Fir Avenue, Fergus Falls, MN March 8, 2016 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, March 8, 2016, at the Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Wayne Johnson, Roger Froemming, and John Lindquist present. Vice-Chair Doug Huebsch was absent. .. Approval of Agenda Chairman Rogness called for approval"of the Board agenda. Request for Approval of Final Payment to Traffic Marking Services, Inc. for 2015 Traffic Marking Project RESOLUTION APPROVING SURVEYOR'S CERTIFICATE OF PLAT CORRECTION (Plat Correction for Shady Nook Beach) Shady Nook Beach is located in Government Lot 8 -Section 15 of Maine Township Otter Tall County Resolution No. 2016 -13 WHEREAS, Pursuant to the provisions of Minnesota Statutes, Chapter 505.174 and 505.175, Michael L. Fletchall, a duly Licensed Land Surveyor in and for the State of Minnesota has prepared a Surveyor's Certificate of Plat Correction to the Plat of Shady Nook Beach; and WHEREAS, Pursuant to the provisions of Minnesota Statutes, Chapter 505.176, when the certificate has been approved by the governing body of the area involved and a certificate stating that said plat certificate has been approved by the governing body signed by the clerk of said body is attached to said plat certificate, the county recorder of the county in which the land so platted or subdivided is located shall accept each such certificate for filing and recording in the recorder's office upon payment of a fee therefor commensurate with the length of the certificate. NOW THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners hereby accepts and approves the attached Surveyor's Certificate of Plat Correction to the plat of Shady Nook Beach as prepared by Michael L. Fletchall, a duly Licensed Land Surveyor in and for the State of Minnesota; and OTC Board of Commissioners' Minutes March 8, 2016 Page 2 BE IT FURTHER RESOLVED, Pursuant to the provisions of Minnesota Statutes, Chapter 505.176 that the Otter Tail County Recorder shall make suitable notations on the record of said Plat to which the attached Surveyor's Certificate of Plat Correction refers to direct the attention of anyone examining said Plat to the record of such certificate. Upon the motion of Commissioner Lindquist, seconded by Commissioner Johnson and passed on a 4-0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. OTTER TAIL COUNTY BOARD OF COMMISSIONERS A-~¢ Larry Kroh ;cfe U.S. Fish and Wildlife Service Wetland Eas t USFWS Representatives appeared before the Board and requested certification of a wetland protection easement consisting of about 40 acres with 7 wetland acres and 11 basins on the property. Documentation was previously submitted regarding the request. After County Board approval, the wetland easement request will be considered by the State Land Exchange Board. The owner continues to be responsible for maintenance and taxes on the property. Motion by Lindquist, second by Froemming, and unanimously carried to approve certification for the USFWS to secure the following wetland easement: Johnson, Donald E: T. 131 N., R. 39 W., 5th P.M. Section 3, SW¼SW¼ Otter Tail County Legislative Initiatives Administrator Larry Krohn presented a document of legislative initiatives for Commissioners to consider. Discussion followed. Commissioners will review documentation for the various topics and choose several specific topics to advocate for on behalf of Otter Tail County, in addition to the topics handled by the County's organizations such as Association of Minnesota Counties (AMC) and the Minnesota Inter-County Association (MICA). This topic will be placed on the next Board of Commissioners agenda for further discussion. Vehicle Replacement Request Assistant Solid Waste Director, Zach Fjestad presented a quote from Nelson Auto Center, Fergus Falls, MN for a 2016 Jeep Cherokee to replace a 2001 Jeep Cherokee that is requiring maintenance and may not be as reliable as needed. Motion by Johnson, second by Froemming, and unanimously carried to approve the purchase, from the Solid Waste Capital Expenditure Fund, of a KLJL74 2016 Jeep Cherokee, in the amount of $23,923.98. RESOLUTION OF THE COUNTY BOARD OF COMMISSIONERS OF OTTER TAIL COUNTY APRIL AS RECYCLE MONTH Otter Tail County Resolution No. 2016 -14 WHEREAS: Otter Tail County through its Solid Waste Department strives to provide county residents with opportunities to recycle, and OTC Board of Commissioners' Minutes March 8, 2016 Page 3 WHEREAS: It is in the interests of residents of Otter Tail County to recycle and to increase participation in recycling, and WHEREAS: Otter Tail County, through its Solid Waste department, has invested considerable financial and educational resources in recycling and waste reduction to assure that residents have access to recycling facilities, recycling bins and educational programs, and WHEREAS: County residents can use these resources while working toward increasing participation rates for recycling within the county, and WHEREAS: Reducing, reusing and recycling eliminates certain materials from entering the waste stream, saves resources, protects the environment, prevents pollution, supports public health and creates jobs in Otter Tail County, and WHEREAS: According to the MPCA, Minnesotans recycle enough waste to conserve over 5 million trees and reduce greenhouse gases equal to taking more than 1.3 million cars off the road, and WHEREAS: Minnesota's recycling programs collected material worth almost $700 million, while at the same time throwing away 1.2 million tons of recyclable materials worth $285 million and spending $200 million in disposal cost, and WHEREAS: There is a continued need for increasing participation in reducing, reusing and recycling in Otter Tail County with both residential and commercial sectors partnering toward working to recycle more and keeping Otter Tail County sustainable for generations. NOW THEREFORE, BE IT RESOLVED, that Otter Tail County, by virtue of the authority vested in the Board of County Commissioners, do hereby proclaim April as Recycling Month in Otter Tail County. BE IT THEREFORE, FURTHER RESOLVED, that the Board of County Commissioners encourages residents to use the County facilities to recycle, to participate in the "Making Our Hometowns Greener Campaign" kickoff event on Earth Day April 22nd, and to be recognized as stakeholders in protecting the environment by continuing to be conscientious citizens seeking education and information to further reduce, reuse and recycle. Attes1 L~~ Larry~ Clrk OTC Board of Commissioners' Minutes March 8, 2016 Page 4 PLMSWA Discussion/Update Solid Waste Director, Mike Hanan opened discussion regarding the upcoming Prairie Lakes Municipal Solid Waste Authority meeting scheduled at 10:00 a.m. on Wednesday, March 23, 2016 at the Perham City Council Chambers. County officials from all participating counties have been invited to this meeting. Mr. Hanan submitted the 2015 PLMSWA annual review which contains operations and construction budget and income statements and balance sheets. Mr. Hanan will meet with Auditor Wayne Stein and two commissioners to establish the agenda for the meeting which will be moderated by the PLMSWA Chairman and its Board. The Agenda should be mailed out to all participating counties by March 18th. There are a number of items to be discussed including upcoming bond payments on the building and deficits that have been created due to delayed completion of the project. Annual Conference of the Red River Watershed Management Board Commissioners requested that BRRWD Representative, Peter Fjestad, attend the 18th Joint Annual Conference in Moorhead, MN, sponsored by the RRWMB and RR Flood Damage Reduction Work Group. Food & Lodging Ordinances Public Hearing At 10:30 a.m., Otter Tail County Public Health Director, Diane Thorson opened a Public Hearing for the consideration of the adoption of Environmental Health ordinances. The County needs to adopt ordinances because Otter Tail County has given notice to the State Health Department that the County wants to re- enter into a delegation agreement to enforce the environmental health regulations. The proposed ordinances have been submitted to the Board and are named as follows: Food Protection Ordinance, Lodging Establishment Ordinance, Manufactured Home Park and Recreational Area Ordinance, Public Swimming Pool and Spa Ordinance, Public Water Supply Ordinance and Youth Camp Ordinance. The proposed ordinances have adopted the State statute and rules by reference along with a couple of additional specifications for Otter Tail County. Bruce Jasper, Director of Clay County Environmental Health was present for technical questions. Ms. Thorson indicated that the fees for environmental health regulation are set every year by the Community Health Board. Chairman Rogness opened the Hearing for public comments summarized as follows: Written Comments: Written comments were received from Nick Leonard and Brad Stevens requesting: 1. Definitions for B&B's, Boarding Establishments and Vacation Home Rentals be added to the Lodging Ordinance 2. Changing a resort from "five or more cottages, rooms or enclosures" to "three or more cottages, rooms or enclosures" to be consistent with the County's Shoreland Management Ordinance definition Public Comments: Cheryl Harris, former resort owner: 1. Why does Otter Tail County want to take the environmental health regulations responsibility back from the State of MN? Answer: Otter Tail County feels that the best service to business owners can be provided at the local level and Otter Tail County is working towards adopting similar policies as the other counties in the local Community Health Board which includes Becker, Clay, Otter Tail and Wilkin counties . . ' 2. Will Inspectors be respectful and.sensitive to business owners in our community? Answer: Otter Tail C_ounty is taking on this responsibility to regulate environmental health services to be more local, attentive,and,sensitivt;i to our con:imunity. · : 3. How long will the resinspection fees last and do those fees go directly to the County? Answer: The only time resinspection fees are assessed is if there is non-compliance from a business owner/operator. OTC Board of Commissioners' Minutes March 8, 2016 Page 5 Keith Edwards Nichols, Jolly Ann Lake Property Owner: 1. Mr. Nichols read a statement of concern that our environment is suffering. He specifically spoke about the problems of spraying chemicals and the effect on wildlife, loss of honey bees, and the need for renewable energy and a natural, healthy environment. There did not appear to be direct comment(s) relative to the proposed ordinances. Vince Prososki, 1. Expressed satisfaction with the State environmental health inspections and asked if the process will remain the same. Will inspectors go into occupied cabins? Answer: The inspection process will be similar and every effort will be made not to go into occupied cabins or rooms. 2. Will a permit be required when changing windows, paneling or faucets? Answer: State codes apply -the environmental health ordinances do not address building codes. 3. What has Clay County done to address vacation home rentals? Will vacation home rentals need to obtain a license the same as resorts and hotels? If not, this is an unfair advantage. Answer: Clay County does not have many vacation home rentals so it is not an issue for Clay County. County Economic Development Director, Nick Leonard, indicated that these types of rentals are already controlled by statute and the definitions need to be added to the proposed Lodging Ordinance. Commissioners requested further research on this issue and directed the County Attorney to draft proposed language to add vacation home rentals by owner to the Ordinance to treat them the same as other lodging rentals. Commissioners will consider the public comments and consider adoption of the Environmental Health ordinances at 11 :00 a.m. on Tuesday; March 22, 2016. If the ordinances are adopted, the previous 1984 ordinances will be repealed. Chairman Rogness closed the Public Hearing at 11 :00 a.m. Strategic Plan Community Services Director, John Dinsmore and Human Resources Director, Nicole Hansen presented a draft document titled "Otter Tail County Government Action Plan" which is a result of the County Board planning retreat held January 15, 2016. The report identifies three broad goals; 1) Technology, 2) External Infrastructure (outreach) to citizens, and 3) Succession Planning. Discussion followed regarding the goals within each category and work components chart from 2016 through 2018. Commissioners will review the document for additions or changes and discuss the process further at their next regular County Board meeting. Rural Rebound Workforce Development Grant Economic Development Director, Nick Leonard reported that Otter Tail County and the Fergus Falls Economic Improvement Commission along with several public and private sector partners are currently applying for grant funding to address the regional workforce shortage. The grant proposal is titled Otter Tail County Rural Rebound Initiative. The grant will provide the resources needed to hire a Coordinator to lead the process and pull together all of the efforts to attract, develop, retain and expand the employee pool in Otter Tail County. Motion by Lindquist, second by Froemming, and unanimously carried to identify the Otter Tail County Economic Development Director as the leader of the Rural Rebound Initiative and to commit a maximum of $15,000 over a two year period starting in CY2017 for a portion of the grant match. Recess & Reconvene At 11 :45 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch. The meeting was reconvened at 12:35 p.m. OTC Board of Commissioners' Minutes March 8, 2016 Page6 Public Health Positions Motion by Lindquist, second by Froemming, and unanimously carried to approve the following two new positions in the Public Health Department: Assistant Public Health Director and Public Health Nurse Lead Worker. These two positions will be filled internally for succession planning; however, moving to these positions will not create public health nurse vacancies. ASSOCIATION OF MINNESOTA COUNTIES' COUNTY PROGRAM AID FORMULA Otter Tail County Resolution No. 2016-15 Affirming Otter Tail County's endorsement of the revised County Program Aid formula developed by the Association of Minnesota Counties' County Program Aid Work Group. WHEREAS, Minnesota's counties are mandated by the state to provide essential services in many program areas including human services, public safety, and transportation; and WHEREAS, counties depend on County Program Aid ("CPA") for the financial sustainability of these state- mandated, county-administered services; and WHEREAS, the current structure of the CPA formula, pursuant to MS Chapter 447A.0124, creates considerable volatility in the fund's distribution, interfering with counties' abilities to accurately budget for essential services; and WHEREAS, the current formula's inadequacies have also resulted in the dramatic reduction of funding for one-third of counties, that have lost at least 50 percent of their funding since 2005; and WHEREAS, despite fluctuations over the past ten years, the state appropriation to the 2015 CPA is equal to the 2005 appropriation making it greatly depressed in terms of inflation; and WHEREAS, a revised CPA formula in conjunction with additional funding will enable counties to continue to provide quality services that may also translate into reductions in county levies, decreasing the tax burden of Minnesota residents; and WHEREAS, in October 2014, the Association of Minnesota Counties assembled the CPA Work Group including leadership from twenty counties and representatives from the Metropolitan Inter-County Association and the Minnesota Rural Counties Caucus to analyze and develop a CPA formula that reflects the pressing needs of Minnesota's counties; and WHEREAS, the CPA Work Group unanimously approved a revised CPA formula that benefits all Minnesota counties by reducing volatility and ensuring a fair distribution of CPA; and WHEREAS, the Board of Directors of the Association of Minnesota Counties that represents the diverse interests of Minnesota's 87 counties, voted to support the proposed CPA formula revisions; now, therefore, BE IT RESOLVED, Otter Tail County endorses the following revisions to the Minnesota County Program Aid formula: • A funding increase of $40 million; • The creation of a funding floor that guarantees each county $350,000 in tax base equalization aid ("TBEA"); • Adjustments to the TBEA formula factors to slow down counties' loss of TBEA funding, including: and increase of the per capita factor to $190 and a decrease of the county adjusted net tax capacity (ANTC} factor to 9 percent; • The elimination of special funds and transition aid; and OTC Board of Commissioners' Minutes March 8, 2016 Page 7 • The creation of a 5% cap on annual CPA losses; ensuring no county will lose more than 5% of its funding each year.
