Fir Avenue, Fergus Falls, MN November 24, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, November 24, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Wayne Johnson, Roger Froemming and Doug Huebsch present. Approval of Agenda Chairman Lindquist called for approval of the November 24, 2015, agenda. Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of November 24, 2015, with the following addition: Agreement with MN Dept. of Revenue for the Local Option Sales Tax Consent Agenda Motion by Johnson, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: 1. November 10, 2015, Board of Commissioners' Meeting Minutes 2. Warrants/Bills for November 24, 2015 (Exhibit A) 3. Issuance of County Credit Card with $1,000-30 Day Limit for Melissa Duenow, Public Health 4. Issuance of County Credit Card with $2,000-30 Day Limit for Michelle Fronning, Public Health 5. 2016 Tobacco License for Battle Lake Standard and Larry's Foods in Battle Lake 6. Human Services Bills & Claims SWCD Award/Meeting Dates County Administrator, Larry Krohn reported that Otter Tail County will be receiving an award from the Soil and Water Conservation Districts at their annual meeting December 8th. Motion by Rogness, second by Froemming, and unanimously carried to thank the SWCD's for the conservation award and to direct Mr. Krohn to ask the local SWCD Managers to accept the award on behalf of Otter Tail County due to a meeting conflict with the annual Association of Minnesota Counties (AMC). After discussion with the County Board, Mr. Krohn reported that the Otter Tail County Retreat will be Friday, January 15, 2015 at Thumper Pond. More details will be provided regarding the Retreat. Parking Lot for County Vehicles at the GSC Assistant County Attorney, Jeffrey Pabarcus presented a proposed 99 Year Lease Agreement between Otter Tail County and the City of Fergus Falls for the Government Service Center Parking Lot adjacent to and westerly of Circle Drive. Lengthy discussion took place regarding ownership of the Parking Lot area. Further research will take place to allow purchase of this parking lot with the Lease Agreement being an interim solution. Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Lease Agreement for the Government Service Center Parking Lot described as follows: That part of the Dedicated Road being 66 feet westerly of Lot 1, Block 2 Kirkbride Addition to the City of Fergus Falls as shown in orange of Exhibit A as presented. OTC Board of Commissioners' Minutes November 24, 2015 Page 2 AIS Specialist Memorandum of Understanding Motion by Huebsch, second by Froemming, and unanimously carried to approve the appropriate County Officials' signatures to execute a Memorandum of Understanding (MOU) between Otter Tail County and Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320, representing the Government Services Technical Unit. This MOU approves the addition of a position assignment titled "Aquatic Invasive Species (AIS) Specialist" funded by State AIS Preventive Aid. Recess & Reconvene At 9:52 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 10:00 a.m. Solid Waste Designation Ordinance Planning Process At 10:00 a.m., Chairman Lindquist opened the Public Hearing for the Solid Waste Designation Ordinance planning process with the following Solid Waste Department Managers present: Solid Waste Director, Mike Hanan; Assistant Solid Waste Director, Zach Fjestad; and Public Education Officer, Shannon Terry. Two members of the public were also present. Mike Hanan reviewed the purpose of the Public Hearing which is to begin the process that Otter Tail County and other member counties of Prairie Lakes Municipal Solid Waste Authority (PLMSWA) are undertaking to ultimately develop waste designation. The PLMSWA Board determined the need to implement waste designation in the Prairie Lakes area. As part of the process, PLMSWA has developed and submitted a plan to the State of Minnesota Pollution Control Agency (PCA). The plan is available on the Otter Tail County website. The PCA has indicated that the proposed plan for waste designation complies with state and federal laws. Waste designation is a process that indicates that waste generated in a specific area will be hauled to the entity indicated in the Ordinance. A public entity can direct waste to a publicly owned facility from within that public entity's boundaries. This Public Hearing is to offer the public an opportunity to comment on the process. Mr. Hanan indicated that an Ordinance and agreements with haulers will be developed. Haulers will have an opportunity to review the agreement. At 10:05 a.m., Chairman Lindquist opened the floor to public comment. No one from the public offered comment(s). Discussion took place regarding the main purpose of the proposed Ordinance which is to ensure that enough waste is delivered to the PLMSWA facility so it can continue to exist financially into the future for the common purpose of waste disposal/recycling. It was noted that tribal land cannot be included for purposes of a Waste Designation Ordinance. With no further comments, Chairman Lindquist closed the Public Hearing at 10:16 a.m. Farming Practices -Soils & Environment Motion by Huebsch, second by Johnson, and unanimously carried to authorize Commissioner Lee Rogness to attend an Agriculture Event in February 2016 located in Wilmar, MN sponsored by the Universities of Minnesota and North Dakota. MICA Report Chairman Lindquist reported on a recent MICA meeting. He discussed State surplus, wheelage tax, local option sales tax, transportation funding, jail overcrowding and reduction of drug possession offenses, MNsure and high risk groups, and adult foster care. OTC Board of Commissioners' Minutes November 24, 2015 Page 3 Muskie Management/Stocking Discussion Mike Johnson, representing the Lake Lizzie Lake Association and Dave Majkrzak, representing the Otter Tail County COLA and Pelican Lake, submitted several documents regarding muskie management, and more broadly, the MN DNR's Long Range Muskellunge 2020 plan. Mike Johnson's presentation provided a background of how three lakes in Otter Tail County (Lizzie, Franklin and Loon) were selected for muskie stocking. He indicated that the DNR met with muskie fishing advocates in Fargo/Moorhead to decide the fate of a lake in Otter Tail County. He expressed concern that the DNR will not listen to the Otter Tail County lake association groups even though the State DNR website indicates that the process for muskie stocking should be an open and transparent public input process. Muskie fishing and stocking statistics were provided and concern was expressed that some DNR statistics may be misleading. They cited possible reduction in tourism due to reduction in walleye fishing and safety issues as additional issues that have not been addressed. Mr. Johnson encouraged Otter Tail County to pass a resolution requesting that muskie stocking in Otter Tail County be halted immediately until the DNR follows their own 2020 plan by forming a committee that includes those most invested and impacted by muskie stocking, their people, and their representatives in Otter Tail County. Commissioners discussed the issues at length. Commissioner Huebsch expressed concern that there is not adequate science and evidence of what stocking muskies (not natural to the environment) is going to do to our lakes in the long run. Motion by Huebsch and second by Froemming to pass a resolution opposing the stocking of muskies in Otter Tail County until further research or evidence is found which shows no negative environmental impacts, including an Environmental Assessment Worksheet (EAW) and Environmental Impact Statement (EIS). Motion by Johnson and seconded by Rogness to table the motion regarding muskie stocking. Chairman Lindquist declared that this issue will be discussed at the County Board's regular meeting on Tuesday, December 15, 2015 to review proposed resolutions and avoid unintended consequences. Safe Communities Coalition Update Safe Communities Coalition Coordinator, Jane Patrick submitted a document titled "Otter Tail County 2015 TZD Safe Roads Coalition". This progress report included Coalition goals, crash reviews, contributing factors and trends. Public Works Director, Rick West talked about the County highway safety plan and trending results. Amendment No. 1 to Agreement for Bridge No. 56520 Motion by Huebsch, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute Amendment No. 1 to Engineering Services Agreement between Otter Tail County and Interstate Engineering, Inc. for the channel restoration project on Bridge No. 56520 on CSAH 1 over the Hoot Lake channel. PERHAM_ TO PELICAN RAPIDS REGIONAL TRAIL SPONSORING AGENCY Otter Tail County Resolution No. 2015-75 Upon a motion by Johnson, seconded by Huebsch and unanimously carried, the following resolution was adopted: BE IT RESOLVED THAT: Otter Tail County agrees to act as sponsoring agency for a "Transportation Alternatives" project identified as Perham to Pelican Rapids Regional Trail Project and has reviewed and approved the project as proposed. Sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations. Adopted at Fergus Falls, Minnesota, this 24th day of November 2015 Dated: __ 1_2--_-_l_-_!5' ___ _ OTTER TAIL COUN Attest: J, ~ Larry ~, Clrk By: PERHAM TO PELICAN RAPIDS REGIONAL TRAIL AGREEMENT TO MAINTAIN FACILITY Otter Tail County Resolution No. 2015-76 Upon a motion by Johnson, seconded by Huebsch and unanimously carried, the following resolution was adopted: WHEREAS.: The Federal Highway Administration (FHWA) requires that states agree to operate and maintain facilities constructed with federal transportation funds for the useful life of the improvement and not change the use of right of way or property ownership acquired without prior approval from the FHWA; and WHEREAS: Transportation Alternatives projects receive funding; and WHEREAS: the Minnesota Department of Transportation (Mn/DOT) has determined that for projects implemented with alternative funds, this requirement should be applied to the project proposer; and WHEREAS: Otter Tail County is the sponsoring agency for the Transportation Alternatives project identified as Perham to Pelican Rapids Regional Trail Project. THEREFORE BE IT RESOLVED THAT: the sponsoring agency hereby agrees to assume full responsibility for the operation and maintenance of property and facilities related to the aforementioned Transportation Alternatives project. Adopted at Fergus Falls, Minnesota, this 24th day of November 2015 Dated: __ I _~_-_l_-_t_s ___ _ ARD OF COMMISSIONERS Otter Tail County Master Transportation Plan Motion by Froemming, second by Rogness, and unanimously carried to approve Commissioners attendance at a presentation to the Upper Mississippi Valley Regional Development Commission on December 3, 2015 at the Appleton City Council Chambers. Otter Tail County Officials will present the process and development of the Transportation Master Plan. Caseworks MNsure Module OTC Board of Commissioners' Minutes November 24, 2015 Page 5 Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute an agreement between Otter Tail County and Next Chapter Technology, Inc. to purchase the Caseworks MNsure Module which is an electronic management system for MNsure claims and documents at a cost of $8,680. This module will provide better functionality to the MNsure system. Conduit Bond Fee Recommendation Tourism & Economic Development Director, Nick Leonard briefed the Board regarding the Schuett Conduit Bonding process. Motion by Huebsch, second by Rogness, and unanimously carried to reinvest the dollars collected from the 1 % fee on the total dollars bonded for the Schuett project into future economic development in Otter Tail County as recommended. Mr. Leonard will work with other County officials to develop a fund and create a policy for accessing the funds. Target date for completion is next spring. Sustainability Grant Nick Leonard reported that a CSC grant in rural sustainability has been received to assist in conducting research to better understand the economics of our declining resort industry. Recess & Reconvene At 11 :45 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for an Internal Services Committee meeting and lunch break. The meeting was reconvened at 12:46 p.m. LMPK & Devil's Lakes Outlet Project Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the following expenditures related to the Little McDonald Paul & Kerbs (LMPK) and Devil's Lake Outlet Project: Moore Engineering, Inc. Invoice Nos. 11276, 11423 & 11449 $24,505.96 Ohnstad Twichell, PC Invoice Nos. 138528 & 137340 $12.082.35 Total $36,588.31 Motion by Rogness. second by Froemming, and unanimously carried_ to approve charging the appropriate lake improvement district 4% interest on the funds advanced by the County from the date of payment until reimbursement is received from the State of Minnesota under the approved grant contract for the LMPK and Devil's Lakes Outlet Project. Ditch 5, 36 and 68 Motion by Froemming, second by Rogness, and unanimously carried to establish the Public Hearing for the Redetermination of Benefits for Ditch 5, 36 and 68 at 6:00 p.m. on Monday, January 25, 2016 at the City Hall in Henning. Local Option Sales Tax Agreement Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Agreement between the Minnesota Department of Revenue and Otter Tail County for collection of both a Local Transit Sales and Use Tax and a Transit Vehicle Excise Tax as presented by the Auditor-Treasurer.
