OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, September 8, 2015, at
the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair
Lee Rogness, and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present.
Approval of Agenda
Chairman Lindquist called for approval of the September 8, 2015 agenda. Motion by Froemming, second
by Rogness, and unanimously carried to approve the Board of Commissioners agenda of September 8,
2015 as presented.
Consent Agenda
Motion by Johnson, second by Huebsch, and unanimously carried to approve Consent Agenda items as
follows:
1. September 1, 2015 Board of Commissioners' Meeting Minutes
2. Warrants/Bills for September 8, 2015 (Exhibit A)
3. Human Services Bills & Claims
4. LG220 Application for Exempt Permit, Lake Country Sportsmen's Club for Event

Dog Bite Hearing
PHN Jessica Metzger submitted documents regarding a dog bite incident on July 21, 2015 at the
Scott Sibert residence by a German Shepard/St. Bernard dog named Harley. She also provided
documents regarding two previous dog bites along with the associated Orders and Findings. Mr. Sibert
and Board members discussed various issues including the timing of the microchip placement and
potential danger to the public who visit the residence. Ms. Metzger indicated that the Public Health
Department recommends that the dog Harley be declared a potentially dangerous dog. Assistant Attorney
Jeffrey Pabarcus stated that in order to euthanize a dog, the Board would need to determine substantial
bodily harm under State Statute and make applicable findings. Commissioners requested State Statute
information relative to a potentially dangerous dog and a dangerous dog. They will review the information
and add this item to their next Board Agenda on September 22, 2015.
Public Hearing -Sales Tax Option for Transportation Plan
At 10:05 a.m., Chairman Lindquist opened the Public Hearing for the local option sales tax and use tax for
transportation. Public Works Director, Rick West presented a powerpoint presentation. The local option
0.5% sales tax authorized under M.S. 297 A.993, Subd. 1 and the use tax of $20 per motor vehicle
represents funding for the 2016-2025 County Transportation Program.
Mr. West reviewed the current condition of the County's roadways, preservation strategies, and the
development of a tiered roadway maintenance program referenced by four categories -Platinum, Gold,
Silver, and Bronze. This tiered system is an integrated preservation management system. A Citizens'
Project Steering Committee guided the development and principles within the preservation management
system. Upon completion of the 10 year project list, the local option sales tax is scheduled to sunset
unless a future County Board would choose to develop another Transportation Program. The 0.5% sales
tax does not apply to the purchase of motor vehicles.

Al 10:45 a.m., Chairman Lindquist opened the Public Hearing for public comment. The following are
summarized comments:
Oliver Harrison, Resident North of Fergus Falls, MN about 10 miles:
Mr. Harrison was impressed with the details and extent of work completed for the County's 10 year
Transportation Plan. He asked if Otter Tail County had a gravel tax. Commissioners indicated that one
township and one city in Otter Tail County have a gravel tax. Otter Tail County is not planning a gravel tax
in the immediate future as a funding option. Discussion took place regarding the Highway budget.
Mr. West indicated that the local road and bridge levy is about 3 million dollars annually. Other dollars that
show up in the budget are pass-through dollars from the State or Federal Government. Mr. Harrison spoke
in favor of the work proposed on Cascade Street in Fergus Falls and asked about potential railroad funding
for that project. Discussion continued regarding funding projections for the 2016 highway projects.
Mr. West indicated that the scope of proposed projects will be reviewed annually. Any additions and/or
deletions of projects within the 10 year plan will be made by a public hearing process.
Steve Skauge and Darren Toso, Employees of Productive Alternatives in Fergus Falls:
PA Director, Steve Skauge opened discussion regarding the transit system that Productive Alternatives
operates in Otter Tail County. The public transit system is funded through MN Department of
Transportation (MnDOT) grants which are provided by 85% MnDOT dollars and 15% local match. The
15% local match currently comes from the PA budget. Mr. Toso reported that PA provides 12,000 rides
per month with a budget of 1.4 million dollars and is requesting 1 % of the local option sales tax because
public transit is an allowable item to fund under the applicable statute. This would be about $40,000 per
year which would leverage more dollars for the public transit system through the MnDOT grants. This
funding would allow expansion of public transit to more areas of the County. Mr. West indicated that this is
not part of the proposed Transportation Plan or use of the local option sales tax.
Robert Roehl, Owns Land in Carlisle, MN:
Mr. Roehl spoke in favor of the local option sales tax and highway plan. He would not be in favor of a real
estate tax for transportation funding.
Dean Nelson, Resident of Erhard, MN:
Mr. Nelson and spouse own two businesses in Otter Tail County. He spoke against the sales tax option
because residents may go to a different County to buy their products. He would prefer raising the gas tax
for road funding. Commissioners agreed with the desire to use the gas tax to fund maintenance of roads;
however, that decision would need to be made by the State legislature which does not appear to be
supported at this time.
Les Duenow, Resident of Fergus Falls, MN:
Mr. Duenow spoke against the local option sales tax because it is a regressive tax and he would rather tax
seasonal residents and those who go south or west for the winter who generally can afford an increased
tax.
Consideration of the 0.5% sales tax option and use tax will be scheduled on the next County Board agenda
on September 22, 2015.
Highway Department Agreements
Hoot Lake Channel Engineering Agreement:
Motion by Rogness, second by Johnson, and unanimously carried to approve the appropriate County
Officials' signatures to execute an Engineering Services Agreement between the County of Otter Tail and
Interstate Engineering for channel restoration work at the Hoot Lake Bridge on County Road 1 as
recommended by the Public Works Director.

Motion by Froemming, second by Rogness, and unanimously carried to approve the appropriate County
Officials' signatures to execute an agreement between the County of Otter Tail and BHH Partners for
architectural services for preliminary reconfiguration of space at County Garage #1 as recommended by
the Public Works Director.
ARMER Radio-Channel Expansion
Motion by Johnson, second by Huebsch, and unanimously carried to authorize adding a channel to the
ARMER tower in Barnesville, MN at an estimated cost of $25,000.
Human Services 2014 Chemical Health Unit Report
Human Services Supervisor, Margaret Williams and Social Worker, Dana McClaflin submitted the annual
2014 Chemical Health Unit report. Ms. Williams reviewed the statistics for possible trends. The number of
commitments has increased due to multiple chemical/Ml problems. There is some discussion at the State
level to transfer responsibility for Rule 25. The Department of Human Services (DHS) is exploring options
for the beds at the Fergus Falls 60-bed facility outside of the 16-bed CD portion of the building. The detox
unit served 225 people in Otter Tail County during 2014.
Performance Management System
Human Services Director, Deb Sjostrom explained the Performance Management System. It is designed
to support counties in the delivery of essential human services and the achievement of outcomes for
people in Minnesota. Of the 10 State performance standards, one outcome related to expediting SNAP
application processing under certain circumstances was below the required 55%. Ms. Sjostrom indicated
that a Performance Improvement Plan is being developed to ensure meeting the standard performance
expectations in the future.
Final Payment -Detention Facility Remodel
Motion by Froemming, second by Johnson, and unanimously carried to approve Final Payment, in the
amount of $7,748.22, payable to J.P. Structures for the completion of the Detention Center remodel project
on first floor (nurse's office & lunchroom). Facilities Operations Manager, Terry Hoff provided a synopsis of
the total project.
THE PARTNERSHIP FOR OPPORTUNITY AND WORKFORCE ECONOMIC DEVELOPMENT
REVITALIZATION (POWER) INITIATIVE GRANT
RESOLUTION OF SUPPORT & FINANICAL COMMITMENT
Otter Tail County Resolution No. 2015 -63
WHEREAS: The closure of the Hoot Lake Power Plant in Fergus Falls, MN in 2021 will have a significant
economic impact on the City of Fergus Falls (hereafter referred to as the "City") and County of Otter Tail
(hereafter referred to as the "County"}, AND
WHEREAS: The City is applying for federal funding through the Partnership for Opportunity and
Workforce and Economic Revitalization (POWER) initiative, a multi-agency federal program designed to
assist communities that will be negatively impacted by changes in the coal industry and power sector, AND
WHEREAS: The maximum federal funding available is $100,000 with a dollar for dollar matching
requirement. The City is submitting a grant application requesting the full $100,000 and have preliminarily
received matching funds from local partners such as the Fergus Falls Economic Improvement
Commission, City of Fergus Falls, Otter Tail Power, and Otter Tail Valley Railroad, AND

WHEREAS: If awarded, the grant will provide necessary resources to research and plan for the economic,
environmental, and land use impacts of the plant closure as well as future development opportunities, AND
WHEREAS: As authorized under Minnesota Statute, Section 375.83, a county board may appropriate
money out of the general revenue fund of the county to be paid to any incorporated development society or
organization of this state which, in the board's opinion, will use the money for the best interests of the
county in promoting, advertising, improving, or developing the economic and agricultural resources of the
county.
NOW THEREFORE BE IT RESOLVED THAT: Otter Tail County by this resolution supports the grant
application by the City of Fergus Falls and will contribute up to $10,000 to be designated to matching fund
grant application from the General Revenue Fund of Otter Tail County.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Rogness, duly
seconded by Commissioner Huebsch and, after discussion thereof and upon vote being taken thereon, the
following voted in favor:
Commissioners Huebsch, Johnson, Lindquist, Froemming, and Rogness
and the following voted against the same: None
