Fir Avenue, Fergus Falls, MN July 28, 2015 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 8:30 a.m. on Tuesday, July 28, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present. Approval of Agenda Chairman Lindquist called for approval of the July 28, 2015 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of July 28, 2015 with the following additions: Discussion -West Central Regional Juvenile Center Discussion -Perham Resource Recovery Facility Consent Agenda Motion by Froemming, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: 1 . July 21, 2015 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for July 28, 2015 (Exhibit A) 3. Human Services Bills & Claims 4. Amendment to Productive Alternatives, Inc. Purchase of Service Agreement 5. Temporary Liquor License and LG230 Gambling (raffle) Application Requested by Parkers Prairie Sportsmen's Club for an Event on August 14, 2015 6. LG220 Application for Exempt Gambling Permit Requested by Save The Trinity, Henning, MN for an Event on August 31, 2015 Vulnerable Adult Program Report Human Services Supervisor Margaret Williams submitted a document titled Vulnerable Adult Intake & Assessment Program. The document included program statistics for 2013 and 2014. In 2013, there were 378 VA Intakes with 116 screened for assessment compared to 446 Intakes with 152 screened for assessment in 2014. Staff members talked with the Board regarding assistance that can be provided to keep the elderly in their homes, challenges with home care, and issues with the new centralized VA State reporting system that started July 1, 2015. Health & Safety Contract Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Services Agreement between Otter Tail County and Lakes Country Service Cooperative (LCSC) for the period of July 1, 2015 through June 30, 2016. LCSC provides general and specific safety training services at an annual cost of $27,000. West Central Regional Juvenile Center (WCRJC) Administrator Larry Krohn reported that Cass County is now using the WCRJC in Moorhead, MN. As a result, the facility is running at full capacity. He indicated that the Otter Tail County Probation Department budget will increase from purchasing 2.5 beds to 2.75 beds based on statistical review and the fact that there may not be additional available beds if the need arises. Annual cost for 2.75 beds for CY2016 is $218,625.00 payable monthly. Mr. Krohn also reported that Clay County has retained an architect to reconfigure the Juvenile Center building to gain maximum capacity. OTC Board of Commissioners' Minutes July 28, 2015 Page 2 Prairie Lakes Municipal Solid Waste Authority Commissioner Huebsch reported on factors affecting the PLMSWA budget and cash flow. He indicated that the Business Plan is still viable but may need some adjustments. The PLMSWA Board plans to meet with all member County Boards to update them on the issues, solutions, and possible increased tipping fees. Northern Lights Resort Variance County Attorney David Hauser reported on a court appeal issued by the Dead Lake Association regarding a variance decision made by the Otter Tail County Board of Adjustment for Northern Lights Resort. The Board of Adjustment granted a number of units and dock slips based on the statewide standards; however, Otter Tail County has not adopted those standards. The Court reversed the decision of the Board of Adjustment, granted the appeal and remanded it back to the Board of Adjustment in the event that findings could be made. Motion by Huebsch, second by Froemming, and unanimously carried to consider changes to the Otter Tail County Shoreland Management Ordinance including standards for duplex, triplex, fourplex and commercial use. Recess & Reconvene At 9:23 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 9:33 a.m. RESOLUTION FOR RELEASE OF RIGHT OF WAY COUNTY STATE AID HIGHWAY 82 Otter Tail County Resolution No. 2015 -54 WHEREAS, the County of Otter Tail has received a request for the vacation of a portion of right-of-way on County State Aid Highway 82, and which property is no longer required for right-of-way purposes; and WHEREAS, there remains adequate right-of-way for highway purposes; and WHEREAS, the following legal description was prepared by Anderson Land Surveying and approved by the Otter Tail County Highway Department: Any and all public roads located in that part of Government Lot 1, Section 9, Township 131, Range 42, Otter Tail County, Minnesota, being a part of Parcel 16, OTTER TAIL COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 16, according to the recorded plat thereof, described as follows: Commencing at the East Quarter corner of said Section 9; thence North 00 degrees 16 minutes 52 seconds West (bearing is based on Otter Tail County Coordinates -1996 adjustment) along the east line of the Southeast Quarter of the Northeast Quarter, said Section 9, a distance of 1223.76 feet to the centerline of County State Aid Highway No. 82 as defined in said OTTER TAIL COUNTY RIGHT OF WAY PLAT NO. 16; thence North 61 degrees 23 minutes 52 seconds West along said centerline, a distance of 649.94 feet; thence northwesterly, along said centerline, on a tangential curve concave to the northeast, having a radius of 5729.58 feet and a delta angle of 04 degrees 40 minutes 20 seconds, for an arc distance of 467.22 feet to the point of beginning of the land to be described; thence northwesterly, continuing along said centerline, on a tangential curve concave to the northeast, having a radius of 5729.58 feet and a delta angle of 13 degrees 18 minutes 13 seconds, for an arc distance of 1330.37 feet to the north line of said Government Lot 1; thence South 89 degrees 37 minutes 43 seconds West along said north line, a distance of 323 feet more or less, to the Ordinary High Water line of Mud Lake; thence in a general southeasterly direction, along said Ordinary High Water line to the intersection with a line which bears North 89 degrees 49 minutes 13 seconds West from the point of beginning; thence South 89 degrees 49 minutes 13 seconds East a distance of 154 feet more or less, to the point of beginning. EXCEPT that part within 75.00 feet of the centerline of County State Aid Highway No. 82 as defined in said OTTER TAIL COUNTY RIGHT OF WAY PLAT NO. 16; Containing 4.71 acres more or less. Upon the motion of Rogness, seconded by Froemming, and passed on a 5-0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. Houston Engineering -CSAH 56 at CD 38 Culvert Analysis: Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute an agreement between the County of Otter Tail and Houston Engineering, Inc. for Culvert Hydraulic Analysis on CSAH 56 at County Ditch #38. Interstate Engineering -Bridge No. 56520 on CSAH 1: Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Engineering Services Agreement between the County of Otter Tail and Interstate Engineering, Inc. for design work on Bridge No. 56520 on CSAH 1 east of Fergus Falls over the Wright Lake-Hoot Lake Channel. County Feedlot Program/Officer Discussion Brad Mergens and Darren Newville from the Otter Tail County Soil & Water Conservation Districts (SWCDs) submitted several documents including the Otter Tail County Agricultural Profile, Delegated County Feedlot Program from the Minnesota Pollution Control Agency (MPCA), and County Feedlot Program Budget. They indicated that the MPCA is encouraging Otter Tail County to become a Delegated County for the feedlot program. The program is responsible for the implementation of feedlot rules and regulations and should provide increased local service for livestock producers. Large producers requiring state or federal operating permits would not be included in the program. Lengthy discussion took place regarding the proposed number of feedlots by the MPCA in Otter Tail County, the inspection process, the recommended associated number of employees to implement the program, and related funding. Mr. Mergens indicated that the steps to implement the County Feedlot Program would be a resolution, work plan, and delegation agreement between Otter Tail County and the MPCA. Commissioners requested a meeting with Stearns County's Feedlot Officer and Board Chair for additional information on the program. OTC Board of Commissioners' Minutes July 28, 2015 Page 4 West Central Initiative Reports Dale Umlauf, WCI Vice President of Business Development, presented an Economic Development Snapshot of West Central Minnesota. He spoke about population growth over the last five years, the 65+ age wave, unemployment, poverty rates, and average wages. Lengthy discussion followed regarding an upcoming shortage of workers, benefits of technical school education, and lack of affordable housing. Tom McSparron, WCI Donor Services Officer, provided an update of WCI activities over the past year. Planning Commission Recommendations Conditional Use Permit -Scott & Shaina Adelman: Motion by Johnson, second by Froemming, and unanimously carried to deny the after-the-fact Conditional Use Permit request of Scott & Shaina Adelman as recommended by the Planning Commission and for reasons stated in the Planning Commission minutes dated July 15, 2015. The Land & Resource Management Office will work with the Applicant to gain site restoration. The project is located at Lot 9 Blk 1 Palms of Lida, Section 16 of Lida Township; Lida Lake (56-747) GD. Conditional Use Permit-Christensen Vacation Holdings LLC (Stephen & Janice Christensen): Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit to relocate a driveway that services this residence as presented in the revised drawing received by the Land & Resource Management Office July 15, 2015. The project is located at Lots 9 & 10, Balmoral Beach and Part of GL 2, Sec. 31 of Otter Tail Township, Otter Tail Lake (56-242), GD. Conditional Use Permit-Landon & Maria Menz: Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit for site preparation for a building location and construction of a driveway to service the lot with conditions as recommended by the Planning Commission. The project is located at Lot 20 Blk 2 of Scalp Lake Acres, Section 7 of Hobart Township; Scalp Lake (56-358), RD. Conditional Use Permit-Friends of Creation Science LLC: Motion by Froemming, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for four (4) Recreational Camping Units (RCUs) as presented in the Applicant's revised request with conditions as recommended by the Planning Commission. The project is located at NW¼ SE¼ GL's 1 & 2, & E½ SW¼ Section 21 of Girard Township; Mason Lake (56-196), NE & West Battle Lake (56-239), GD. Final Plat· "The Love Park Addition" Motion by Rogness, second by Froemming, and unanimously carried to approve the Final Plat of Johanna R. Love consisting of four (4) residential backlots and one (1) lot attached to a lake lot located in Section 28 of Girard Township; West Battle Lake (56-239). Aquatic Invasive Species (AISl Task Force Motion by Huebsch, second by Froemming, and unanimously carried to approve $209.00 for ads in the Perham Focus and Perham Contact with their annual fishing photo display as recommended by the AIS Task Force. Motion by Rogness, second by Johnson, and unanimously carried to approve, up to $1,000, for self- looping flex tags with the message of "plug-in plug-out and clean, drain, dry, dispose". The tags will continue the AIS education and awareness campaign.
