OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, February 23, 2016, at the
Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman;
Wayne Johnson, Roger Froemming, and John Lindquist present. Vice-Chair Doug Huebsch was absent.
Approval of Agenda
Chairman Rogness called for approval of the February 23, 2016, agenda. Motion by Lindquist, second by
Froemming, and unanimously carried to approve the Board of Commissioners agenda of February 23,
2016, with the following additions:
• Bid Award for the CSAH 8 Highway Project
• Miscellaneous Items under General Discussion
Consent Agenda
Motion by Froemming, second by Lindquist, and unanimously carried to approve Consent Agenda items as
follows:
1. February 9, 2016, Board of Commissioners Meeting Minutes
2. Warrants/Bills for February 23, 2016 (Exhibit A)
3. Human Service Contract Renewal
4. Human Services Bills & Claims
5. Issue County Credit Card to Richard Kelsven, County IT Director

Report on Recent MICA Meeting
Chairman Rogness and Commissioner Johnson attended the February Minnesota Inter-County
Association meeting in St. Paul. They indicated that the financial status of the organization is good which
includes an adequate reserve account. MICA has a process identified for following the prospective
legislation through the upcoming session and shared the legislative calendar. The Governor's budget does
not include transportation or prison expansion funding. The State completed a Capital Investment
Guideline study which shows the State's indebtedness at percentage of personal income. The State of MN
is well within the accepted guidelines which may be considered in the bonding bill this session.
Fraud & Collection Annual Reports
Lead Fraud Investigator, Sandy Halo submitted the 2015 Fraud Investigation Program Activity Report.
Total savings reported were $194,772.00. Collections Officer, Crystal Herman submitted a 2015 Otter Tail
County Collections spreadsheet and reported total recoveries of $530,775.06. Of that total, Otter Tail
County retains $188,869.04. Discussion took place regarding the issue of MNsure automatically putting
low income clients in Medical Assistance without consideration of assets. People age 55 and older on
Medical Assistance may be subject to liens on property/assets and recoveries at time of death. Otter Tail
County recoveries would be affected if the law changes to eliminate the repayments for people who have
received Medical Assistance. Human Services Case Aide, LeAnn Sudbeck submitted the 2015 Program
Summary for Chemical Dependency Assessment, Detoxification and Out of Home Placement Fees.
CY2015 recoveries were reported as $312,856.52 with a notable increase in recoveries for IV-E foster care
at $110,766.80.

Shoreland Management, Sanitation, and Proposed Dock Ordinances
General Discussion took place regarding the proposed Dock Ordinance and the process used to determine
the number of docks allowed in cluster developments. Commissioners reiterated that these ordinances
need periodic review and possible amendment when issues arise; preferably review on an annual basis.
Ditch 70 Findings and Order
Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Findings and Order for Redetermination of Benefits in the Matter of the
Proposed Improvement of Ditch 70 as submitted by the County Attorney.
Recess & Reconvene
At 10:22 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:26 a.m.
Bid Award -S.A.P. 056-601-061 & 056-608-027
Motion by Johnson, second by Lindquist, and unanimously carried to award the CSAH 1 & CSAH 8 project
to the low bidder, Tri-City Paving, Inc. of Little Falls, MN, in the amount of $3,514,333.60 as recommended
by the Highway Engineer.

Motion by Johnson, second by Lindquist, and unanimously carried to award this CSAH 8 project to the low
bidder, Anderson Brothers Construction Co., in the amount of $1,681,341.59 as recommended by the
Highway Engineer.
Amendment to the CSAH 9 Project Contract
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Amendment to the contract with Evergreen Land Services for
professional right of way acquisition for SAP. 056-609-005. The amendment is an increase of $10,000.00
for continuing services.
CSAH 38 Construction Project
Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an agreement between the County of Otter Tail and Widseth Smith Nolting
for construction staking and inspection services on SAP. 056-638-007.
COUNTY STATE AID HIGHWAY NO. 9 RIGHT OF WAY ACQUISITION
Project No. S.A.P. 056-609-005
Parcel Nos. 50, 67, 69, 78, 85, 90 & 94
Otter Tail County Resolution No. 2016 -12
Upon a motion by Commissioner Johnson, seconded by Commissioner Lindquist and unanimously carried,
the Otter Tail County Board of Commissioners adopts the following resolution:
WHEREAS, Otter Tail County proposes to reconstruct and improve County State Aid Highway No. 9,
running from South Pelican Drive, North & East 2.33 miles to the North County Line, and located in
Sections 1, 2, and 11 of T137N-R43W; and
WHEREAS, the reason for the construction of this segment of County State Aid Highway No. 9 is due to
the existing highway's poor condition and the construction of entrances, medians and sidewalk; and
WHEREAS, this improvement is necessary to provide for the safety of the traveling public and pedestrians;

WHEREAS, Otter Tail County has a right to acquire the right of way after an award of damages has been
filed with the County Auditor in accordance with Minnesota Statute, Section 163.02 and 163.12; and
WHEREAS, all necessary additional highway rights of way and/or temporary construction easements have
been acquired for this reconstruction except for 6 tracts:
A) tract owned by David 0. Soderholm and Adair L. Soderholm, husband and wife, as joint tenants,
an undivided (1/2) interest; and Edward G. Johnson, an undivided (1/2) interest. Tract being a
strip of land described as follows:
Those parts of Lots 1, 2, 3, 4, 5 and 6, Block 4, PELICAN BEACH, plat of which is on file in the Office of
the Recorder, Otter Tail County, Minnesota shown as PARCEL 50 on the OTTER TAIL COUNTY
HIGHWAY RIGHT OF WAY PLAT NO. 26, County State Aid Highway No. 9, as the same is on file and of
record in the Office of the County Recorder in and for Otter Tail County.
Excepting therefrom right of way of existing highways.
Containing 1,889 square feet, more or less.
Also, a temporary construction easement which will cease on December 31, 2017, as described below:
Those parts of Lots 1, 2, 3, 4, 5 and 6, Block 4, PELICAN BEACH, plat of which is on file in the
Office of the Recorder, Otter Tail County, Minnesota, shown as C.E. PARCEL 50 on the plan

of the Recorder, Otter Tail County, Minnesota; all together shown as
C.E. PARCEL 90 on the plan view of the Plan and Profile sheets of the Construction Plan for
S.A.P. 056-609-005. The outer limits of said C.E. PARCEL 90 are established at 5 feet offset
from and at right angles to the cut and fill limit lines.

VIEW, more or less.
F) tract owned by Norman John Family Limited Partnership of Henderson, NV.
Said tract having strips of land described as follows:
A temporary construction easement which will cease on December 31, 2017, as described below:
That part of Government Lot 3 and the SE1/4 of the NW1/4, Section 1, Township 137 North, Range 43
West, shown as C.E. PARCEL 94 on the plan view of the Plan and Profile sheets of the Construction
Plan for S.A.P. 056-609-005. The outer limits of said C.E. PARCEL 94 are established at 5 feet offset
from and at right angles to the cut and fill limit lines.
Containing 14,774 square feet, more or less.
Due to the reconstruction and realignment of County State Aid Highway No. 9 under Project No. S.A.P.
056-609-005, said strips being all those described above, to be retained for CSAH No. 9 right-of-way
recorded as Parcel Nos. 50, 67, 69, 78, 85, 90 & 94 on Sheets 4-7 of 7 of CSAH No. 9 Right of Way Plat
No. 26.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
authorizes the acquisition of the requested right of way as described above pursuant to Minnesota Statute,
Section 163.02 and 163.12, and to take title and possession of that land after an award of damages has
been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; including the
"Quick-Take" provisions provided for in Minnesota Statute 117.042.
BE IT FURTHER RESOLVED that the Otter Tail County Attorney is authorized to file the necessary
documents in court, and represent the county in this matter.

Legislative Initiatives Discussion
Commissioner Johnson opened discussion about Otter Tail County's legislative initiatives for the upcoming
session. Commissioners talked about important topics to Otter Tail County including Transportation, Rural
Broadband, and the status of the C.A.R.E. facility. Discussion continued. Motion by Johnson, second by
Lindquist, and unanimously carried to direct Administrator Larry Krohn to reach out to Division Directors
and request, that they identify two critically important items for their Division that may be affected by
legislative action. Additionally, the motion requests that Mr. Krohn develop a one page flyer with these
legislative priority items and determine the best way for Otter Tail County to reach out to legislators as the
identified priority items pass through the legislative process. Motion by Johnson, second by Froemming,
and unanimously carried to request that the Administrator prepare, in advance, for a meeting with County
legislators mid to late April for Otter Tail County to comment on these priorities and corresponding bills
being considered at that time.
Motion by Lindquist, second by Froemming, and unanimously carried to request that Economic
Development Director, Nick Leonard, organize a meeting and spearhead discussion with communication
providers and other stakeholders in an effort to increase broadband services in rural Otter Tail County.
Mr. Leonard also updated the Board on progress with the proposed daycare initiative.
Appreciation Expressed
Motion by Froemming, second by Johnson, and unanimously carried to send a letter of appreciation to the
Otter Tail County Sheriffs office for their officer's bravery and strength in the face of often dealing with
people at their worst and for working every day to keep our community as safe as possible.
Adjournment
At 1 :34 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 9:30 a.m. on Tuesday, March 1, 2016 at the Government Services Center in Fergus Falls,
MN.
