Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, October 27, 2015, at
the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair
Lee Rogness and Commissioners Wayne Johnson, Roger Froemming and Doug Huebsch present.
Approval of Agenda
Chairman Lindquist called for approval of the October 27, 2015 agenda. Motion by Rogness, second by
Froemming, and unanimously carried to approve the Board of Commissioners agenda of October 27, 2015
with the following modifications:
Add Human Services DWI Court Contract
Cancel Request for Approval of Final Plat
Consent Agenda
Motion by Huebsch, second by Johnson, and unanimously carried to approve Consent Agenda items as
follows:

4. Approval of Tobacco Licenses for City of Dalton, Elizabeth General Store,

Child Care Summit
Motion by Johnson, second by Rogness, and unanimously carried to clarify that the funding, up to $7,500,
for the Child Care Summit held October 27, 2015 in Battle Lake, MN, is payable to the United Way.
Employer Benefit Contribution
Motion by Johnson, second by Rogness, and unanimously carried to approve $1,150.00 per month for the
2016 non-union benefit employer contribution.
Public Information Meeting
Commissioners discussed the upcoming public information meeting to gain public input regarding
proposed changes to the Shoreland Management Ordinance (SMO), Sanitation Code, and to gain input on
a proposed Dock Ordinance. Comments on proposed changes posted on the Otter Tail County website
may be provided at the meeting on November 2, 2015 at the Government Services Center in Fergus Falls,
MN or comments may be submitted in writing.
Proposed Solid Waste Designation Ordinance
Solid Waste Director, Mike Hanan submitted a proposed Solid Waste Ordinance and draft public notice.
Motion by Rogness, second by Huebsch, and unanimously carried to set the Public Hearing for
consideration of the proposed Solid Waste Designation Ordinance at 10:00 a.m. on Tuesday,
November 24, 2015.

Addendum to CodeRED Contract
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Addendum to the CodeRED Next Services Agreement. The Addendum
includes 911 Data Updates to the CodeRED system four times per year.
Central MN Emergency Management Advisory Committee
Motion by Rogness, second by Froemming, and unanimously carried to approve the reappointment of
Emergency Management Director Patrick Waletzko and Chief Deputy Stacy Paulseth to the Central MN
Emergency Management Advisory Committee.
ADOPTION MONTH NOVEMBER 2015
Otter Tail County Resolution No. 2015 -70
WHEREAS, the family, serving as the primary source of love, identity, self-esteem and support, is the very
foundation of our communities, our state, and our country; and
WHEREAS, adoption gives children who have been orphaned, abandoned, or abused a precious second
chance at happiness; a chance to love and be loved and to reach their full potential in a secure, supportive
environment; and
WHEREAS, as of September 1, 2014, there are 804 children under state guardianship, many waiting to be
adopted into a family; and
WHEREAS, the majority of the families seeking children for adoption are pursuing the adoption of younger
children. In 2014, of the children waiting to be adopted in the State of Minnesota, 40% were 12-18 years
old; 27% were 6-11 years old; 33% were under 6 years old. Of the children waiting to be adopted, 61%
are siblings who need to be adopted together. The majority of children who come under the Guardianship
of the Commissioner of Human Services have been abused or neglected and have mental health issues.
WHEREAS, there is a continued need for an increased number of families in the State of Minnesota and in
Otter Tail County who will adopt older children with special needs; and
WHEREAS, both the public and private sectors are working together as a "team" to find adoptive homes
for the children throughout the counties and the State of Minnesota; and
NOW, THEREFORE, we, The Otter Tail County Board of Commissioners, by virtue of the authority vested
in us as County Commissioners of Otter Tail County, do hereby proclaim November as Adoption Month in
Otter Tail County. In honor of this event, we encourage community agencies, religious organizations,
businesses and others to celebrate adoption, honor families that grow through adoption, further an
awareness of the changes and issues in adoption, and focus attention on those children who live in the
shadow of an uncertain future while they await permanent families.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Froemming,
seconded by Commissioner Johnson, and unanimously carried.

Child Foster Care and Adoption Report
Human Services Supervisor, Melanie Courrier submitted a Child Foster Care and Adoption report. There
are currently twenty-four homes licensed for child foster care with eleven newly licensed in 2015.
Discussion took place regarding the challenges of providing foster care for children especially those with
high needs. Commissioners requested more frequent updates and documentation of foster care and
adoption services that are provided by other organizations in Otter Tail County.
DWI Court Agreement with Human Services
Motion by Froemming, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Agreement for Professional Services between the State of Minnesota,
Seventh Judicial District and Otter Tail County Human Services for the DWI Court program. The contract
is effective for the period of October 1, 2015 through September 30, 2016 (FY16).
Recess & Reconvene
At 10:23 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The meeting was reconvened at 10:29 a.m.

Motion by Huebsch, second by Froemming, and unanimously carried to approve reimbursement from the

Tourism & Economic Development Director, Nick Leonard updated the Board regarding the Schuett Bond
proposal. The Housing and Redevelopment Authority (HRA) adopted their required resolution pending the
joint public hearing scheduled for November 10, 2015 with the County Board.
DNR Meeting -Muskie Management Program
Motion by Rogness, second by Johnson, and unanimously carried to approve Commissioners attendance
at a State Department of Natural Resources meeting regarding their Muskie Management Program.
LMKP/DLD Project Agreement
A motion was offered by Huebsch and seconded by Johnson to authorize the appropriate County Officials'
signatures to execute an Agreement between the Little McDonald, Kerbs and Paul Lakes Improvement
District (LMKP LID), the Devils and Little Devils Lake Improvement District (DLD LID) and Otter Tail County
for the LMKP/DLD Outlet Project. Chairman Lindquist called for a roll call vote with members voting as

Motion by Rogness, second by Huebsch, and unanimously carried to approve a new position, Aquatic
Invasive Species (AIS) Specialist, in the Land & Resource Management Department funded through the
Local AIS Prevention Aid as presented by the Human Resources Director. Ms. Hansen will schedule a
meet and confer with the Government Services Technical (GST) union.
Class Action Lawsuit Settlement
Motion by Huebsch, second by Froemming, and unanimously carried to accept a class action settlement
check, in the amount of $21.89, in the matter of time sensitive delivery of packages by the United Postal
Service (UPS).
Planning Commission Reappointments
Motion by Johnson, second by Huebsch, and unanimously carried to reappoint Brent E. Frazier (District 2)
and Jack Rosenthal (District 1) to the Otter Tail County Planning Commission effective January 1, 2016 for
a three year term.
Planning Commission Recommendations
Conditional Use Permit -Lance Bergstrom:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for an after-the-fact earth moving project as submitted on the revised plan received by the Land &
Resource Management office on September 23, 2015. The Landscape Architect must oversee the project
and the project may not begin prior to April 15, 2016. The project is located in Pt of NW¼NE¼ & GL 1,
Section 10 of Eagle Lake Township; Eagle Lake (56-253), GD.
Conditional Use Permit -Patrick S. & Pamela Honer:
Land & Resource Director, Bill Kalar reported that the Planning Commission recommended denial of this
after-the-fact request to remove an ice ridge and place spoils in a wetland. Lengthy discussion took place
with the applicants regarding the ice push that caused the debris and the high ridge, the need to move their
dock away from the public access side of the property and the Wetland Conservation Act. Motion by
Johnson, second by Rogness, and unanimously carried to deny this project as presented. The Land &
Resource office will work with the applicants to develop a restoration plan regarding the ice ridge and
space for their dock. The applicants will work with WCA officials regarding restoration of the wetland. The
project is located in Pt GL 1, Section 35 of Dora Township; Star Lake (56-385), GD.
Preliminary Plat & Conditional Use Permit-Wylie's Realignment/Susan Risher & Marty & LaRae Danielson:
Motion by Froemming, second by Johnson, and unanimously carried to approve the Preliminary Plat
known as "Wylie's Realignment" consisting of 2 single family residential lots and 1 non-residential lot and a
Conditional Use Permit to build a road to service the plat as submitted in a revised plan dated October 14,
2015. Work is authorized this fall prior to November 15, 2015. The project is located in Part of GL 3 and
Lots 1 -6, Rose Lake Beach Wylie's Addition, Section 22 of Hobart Township; Rose Lake (56-360), RD.
Preliminary Plat-Lenius Beach Backlots Addition/Linda J. Miller and Dale & Karen Bucholz:
Motion by Huebsch, second by Rogness, and unanimously carried to approve the Preliminary Plat titled
"Lenius Beach Backlots Addition" consisting of 3 non-residential backlots to be permanently attached to
riparian lots as presented and recommended by the Planning Commission. The project is located in Pt of
GL 4, Section 2 of Edna Township; Little McDonald Lake (56-328), GD.
Conditional Use Permit-Bernie & Rhonda Ness:
Motion by Huebsch, second by Johnson, and unanimously carried to approve a Conditional Use Permit for
this topographic alteration project to reshape the shore impact zone to direct drainage away from the lake
as presented and recommended by the Planning Commission. The project is located on Lot 8 Blk 1 Scalp
Lake Acres, Section 7 of Hobart Township; Scalp Lake (56-358), RD.

Conditional Use Permit -East Silent Resorl:
Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for
a grade and fill project which is part of the Resort's on-going renovation project as presented. The project
may be completed this fall. The project is located in Pt GL 1 & 2, Section 33 of Dora Township; East Silent
Lake (56-517), RD.
Conditional Use Permit-Larry Kohler and Todd Kohler:
Motion by Huebsch, second by Froemming and carried, with Johnson abstaining, to add 2 campsites as
presented and recommended by the Planning Commission. The project is located in Pt of GL 8 E of Hwy
& S of River, Section 2 and Pt of GL 1, Section 11 of Dunn Township; Pelican River (56-PR), AG and
Pelican Lake (56-786), GD.
Conditional Use Permit-Craig & Michele Emerson:
Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit
for this earth moving project as presented and recommended by the Planning Commission. The project is
located on Lot 1 Block 1 Froslee Shores, Section 35 of Girard Township; East Battle Lake (56-138), RD.
University of MN Extension Service Memorandum of Understanding
Community Services Director, John Dinsmore reported that a County Administrative Assistant position will
be eliminated while a new position with the University of Minnesota will be part of the new agreement
between the U of MN and Otter Tail County. He explained how current duties of the Administrative
Assistant position will be redirected to the new position and existing coordinators. Commissioners
discussed possible solutions to creating more vibrant County Fairs throughout the State. Motion by
Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials'
signatures to execute the Agreement between the University of Minnesota and Otter Tail County for
providing Extension programs locally and Employing Extension Staff. This is a three year agreement
(2016 through 2018) with a 6.75% salary increase over the term of the agreement.
Recess & Reconvene
At 11 :43 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a committee meeting and lunch break. The meeting was reconvened at 1 :04 p.m. with Commissioners
Lindquist, Huebsch and Froemming present. Commissioners Johnson and Rogness were present at
1:08 p.m.
Planning Commission Reappointment
Motion by Froemming, second by Huebsch and carried, with Johnson and Rogness absent, to reappoint
David Wass (District 3) to the Otter Tail County Planning Commission for a three year term effective
January 1, 2016.
County Drainage Systems
Ditch 63:
Motion by Johnson, second by Froemming, and unanimously carried to award a tile replacement project to
DM Enterprises, in the amount of $6,000.00, consisting of removing and replacing about 700 ft. of 12" tile
at existing grade across Gary Wilde's property in County Ditch 63. The proposal includes payment for the
work as follows: Ditch 63 Fund -$2,000.00; Lee Uhlig $2,000.00; and Dale Boese $2,000.00

Ditch Inspector, Kevin Fellbaum reported that contractors hired by Daryl Velo replaced an open channel
with 15" tile in Ditch 56 in Section 16 of Trondhjem Township. Motion by Huebsch, second by Rogness,
and unanimously carried to authorize an after-the-fact approval for the work completed by Lavigne Ag
Tiling in Ditch 56 because the repair will not affect the functionality of the Ditch and permits were received
by the NRCS. Property owners and contractors were unaware that this area was part of County Ditch 56.
Ditch 56:
Motion by Rogness, second by Johnson, and unanimously carried to award a ditch cleaning project (red &
yellow on map) on Kevin Brendan's property in Ditch 56 in Trondhjem Township to OM Enterprises at a
cost of $150/hour as submitted by the Ditch Inspector. The project creates an opportunity to include buffer
strips on the outlet end of the County Ditch.
Emergency Management Training for Senior/Elected Officials
Joe Kelly, Director of Homeland Security and Emergency Management (HSEM), provided a brochure titled
"Emergency Management Handbook for Government Officials" and briefed Commissioners and other
senior managers on their roles and responsibilities during a disaster.
