Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, May 24, 2016, at the
Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman;
Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Lindquist,
and unanimously carried to approve the Board of Commissioners Agenda of May 24, 2016 with the
following modification:

Motion by Huebsch, second by Lindquist, and unanimously carried to approve Consent Agenda items as

Probation Services Interim Advisory Workgroup
Community Services Director, John Dinsmore submitted a document regarding the purpose, membership
and meeting frequency of the PSIAW Charter. This group will focus on the corrections delivery of service
systems and promote a sustainable, long-term partnership to influence substantive corrections issues.
Motion by Johnson, second by Huebsch, and unanimously carried to appoint Commissioner
Roger Froemming to serve on the PSIAW with Commissioner Doug Huebsch as an alternate member
representing the County Community Services Division.
Nitrate Testing on Private Wells
EOT SWCD Manager, Darren Newville and Luke Stuewe from the Minnesota Department of Agriculture
presented a power point titled Otter Tail County Township Nitrate Testing & MDA Nitrogen Fertilizer Plan.
The MDA is the responsible agency for protecting groundwater from fertilizer and pesticides. Mr. Stuewe
shared results of the Otter Tail County private township well testing and State-wide Township testing. Data
collected is then used to develop the Nitrogen Fertilizer Management Plan (NFMP). Lengthy discussion
took place regarding the areas that test 10% or more above 10 mg/L nitrate level. MDA and the Soil &
Water Conservation Districts will work together to ensure at least 80% adoption of Best Management
Practices in these areas. Chairman Rogness stated that Otter Tail County wants to be recognized as a
leader in nitrate management on a volunteer and economic basis and requested reports on this project as
it is implemented.

One Watershed, One Plan
WOT SWCD Manager, Brad Mergens introduced discussion regarding One Watershed, One Plan which is
rooted in work initiated by the Association of Minnesota Counties, Minnesota Association of Watershed
Districts, and Minnesota Association of Soil and Water Conservation Districts. Recommendations of this
group supported 2012 legislation that authorizes the Minnesota Board of Water and Soil Resources
(BWSR) to adopt methods to allow local comprehensive water management plans to be replaced with one
comprehensive watershed management plan. BWSR grants for watershed planning will be available.
BWSR plans to achieve statewide transition to comprehensive watershed management plans by 2025.
Mr. Mergens requested adoption of a resolution of support from Otter Tail County by June 15, 2016 in
order to move forward with Request for Proposals for a consultant to begin work on the water management
plans.
RESOLUTION TO SUPPORT ONE WATERSHED, ONE PLAN PROJECTS
WITHIN OTTER TAILCOUNTY
Otter Tail County Resolution No. 2016 -34
WHEREAS, the Minnesota Board of Soil and Water Resources has developed policies for coordination and
development of comprehensive watershed management plans, also known as One Watershed, One Plan,
consistent with Minnesota Statutes, Chapter 1038.801, Comprehensive Watershed Management
Planning Program; and
WHEREAS, Otter Tail County has a state approved Comprehensive Local Water Management Plan that
covers the period of August 31, 2009 through August 31, 2019 in accordance with Minnesota Statutes,
Chapter 1038.301,Comprehensive Local Water Management Act; and
WHEREAS, the counties, soil and water conservation districts, and watershed districts within the Otter
Tail River (36), Mustinka River (35), Bois de Sioux River (59), Crow Wing River (7), Red River/Buffalo River
(37), Pomme de Terre River (17), Chippewa River (20), Redeye River (8), Long Prairie River (9), as
delineated in the attached (Exhibit B) One Watershed, One Plan Suggested Boundary Map, have interest in
developing a comprehensive watershed management plan for this area; and
WHEREAS, Otter Tail County commits to continued implementation of the current Comprehensive Local
Water Management Plan, until such time as Comprehensive Water Management Plans, also known as One
Watershed, One Plan, are developed for all watersheds within Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County supports the adoption of Comprehensive
Water Management plans, also known as One Watershed, One Plan, for the Otter Tail River, Mustinka
River, Bois de Sioux River, Crow Wing River, Red River/Buffalo River, Pomme de Terre River, Chippewa
River, Redeye River, Long Prairie River as delineated in the attached One Watershed, One Plan
Suggested Boundary Map; and
BE IT FURTHER RESOLVED, that Otter Tail County welcomes the opportunity to collaborate with the
counties, soil and water conservation districts, and watershed districts for an application to the Board
of Water and Soil Resources for a planning grant to develop a comprehensive watershed management
plan and anticipates entering into a Memorandum of Agreement with the counties, soil and water
conservation districts, and watershed districts within the Otter Tail River, Mustinka River, Bois de
Sioux River, Crow Wing River, Red River/Buffalo River, Pomme de Terre River, Chippewa River,
Redeye River, Long Prairie River, to collaborate on this effort, pending selection as a recipient of a
planning grant

The motion for the adoption of the foregoing resolution was introduced by Commissioner Huebsch, duly
seconded by Commissioner Lindquist and, after discussion thereof and upon vote being taken thereon, the

Recess & Reconvene
At 10:47 a.m., Chairman Ro ss declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:52 a.m.
Maintenance Worker II Position
Motion by Lindquist, second by Froemming, and unanimously carried to approve a new Maintenance
Worker II position in the Facilities Operations Department as recommended by the Internal Services and
Finance committees .
. Request for Tax Abatement and Forgiveness of Penalty & Interest
Property Owner, Larry J. Zacher requested tax abatement and forgiveness of penalty & interest for Parcel
No. 23000220171002. Commissioners referred him to the Assessor's office to apply for tax abatement
through the Board of Equalization process. No other action was taken. ·• · ·,
Planning Commission Recommendations
Preliminary Plat-"Williams Eagle Glen"/ William E. Williams:
Motion by Lindquist, second by Johnson, and unanimously carried to approve a Preliminary Plat titled
'Williams Eagle Glen" consisting of 2 single family residential lots as presented. Lake access must be
approved by the Department of Natural Resources (DNR). The proposal is located in that Pt Lot 1 Blk 4
Lying Sly of a Ln Com NW Car Lot 1 of Bailey's Beach, Section 1 of Sverdrup Township; East Lost Lake
(56-378), RD.
Preliminary Plat -"Big Mac Junction''/ Marv & Ann Hex um:
Motion by Huebsch, second by Johnson, and unanimously carried to approve a Preliminary Plat titled "Big
Mac Junction" consisting of 4 non-buildable riparian lots (permanently attached to a residential lot) and 5
single family residential non-riparian lots. The approval is subject to conditions as recommended by the
Planning Commission. The proposal is located in Part of GLs 4, 5 & 6, Section 24 of Dora Township; Big
McDonald Lake (56-386), RD.
Conditional Use Permit-"Beach Bum's''/ BLM LLP:
Motion by Froemming, second by Lindquist, and unanimously carried to approve a Conditional Use Permit
to serve food and beverages on the beach area across the road from the restaurant known as Beach
Bum's with conditions as recommended by the Planning Commission. The proposal is located in Pt Res 3
of GL 1 (.40 Ac), Lot 14 Blk 4 Ex Tr and Lot 15 Blk 4 of Bonita Beach, 2-3 Lot A Blk 3 and 2-3 Lot B Blk 3

ACCEPTING DEDICATED DONATION TO SUPPORT I-LIDS
FOR AQUATIC INVASIVE SPECIES PREVENTION
Otter Tail County Resolution No. 2016 -35
WHEREAS, Otter Tail Lake Property Owners Association Foundation has offered to donate funds in
the amount of four thousand dollars ($4,000.00) to the County of Otter Tail on behalf of the Land &
Resource Office to assist in funding an Internet Landing Installed Device Sensor (I-LIDS); and
WHEREAS, Minnesota Statute §465.03 requires the County to accept the gift by resolution expressed
in terms prescribed by the donor in full; and
WHEREAS, the acceptance of the funds in accordance with the donor's terms is in the best interest of ~ . , ·.c·--· .1,. , -:')C· ", the County of Otter Tail. · · · · ·
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners does

Otter Tail River Watershed Assessment Meeting
Motion by Johnson, second by Froemming, and unanimously carried to: authorize Land & Resource
Director, Bill Kalar to attend the Otter Tail River Watershed Assessment Meeting on Tuesday, May 31,
2016 in Detroit Lakes, MN and provide a report back to the County Board.
Becker, Clay. Otter Tail & Wilkin (BCOW) Adult Mental Health Initiative Update
Human Services Managers, Deb Sjostrom and Margaret Williams provided the 2015 BCOW Mental Health
Initiative Annual Report and financial status. Ms. Williams reported that the Initiative serves people with
mental health conditions and works towards keeping them in their communities. The Adult Mental Health
Steering Committee is comprised of about 40 active members from all four counties including consumers,
family members, service providers, Advisory Committee members and Department of Human Services
Technical Advisory staff.
MNSure Navigator Contract
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the MNsure Joint Powers Agreement Navigator/In-Person Assister between
the State of Minnesota and County of Otter Tail Human Services for the period of July 1, 2016 through
June 30, 2019.
Highway Department Contracts
Motion by Johnson, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the following contracts between the County of Otter Tail and L & M Road
Services LLC of Ulen, MN for the period of June 20, 2016 through September 2, 2016:
• County Highway Right of Way Weed Control -East Otter Tail County
• County Highway Right of Way Weed Control -West Otter Tail County
• County Highway Right of Way Brush Control
Design Services Agreement
Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Proposal for Engineering Services between the County of Otter Tail and
Moore Engineering, Inc. for design and permitting requirements forthe.CSAH1 projectfrom CSAH 10 east
about 6 miles to CSAH 35. '
Perham to Pelican Rapids Regional Trail Project
Public Works Director, Rick West reported that the Perham to Pelican Rapids Regional Trail project
funding from the District 4 Transportation Alternative Program (TAP) has been selected to receive a grant
up to $440,000 during fiscal year 2020. There will be a 20% local match and will follow the reconstruction
of CSAH 34 from TH10 west to CSAH35. Otter Tail County will be the sponsoring agency.

Tax Forfeited Demolition Project
Motion by Johnson, second by Froemming, and unanimously carried to approve payment, in the amount of
$27,850.00, to Ripley's Inc. for completion of the tax forfeited demolition project located at 31112 380th St,
Dent, MN (Parcel No. 56-000-15-0108-000) subject to inspection of the completed project by county
personnel.
Election Recount Services Agreement
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to sign the agreements between the State of Minnesota Office of Secretary of State
and the County of Otter Tail for the automatic recount of votes for the 2016 primary and general election as
necessary under Minnesota Statutes, Section 204C.35 Subd. 1. The agreement for the primary election is
effective July 1, 2016 through September 30, 2016, or the date the State obtains all required signatures
and all obligations have been satisfactorily fulfilled, whichever occurs later. The agreement for the general
election is effective November 1, 2016 through December 31, 2016, or the date the State obtains all
required signatures and all obligations have been satisfactorily fulfilled, whichever occurs later.
Absentee Ballot Board Appointments
Motion by Johnson, second by Froemming, and unanimously carried to appoint the following individuals to
the Absentee Ballot Board for the processing of absentee ballots issued and received under Minnesota
Statutes 2038.04 through 203B.15 and Minnesota Statutes 2038.16 through 2038.27 for the August 9,
2016 State Primary and for the November 8, 2016 State General Election and to establish compensation
for these.services at $L1 .00 per hour with a reimbursement for travel at $0.54 per mile.

Request for Forgiveness of Penalty & Interest
The Red River Valley Campfire submitted an application for forgiveness of penalty and interest, in the
amount of $49,523.17, for parcel nos. 08000100069003 and 08000150092001 located in Sections 10 and
15, Township 137, R. 041, under M.S. 375.192. Motion by Johnson, second by Lindquist, and
unanimously carried to deny the aforementioned request because the reason for late payment(s) does not
fall under the County policy for forgiveness of assessed penalties and/or interest.
