Fir Avenue, Fergus Falls, MN November 3, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, November 3, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness and Commissioners Wayne Johnson, Roger Froemming and Doug Huebsch present. Approval of Agenda Chairman Lindquist called for approval of the November 3, 2015 agenda. Motion by Huebsch, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of November 3, 2015 with the following additions: Proposed Order for Ditch 58 Redetermination of Benefits Discussion Regarding M.S. Chapter 103E Drainage Consent Agenda Motion by Rogness, second by Johnson, and unanimously carried to approve Consent Agenda items as follows: 1. October 27, 2015 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for November 3, 2015 (Exhibit A) 3. Approval of Otter Tail County Pawnbroker's License to Wayne's Pawn (subject to approval of Sheriff's Office) Increase of Laredo Fees Motion by Rogness, second by Johnson, and unanimously carried to increase Laredo plan fees to assist in covering the cost of the Fidlar Technologies software. The following fee increase will be effective January 1, 2016 as recommended by the County Recorder: Plan Selection Per Minute Monthly Subscriber Fee Min. Overage Fee Coov Fee Plan A 0-250 $82.50 .15perminute Free for 2016 Plan B 251-500 $108.75 .15perminute Free for 2016 Plan C 501-1000 $136.25 .15 per minute Free for 2016 Plan D 1001-2000 $161.25 .15 per minute Free for 2016 Plan E Unlimited $177.50 N/A Free for 2016 Drainage System -Repair vs. Improvement County Attorney, David Hauser briefed the Board on Minnesota Statutes Chapter 103E (Drainage) and discussed the definitions of improvement and repair of drainage ditch systems. Findings and Order for Redetermination of Benefits -Ditch 58 Motion by Huebsch, second by Froemming, and unanimously carried to approve the Chairman's signature to execute the Findings and Order for Redetermination of Benefits in the matter of the Redetermination of Benefits for Ditch 58 as presented by the County Attorney. MN Geological Survey Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Letter of Intent between the University of Minnesota and the County of Otter Tail for the Minnesota Geological Survey (MGS) program to establish accurate well locations. OTC Board of Commissioners' November 3, 2015 Page 2 Natural Resources Block Grant Agreement Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute the FY 2016/2017 NRBG Agreement (3000006240) between the State of Minnesota Board of Water and Soil Resources (BWSR) and the County of Otter Tail. Final Plat -Sunset Bay View Motion by Johnson, second by Rogness, and unanimously carried to approve the Final Plat owned by Marv Hexum titled "Sunset Bay View" consisting of five residential lake lots located in Section 6 of Dead Lake Township; Star Lake (56-385). Recess & Reconvene At 10:13 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 10: 17 a.m. Ditch 70 Engineer's Report and Ditch Viewers' Report Jeff Langan, from Houston Engineering, Inc. submitted the Engineer's Detailed Survey Report for a Drainage System Improvement on Otter Tail County Ditch No.70 and explained the proposed project. Mr. Langan reviewed the process which included a preliminary report, comments from the MN Department of Natural Resources and the public, completion of an Environmental Assessment Worksheet (EAW), the permit process, and archeological review which has culminated into the Final Report. He explained that the project is very similar as the preliminary report with a couple of changes involving the fish screen. The Final Report also defines the overflow section of the existing outlet. Motion by Rogness, second by Huebsch, and unanimously carried to establish the Public Hearing for Ditch No. 70 Improvement project at 7:00 p.m. on Monday, December 14, 2015 at the Government Services Center in Fergus Falls, MN. The Public Hearing is to present the Final Detailed Project Report, the Ditch Viewers' Report and the Redetermination of Benefits. The Final Report will be mailed to the MN DNR for their review and comments prior to the Public Hearing. SPEED ZONE STUDY REQUEST CSAH 51, OTTER TAIL COUNTY, MN Otter Tail County Resolution No. 2015 -73 Motion by Huebsch, second by Froemming, and unanimously carried to adopt the following resolution: WHEREAS, the City of Perham has requested that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on CSAH No. 51 from 9th Street NW to 450th Avenue be reduced to 30 MPH, AND WHEREAS, the City of Perham has also requested that on CSAH No. 51 from 450th Avenue and North to City Limits of Perham the speed be reduced to 45 MPH, AND WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in these areas. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. OTC Board of Commissioners' November 3, 2015 Page 3 Adopted at Fergus Falls, MN this 3rd day of November 2015 Dated: ___ /_l_-_f_O_~_t_5_-__ OT TAI CO Attest: _____..___.ln2~~"1--+----=•/ If_ Larry KTot{rl, c~ By:..:::..,..~~=~~=~~~i\.A<'.ir..!::l._ __ ' COUNTY STATE AID HIGHWAY NO. 9 RIGHT OF WAY ACQUISITION S.A.P. 056-609-005, PARCEL NO. 78 Otter Tail County Resolution No. 2015 -74 Upon a motion by Huebsch, seconded by Froemming, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Otter Tail County proposes to reconstruct and improve County State Aid Highway No. 9, located from South Pelican Drive, North & East 2.33 miles to the North County Line, located in Sections 1, 2, and 11 ofT137-R43W; and WHEREAS, the reason for the construction of this segment of County State Aid Highway No. 9 is due to the existing highway's poor condition and the construction of entrances, medians and sidewalk; and WHEREAS, this improvement is necessary to provide for the safety of the traveling public and pedestrians; and WHEREAS, Otter Tail County has a right to acquire the right of way after an award of damages has been filed with the County Auditor in accordance with Minnesota Statute, Section 163.02 and 163.12; and WHEREAS, all necessary additional highway right of way is being acquired for the reconstruction except a tract owned by Brent Cavallin of Samoa, CA Said tract being a strip of land described as follows: That part of Lot 12, ENGLE'S BEACH, shown as PARCEL 78 on the OTTER TAIL COUNTY RIGHT OF WAY PLAT NO. 26, County State Aid Highway No. 9, as the same is on file and of record in the Office of the County Recorder in and for Otter Tail County. Excepting therefrom right of way of existing highways. Containing 250 square feet, more or less. Due to the reconstruction and realignment of County State Aid Highway No. 9 under Project No. SAP. 056-609-005, said strip being all that described above, to be retained for CSAH No. 9 right-of-way recorded as Parcel No. 78 on Page 5 of 7 of CSAH No. 9 R/W Plat No. 27. Also a Temporary Construction Easement which will cease on or before December 31, 2017, as described below: That part of Lot 12, ENGLE'S BEACH, according to the recorded plat thereof, shown as CE PARCEL 78 on the plan view of the Plan and Profile sheets of the Construction Plan for SAP. 056-609-005. The outer limits of said CE PARCEL 78 are established at 5 feet offset from and at right angles to the cut and fill limit lines. Containing 2,578 square feet, more or less. OTC Board of Commissioners' November 3, 2015 Page 4 NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby authorizes the acquisition of the requested right-of-way as described above pursuant to Minnesota Statute, Section 163.02 and 163.12, and to take title and possession of that land after an award of damages has been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; including the "Quick-Take" provisions provided for.in M.innesota Statute 117.042. BE IT FURTHER RESOLVED that the Otter Tail County Attorney is authorized to file the necessary documents in court, and represent the county in this matter. After a discussion of the best way to assist with public transit funding in Otter Tail County, a motion was offered by Froemming, seconded by Johnson, and unanimously carried to contribute $20,000 to Productive Alternatives from the Highway Budget to be used for public transportation. The dollars will allow PA to leverage approximately $100,000 of State funding. The City of Fergus Falls and City of Perham are also contributing to support PA's public transit system.
