MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room 515 W. Fir Avenue, Fergus Falls, MN October 6, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, October 6, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Wayne Johnson, Roger Froemming and Doug Huebsch present. Approval of Agenda Chairman Lindquist called for approval of the October 6, 2015 agenda. Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of October 6, 2015 with the following additions: Economic Development Report -Broadband Dog Bite Order Solid Waste Management Tax Resolution Finance (Budget) Committee Meeting Canceled Consent Agenda Motion by Johnson, second by Rogness, and unanimously carried to approve Consent Agenda items as follows: 1. September 22, 2015 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for October 6, 2015 (Exhibit A) USFWS Structure in County Ditch 32 Biologist, Shawn Papan explained that the US Fish and Wildlife Service (FWS) is working on a property east of Pelican Rapids in Pelican Township, in Sections 24 and 25, which contains a wetland restored in 1997. The FWS purchased a wetland easement and the rights to maintain (not drain) the property. There are about 57 acres of wetlands in this area owned by the Cook Waterfowl Foundation. A structure has failed and a portion of the southern part of the wetland (south of highway 108) has drained. While completing paperwork to proceed with replacement of the failed structure, Mr. Papan realized that this area is in County Ditch 32. There should have been a Petition for lmpoundment submitted to the County in 1997. That process was inadvertently overlooked. Mr. Papan submitted paperwork including an agreement with Cook Waterfowl Foundation, maps showing the location of the project, and proposed replacement of the structure along with some elevation data. Discussion continued regarding the correct process and need to make sure no one is harmed by the impoundment. Commissioners requested that the USFWS submit a Petition for lmpoundment in Ditch 32 and an engineering study to the County Board. County Geologic Atlas (CGAl Program MGS Geologist, Dale Setterholm showed a powerpoint presentation about the University of Minnesota CGA Program. A geologic atlas provides comprehensive geologic and hydrogeologic mapping and associated databases suitable for managing water and mineral resources. This is a useful tool for land use decisions. Mr. Setterholm discussed the process to gather information to build the databases. This starts with location of all wells in Otter Tail County. There are about 12,000 wells that need to be located. The State Health Department has locations for about 6,000 wells in the County. Mr. Setterholm showed a map of those counties who have completed their CGA and those counties in progress. He requested that Otter Tail County begin gathering well location data. Funding for the Minnesota Geologic Survey to begin their portion of the project is expected to be available in one year. OTC Board of Commissioners' Minutes October 6, 2015 Page 2 County Geologic Atlas Program continued: Motion by Rogness, second by Johnson, and unanimously carried to proceed with the Otter Tail County Geologic Atlas program as requested and, to appoint the following ad hoc committee to identify an action plan for location of wells within the County and return to the County Board: OTC Land & Resource Director, Bill Kalar; OTC Land Division Director, Brian Armstrong; WOTSWCD Manager, Brad Mergens; and EOTSWCD Manager, Darren Newville Proposed County Feedlot Program SWCD Managers, Brad Mergens and Darren Newville indicated that the Minnesota Pollution Control Agency (MPCA) is requesting a decision from the County to manage the proposed Otter Tail County Feedlot program. The program is currently managed by the State of Minnesota. Commissioners discussed the pros and cons of taking over the program from the State. Although it is a good program, funding is an issue along with the desire to grow agriculture in Otter Tail County. Commissioner Huebsch spoke in favor of local control. No action was taken to add the program; however, future opportunities were discussed. Dog Bite Hearing Order Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Finding of Fact and Order regarding the dog Harley owned by Scott Rolland Sibert as submitted by the County Attorney. Recess & Reconvene At 11 :10 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 11:17 a.m. · LCSC Board Member Position Motion by Froemming, second by Johnson, and unanimously carried to nominate Commissioner Doug Huebsch for a Lakes Country Service Cooperative (LCSC) Board position. Mr. Huebsch's current four year term ends December 31, 2015. Pomme de Terre River Association Update PdT Manager, Jared House submitted a written report and briefed the Board regarding the Pomme de Terre River Association funding, projects and programs. Grant dollars were identified along with the leveraged funds associated with the grants. Discussion took place regarding water quality monitoring and management of the data gathered by many different organizations. Mr. House indicated that the Minnesota Department of Natural Resources manages the data; however, coordination of gathering useful water monitoring data could be improved. Transfer of Funds Motion by Huebsch, second by Froemming, and unanimously carried to approve reimbursement from the Capital Improvement Fund to the Road and Bridge Fund for the following 2015 Budget Capital Expenditures: Three 2016 Mack GU713 Tandem Axle Cab & Chassis, etc. Fergus Falls Garage Salt/Sand Storage Building Parkers Prairie Garage Salt/Sand Storage Building 2015 Ford F450 1.5 Ton -2nd Crew Cab Pickup Fergus Falls Garage Lighting Upgrades Total $ 749,014.08 225,000.00 75,000.00 60,064.34 7.176.00 1,116,254.42 OTC Board of Commissioners' Minutes October 6, 2015 Page 3 SALE OF TAX FORFEITED LANDS Otter Tail County Resolution No. 2015-67 BE IT RESOLVED, by the Board of County Commissioners of Otter Tail County, Minnesota that all parcels of tax-forfeited land included on the "Final List of Tax-Forfeited Lands for Public Sale" document as submitted by the Auditor-Treasurer, be approved and authorization for a pubic and/or private sale of this land be granted, pursuant to Minn. Stat. §282.01: that the Public sale will be held at 9:00 A.M., Wednesday, December 16, 2015, and that the Private sale will be held at 1:00 P.M., Wednesday, December 16, 2015, by the Otter Tail County Auditor-Treasurer in the County Board/Otter Tail lake Rooms in the Otter Tail County Government Services Center, for not less than the basic sale price; and that all sales shall be full cash payment per the terms set forth in the Notice of Public/Private Sale of Tax-Forfeited Lands. Upon motion by Huebsch and seconded by Rogness, the foregoing resolution was adopted on a roll call vote as follows: Board Members - Doug Huebsch Wayne D. The meeting was reconvened at 1 :34 p.m. PaintCare Agreement Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement between the Otter Tail County Regional HHW Program (counties of Grant, Otter Tail, Stevens, Traverse, Wadena, & Wilken) and PaintCare, a Delaware Corporation. The Agreement provides reimbursement to Otter Tail County for the appropriate collection and disbursement of paint by way of a MPCA program administered by PaintCare. Cooperative Agreement for Waste Pesticide Collection Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement between the State of Minnesota Department of Agriculture and the Regional Household Hazardous Waste Program to allow Otter Tail County to collect and properly dispose of residential and agricultural generated waste pesticides. MARKET PRICE FOR THE SOLID WASTE MANAGEMENT TAX Otter Tail County Resolution No. 2015-68 WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market price if the political subdivision: Subsidizes the cost of service at a facility; and WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market price amount identified through this resolution; and WHEREAS, the market price is identified in state statutes as the "lowest price available in the area"; and WHEREAS, Otter Tail County has performed research to identify the lowest price available in the area. OTC Board of Commissioners' Minutes October 6, 2015 Page4 THEREFORE, the County of Otter Tail declares a market price of $64.48 per ton for a facility, based on a tipping fee amount of $35.59 per ton at the Dakota Landfill and an additional contracted transportation cost of $28.89 per ton. The motion for the adoption of the foregoing resolution was introduced by Commissioner Huebsch, second by Commissioner Johnson, and unanimously carried. Adopted at Fergus Falls, MN this 6th day of October 2015 Dated: Attest: Solid Waste Hauler License Motion by Johnson, second by Rogness, and unanimously carried to issue a Solid Waste Hauler license to Lakes Area Sanitation of Battle Lake, MN as recommended by the Solid Waste Director. Lakes Area Sanitation purchased an existing solid waste hauler business. Tourism and Economic Development Update New York Mills Office Space: Nick Leonard, Tourism and Economic Development Director, briefed the Board on the possibility of the New York Mills Community Interest/Wellness Center relocating to the County's open space at the New York Mills offices. Mr. Leonard will update the Board as the details are developed. Shooting Star Casino: Mr. Leonard briefed the Board on a proposal by Shooting Star Casino to develop a casino and resort on Star Lake near the intersection of County Highway 41 and 380th Street. The development would be owned and operated by the White Earth Nation. Construction is planned to begin in 2016 with project opening slated for 2017. The proposal includes a casino, 11 O room hotel, RV Park, Restaurant, Ballroom and Event Center, indoor/outdoor swimming pool, and observation tower. It is expected to employ 500 people in the beginning and may bring natural gas, fiber optics and enhanced electrical service to the area. County Attorney, David Hauser offered his opinion that Otter Tail County does not have jurisdiction on the 14.5 acre trust land that is Indian country lands and gaming can occur on the land under the federal Indian Gaming Act. Otter Tail County and/or the State of Minnesota may have some regulatory authority over the additional land purchased which may be subject to shoreland regulation and/or sanitation code regulation. Chairman Lindquist opened the floor to public comments. The following comments were made by Star Lake area residents: • Concern about the potential of accessing Star Lake on the Northwest shore • Concern about traffic as it relates to public safety on 380th St if they access the lake to the north of the property and traffic concerns during the construction phase • What jurisdiction does the State Department of Natural Resources have over the project including the lake and hunting, fishing, and ricing? • What are the details of enhancement to the roads in the area and who will pay for road upgrades? • County Highway 41 cannot handle additional traffic. Motion by Rogness, second by Huebsch, and unanimously carried to develop a Frequently Asked Questions document to post on the County website, update the information as the County learns more, provide maps that explain what we currently know, and identify Tourism and Economic Development Director, Nick Leonard, as the County's contact person. OTC Board of Commissioners' Minutes October 6, 2015 Page 5 Child Care Open Forum Summit Motion by Huebsch, second by Johnson, and unanimously carried to approve up to $7,500.00 from the 2015 Commissioners Contingency Fund to sponsor a daycare summit October 22, 2015 at the Battle Lake Community Center at 6:00 p.m. Information from the Summit will be used to draft a plan to identify daycare needs. Recess & Reconvene At 2:45 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. Highway Project Contracts Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Contract and Bond: • County of Otter Tail and Robert Nordick Construction for CSAH 5 Sidewalk, Curb, and Gutter in Clitherall Highway Culvert Replacements Motion by Huebsch, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Contracts and Bonds: • County of Otter Tail and OM Enterprises for CSAH 40 Culvert Replacement • County of Otter Tail and OM Enterprises for CSAH 56 Culvert Replacement at County Ditch 38 OTC Board of Commissioners' Minutes October 6, 2015 Page6 Agreement-Pump Station and Drainage System Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement between the County of Otter Tail and MN Department of Transportation for Lake Olaf and Lake Annie Pump Station and Drainage System Operation (MN DOT Contract No. 1001651 ). Agreement-Little McDonald Paul & Kerbs/Devils Lake Outlet Project Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Grant Contract between the County of Otter Tail and State of Minnesota DNR for the Little McDonald, Paul, & Kerbs (LMPK) and Devil's Lake Outlet Project. The Public Works Director reported that representatives of both Lake Improvement Districts have signed contracts with the County and cost splits have been agreed upon. Dalton Highway Garage Building Motion by Froemming, second by Rogness, and unanimously carried to direct Auditor-Treasurer, Wayne Stein to proceed with advertising for the sale of the Dalton Highway Garage building. Tuition Assistance Agreement Motion by Rogness, second by Johnson, and unanimously carried to approve a Tuition Assistance Agreement between Otter Tail County and Mark K. Nelson as presented and recommended by the Public Works Director. Broadband Discussion Commissioner Wayne Johnson briefed the Board on preliminary discussions with various partners on the possibility of providing high speed internet access throughout Otter Tail County. NORTH COUNTRY FOOD BANK RESOLUTION OF SUPPORT Otter Tail County Resolution No. 2015 -69 The following resolution was offered by Commissioner Doug Huebsch: WHEREAS, North Country Food Bank, Inc. (North Country) is a 501 (c)3 nonprofit organization located in the City of Crookston, County of Polk, State of Minnesota. North Country has a profound regional impact on hunger issues-serving 21 counties in northwest and west central Minnesota; and WHEREAS, North Country provides over 7 million pounds of surplus, quality food and nonfood products to 220 charitable organizations for distribution to people in need. The charitable food programs served by North Country include soup kitchens, food shelves, homeless shelters, low-income individuals in need of supplemental assistance, senior community centers, after-school programs, domestic abuse programs, and addiction treatment centers; and WHERERAS, North Country provides an important service that impacts the lives of many in northwest and west central Minnesota; and WHEREAS, North Country's current facility provides space, storage, access and compliance challenges. North Country must move its operations to a new facility to better and more efficiently serve the population in northwest and west central Minnesota, and to comply with the contractual obligations and safety requirements of Feeding America, state and federal regulations, and the requirements of other governing agencies; and WHEREAS, North Country is in a position to pursue a new facility building construction project and capital fundraising campaign, including a proposition to partner with Polk County to pursue a $3 million State of Minnesota Bonding Request in the 2015 and 2016 Bonding Bill.
