OTTER TAIL COUNTY BOARD OF COMMISSIONERS
Government Services Center, Commissioners' Room

9:30 a.m.
Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, October 13, 2015, at
the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair
Lee Rogness and Commissioners Wayne Johnson, Roger Froemming and Doug Huebsch present.
Approval of Agenda
Chairman Lindquist called for approval of the October 13, 2015 agenda. Motion by Johnson, second by
Rogness, and unanimously carried to approve the Board of Commissioners agenda of October 13, 2015
with the following additions:
Discussion Regarding Lake Street
Discussion Regarding Road Access Policy
Consent Agenda
Motion by Huebsch, second by Froemming, and unanimously carried to approve Consent Agenda items as
follows:
1. October 6, 2015 Board of Commissioners' Meeting Minutes
2. Warrants/Bills for October 13, 2015 (Exhibit A)
3. Human Services Bills & Claims
4. Agreement for Professional Services between State of MN, Seventh Judicial
District & OTC Probation (FY2016)
5. Approve LG240B Application to Conduct Excluded Bingo by the Re-Use-It Thrift
Store, Perham, MN for an Event on Dec. 6, 2015 at The Cactus
6. Approve a 2016 Tobacco License for the Dalton Corner Store
Lake Street
Commissioners discussed issues with accessing Lake Street which is a dedicated public road without a
road authority. The road should not be blocked. This issue will be researched further.
Otter Tail County Historical Museum Update
Historical Society Executive Director, Chris Schuelke reported that the Society will be having their 88th
annual meeting soon. He provided statistics for activities provided throughout the County and the numbers
of people participating in the activities and visiting the museum. There were 4,100 hours of volunteer time
donated to the museum in the past year. Mr. Schuelke stressed the importance of history. He thanked the
Board for their support and is looking forward to Otter Tail County's 75th anniversary in 2018.
Indian Gaming Land
County Attorney, David Hauser briefed the Board on regulation of Indian Land. Mr. Hauser will reach out
to the Wt,ite Earth Nation Attorney. It is important that there is infrastructure to accommodate the
people/traffic coming in and to maintain cohesive relationships in the neighborhood.
Final Payment -Phase 2 Courthouse Remodel
Motion by Johnson, second by Rogness, and unanimously carried to approve Final Payment, in the
amount of $10,000, payable to Gast Construction for completion of the Phase 2 Courthouse Remodel
project.

Ordinance Discussion
Land & Resource Director, Bill Kalar submitted proposed language changes to the Shoreland Management
Ordinance (SMO) and Sanitation Code. For reference purposes, portions of the Statewide Standards for
Management of Shoreland Areas were also provided. Mr. Kalar reviewed and discussed the SMO
proposed changes.
Recess & Reconvene
At 11 :26 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The meeting was reconvened at 11 :31 a.m.
Private Cemetery
Gerry Schram, resident of Candor Township, spoke to the Board regarding vandals in their private
cemetery. Commissioners suggested some solutions to the issue of tipped over headstones and indicated
that there are no easy solutions because the area is very rural and secluded.
Child Care Assistance Program
Kelli Rohrer, from Lakes and Prairie Community Action, submitted an Otter Tail County Child Care
Assistance program report. The report indicated that usage has increased; however about 19% of the
child care allocation is expected to remain unused. The funding may be redistributed in the future to other
counties who have waiting lists for child care assistance. Commissioner Huebsch invited Ms. Rohrer to a
Child Care Summit in Battle Lake on October 22, 2015.
Minnesota Family Investment Program 2016-2017 Plan
Human Services Director, Deb Sjostrom provided the MFIP 2016-2017 Plan. This required biennial plan
was posted for a 30-day public comment period. Motion by Rogness, second by Froemming, and
unanimously carried to approve the MFIP 2016-2017 Plan for submission to the State of Minnesota
Department of Human Services.
Human Services Fiscal Quarterly Report
Ms. Sjostrom reviewed the most recent quarterly budget report for Human Services. She reported that the
Agency is expected be within budget at the end of 2015; although, out of home placement expenses are
projected to be 20% over budget. Discussion took place regarding services that could be provided for
children with serious and persistent mental illness in their homes before an out of home placement
becomes necessary.
Recess & Reconvene
At 11 :57 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for committee meetings and lunch break. The meeting was reconvened at 12:34 p.m.
Ordinance Discussion
At 12:34 p.m., Land & Resource Director, Bill Kalar reviewed proposed Sanitation Code changes. The
soils verification process will need further research. Motion by Rogness, second by Johnson, and
unanimously carried to schedule a public information meeting at 7:00 p.m. on Monday, November 2, 2015
at the Government Services Center in Fergus Falls, MN. The purpose of the meeting is to discuss
proposed changes to the Shoreland Management Ordinance, Sanitation Code for Subsurface Sewage
Treatment Systems and consideration of a Surface Water Ordinance.
Federal Boat & Water Grant
Motion by Froemming, second by Huebsch, and unanimously carried to approve the appropriate County
Officials' signatures to execute the 2015 State of Minnesota Federal Boating Safety Supplemental
Equipment Grant Agreement, in the amountof $26,100.00. The Otter Tail County Sheriff's office will use
the grant dollars for a new boat for water patrol. There is no match requirement for this grant.

Schuett Company Conduit Bond Update
Tourism and Economic Development Director, Nick Leonard reviewed the Schuett bond application which
initially included three apartment complexes in Otter Tail County. Mill Pond View Apartments in Pelican
Rapids has been removed from this bonding application. They are pursuing other financing options.
Kaleva and River Bend apartment complexes are ready to proceed with the bonding. Otter Tail County's
bond counsel presented the information to the Housing and Redevelopment Authority. A joint Otter Tail
County/HRA Board meeting is scheduled for November 10, 2015 to finalize financing for these remodel
projects.
Agreement for GASB 45 Reporting
Motion by Huebsch, second by Johnson, and unanimously carried to authorize the County Auditor-
Treasurer to sign the Agreement for Consulting Services with Hildi Inc. to complete the required
Governmental Accounting Standards for other postemployment benefits (GASB Statement 45).
NACO Annual Dues
Motion by Huebsch, second by Froemming, and unanimously carried to approve payment of the 2016
annual membership dues, in the amount of $1,146.00, to the National Association of Counties (NACO).
Otter Tail River State Water Trail Phelps Mill Portage
DNR Area Supervisor, Shawn Donais explained the DNR project to develop a take-out point on the Otter
Tail River on the upstream side of the Phelps Mill Dam and a designated put-in area below the dam. This
will assist water trail users at the Phelps Mill Park. Motion by Huebsch, second by Johnson, and
unanimously carried to approve the Otter Tail River State Water Trail Phelps Mill Portage project as
presented.
Negative EIS Declaration -CSAH 38 Project
Public Works Director, Rick West reported that an Environmental Assessment Worksheet (EAW) has been
prepared as part of the State environmental review process for the proposed CSAH 38 Reconstruction
project. The EAW was published and made available for comment from the. public and other agencies.
Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Negative Environmental Impact Statement (EIS) Declaration in the
matter of the mandatory EAW for CSAH 38 reconstruction from City of Urbank to City of Parkers Prairie.
Phelps Mill Dam Fish Passage Agreement
Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Professional and Technical Services Contract between the County of
Otter Tail and the State of Minnesota DNR for the Phelps Mill Dam Fish Passage project (SWIFT Contract
No. 100958).
Engineering Services -CSAH 15/CH 112
Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Agreement between the County of Otter Tail and Houston Engineering
for a Basin Outlet project on CSAH 15/CH 112.
Joint City/County Projects
Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Agreement between the County of Otter Tail, City of Fergus Falls and
Braun lntertec for gravel subgrade work, at an estimated cost of $4,215.00, on portions of Cascade St. and
Alcott and Summit avenues.

Road Access Control
Discussion took place regarding the need to add approaches or improve roadways when a development or
business increases traffic. Motion by Huebsch, second by Froemming, and unanimously carried to remand
road access/approaches discussion to the Public Works Committee.
Recess & Reconvene
At 1 :50 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The meeting was reconvened at 1 :54 p.m.
Drainage Systems -Ditch 63
Motion by Rogness, second by Johnson, and unanimously carried to authorize Wayne Mortenson to repair
two areas on the map submitted; 1) where red meets the yellow, and 2) the area indicated in green, in
Ditch 63 on his own property. Mr. Mortenson plans to hire DM Enterprises to perform the work at his
expense. The Ditch Inspector indicated that the water flows into a wetland, crosses Highway 18, flows
through tile and into Altner Lake so the repair should not affect other property owners.
Ditch Inspector, Kevin Fellbaum reported that Lee Uhlig and Dale Boese are seeking approval to perform
tile repair work on County Ditch 63 on their own properties at their expense. They would replace the
original tile with new tile at the same elevation as shown in the map presented. In order for the repairs to
function properly, there is an area on Gary Wilde's property that flows into Altner Lake that needs repair.
Discussion took place regarding the cost of the repair needed on the Wilde property. The Ditch 63
maintenance fund does not have enough money to pay for the repair. County Attorney David Hauser
explained that landowners who need a ditch repaired on some else's property must petition to request the
repair work under M.S. 103E.715.
Adjournment
At 2:34 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners
recessed until 9:30 a.m. on Tuesday, October 27, 2015 at the GSC in Fergus Falls, MN.
