Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, December 22, 2015, at
the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist and Commissioners
Wayne Johnson, Doug Huebsch, and Roger Froemming present. Vice-Chair Lee Rogness was absent.
Approval of Agenda
Chairman Lindquist called for approval of the December 22, 2015, agenda. Motion by Froemming, second
by Johnson, and unanimously carried to approve the Board of Commissioners agenda of December 22,
2015 with the following additions:

Ditch 44 Findings and Order
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Findings of Fact and Order of Redetermination of Benefits in the Matter
of County Ditch No. 44 as submitted by the County Attorney. The Order adopts the Amended Viewers'
Report as submitted at the Public Hearing on Tuesday, December 15, 2015.
Non-Union 2016 Cost of Living Adjustment {COLA)
Motion by Johnson, second by Huebsch, and unanimously carried to approve a 3% COLA for non-union
employees effective January 1, 2016. This COLA follows other groups' salary increases and is included in
the 2016 approved County Budget.
Final Plat -"Coleman Estates"
Motion by Froemming, second by Huebsch, and unanimously carried to approve the Final Plat of Jody D.
and Leisha M. Coleman titled Coleman Estates, a twelve lot subdivision located in Section 1 of Clitherall
Township, West Battle Lake (56-239).
Proposed Revisions to SMO, SC and Proposed Dock Ordinance
Land & Resource Director, Bill Kalar submitted the most recent draft Shoreland Management Ordinance
(SMO) and Sanitation Code (SC). He reported that the Public Works Committee met December 16, 2015
and he reviewed the revisions discussed at that meeting. County Attorney David Hauser submitted a
revised draft Dock Ordinance. Mr. Hauser submitted a revised Notice for the Public Hearing scheduled at
2:00 p.m. on Tuesday, January 19, 2016.

Civil Process Fees
Motion by Huebsch, second by Froemming, and unanimously carried to approve the Otter Tail County
Sheriffs Office Civil Process Fee-for-Service Schedule (Attachment B) as presented by the Sheriff and
dated December 22, 2015.
A'viands, LLC Detention Facility Meal Contract
Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute Amendment Number Ten to the Food Service Management Agreement
between the County of Otter Tail and A'viands, LLC effective January 1, 2016 as submitted.
Public Health Nurse Position
Motion by Huebsch, second by Froemming, and unanimously carried to approve a .4 FTE PHN-Health
Care Initiative Coordinator position. The position will be funded by a recent grant to the
PartnerSHIP4HealthCHB to further the work of the SHIP program to work with community organizations to
build support for lifestyle change, particularly for those at high risk, supporting diabetes, heart disease, and
stroke prevention efforts.
Forgiveness of Penalty Requests
Motion by Huebsch, second by Froemming, and unanimously carried to deny the following requests for tax
penalty forgiveness:
Lawrence & Lisa Homuth, Parcel #54-000-22-0149-001, 2nd half late payment penalty of $90.80
Craig Vaughn, Parcel #13-000-30-0198-001 , 2nd half late payment penalty of $43.80
County Credit Card Request
Motion by Johnson, second by Huebsch, and unanimously' carried to approve the issuance of a County
credit card, having a 30 day limit of $1,000, to Deputy Sheriff, Kelly Douglas Backman, as requested by the
Otter Tail County Sheriff.
HRA Board Reappointment
Motion by Froemming, second by Johnson, and unanimously carried to reappoint Ralph Hemmerlin to the
Otter Tail County Housing and Redevelopment Authority (HRA) Board for the term of August 1, 2015
through August 1, 2020.
Quit Claim Deed -Dalton Garage Property
Motion by Lindquist, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to sign the Quit Claim Deed conveying the following described property (also known as
the Dalton Garage) to Cary M. and Anita M. Aasness: That part of the Northwest Quarter of the Southeast
Quarter, Section 11, Township 131, Range 42, Otter Tail County, Minnesota, described as follows:
Commencing at the northwest corner of Lot 6, NEW HOME ADDITION TO DAL TON, according to
the recorded plat thereof; thence South 00 degrees 17 minutes 18 seconds East (bearing is based
on Otter Tail County Coordinates -1996 Adjustment) along the west line of said NEW HOME
ADDITION TO DAL TON, a distance of 17.00 feetto the intersection with a line 50.00 feet southerly
of, as measured at a right angle to and lying parallel with, the centerline of County State Aid
Highway No. 12, the point of beginning of the land to be described; thence South 89 degrees 08
minutes 13 seconds West along said parallel line, a distance of 155.38 feet to a point of curvature in

to approve payment of the Otter Tail County Commissioners' bills from December 23, 2015 through

RESOLUTION ADOPTING GRACE PERIOD FOR IMPLEMENTATION OF UNIFORM ADMINISTRATIVE
REQUIREMENTS (PART 200)
(Code of Federal Regulations -Title 2 Grants and Agreements -Part 200 -Subpart D -Post Federal
Award Requirements)
(Procurement Standards -Sections 200.317 through 200.326)
Otter Tail County Resolution No. 2015 -86
Upon a motion by Johnson, seconded by Huebsch and unanimously carried, the following resolution was
adopted:
WHEREAS, Otter Tail County has recently become aware that the Uniform Administrative Requirements
for Federal Programs/Awards has become effective for most, if not all, of Otter Tail County's 2015 and
future Federal Grants, and
WHEREAS, the Procurement Standards contained within Part 200 Subpart D Sections 200.317 through
200.326 require Otter Tail County to have a written procurement policy which reflect applicable State and
Local statutes, rules and regulations and conforms to applicable Federal statutes and the procurement
standards/requirements as identified in Part 200 Subpart D Sections 200.317 through 200.326, and

WHEREAS, Otter Tail County does have a Contract Administration Guideline Policy, which was adopted
by the Otter Tail County Board of Commissioners on Tuesday, March 4, 2014, and
WHEREAS, Otter Tail County's Contract Administration Guideline Policy does comply with State and Local
statutes, rules and regulations, and
WHEREAS, Otter Tail County desires to review and updated, as needed, the County's Contract
Administration Guideline Policy and other applicable County policies, if any, to conform with applicable
Federal statutes and the procurement standards/requirements as identified in Part 200 Subpart D Sections
200.317 through 200.326, and
WHEREAS, Otter Tail County was made aware through the Office of the State Auditor of a technical
correction, which grants a two year extension for full compliance with the procurement
standards/requirements as identified in Part 200 Subpart D Sections 200.317 through 200.326, and
WHEREAS, Otter Tail County desires to adopt on or before December 31, 2016 written policies and
procedures to ensure conformity and compliance with the Code of Federal Regulations Title 2 Grants and
Agreements -Part 200 Subpart D -Post Federal Award Requirements specifically related to Procurement
Standards -Sections 200.317 through 200.326.
NOW, THEREFORE, BE IT RESOLVED, to allow adequate time to review and update existing policies and
procedures to comply with the requirements noted above, Otter Tail County by this resolution is formally
opting to exercise the two year extension granted by the technical correction and will adopt policies and
procedures related to procurement that are in conformity and compliance with the Code of Federal
Regulations Title 2 Grants and Agreements -Part 200 Subpart D -Post Federal Award Requirements
specifically related to Procurement Standards -Sections 200.317 through 200.326.

Off Sale Liquor License Request
A Public Hearing for a request to receive an Off-Sale Liquor License from Playtime Bar and Grill was set at
11 :00 .m. on Tuesday, February 9, 2016. This Public Hearing will be at a regular County Board meeting
located at the Government Services Center in Fergus Falls, MN.
HENNING SAFE ROUTES TO SCHOOL PLANNING
SPONSORING AGENCY
Otter Tail County Resolution No. 2015 -87
Upon a motion by Froemming, seconded by Johnson and unanimously carried, the following resolution
was adopted:
BE IT RESOLVED THAT: Otter Tail County agrees to act as sponsoring agency for a "Transportation
Alternatives" project identified as Henning Safe Routes to School Planning Assistance Grant and has
reviewed and approved the project as proposed. Sponsorship includes a willingness to secure and
guarantee the local share of costs associated with this project and responsibility for seeing this project
through to its completion, with compliance of all applicable laws, rules and regulations.

BE IT FURTHER RESOLVED THAT: Richard K. West, P.E., County Engineer is hereby authorized to act
as agent on behalf of this sponsoring agency.

HENNING SAFE ROUTES TO SCHOOL PLANNING
AGREEMENT TO MAINTAIN FACILITY
Otter Tail County Resolution No. 2015 -88
Upon a motion by Froemming, seconded by Johnson and unanimously carried, the following resolution
was adopted:
WHEREAS: The Federal Highway Administration (FHWA) requires that states agree to operate and
maintain facilities constructed with federal transportation funds for the useful life of the improvement and
not change the use of right-of-way or property ownership acquired without prior approval from the FHWA;
and
WHEREAS: Transportation Alternatives projects receive funding; and
WHEREAS: the Minnesota Department of Transportation (Mn/DOT) has determined that for projects
implemented with alternative funds, this requirement should be applied to the project proposer; and
WHEREAS: Otter Tail County is the sponsoring agency for the Transportation Alternatives project
identified as Henning Safe Routes to School Planning Assistance Grant.
THEREFORE BE IT RESOLVED THAT: the sponsoring agency hereby agrees to assume full
responsibility for the operation and maintenance of property and facilities related to the aforementioned
Transportation Alternatives project.

Commissioner Johnson offered the following and moved its adoption:

WHEREAS, Minnesota Statutes 375.055 provides that County Commissioners may receive per diem
payments and reimbursement for necessary expenses incurred in performance of the duties of the office
and shall receive compensation of annual salaries, as set by resolution of the County Board; and
WHEREAS, the current annual salary for Otter Tail County Commissioners is $34,878.00 effective
January 1, 2015; and
NOW, BE IT RESOLVED, that the annual salaryJor Otter Tail County Commissioners shall be established
as $35,924.00 effective January 1, 2016 which reflects a 3% Cost-of-Living Adjustment similar to increases
received by other emploxee groups.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the annual benefits compensation for CY2016
will be set at $1,150.00 per month, similar to increases received by other employee groups.

County Program Aid
Administrator Larry Krohn presented a packet including the CPA formula compared to 2015 and 2016
certified CPA values. Discussion followed.
Detoxification Services
Productive Alternatives, Inc. (PAI) has provided detox services in Fergus Falls since 2006. PAI has
recently announced that they will no longer provide the service effective 01/01/2016. Community Services
Director, John Dinsmore submitted an overview of the Productive Alternatives, Inc. Detoxification Center
program and planning recommendations to continue the services in Fergus Falls. Mr. Dinsmore reported
that County Officials have held a series of meetings with various individuals and groups who may have an
interest in continuing detox services, possibly through a partnership of various providers. Mr. Dinsmore
reviewed 5 recommendations to provide continuous, uninterrupted detox services. Human Services
Director, Deb Sjostrom and Public Health Director, Diane Thorson, requested funding to allow PAI to apply
for licensure for CY2016. Ms. Thorson estimated that it would take 6 months for completion of the required
contracts to transfer services from PAI to Otter Tail County. Discussion took place regarding the debt on
the Detox building. Motion by Johnson~ second by Froemming, and unanimously carried to authorize
$3,000 from the Human Services Budget to fund the cost of CY2016 license renewal for Detoxification
services on behalf of PAI to give Otter Tail County the opportunity to explore all options.
Emergency Operations Plan
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signature on the Otter Tail County EOP revised December 2015 and on the Homeland Security
and Emergency Management (HSEM) Local Emergency Operations Plan Review Form as submitted by
the County Emergency Manager.
2016 Solid Waste Fee Schedule
Assistant Solid Waste Director, Zach Fjestad reviewed the proposed 2016 Solid Waste Fee schedule.
Commissioners discussed the proposed changes and upon a motion by Johnson, second by Froemming
and unanimously carried, the 2016 Solid Waste Fee schedule was approved as revised and included in
these minutes as Attachment C.
Regional Recycling Evaluation Discussion
Motion by Huebsch, second by Johnson, and unanimously carried to support a Regional Recycling Study
to evaluate a long term regional recycling plan. The MN Pollution Control Agency has agreed to pay for ½
of the total cost to a maximum of $50,000. The remainder would be funded by each participating County in
the region based on population.

Correction to December 1, 2015 Minutes
Motion by Johnson, second by Froemming, and unanimously carried to correct the minutes of December 1,
2015 as follows: On Page 1, under the Heading "Road & Bridge Fund";
Change "2016 Ford F450 1 ½ Tom @WO Crew Cab Pickup" to read "2016 Ford F450 1 ½
Ton 2WD Crew Cab Pickup" and change the Grand Total from $81,780.41 to $81,870.41.
LMHC Purchase of Service Agreement
Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Purchase of Service Agreement for Court Ordered Evaluation Services
for Otter Tail County Court Administration. The Contract is between Otter Tail County and Lakeland
Mental Health Center, Inc. with cost of the services remaining the same as 2015.
