Call to Order
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, June 14, 2016, at the
Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman;
Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Johnson,
and unanimously carried to approve the Board of Commissioners Agenda of June 14, 2016 with the
following modifications:

U.S. Fish and Wildlife Service Wetland/Habitat Easements
USFWS Representatives appeared before the Board and requested certification of wetland and habitat
protection easements. Documentation was previously submitted regarding the requests. After County
Board approvals, the protection easement requests will be considered by the State Land Exchange Board.
The owner continues to be responsible for maintenance and taxes on the properties.
Motion by Huebsch, second by Lindquist, and unanimously carried to approve certification for the USFWS
to secure the following wetland easement located in Section 12 of Buse Township consisting of 8.04 acres
of wetland basins:

Motion by Lindquist, second by Huebsch, and unanimously carried to approve certification for the USFWS
to secure the following waterfowl easement located in Section 35 of Dane Prairie Township consisting of 2
acres of wetland basins:

Section 35. that part of Government Lots 3 and 4 described as follows: Beginning at the southwest corner
of said Section 35; thence South 89°34'28" East (assumed bearing) along the south line of said Section 35
a distance of 1423.29 feet; thence North 26°05'20" East a distance of 49 feet more or less to the shoreline
of Fossan Lake; thence northwesterly and northerly following along said shoreline a distance of 2570 feet
more or less to its intersection with the southerly shoreline of the Pomme De Terre River; thence

allows haying after July 15th (23.3 acres), and habitat protection easement that allows grazing (32.8 acres)
located in Section 16 of Dane Prairie Township:

U.S. Fish and Wildlife Service Land Acquisition
USFWS Manager, Larry Martin requested approved of about three (3) acres of land owned by Eldon J.
Thompson, et al located in Section 6 of Norwegian Grove Township which would give the FWS legal
access to the current neighboring protected lands. The road is owned by the land owner to the north of the
road. The Eldon Thompson Estate has right of way to access the property; however, the road is not a
public road. The intent would be to remove the buildings on the property. Lengthy discussion followed
regarding when a parking lot for the public would be built and public parking in general for FWS hunting
land. Commissioners also expressed concern about the condition(s) of other public, protected lands.
Motion by Huebsch, second by Johnson, and unanimously carried to certify the acquisition/purchase of the
Eldon J. Thompson, et al property subject to public access and parking to the property. Public road access
and adequate parking to public hunting lands should be negotiated at the time of the acquisition.

Recess & Reconvene
At 9:06 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for an Internal Services Committee meeting. The Board meeting was reconvened at 9:38 a.m.
Buffalo Red River Watershed District Update
Commissioner Lindquist reported that the BRRWD voted against approval of the Red River Basin
Commission Joint Powers Agreement. The City of Moorhead voted to join the Red River Basin with no
financial obligations other than being the sponsoring entity for application of the grant dollars for Minnesota
as it relates to the Fargo/Moorhead Diversion project.
Proposed Casino/Resort on Star Lake Update
Chairman Rogness reported on the Limited Comprehensive Plan meeting held by the White Earth Nation,
Star Lake Township, Star Lake Association, SRF Consulting, and Otter Tail County on June 9, 2016 at the
Dent Community Center. All information presented is being shared on the County website. Otter Tail
County is not partnering in the development of the project but rather, partnering in Comprehensive
Planning for potential changes in transportation, utilities, recreation, emergency management and housing.
The Comprehensive Planning also provides a forum for the White Earth Nation to share their proposed
project(s) to provide transparency to the public.
Proposed Phelps Mill Dam Fish Passage
Representatives from the MN Department of Natural Resources (DNR) previously met with the County
Board regarding a proposed fish bypass around the Phelps Mill Dam. The DNR entered into an
Agreement with Otter Tail County to work on conc~ptual design to secure funding for the project. The
current proposal for the project includes dam removal and installing rock rapids. Photos were submitted of
similar projects on the Mississippi, Lac Qui Parle and South Fork Crow Rivers. DNR representatives
stated that the project to remove the Dam may be more apt to receive funding. Discussion took place
regarding the historical significance of the Dam, the major change from the initial project, the goal of the
project to move fish, and perceptions of the public. The MN DNR and USFWS were requested to conduct
public outreach/public information meeting(s) regarding the proposed Phelps Mill Dam Fish Passage
project under the direction of Rick West, Public Works Director. This public outreach effort is to be
conducted prior to returning to the County Board for their further consideration of this proposed project.
Utility Relocation and Reimbursement Agreement
Motion by Froemming, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Utility Relocation and Reimbursement Agreement between the County
of Otter Tail and Otter Tail Power Company for S.A.P. 056-638-007, CSAH 38 Project from CSAH 59 in
Urbank MN to TH 29 in Parkers Prairie, MN. Total cost of the project is estimated at $638,069.32 with
Otter Tail County responsible for 75% of the project.
Recess & Reconvene
At 10:26 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board meeting was reconvened at 10:32 a.m.
Minnesota Inter-County Association (MICA) Legislative Update
MICA Executive Director, Keith Carlson and staff presented the 2016 End of Session Report which is
MICA's annual overview of legislative changes. Mr. Carlson reported that Governor Dayton vetoed the
Omnibus Tax Bill. This may be resolved in a special session. There were no major funding or bonding
bills for Transportation. The report reviewed bills passed in the areas of Health & Human Services, Public
Health, Public Safety and Corrections, and Environment. MICA will continue to update the Board on
legislative initiatives/proposals.
Planning Commission
Preliminary Plat-"Tucker Farm" -Melissa Lage. Et Al:

Motion by Froemming, second by Huebsch, and unanimously carried to approve the Preliminary Plat titled
'Tucker Farm" consisting of 1 single family residential lot, subject to conditions as recommended by the
Planning Commission .. The proposal is located in GL 1 (72.32 AC), Section 12 of Scambler Township;
Pelican Lake (56-786), GD.
Conditional Use Permit--Michael G. Evenson:
Motion by Johnson, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for excavation of a building site as presented. The proposal is located in Pt of GL1 O BG S1/4 Cor, N 1
DEG W 403.82', N 88 DEG E 215.10', S 1 DEG W 66.15', S 84 DEG E (6.82 Acres), Section 02 of Dunn
Township; Little Pelican Lake (56-761), RD.
Conditional Use Permit-Jerome & Evelyn Sampson:
Motion by Lindquist, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to remove an existing railroad retaining wall as presented. This proposed project lies within a Public Road
Right of Way. The proposal is located in E 65' of Lot 12 & Tr BTW Lot & Lake of Blue Heron Beach,
Section 7 of Otter Tail Township, Otter Tail Lake (56-242), GD.
Conditional Use Permit-Bryan & Rvne/1 Freeland and Robin & Jen Hanson:
Motion by Johnson, second by Lindquist, and carried with Commissioner Huebsch abstaining, to approve a
Conditional Use Permit for topographical alteration/earthmoving as presented provided the beach area is
riprapped to match the neighbors or work with Land & Resource Management in stabilizing the sand beach
area. The project is located on Lots 1 & 2 of Birchwood Subdivision, Section 11 of Edna Township, Little
McDonald Lake (56-328), GD.
Otter Tail River Watershed
Land & Resource Director, Bill Kalar reported that the MN Pollution Control Agency (PCA) will be doing a
two year study of water quality for the Otter Tail River Watershed with a report to be submitted in the spring
of 2019 which will include findings. The study will look at diversity of aquatic life and suitability for
recreational activities such as swimming and boating. It will identify problems, causes of problems and
solutions.
Pleasant Lake Development Discussion
Mr. Kalar reported that owners of the development titled "Kid's Corner" requested building a borrow area
on a bank by the lake with the long term goal of creating a road to the lake. This is a prohibited use and is
not affected by the change in classification of Pleasant Lake in 2014 from a Recreational Development
(RD) lake to Natural Environment (NE) lake. A revised plan has been submitted to the County and will be
processed appropriately by the Land & Resource office.
Administrative Specialist
Motion by Lindquist, second by Huebsch, and unanimously carried to approve a new, full time
Administrative Specialist position in the Administrator's office to replace two part time positions as
recommended by the Human Resources Director.
Tax Abatement Agreement
Motion by Johnson, second by Lindquist, and carried with Commissioner Huebsch abstaining, to authorize
the appropriate County Officials' signatures to execute the Tax Abatement Agreement with the City of
Perham, Otter Tail County, Perham-Dent School District #549 and grow Perham, LLC for a 24 unit
apartment building workforce housing project
