OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened at 8:32 a.m. Tuesday, August 16, 2016, at the
Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman;
Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approval of the Board agenda. Motion by Huebsch, second by Froemming,
and unanimously carried to approve the Board of Commissioners Agenda of August 16, 2016 with the
following changes:

Motion by Lindquist, second by Froemming, and unanimously carried to approve Consent Agenda items as
follows:

3. Human Services Bills & Claims
4. Approve Issuance of County Credit Cards to Shannon Terry ($1,000 limit) and
Zachary Fjestad ($2,500 Limit)
Minnesota Employee Recreation & Services Council (MERSC)
Labor Management Co-Chair, George Meyer, requested approval for Otter Tail County membership in the
MERSC Program which offers discounts to employees for travel and entertainment. Mr. Meyer indicated
that Economic Development Director, Nick Leonard, will be the County contact person for the program.
Motion by Huebsch, second by Johnson, and unanimously carried to approve Otter Tail County
membership in the MERSC organization at an annual membership fee of $175.00.
Child Support Program Overview
Human Services Supervisor, Brooks Anderson submitted the following documents: 2015 Minnesota Child
Support Performance Report, County Performance Ratios, and State and County Administrative Costs.
Mr. Anderson briefed the Board regarding the statistics and reported the Net County Administrative Costs
at about $514,000 with act1:1al program expenditures at $1,700,000. He indicated that much of the costs
are covered.by state and federal reimbursements. Mr. Anderson stated that County performance is more
efficient with the use of the new Caseworks software. ·
Security Cameras for Small Towns
Commissioner Lindquist reported that the City of Underwood, working with the County Sheriff Department,
has installed a camera to view Main Street. This will be a test case to determine the value of this initiative.
RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS
WITH THE COUNTY OF OTTER TAIL ON BEHALF OF ITS COUNTY ATTORNEY AND SHERIFF
Otter Tail County Resolution No. 2016 -44
WHEREAS, the County of Otter Tail on behalf of its County Attorney and Sheriff desires to enter into Joint
Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal
Apprehension to use systems and tools available over the State's criminal justice data communications
network for which the County is eligible.

The Joint Powers Agreements further provide the County with the ability to add, modify and delete
connectivity, systems and tools over the five year life of the agreement and obligates the County to pay the
costs for the network connection.
NOW, THEREFORE, BE IT RESOLVED by the County Board of Otter Tail, Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting
through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Otter Tail
on behalf of its County Attorney and Sheriff are hereby approved.
2. That the Otter Tail County Sheriff, Brian Schlueter, or his or her successor, is designated the
Authorized Representative for the Sheriff. The Authorized Representative is also authorized to sign
any subsequent amendment or agreement that may be required by the State of Minnesota to maintain
the County's connection to the systems and tools offered by the State. ·
To assist the Authorized Representative with the administration of the agreement, the Chief Deputy in the
Otter Tail County Sheriff's Office is appointed as the Authorized Representative's designee.
3. That the County Attorney, David J. Hauser, or his or her successor, is designated the Authorized
Representative for the County Attorney. The Authorized Representative is also authorized to sign any
subsequent amendment or agreement that may be required by the State of Minnesota to maintain the
County's connection to the systems and tools offered by the State. ·
To assist the Authorized Representative with the administration of the agreement, the Administrative
Assistant in the Otter Tail County Attorney's Office is appointed as the Authorized Representative's
designee.
4. That Leland Rogness, the Chair of the County of Otter Tail Board and Larry Krohn, the County Board
Clerk are authorized to sign the State of Minnesota Joint Powers Agreements.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Lindquist and, after discussion thereof and upon vote being taken thereon, the
following voted in favor:

Comments/Concerns Regarding Proposed Casino & Hotel Development
At 9:30 a.m. Chairman Rogness reconvened the Board of Commissioners meeting and opened discussion
to Ty Dayton, spokesperson for the Star Lake Concerned Citizens Group (SLCCG) regarding the proposed
casino and hotel development.
Speaking on behalf of concerned citizens, Ty Dayton requested support for County, State, and Federal
Officials and White Earth' Enterprises to elevate the environmental review for the proposed Star Lake
Casino Development to the highest standards available. He stated that the SLCCG is supported in this
mission by the Star Lake and Dead Lake Property Owners Associations and by approximately 700
residents' signatures on a "Statement of Concern". Mr. Dayton submitted a packet of information including
the Statement of Concern, a Sacred Food and Medicine document, Questions regarding -the Limited Area
Star Lake Comprehensive Plan, a photograph of the South Arm of Star Lake and letters from the following
individuals: ·

Mr. Dayton read the following environmental concerns:
• Threat to waters from wastewater treatment and storm water runoff
• · Threat to centuries old wild rice beds, a key hub to vital ecosystems
• Threat to birds and wildlife; many species are especially sensitive to disturbance
• Threat to fishing; both north and south exposures to Star Lake traditional spawning areas
• The likely increased boat traffic will bring increased safety and AIS issues
• Threat of noise and light ,pollution, degraded water quality and potential harm to wetlands poses
significant impacts to fish, waterfowl, wildlife, and human quality of life on Star Lake

. The following letters of concern were read expressing reasons why the proposed casino and hotel
development on Star Lake is not suitable or compatible with the surrounding proposed area and concern
regarding the process of purchasing wetland credits to be placed in other areas of Minnesota:
Brenda Ebanks, Stuart Peterson, Mike Donaho, Tony Rondeau, James Lilienthal, and Deb Wallwork
Responses to questions regarding the Limited Area Star Lake Comprehensive Plan to study the impacts of
the proposed casino development are summarized as follows:
County Attorney, David Hauser, stated that Otter Tail County would not receive financial benefit from the
gaming proceeds. Gaming is regulated by the Federal Government. Otter Tail County would benefit by
increased economic activity bringing more people to the County that would occur when any large
development is constructed. The Limited Area Star Lake Comprehensive Plan and proposed cost
participation policy referencing transportation roadways is scheduled to be completed soon.
Commissioner Johnson stated that the public will have an opportunity to comment on the final version of
the study when it is released. Public Works Director, Rick West, stated that the draft Limited Area Star
Lake Comprehensive Plan will be available late August for review by the public and posted on the County
website prior to the public open house on September 8, 2016 at the Dent Community Center. Discussion
took place regarding the membership of the Project Management Team (PMT).
Mr. Dayton read a letter to Robert Maroney, US Army Corps of Engineers Project Manager, from
Stephanie Williams, a White Earth Tribal Member. She addressed the feasibility study that has been
conducted which did not include the potential of avoiding wetland impacts by using a different site known
as Pine Point and questioned why this option has been omitted from the Wetland Conservation Act (WCA)
replacement application. County Attorney, David Hauser, stated that the WCA application was completed
and submitted, and if there is information that should be raised or missing information, there is a process
for the public to provide the information. Most of the public processes have not started at this time.
Mr. Hauser indicated that Otter Tail County is involved with this· project because of the responsibility to
issue potential Conditional Use Permits for the parking lot based on the current plan. Otter Tail County is
also the Local Governmental Unit for the wetland application.. For both of those, Otter Tail County has
indicated to the proposer that an Environmental Assessment Worksheet (EAW) is appropriate and they are
completing an EAW voluntarily. The County does not currently have a Conditional Use Permit application
submitted for the project. There has been information shared with the public about this project and the
SLCCG website contains very good information about the process, when there are opportunities to make
comment, and apprqpriate questions for environmental review. Public Hearings will occur in this
environmentaLreview process. Otter Tail County is most likely the Responsible Governmental Unit (RGU);
however, the Minnesota Environmental Quality Board (EQB) may need to make that determination.
The purpose of an EAW is to determine whether an Environmental Impact Statement (EIS) is necessary.
A negative declaration means that an EIS is not needed and findings would be provided to support that
decision. A negative declaration would mean that there is no additional information needed to make an
environmental decision, which is the permitting process. A positive declaration is that an EIS is needed
and the EAW is used as the scoping document to learn what additional information is needed. For this
process and Conditional Use Permit application requests, there will public hearings for opportunity for
comment.

Township Road Discussion
Discussion took place regarding a Township road, 460th St, located between Dunn, Pelican and Scambler
Townships which is scheduled to be overlayed this fall. Motion by Froemming, second by Lindquist, and
unanimously carried to authorize County Attorney, David Hauser; Public Works Director, Rick West; and
Commissioner Wayne Johnson; to facilitate a meeting with the Townships to assist with a compromise
regarding the financial needs of the road.
Proposed Pelican Rapids Area Highway Garage
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Agreement between the County of Otter Tail and bhh Partners Planners
and Architects for architectural services for a proposed Pelican Rapids Area Highway Garage.
AGENCY AGREEMENT NO. 1026226 FOR FEDERAL PARTICIPATION IN ADVANCE
CONSTRUCTION FOR S.P. 056-070-026, M.P. HSIP 8816(199)
Otter Tail County Resolution No. 2016 -45
BE IT RESOLVED, that pursuant to Minnesota Statutes Section 161.36, the Commissioner of
Transportation be appointed as Agent of Otter Tail County to accept as its agent, federal aid funds which
may be made available for eligible transportation related projects.
BE IT FURTHER RESOLVED, the County Board Chair and the County Board Clerk are hereby authorized
and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the
Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as
set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 1026226", a
copy of which said agreement was before the County Board and which is made a part hereof by reference.

Motion by Huebsch, second by Lindquist and carried, with Johnson abstaining, to approve the Preliminary

presented. The proposal is located in Part of GL 5 as described in Doc. No. 1168817, Section 31 of Dunn

Preliminary Plat-"Lida West First Addition'1/Richard Gilbert:
Motion by Johnson, second by Froemming, and unanimously carried to approve the Preliminary Plat of
