Fir Avenue, Fergus Falls, MN April 26, 2016 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, April 26, 2016, at the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the Board agenda. Motion by Froemming, second by Huebsch, and unanimously carried to approve the Board of Commissioners Agenda of April 26, 2016, with the following modifications: Personnel Board of Appeals -moved to 10:30 a.m. General Discussion -Coffee Vending, Lake Street, Economic Development Update Consent Agenda Motion by Johnson, second by Lindquist, and unanimously carried to approve Consent Agenda items as follows: 1. April 12, 2016 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for April 26, 2016 (Exhibit A) 3. Approve Out-of-State Travel May 24-26, 2016 for Public Health Nurse for National Diabetes Prevention Program 4. Authorization for West Central Ag-Air Inc. to do Forest Tent Caterpillar Spraying in Unincorporated Areas of Otter Tail County 5. Human Services Bills & Claims 6. Approve Payment in the amount of $1,602.02 to LRH for Cost Incurred under M.S. 609.35 7. Approve Exempt Permit (gambling permit) for St. Lawrence Church for an Event on August 7, 2016 8. Approve Liquor Licenses as Submitted in Supporting Documents Identified as 2.8 Lake Street County Attorney David Hauser discussed issues regarding the use of the Lake Street access with the Board. Motion by Johnson, second by Huebsch, and unanimously carried to authorize the Public Works Director/Highway Engineer to hire a surveyor to locate and mark the boundaries of Lake Street. Mr. Hauser will return to the Board with a formal resolution for this action. Tax Abatement Public Hearing At 9:40 a.m., Chairman Rogness opened the Public Hearing for consideration of a tax abatement for property taxes for a 24-unit apartment building (parcel #77000220020003) proposed by Grow Perham, LLC. Commissioners Johnson, Lindquist, Froemming and Rogness were present for the Public Hearing. Commissioner Huebsch was absent during the Hearing due to a conflict of interest. Chuck Johnson from the City of Perham presented the project. A Grant has been received through the MN Department of Employment and Economic Development (DEED) Workforce Housing program in the amount of $620,000 which is about 25% of the 2.6 million dollar project. The grant requires a local match of $310,000. To meet the required match, a fifteen year tax abatement from the City, County and School District is being proposed with the remaining local match coming from the City of Perham. There is great need for housing in the City of Perham and surrounding area. No one from the public was present to offer comment. OTC Board of Commissioners' Minutes April 26, 2016 Page2 Tax Abatement Public Hearing continued: At 9:55 a.m., Chairman Rogness closed the Public Hearing. Because of a great need for workforce housing, a motion was offered by Johnson and seconded by Froemming to approve the Tax Abatement Agreement by and among the City of Perham, Otter Tail County, Perham-Dent School District #549 and Grow Perham, LLC as presented and dated May 1, 2016. This Tax Abatement Agreement is for a specific housing project and differs from the current County Tax Abatement policy which has general application to proposed economic development projects in that this agreement does not require the payback of the abated tax after start-up of the project. Rogness YEA X X X X Recess & Reconvene NAY ABSENT X ABSTAIN At 10:00 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:05 a.m. with all five seated Commissioners present. Tax Abatement Policy Motion by Lindquist, second by Froemming, and unanimously carried to request that the appropriate staff work with the Finance Committee to develop an updated County Tax Abatement Policy. Tax Forfeited Demolition Projects Motion by Lindquist, second by Froemming, and unanimously carried to award the tax forfeited demolition projects on Parcel #71-001-99-0418-000 (735 Riverside Court -Fergus Falls, MN) to Ness Backhoe, Inc. at the low quote of $5,200.00. Motion by Johnson, second by Huebsch, and unanimously carried to award the tax forfeited demolition projects on Parcel #56-000-15-0108-000 (31112 380th St. -Dent) to Ripley's Inc. at a quote price of $27,850.00, subject to the Auditor confirming the complete job is included in the quotation. If the complete job is not included in the low quote, the Auditor may hire the 2nd lowest bidder, Shaw Excavating at a quotation price of $35,000. Highway Project Contracts Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Highway Contracts: OM Enterprises, Wadena, MN Culvert Replacement on CSAH 16; OM Enterprises, Wadena, MN Culvert Replacement on CSAH 22; Riley Bros. Construction, Inc., Morris, MN Reconstruct CSAH 38 (S.A.P. 056-638-007) Anderson Brothers Construction, Brainerd, MN County Wide Crack Sealing (C.P. 16:CS) Coffee & Vending Supply Discussion Facilities Manager, Terry Hoff reported that a vendor has requested that the County try their coffee for employees and have provided samples. Currently, the vending and coffee are supplied by the same vendor. Discussion followed. Motion by Lindquist, second by Johnson, and unanimously carried to request that the appropriate County Officials develop a Request for Proposal (RFP) and proceed with a specific contract for vending and coffee supplies which must include an annual remuneration to Otter Tail County. OTC Board of Commissioners' Minutes April 26, 2016 Page 3 Economic Development Update Economic Development Director, Nick Leonard reported on several recent meetings with resort owners, COLA group and the organization that replaces the Otter Tail Country Tourism Association. Discussion took place regarding the balance between taking care of the environment while supporting economic development. Chief Deputy Treasurer Reclassification Motion by Lindquist, second by Huebsch, and unanimously carried to approve reclassification of the Chief Deputy Treasurer position to the Accounting Analyst Classification (C41) effective May 1, 2016. Personnel Board of Appeals Motion by Lindquist, second by Froemming, and unanimously carried to approve the following Personnel Board of Appeal appointments: Term Appointment Mike Hartwell May 1, 2016-December 31, 2018 City of Fergus Falls HR Director Dave Schornack May 1, 2016 -December 31, 2017 Arvig Enterprises Director Katie Johnson May 1, 2016-December 31, 2016 Lake Region Healthcare Communications West Central Regional Juvenile Center Update Probation Director, Chuck Kitzman submitted a WCRJC Advisory Board Meeting report dated April 14th, 2016. He reviewed 2015 population information, Otter Tail County purchased and used beds, budget information and proposed changes to usage of beds by member counties. Planning Commission Recommendations Conditional Use Permit-Kyle Petersen: Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for a project as submitted on the revised plan as presented to the Land & Resource Department on December 15, 2015 and as recommended by the Planning Commission. The proposal is located in Pt GL 4 & 1, Section 28 & 29, Tordenskjold Township; Stalker Lake (56-437), RD. Conditional Use Permit-Linda & Jon Grefsrud: Motion by Froemming, second by Lindquist, and carried, with Johnson abstaining, to approve a Conditional Use Permit to construct a driveway as presented. The proposal is located in Pt NW¼ SW¼ & Pt GL 5 (12 Ac), Section 20, Dunn Township; Lake Lizzie (56-760), RD. Aquatic Invasive Species Task Force Land & Resource Director, Bill Kalar reviewed the AIS Task Force minutes of April 11, 2016. Motion by Johnson, second by Huebsch, and unanimously carried to approve AIS prevention expenditures recommended by the AIS Task Force at their April 11, 2016 meeting and to authorize the appropriate County Officials' signatures on the Master Agreement between Otter Tail County and Environmental Sentry Protection, LLC. Environmental Sentry Protection provides the I-LIDS systems (cameras at public accesses). The expenditures include: Welcome Boaters Signs, Advertising in Lakes Journal, Leighton Broadcasting Invasive Species Awareness Campaign, Clean Drain Dry Towel program, preliminary work on a Boat Tracking Application and I-LID cameras. OTC Board of Commissioners' Minutes April 26, 2016 Page4 Sanitation Code Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute the revised Sanitation Code to be effective April 26, 2016 as submitted. Fidlar Symposium Motion by Johnson, second by Froemming, and unanimously carried to approve out-of-state-travel for Recorder Carol Schmaltz to attend the Fidlar Symposium in Davenport, Iowa May 23-25 of 2016. Fidlar will pay for transportation and meals with the hotel expense to be paid by way of a Tapestry credit to Otter Tail County. Fidlar is the company that provides Otter Tail County with land/deed software. FOSTER CARE MONTH -MAY 2016 Otter Tail County Resolution No. 2016 -25 WHEREAS, the family, serving as the primary source of love, identity, self-esteem and support, is the very foundation of our communities, our state, and our Country, and WHEREAS, in 2016 there were 33 children in the Otter Tail County licensed foster homes. Foster care provides a safe, secure and stable home for children also providing compassion and nurturance of a family setting, and WHEREAS, in 2016, Otter Tail County Human Services currently has16 licensed foster families who have opened their homes and hearts to children whose families are in crisis, play a vital role helping children and families heal, reconnect, and launch children into successful adulthood, and WHEREAS, there are over 133 adults in licensed adult family foster care homes, and WHEREAS, there are over 50 licensed adult family foster care providers, who have opened their homes to provide a family environment to individuals with developmental disabilities, mental illness or who are elderly, and WHEREAS, there are numerous individuals, public and private organizations who work to increase public awareness of the needs of children and adults in foster care as well as the enduring and valuable contribution of foster care providers. NOW, THEREFORE, we, the Otter Tail County Board of Commissioners, do hereby proclaim May as FOSTER CARE MONTH in Otter Tail County and urge all citizens to volunteer their talents and energies on behalf of children/adults in foster care, foster parents, and the professional staff working with them during this month and throughout the year. The motion for the adoption of the foregoing proclamation was introduced by Commissioner Lindquist, duly seconded by Commissioner Froemming and, after discussion thereof and upon vote being taken thereon, the following voted in favor: Commissioners Huebsch, Johnson, Lindquist, Froemming and Rogness and the following voted against the same: None OTC Board of Commissioners' Minutes April 26, 2016 Page 5 Adopted at Fergus Falls, Minnesota, Tuesday, April 26, 2016 OTTER TAIL COUNTY BOARD OF COMMISSIONERS By: 11::s-wARE PROVIDER WEEK PROCLAMATION May 1st-7th 2016 Otter Tail County Resolution No. 2016 -26 WHEREAS, Otter Tail County has over 128 licensed family child care providers; and WHEREAS, Otter Tail County family child care providers serve approximately 1,300 children and their families; and WHEREAS, children are Otter Tail County's most valuable asset and resource; and WHEREAS, the care and education of Otter Tail County's children-provided by licensed family child care givers is an invaluable occupation; and WHEREAS, many Otter Tail County families choose child care outside their own home; and WHEREAS, licensed family child care providers are highly competent, dedicated, caring, and concerned professionals. NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners hereby proclaim the week of May 1st -7th, 2016, as Licensed Family Child Care Provider Week in Otter Tail County, in honor of its many licensed family child care providers, and asks the community to join in recognizing the valuable contributions these family child care providers make to our community. Other possibilities to inform the public of foster care needs were also discussed. Ms. Sjostrom shared the current Human Services 2016 expenditures and revenues budget. '';, " Drone Inspection Update Ditch Inspector, Kevin Fellbaum provided a video of Ditch 39 in Western Township as an example of the potential to use drones to inspect ditches. A suggestion was offered to use the drone fly-over to monitor the Ditch 70 Improvement project. Motion by Johnson, second by Lindquist, and unanimously carried to use drone video for the upcoming Ditch 48 and Ditch 8 Public Information meetings. Adjournment At 12:13 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, May 3, 2016.
