Fir Avenue, Fergus Falls, MN May 10, 2016 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, May 10, 2016, at the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Doug Huebsch, Vice-Chair, Wayne Johnson, John Lindquist and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners Agenda of May 10, 2016 with the following additions: 10:25 a.m. -Boat & Water Safety Grant Agreement 10:45 a.m. -County Wide Seal Coat Project Contract Consent Agenda Motion by Huebsch, second by Johnson, and unanimously carried to approve Consent Agenda items as follows: Ditch 30: 1. May 3, 2016 Board of Commissioners' Meeting Minutes with an Editorial Correction 2. Warrants/Bills for May 10, 2016 (Exhibit A) 3. Human Services Bills & Claims 4. Approve Payment, in the amount of $2,016.83, to Lake Region Healthcare for Cost incurred under M.S. 609.35 5. Approve Issuance of 2016 Tobacco License for Pelican Hills RV Park 6. Approve Issuance of 2016 On-Sale Seasonal Liquor & Sunday Liquor License for Elks Point Bar & Grill Public Hearings for Redetermination of Benefits Motion by Lindquist, second by Froemming, and unanimously carried to schedule the Ditch 30 Redetermination of Be11efits Public Hearing at 7:00 p.m. on Monday, June 20, 2016 at the Government Services Center, Fergus Falls, MN. Ditch 58: . . Motion by Huebsch, second by Lindquist, and unanimously carried i:o schedule the Ditch 58 Redetermination of Benefits Public Hearing at 7:00 p.m. on Monday, July 25, 2016 at the Perham City Hall. Election Services Agreement Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the SeaChange Election Services Agreement between Otter Tail County and SeaChange Print Innovations for election ballot services. The agreement is effective from June 1, 2016 through May 31, 2020. REQUEST TO REPURCHASE TAX FORFEITED PROPERTY Otter Tail County Resolution No. 2016 -31 Commissioner Johnson introduced the following resolution and moved its adoption: RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, that OTC Board of Commissioners' Minutes May 10, 2016 Page 2 WHEREAS, Thomas Runningen, owner, has made application to repurchase the following legally described parcel: Parcel No. 76-000-99-0480-001 FRAZEE'S 2ND ADDN E1/2 OF LOTS 1, 2 & 3 BLK 11 Said property having forfeited to the State of Minnesota on the 29th day of July, 2014, for nonpayment of the 2005, 2006, 2007, 2008, 2009, 2013 and 2014 property taxes, and WHEREAS, an application to repurchase the above described property was timely submitted on Wednesday, May 4, 2016, and WHEREAS, the sum of $5,530.40 represents aggregate of all delinquent and current taxes through Payable Year 2015, penalties, costs, assessments, and fees as of February 29, 2016, that would have been due and payable had the above described parcel not forfeited to the State of Minnesota, and WHEREAS, the applicant has requested that the Otter Tail County Board of Commissioners consider his application to repurchase the above-described parcel and has requested that the Otter Tail County Board of Commissioners approve the applicant's request to repurchase the above-described property under the terms as outlined in the Contract for Repurchase of Tax-Forfeited Land. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the repurchase of the above described tax forfeited property under the terms as outlined in the Contract for Repurchase of Tax-Forfeited Land, and BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners hereby finds that the repurchase is in the best public interest and that it will relieve any undue hardship which has resulted from the forfeiture. Commissioner Huebsch seconded the motion, and upon being put to vote, the above resolution was unanimously adopted. Adopted this 10th day of May 2016 OTTER TAIL COUNTY BOARD OF COMMISSIONERS Grant Application Assistant Solid Waste · or, Zach Fjestad requested a letter of support for Tri-County Solid Waste's grant application for research to develop proper management of agricultural plastics and boat wrap which is a growing problem in the rural waste stream. Discussion followed regarding the potential to also recycle silage wrap, bale wrap, seed bags and plastic bags used for corn and hay. Motion by Huebsch, second by Froemming, and unanimously carried to authorize the Chairman's signature on the Letter of Support for a grant for proper management of agricultural materials as submitted and addressed to the Minnesota Pollution Control Agency. · OTC Board of Commissioners' Minutes May 10, 2016 Page 3 MINNESOTA POLLUTION CONTROL AGENCY FY 2016-17 GRANT PROGRAM Otter Tail County Resolution No. 2016 -32 WHEREAS, Tri-County Solid Waste Management Commission (representing Stearns, Benton, and Sherburne counties) has applied for a grant from the Minnesota Pollution Control Agency (MPCA), under its FY16°17 Environmental Assistance Grant Program; and WHEREAS, if MPCA funding is received, Otter Tail County is committed to implementing the proposed project as described in the grant application; and WHEREAS, MPCA requires that Tri-County Solid Waste Management Commission enter into a grant agreement with the MPCA that identifies the terms and conditions of the funding award; BE IT RESOLVED THAT Otter Tail County hereby agrees to implement the proposed project as described in the grant application identifying Otter Tail County in-kind match contribution of 200 hours over a three year period to carry out the project specified therein and to comply with all of the terms, conditions, and matching provisions of the grant agreement and authorizes and directs the Board Chairman to sign this resolution on its behalf. The motion for the adoption of the•foregoing resolution was introduced by Commissioner Huebsch, duly seconded by Commissioner Froemming and, after discussion thereof and upon vote being taken thereon, the following voted in favor: Commissioners Huebsch, Johnson, Lindquist, Froemming and Rogness and the following voted against the same: None Adopted at Fergus Falls, Minnesota, Tuesday, May 10, 2016 OTTER TAIL COUNTY BOARD OF COMMISSIONERS Dated: S"-~ '{-//p By:~~~~~~~~~~~-::~-:~-::-::--Attest ~~ ·~ LarryKrofi: Clerk Closed to the Public At 9:55 a.m., Chairman Rogness declared the Board of Commissioners meeting closed to the public to discuss attorney-client privileged matters involving potential litigation over a dispute with the State Court Administration on the cost of a remodeling item provided by New Life Communications. The closed session is authorized under Attorney-Client privilege, M.S. §13D.05, Subd. 3(b). Present were all five seated Commissioners, County Attorney, County Administrator and Board Secretary. Al 10:11 a.m., Chairman Rogness declared the closed session adjourned and the remainder of the Board meeting open to the public. Boating Safety Patrol Grant Agreement Motion by Johnson, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute the 2016 State of Minnesota Federal Supplemental Boating Safety Patrol Grant Agreement in the amount of $11,375.00 for extra safety enforcement hours. OTC Board of Commissioners' Minutes May 10, 2016 Page4 Salary Market Study Human Resource Director, Nicole Hansen requested approval of a market study to ensure competitive salaries and current data that could ·be used during upcoming union negotiations. Discussion followed. Motion by Lindquist, second by Froemming, and unanimously carried to approve the Salary Market Study at a cost of $7,500 and to authorize the appropriate County Officials' signatures to execute the Agreement for Professional Services between Otter Tail County and Gallagher Benefit Services, Inc. (Fox Lawson & Associates parent company). Ms. Hansen also updated the Board on previous and on-going supervisor training sessions. Highway Project Bid Awards C.P. 16:TM-Traffic Marking: Motion by Johnson, second by Froemming, and unanimously carried to award the 2016 County Wide Traffic Marking project to the low bidder, Traffic Marking Service, Inc. of Maple Lake, MN in the bid amount of $351, 163.38. Seasonal Salt Supply: Motion by Johnson, second by Froemming, and unanimously carried to award the Seasonal Supply of Salt to the low bidder, L & 0 Acres of Westport, SD in the bid amount of $75.50/Ton. Highway Contract-S.A.P. 056-601-063 & Etc. Motion by Froemming, second by Huebsch, and unanimously carried to .authorize the appropriate County Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and Morris Sealcoat & Trucking, Inc. for the County Wide Seal Coat project, contingent upon the approval of the County Attorney. WORK ZONE SPEED LIMITS Otter Tail County Resolution No. 2016 -33 Upon a motion by Johnson, seconded by Lindquist and unanimously carried, the following resolution was adopted: WHEREAS, work zone speed limits may be established by the local road authority in accordance with the provisions of Minnesota Statutes 169.14, Subd. 5d, and · · · WHEREAS, the County of Otter Tail is the local road authority for County State Aid Highways and County Highways within said County, and WHEREAS, said County is prepared to proceed with improvements on the following County State Aid Highways (CSAH) and County Highways (CH): CSAH 1 CSAH 25 CSAH 51 CSAH 75 CH 136 CSAH3 CSAH 36 CSAH 54 CSAH 79 CH 141 CSAH8 CSAH 38 CSAH 56 CSAH 82 CSAH9 CSAH 40 CSAH 57 CSAH 83 CSAH 11 CSAH 42 CSAH 64 CH 126 CSAH 21 CSAH 50 CSAH 73 CH 135 NOW, THEREFORE, BE IT RESOLVED: that the Otter Tail County Board of Commissioners authorize work zone speed limits be established on the above CSAH and CH routes within Otter Tail County as called for in the Contract Special Provisions for the project(s) associated with each highway. The Collaboration meeting focused on City/County street improvements, trails, recycling/landfill services and economic development opportunities. The next County Board meeting is scheduled at 9:30 a.m. on Tuesday, May 24, 2016.
