering SeNices-S.A.P. 56-652-014: Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Consulting Services Agreement between the County of Otter Tail and Interstate Engineering, Inc. of Fergus Falls, MN. Interstate Engineering will prepare detailed plans for the replacement of Bridge No. L0909 on CSAH 52 in Deer Creek Township. Adjournment At 10:55 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, September 13, 2016. The total amount of the taxes proposed to be abated by the County for ten (10) years will be tied to the increase in taxes over the current market value which is initially estimated to t;,e $6,400 annually but may increase based upon valuation adjustments over the term of assistance. The County Board will consider granting property tax abatement in response to the request. All interested persons may appear at the September 13, 2016 Public Hearing and present their views orally or in writing for consideration by the County Board.
