Fir Avenue, Fergus Falls, MN July 12, 2016 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, July 12, 2016, at the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners Agenda of July 12, 2016 with the following additions: Final Plat Approval Meeting with Legislators Consent Agenda Motion by Huebsch, second by Froemming, and unanimously carried to approve Consent Agenda items as follows: 1. June 28, 2016 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for July 12, 2016 (Exhibit A) 3. Human Services Bills & Claims 4. Approval for Issuance of Liquor & Sunday Liquor License for Oakwood Supper Club for the period of 07/01/16 -06/30/17 REVIEW OF PROPOSED STATE WILDLIFE LAND ACQUISITION Otter Tail County Resolution No. 2016 -42 WHEREAS, In accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources, on July 12, 2016, provided the County Board and appropriate Town Officers with a description of lands to be acquired by the State of Minnesota for water and wildlife conservation purposes, and WHEREAS, Lands to be acquired are described as follows and attached as Exhibit 8: 24 acre parcel located in SE¼, Section 23, T. 132N, R 43W adjoining the Hiview WMA NOW, THEREFORE, IT IS HEREBY RESOLVED, by the Board of County Commissioners of Otter Tail County on July 12, 2016, that the State's proposed acquisition of the above described property be approved contingent upon providing the public a signed parking area for use of this public land. The motion for the adoption of the foregoing resolution was introduced by Commissioner Huebsch, duly seconded by Commissioner Johnson and, after discussion thereof and upon vote being taken thereon, the following voted in favor: Commissioners Huebsch, Johnson, Lindquist, Froemming and Rogness and the following voted against the same: None OTC Board of Commissioners' Minutes July 12, 2016 Page 2 Adopted at Fergus Falls, Minnesota, this 1ih day of July 2016 OTTER TAIL COUNTY BOARD OF COMMISSIONERS Dated: '7 -Z ~-/ fo Attest ~~ LarryKr n~lerk Phelps Mill Park Fishing Pier Public Works Director, Rick West presented a proposal from the Lake Country Sportsmen Club of Otter Tail Lake/Amor to donate and install a fishing pier at the Phelps Mill County Park. Mr. West provided a photo of the proposed pier and two potential locations. Commissioners discussed responsibility for putting the pier in and out (spring and fall) and questioned whether or not the pier was on wheels. Motion by Froemming, second by Johnson, and unanimously carried to support the concept and authorize the Public Works Director to continue discussions with the Sportsmen's Club regarding long term service requirements for the donation. Mr. West will return to the Board for formal acceptance of the gift. Highway Contract Motion by Lindquist, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Contract for Seasonal Supply of Salt between the County of Otter Tail and L & 0 Acres Transport, Inc. of Westport, SD, contingent upon the approval of the County Attorney. Limited Area Star Lake Comprehensive Plan Mr. West discussed the need for an addendum to the SRF Limited Area Star Lake Comprehensive Plan to increase the contract amount about $18,000 due to an expanded scope of work involving design as well as short and long term solutions. Motion by Johnson, second by Lindquist, and unanimously carried to approve the concept requiring an Addendum to the SRF Contract contingent upon the Whiter Earth Nation's agreement to fund half of the increased cost. Public Meeting At 9:05 a.m., Chairman Rogness declared the County Board meeting open for public comments regarding a permit application for expansion of Tollerud Farms, LLC located at 37541 150th Ave, Rothsay, MN. The public meeting is being held according to M.S. 116.07, Subd. 7(1). The MN Pollution Control Agency (PCA) is responsible for issuing a permit for the dairy operation. The County provides a local forum for the public to express their opinions regarding the project. Travis Tollerud explained the specifics of the expansion. No one from the public was present for this agenda item and no written comments were received o~ the proposed project. Commissioners expressed their support for this expansion of dairy agriculture which is a core component of Otter Tail County's economy. The public meeting was closed at 9:11 a.m. Developmental Disabilities Service Report Human Services Director, Deb Sjostrom and DD Staff submitted a document titled "Developmental Disabilities Annual Report -2015 Overview". Discussion took place regarding case load, services, and funding. Human Services Fiscal Quarterly Report Deb Sjostrom presented the Human Service Financial Report for January 1, 2016 through June 30, 2016. Total expenses were reported at 53% of budget and revenues at 49% of budget. The VCAA grant and Child Protection allocation will be received in July. Ms. Sjostrom discussed Out of Home placement and Mental Health State Operated Services as a concern for increasing expense for the County. Commissioners encouraged continued discussion regarding detox and mental health services. OTC Board of Commissioners' Minutes July 12, 2016 Page 3 MASTER SUBSCRIBER AGREEMENT FOR MINNESOTA COURT DATA SERVICES FOR GOVERNMENTAL AGENCIES Otter Tail County Resolution No. 2016 -41 WHEREAS, the State of Minnesota, Office of State Court Administration, offers Court Data Services to Otter Tail County, a Minnesota Government Subscribers; and WHEREAS, the Otter Tail County Sheriffs Office is entering into an agreement with the State of Minnesota, Office of State Court Administration, to authorize access, use and dissemination of Court Data Services and Court Records; and WHEREAS, Court Data Services may involve one-way or two-way transmission of information between the Court and Otter Tail County Sheriffs Office: and WHEREAS, this agreement allows Otter Tail County Sheriffs Office access to Court Records and Court Documents. THEREFORE BE IT RESOLVED THAT: The Otter Tail County Sheriffs Office Chief Deputy has authority to sign the Master Subscriber Agreement for Minnesota Court Data Services for Governmental Agencies on behalf of Otter Tail County. The motion for the adoption of the foregoing resolution was introduced by Commissioner Froemming, duly seconded by Commissioner Lindquist and, after discussion thereof and upon vote being taken thereon, the following voted in favor: Commissioners Huebsch, Johnson, Lindquist, Froemming and Rogness and the following voted against the same: None Dated: 7-Z.~-/(p By State Primary Election Motion by Huebsch, second by Lindquist, and unanimously carried to appoint Commissioner Wayne Johnson and Commission Roger Froemming to serve on the Canvassing Board for the primary election. The Canvassing Board will meet at 9:00 a.m. on Friday, August 12, 2016. Buffer Initiative Update WOTSWCD Manager, Brad Mergens updated the Board on the County's Buffer Initiative requ1nng permanent vegetation on agricultural land in shoreland areas adjacent to designated public waters (M.S. 103F.48). He reported total acres of required vegetation at 1,041.27 acres with total parcels of 1,072 and average of 1.02 acres per parcel. Phase 1 has been completed with a 25% response to the initial letter that was mailed to landowners. The Soil & Water Conservation District will be implementing Phase II of the project including a media campaign and mailing a second letter to landowners. Phase II will require a significant amount of field work. In March, the MN Board of Water and Soil Resources (BWSR) will be requesting that Local Government Units (LGUs) accept responsibility for reporting and enforcement of the buffer laws similar to the Shoreland Management Ordinance (SMO) arrangement. OTC Board of Commissioners' Minutes July 12, 2016 Page4 Recess & Reconvene At 9:54 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board meeting was reconvened at 10:00 a.m. Meeting with Legislators Commissioner Johnson reported that he will meet with State Legislators at Lake Region Electric Cooperative and will discuss various topics important to Otter Tail County. He also informed the Board of a meeting on July 26, 2016 regarding the MN Pollution Control Agency (PCA) interpretation of soils as they relate to septic systems. Motion by Froemming, second by Johnson, and unanimously carried to authorize commissioners to attend this meeting at 7:00 p.m. at the Becker County Courthouse in Detroit Lakes. Final Plat -Herron Heights Motion by Huebsch, second by Johnson, and unanimously carried to approve the Final Plat of Donald and Carolyn Herron titled "Herron Heights" a two lot subdivision with one backlot located in Section 1 of Star Lake Township on Star Lake (56-385). Buffalo-Red River Watershed District (BRRWD) Update BRRWD Representatives Bruce Albright, Peter Fjestad and Mark Anderson submitted the BRRWD 2015 Annual Report and briefed the Board regarding projects including the Manston Slough Restoration (wetland habitat project), Wolverton Creek/Comstock Coulee, Georgetown Flood Mitigation, and Oakport Flood Mitigation projects. Mr. Albright reported that the BRRWD did not join the Red River Water Management Board. He indicated . that the BRRWD tour is scheduled for September 8, 2016 and expressed appreciation for the County Board's support. Full Time Deputy Position Motion by Lindquist, second by Froemming, and unanimously carried to approve a new full time Deputy position with the Sheriffs Office as requested by the Human Resources Director and County Sheriff. The Deputy position will encompass the part time Court Security Officer duties as the County has been unable to fill the part time position. Chief Deputy Position Sheriff Schlueter announced the appointment of Lieutenant Barry Fitzgibbons as his new Chief Deputy effective September 1, 2016 due to Chief Deputy Paulseth's retirement. '· Otter Tail County Resort Research Economic Development Director, Nick Leonard introduced Kelly Asche from the Center for Small Towns at the University of Minnesota-Morris and Dan Erkkila from the University of Minnesota Tourism Center. They briefed the Board on a collaborative research project funded and implemented by the Center for Small Towns and the University of Minnesota Regional Sustainable Development Partnership which has examined Otter Tail County's declining resort industry. Mr. Asche and Dr. Erkkila reviewed the survey background, challenges and barriers for resort growth, and the economic impact of the declining resort and campground industry. The report estimated average lost revenue since 1985 of 8.8 million dollars in local spending due to resorts closing or changing their use. After applying inflation, the estimated loss since 1985 is 275 million dollars. Dr. Leonard reported that this data will be presented to the resorts this fall and he will return to the Board with suggestions to alleviate some of the barriers for this industry.
