Call to Order
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, July 26, 2016, at the
Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman;
Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present.
Commissioner Wayne Johnson was absent at 9:30 a.m.
Approval of Agenda
Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Huebsch,
and unanimously carried to approve the Board of Commissioners Agenda of July 26, 2016 with the
following addition:

Motion by Johnson, second by Lindquist, and unanimously carried to approve Consent Agenda items as
follows:

Statewide DNR Muskie Water Initiative
Minnesota Department of Natural Resources (MNDNR) Officials reported that the DNR is designating Gull
Lake near Brainerd and the Fairmont chain of lakes in southern Minnesota as new muskie management
lakes in Minnesota. No other lakes in Minnesota will be added to the muskie stocking program at this time.
Three lakes in Otter Tail County were being considered; however, public input showed negative support for
muskie stocking in the County. On a statewide basis, the DNR would like to identify three more lakes for
stocking muskies in the future, with one being located in the northwest region of the State. Jim Wolters,
Area Fisheries Supervisor, provided a PowerPoint presentation and summarized comments and concerns
received since the public input process was initiated in August of 2015. He also reviewed fisheries data
and the effects of fish populations due to muskie stocking. The DNR data shows that muskies have been
present in Pelican Lake for thirty-eight years. The data indicates a decrease in the northern pike
population and no decrease in the walleye population. Commissioners complimented the DNR for
responding to public input. Discussion took place regarding how surveys are conducted and the value of
long term data when analyzing environmental effects. Commissioners encouraged the DNR to boost
family fishing opportunities to introduce youth to the sport and increase family tourism in the area.
U.S. Fish and Wildlife Service Land Acquisition
Due to designation of appropriate parking for this wildlife management land, a motion was offered by
Johnson, seconded by Lindquist, and unanimously carried to certify the acquisition of the following
property by the U.S. Fish and Wildlife Service to be added to a larger, adjacent wildlife management area:

Closed to the Public
At 9:20 a.m., Chairman Rogness declared the Board meeting closed to the public for purposes of
discussing labor negotiation strategies regarding the Teamsters Sheriffs Office and GST unions and the
AFSCME Highway union. Present were all five seated Commissioners; HR Director, Nicole Hansen;
County Attorney, David Hauser; Administrator, Larry Krohn; and the Board Secretary. At 9:40 a.m.,
Chairman Rogness declared the meeting open to the public for the remainder of the agenda items.
Vulnerable Adult Program Report
Human Services Supervisor, Margaret Williams and staff submitted the 2016 Vulnerable Adult Intake and
Assessment Program Overview document. They briefed the Board on the Minnesota Adult Abuse
Reporting Center (MAARC) system that began July 1, 2015 and intake and screening data. Discussion
took place regarding challenges surrounding financial exploitation of vulnerable adults.

At 9:51 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board meeting was reconvened at 9:55 a.m.
Highway Projects
CH 122 Sidewalk Replacement:
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and
Quality Construction of Fergus Falls for sidewalk replacement on CH 122 in the City of Underwood, MN.
Bituminous Surfacing -Banker's Drive:
Motion by Froemming, second by Lindquist, and unanimously carried to reject the bid received from
Central Specialties, Inc. for S.A.P. 056-600-027 on Banker's Drive as recommended by the Public Works
Director. The bid amount of $145,530.50 was significantly higher than the Engineer's estimate.
Bridge Removal -Deer Creek Township:
Motion by Froemming, second by Huebsch, and unanimously carried to award S.A.P. 056-599-059 to the
low bidder, Korby Contracting Co., Inc. of Fergus Falls, MN, at the bid price of $31,499.90 as
recommended by the Public Works Director.
Ditch 70 Improvements:
Motion by Lindquist, second by Froemming, and unanimously carried to award C.P. 16:DITCH 70
Improvements to the low bidder, M & M Contractors, LLC, of Breckenridge, MN, at the bid price of
$331,377.20 as recommended by the Public Works Director.
Right of Way Survey-CSAH No. 27:
Motion by Huebsch, second by Lindquist, and unanimously carried to award S.A.P. 056-627-014 for CSAH
No. 27 Reconstruction from 1 mile north of Fir Avenue to CSAH 10 to Anderson Land Surveying, Inc. of
Fergus Falls, MN at the low quote of $16,900.00.
Economic Development Committee
Economic Development Director, Nick Leonard spoke to the Board regarding the process of reconvening
the County Economic Development Committee originally brought together in 2012. Motion by Huebsch,
second by Lindquist, and unanimously carried to provide notice to Otter Tail County townships,
municipalities and economic development authorities of the County's intent to form an Economic
Development Committee under M.S. 469.1082 Subd. 2.

At 10:10 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a Finance Committee meeting. The Board meeting was reconvened at 10:30 a.m.
Liquor License Approval
Motion by Froemming, second by Lindquist, and unanimously carried to approve a 3.2% On-Sale Malt
Liquor License for Lida Green Golf LLC for the period of July 1, 2016 through June 30, 2017.
Payment Approval
Motion by Huebsch, second by Lindquist, and unanimously carried to approve payment to Carr's Tree
Service, Inc. in the amount of $475.00, for the June 24, 2016 spraying of noxious weeds located at 26726
555th Ave, Deer Creek, MN. The owner of the property will be billed for the service.
Ditch #30 Public Hearing
At 10:35 a.m., Chairman Rogness continued the Redetermination of Benefits Public Hearing for Ditch #30
from June 20, 2016. After the June 2016 meeting and further review, total benefits were decreased from
$748,131.68 to $677,370.80. Ditch Inspector, Kevin Fellbaum reported that he is working with the viewers
on a response to concerns of the MN Department of Transportation (MnDOT) as it relates to their property
on the Ditch. The Ditch #30 Public Hearing will be continued at 10:30 a.m. on August 23, 2016 at the
Government Services Center in Fergus Falls, MN.
Prairie Lakes Municipal Solid Waste Authority (PLMSWA) Update
Commissioner Huebsch reported that the PLMSWA Resource Recovery Facility processed a record
amount of garbage and made $179,000 after depreciation last month. The PLMSWA Budget Committee is
working on budget predictability for the participating counties moving forward.
Conferences Authorized
Motion by Froemming, second by Lindquist and unanimously carried to authorize Commissioner Huebsch
to speak at a conference titled "Minnesota Business First Stop" in Morris, MN on September 8, 2016.
Motion by Huebsch, second by Froemming, and unanimously carried to authorize commissioners to attend
a Town Hall Meeting titled "Solutions to the Skills Gap" at 1:30 p.m. on Thursday, July 28, 2016 at
Roosevelt Education Media Center in Fergus Falls, MN.
Minnesota Counties Computer Cooperative (MnCCC)
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Joint Powers Agreement between Otter Tail County and the MnCCC to
cooperatively provide the operation and maintenance of data processing facilities, software and other
information management systems for use and benefit of all parties.
Board Meeting Location
1Motion by Froemming, second by Huebsch, and unanimously carried to approve the location of the
August 16, 2016 Board of Commissioners meeting at the New York Mills County offices to coincide with
the employee summer picnic.

Planning Commission Recommendations
Preliminary Plat -"Roberts 2nd Addition" I Greg Roberts:
Motion by Froemming, second by Lindquist, and unanimously carried to approve the Preliminary Plat of
Greg Roberts titled "Roberts 2nd Addition" consisting of three single family residential lots as presented.
The proposal is located in Lots 1 & 2 Blk 1 of Roberts Addition, Section 4 of Otter Tail Township; Non-
Shoreland Area.
Conditional Use Permit -CIC #53 I Copper Landing at Horseshoe Bay/Tradeshares Investment Group:
Motion by Lindquist, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to modify Common Interest Community #53. (CUP #6602) of Copper Landing at Horseshoe Bay from 10
dwelling units to a total of 6 dwelling units as presented. The project is located in that Part of Gov'! Lots 1
& 2 and the East Half of the Northeast Quarter and CIC #53, Section 22 of Buse Township; Horseshoe
Lake (56-834), NE.
Conditional Use Permit-Steven D. Lind & Todd M. Axtman:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for the installation of an elevated sand beach sitting area as presented. The project is located in Pt GL 4
SWly of McDonald Shores 1st Addn., Section 20 of Edna Township; Big McDonald Lake (56-386), RD.
Conditional Use Permit -Ken Bossert:
Motion by Huebsch, second by Lindquist, and unanimously carried to deny, as recommended by the
Planning Commission, an after-the-fact Conditional Use Permit to alter the shoreline above the high water
mark for easier access to the lake. Mr. Bossert is to work with the Land & Resource Department on a
restoration plan. The proposal is located on Lot 10 Blk 1 of Ratliff Estates, Section 12 of Eagle Lake
Township; Hancock Lake (56-255), NE.
Final Plat -"Big Mac Junction":
Motion by Huebsch, second by Froemming, and unanimously carried to approve the Final Plat of Marvin A.
and Ann K. Hexum titled "Big Mac Junction" located on G.L. 5, Section 24 of Dora Township; Big
McDonald Lake (56-387).
Recess & Reconvene
At 11 :29 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a committee meeting and lunch break. The Board meeting was reconvened at 1 :00 p.m.
Dog Bite Hearing
County Attorney, David Hauser reported that the Sheriff's Office declared the dog "Hunter" owned by
Casey Strauch a potentially dangerous dog under M.S. 347.50 through 347.565. Mr. Strauch was given
notice and an opportunity to request a hearing. Mr. Strauch requested the hearing; however did not
appear for the hearing. Motion by Huebsch, second by Lindquist, and unanimously carried to affirm the
Sheriff's designation that the dog "Hunter" owned by Casey Strauch is a potentially dangerous dog under
Minnesota Statute. Discussion took place regarding possible safeguards needed for public safety.
Commissioners requested that a Dog Bite Hearing be scheduled under the County's Animal Health and
Control Ordinance and that Mr. Hauser return to the Board with an update at the next regular County
Board meeting.

the office of the Regional Director, Region 3, U.S. Fish and Wildlife Service and more

Commencing at the Southwest corner of said Section 6; thence North 00 degrees 19 minutes 26
seconds East (bearing is based on Otter Tail County Coordinates-1996 Adjustment) along the
west line of said Section 6, a distance of 1316. 96 feet to the north line of Government Lot 7, said
Section 6; thence South 89 degrees 21 minutes 05 seconds East along said north line of
Government Lot 7, a distance of 1035.52 feet to the west line of said Northeast Quarter of the
Southwest Quarter, being the point of beginning of the land to be described; thence North 00
degrees 39 minutes 49 seconds East along last said west line, a distance of 445.95 feet; thence
North 88 degrees 09 minutes 31 seconds East a distance of296.38 feet; thence South 01 degrees
45 minutes 54 seconds East a distance of 459.23 feet to the south line of said Northeast Quarter
of the Southwest Quarter; thence North 89 degrees 21 minutes 05 seconds West along said south
line, a distance of 315.56 feet to the point of beginning, containing 3.18 acres, more or less.
Together with and subject to an easement for ingress and egress purposes, over, under and across

Minnesota, being a strip of land lying 33.00 feet to the left of and adjoining the following
described line: Commencing at the Southwest comer of said Section 6; thence North 00 degrees
19 minutes 26 seconds East (bearing is based on Otter Tail County Coordinates-1996
Adjustment) along the west line of said Section 6, a distance of 1316.96 feet to the north line of

line, a distance of 1035.52 feet to the east line of said Government Lot 6; thence North 00

Beginning; thence South 89 degrees 57 minutes 22 seconds West a distance of 566.80 feet;
thence South 87 degrees 36 minutes 54 seconds West a distance of 469.49 feet to the west line of
said Government Lot 6 and there terminating. At the point of termination of said line, the
southerly sideline of said easement shall be extended to terminate on the westerly line of said
