Call to Order
The Otter Tail County Board of Commissioners convened at 7:00 p.m. on Tuesday, July 21, 2015 at the
Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness,
and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present.
Approval of Agenda
Chairman Lindquist called for approval of the July 21, 2015 agenda. Motion by Johnson, second by
Rogness, and unanimously carried to approve the Board of Commissioners agenda of July 21, 2015 with
the following changes:
Contracts and Bonds -Finn Ice, LLC
Proposed Order for Ditch #70
Proposed Order for Dog Bite
Dangerous Dog Information
Consent Agenda
Motion by Froemming, second by Rogness, and unanimously carried to approve Consent Agenda items as
follows:

County Ditch No. 70
Motion by Rogness, second by Johnson, and unanimously carried to approve of the Findings and Order to
Proceed and for Redetermination of Benefits regarding Ditch #70 as prepared and presented by County
Attorney David Hauser.
Public Hearing for Transportation Plan
Public Works Director Rick West and Brian Shorten of SRF Consulting presented the Transportation Plan
for the County. The presentation included the costs of maintaining current roads, identifying new funding
resources, the transportation plan study process, and future roadway jurisdiction. Following the
presentation, Chairman Lindquist asked for public comments. Discussion took place regarding expanding
the classification to integrate multi-modal transportation into the plan, and how the plan can economically
benefit the County through road and multi-modal improvements.

Upon motion by Johnson, and second by Rogness, Chairman Lindquist called for a roll call vote to adopt
the following resolution:

WHEREAS, the Otter Tail County Board of Commissioners is the duly elected governing body for Otter Tail
County and is responsible for the planning, development, and preservation of a safe and functional
transportation system; and
WHEREAS, Otter Tail County has undertaken the task of preparing a long range comprehensive County
Transportation Plan to ensure the continued performance of the County's transportation network; and
WHEREAS, the transportation planning process was guided by an Advisory Committee, composed of a
cross-section of multi-jurisdictional technical experts and citizens; and
WHEREAS, the public was invited, encouraged and involved in the Plan's preparation; and
WHEREAS, the Otter Tail County Transportation Plan (2040) includes the following key elements: existing
conditions, goals, objectives and performance measures, future traffic forecasts, future multi-model
analysis, system preservation strategies and an implementation plan with alternative funding scenarios;
and
WHEREAS, this County Transportation Plan will assist County and local officials to cooperatively preserve
and improve the County's transportation system.
NOW, THEREFORE, BE IT RESOLVED, THAT: The Otter Tail County Board of Commissioners does
hereby adopt the Otter Tail County Transportation Plan (2040), and agrees to use it as a guide for future
transportation system decisions.

AUTHORIZING WHEELAGE TAX
Otter Tail County Resolution No. 2015 -53
Upon motion by Johnson, seconded by Huebsch, Chairman Lindquist called for a roll call vote to adopt the

WHEREAS, Otter Tail County's transportation infrastructure is essential for the vitality of businesses,
agriculture, recreation and the residents throughout the County; and
WHEREAS, funding for highway systems in Minnesota has not kept pace with growing preservation/
improvement needs, highway safety improvements, and the increased construction and maintenance costs
of our County transportation system; and
WHEREAS, Otter Tail County has identified the need for additional revenues to maintain and preserve our
county highway system though the development and adoption of a long range comprehensive County
Transportation Plan: and
WHEREAS, Minn. Stat. 163.051 in part, authorizes each County to levy by resolution a wheelage tax at a
rate of $10 per year from January 1, 2014 through December 31, 2017 and on and after January 1, 2018 at
a rate of up to $20 per year as specified by each County on each motor vehicle that is kept in the county
that is subject to annual registration and taxation under chapter 168 with vehicle exemptions as noted
under Minn. Stat. 163.051; and
WHEREAS, Minn. Stat 163.051 provides in part, that the State Registrar of Motor Vehicle shall collect such
tax on behalf of the County if requested, and shall issue a warrant in favor of the Treasurer of the County in
the amount of such tax less moneys sufficient to make such payments; and
WHEREAS, Minn. Stat. 163.051 provides in part, the Treasurer of each County receiving payments of said
tax shall deposit such payments in the County road and bridge fund for the highway purposes; and
WHEREAS, the Otter Tail County Board of Commissioners desires to implement such a wheelage tax and
have the State Registrar of Motor Vehicles collect the same; and
WHEREAS, the proceeds of such a wheelage tax would be used to help maintain and improve the quality
of the County highways.
NOW, THEREFORE, BE IT RESOLVED, THAT: The Otter Tail County Board of Commissioners authorize
and impose a wheelage tax as provided in Minn. Stat. 163.051 of $10.00 per year for the year 2016 and
the year 2017 and beginning on January 1, 2018 at a rate of $20.00 per year and for each subsequent
year thereafter.
BE IT FURTHER RESOLVED that the County requests the State Registrar of Motor Vehicles to collect the
wheelage tax on behalf of the County.

Local Option Sales Tax for the Transportation Plan
Rick West, Public Works Director, recommended to the board a local option sales tax as one of the
sources of funding to be used for the Transportation Plan. It is also recommended that the local option
sales tax would be in effect throughout the completion of implementing the plan. This additional revenue
would assist in filling a funding gap to maintain current road conditions, which was recognized within the
Transportation Plan study. Motion by Rogness, second by Huebsch, and unanimously carried to schedule
a Public Hearing for a Local Option Sales Tax for the Transportation Plan to be held at a regular County
Board Meeting on September 1, 2015, at 10:00 a.m.
Bonding for Transportation Plan Projects
Public Works Director Rick West discussed utilizing bonding as an additional source of funding for the
Transportation Plan. Auditor-Treasurer Wayne Stein will be consulting with Mark Ruff of Ehlers regarding
bonding for the project and will request that Mr. Ruff provides a presentation to the Board. It was
discussed that options for bond funding would be considered by the Public Works and Finance
Committees with recommendations brought to the full Board. Motion by Johnson and second by Rogness,
and unanimously carried to direct the Public Works and Finance Committees to consider bonding for future
transportation plan projects and to be heard by the County Board on either August 11 or August 18, 2015,
at such time that Mr. Ruff can be present.
Contract Approval for Finn Ice, LLC
Motion by Froemming, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a contract between the County of Otter Tail and Finn Ice, LLC, of Dassel!,
MN, for work and labor in the construction of County State Aid Highways, Maintenance Project, Job No.
C.P. 15:CS. This contact is contingent upon the approval of the County Attorney.
Recess & Reconvene
At 8:04 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The meeting was reconvened at 8:12 p.m.
County Ditch Nos. 18 and 37
At the July 14, 2015, County Board Meeting, the public hearing on the redetermination of benefits and
possible consolidation of County Ditch Systems #18 and #37 was tabled to consider the application of the
Green Acres law and appraisal practices regarding the highest and best application under ditch law as it
pertains to the property of Mark Schoening. County Attorney David Hauser determined that the Green
Acres law is not applicable to the ditch assessment of this property. With regard to the appraisal practices
for the highest and best use application, Hauser advised that shoreland use is appropriate for its appraisal
value. County Auditor-Treasurer Wayne Stein presented and explained the factors considered to
determine the appraisal value with regard to the property of Mark Schoening. Ditch Inspector Kevin
Fellbaum presented a map showing the difference in the Redetermination Area from the early 1900s to the
most recent Ditch Viewers Report. Motion by Johnson, second Rogness, and unanimously carried to
adopt the amended Ditch Viewers Report with clerical error corrections as discussed regarding the depth
of lots using the Assessor's criteria for lakeshore valuation. County Attorney Hauser will prepare an Order
to submit to the Board for approval.

Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the Findings of Fact and Order in the matter of the dog Tazer owned by
Lois Bogenreif.
Dangerous Dogs
County Attorney Hauser reported that the Regulation of Dangerous Dogs must be enforced by animal
control authorities or law enforcement agencies whether or not the statutes have been adopted into a local
ordinance. A Notice of Dangerous Dog Declaration was also discussed and it will be provided to the
County Sheriff to address dangerous dogs. It was requested by the Commissioners that a Dangerous Dog
ordinance is developed for the County.
Adjournment
At 8:48 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners
adjourned until the next County Board meeting at 8:30 a.m. on Tuesday, July 28, 2015.
