Call to Order
The Otter Tail County Board of Commissioners convened at 8:33 a.m. on Tuesday, June 23, 2015, at the
Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, and Commissioners
Doug Huebsch, Wayne Johnson and Roger Froemming present. Vice-Chair Lee Rogness was present
until 2:10 p.m., at which time he attended a Human Services meeting.
Approval of Agenda
Chairman Lindquist called for approval of the June 23, 2015 agenda. Motion by Rogness, second by
Huebsch, and unanimously carried to approve the Board of Commissioners modified agenda of June 23,
2015 with additional general discussion time.
Consent Agenda
Motion by Froemming, second by Huebsch, and unanimously carried tq approve Consent Agenda items as
follows:

Final Payment -Courthouse Remodel Phase 1
Motion by Huebsch, second by Johnson, and unanimously carried to approve Final Payment, in the
amount of $38,015.37, to Comstock Construction of Fergus Falls, MN, for completion of the Phase 1
Courthouse Remodel project.
Motion by Rogness, second by Froemming, and unanimously carried to approve Final Payment, in the
amount of $6,775.54, to Shultz & Associates Architects of Fargo, ND, for the Phase 1 Courthouse
Remodel project.
Bid Award -NE Landfill Ash Cell Construction
Solid Waste Director, Mike Hanan presented four bids for the Northeast Otter Tail County Landfill
(SW-544) Ash Cell V Construction project. After advertising, the bids were opened at 10:00 a.m. on
June 10, 2015. Mr. Hanan and Commissioners discussed the project and the reasons for significantly
higher project bids than the Engineer's estimate. They also discussed the future goal of recycling/utilizing
ash rather than building more ash disposal cells. Motion by Huebsch, second by Froemming, and
unanimously carried to award the NE Ash Cell Construction project to Hough, Inc. of Detroit Lakes as the
low bidder, in the amount of $363,333.

Pomme de Terre Watershed District
Chairman Lindquist reported that the Pomme de Terre Watershed District has received $1,633,790 in grant
funding for conservation projects with only 5% of those dollars spent for administration costs. He indicated
that this District is a joint powers arrangement with various partners and is very successful completing
needed projects.
Board of Commissioners' Meeting Schedule Changes
Motion by Johnson, second by Froemming, and unanimously carried to cancel the August 4, 2015 Board of
Commissioners' meeting and replace it with a Board meeting on August 18, 2015.
Motion by Johnson, second by Huebsch, and unanimously carried to add a Board of Commissioners'
meeting on Tuesday, July 21, 2015 at 7:00 p.m. at the Government Services Center. This meeting will be
primarily for a Public Hearing to accept comment and discuss the Otter Tail County Transportation Plan.
Other County business may be heard upon completion of the Public Hearing.
Probation Department
Motion by Froemming, second by Johnson, and unanimously carried to approve the appropriate County
Officials' signatures to execute a Grant Agreement between the State of Minnesota and County of Otter
Tail for Caseload/Workload programming. The grant funding to the County is $115, 166 for each fiscal year
of2016 and 2017.
Motion by Froemming, second by Johnson, and unanimously carried to appoint Gene Bremmer of Parkers
Prairie, MN, to the Probation Advisory Committee for a three year term representing District 4.
Probation Director, Chuck Kitzman briefed Board members on training his staff received regarding Fetal
Alcohol Spectrum Disorders (FASO) for the Courts and Correctional Systems.
Recess & Reconvene
At 9:24 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The Board of Commissioners meeting was reconvened at 9:28 a.m.
Sanitation Code Ordinance Discussion
Public Works Director, Rick West and Land & Resource Management Director, Bill Kalar met with the
Board to discuss issues with the Minnesota Pollution Control Agency (MPCA) Sanitation Code regulations
(purple book). Mr. Kalar provided background information dealing with how septic system drain fields have
been approved/certified as an acceptable operating system. In the past, a septic drain field inspection was
determined on the Ordinary High Water Level (OHWL) and the presence of 3' of soil above the restricted
layer. This has changed to reviewing the characterization of the surrounding soils. The MPCA regulations
indicate a failed drain field if the soil boring(s) show red or gray in the soil. Concern was expressed
because there may be many other naturally occurring reasons to have a red or gray color in the soil. For
example, iron in the soil dissolves and can congregate into red splotches, red could be glacial color soils
and gray soil can result from limestone. Septic System contractors are interpreting the rules differently and
homeowners may have a good system that doesn't pass inspection. In order to sell a home in Otter Tail
County, the homeowner must show a certified septic system. Discussion took place regarding a provision
in the MPCA rules that does not require soil boring if the designer and inspector are independent of each
other and agree on the soils. Other solutions discussed were possible legislative action or County
Ordinance change. Chairman Lindquist referred this issue to the Public Works Committee to develop an
Action Plan.

Bois de Sioux Watershed District Boundary Changes
Motion by Johnson, second by Rogness, and unanimously carried to authorize the Chairman's signature to
execute the "Petition for Watershed District Boundary Changes Pursuant to Minnesota Statue§ 103E.251"
as presented by the Auditor-Treasurer and prepared by the District.
Red River Basin Commission Funding Request
Motion by Froemming, second by Johnson, and unanimously carried to deny the funding request of the
Red River Basin Commission for CY2015 in the amount of $400, which is based upon population in the
County.
Forgiveness of Tax Penalty Requests
Motion by Rogness, second by Huebsch, and unanimously carried to approve the forgiveness of tax
penalty request of Myron C. & Cynthia Krause, in the amount of $74.58, as the situation falls under the
County's policy guidelines. The applicable parcels are identified as 06-000-05-0027-000, 25-000-99-0537-
001 and 26-000-99-0223-000.
Motion by Froemming, second by Huebsch, and unanimously carried to deny the forgiveness of tax penalty
request of Terrence L. Anderson as the reason for late payment of first half taxes was not a County error or
hardship as defined in the County guidelines. The applicable parcel is identified as 17-000-27-0342-000.
Motion by Rogness, second by Huebsch, and unanimously carried to deny the forgiveness of tax penalty
request of David Kruse as the reason for late payment was not a County error or hardship as defined in the
County guidelines. The applicable parcel is identified as 17-000-99-1281.
Motion by Froemming, second by Johnson, and unanimously carried to deny the forgiveness of tax penalty
request of Richard Roesler as the reason for incorrect payment was mortgage/escrow issue not a County
error or hardship as defined in the County guidelines. The applicable parcels are identified as 37-000-99-
1103 and 37000-99-1103-000.
Planning Commission Recommendations
Conditional Use Permit-Otter Tail County Highway Department:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for the County Highway 38 Turnback project as presented. The project is identified as S.A.P. 056-638-
007, reconstruction of CSAH 38 (old MN TH 235) from CSAH 59 in Urbank to MN TH 29 in Parkers Prairie,
9,957 miles. Station 170+00 to 209+00 and Station 402+00 to 454+00 are within the Shoreland area,
totaling 9,100 feet; Besser Lake (56-27), NE; Clarno Lake (56-29), NE; and Unnamed Lakes (56-28) and
(56-1077), NE.
Conditional Use Permit-Joe & Tami Seifert:
Motion by Johnson, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for topographical alteration work and construction of a garage as presented. The project is located at
Lot 43 & Lot 44 Blk 3 of Lida Shores, Section 15 of Lida Township; Lida Lake (56-747), GD.
Conditional Use Permit-Matthew & Nannette Hanson:
Motion by Johnson, second by Huebsch, and unanimously carried to deny a Conditional Use Permit to rent
a lake home for a commercial business as recommended by the Planning Commission and for the reasons
as stated in the June 10, 2015 Planning Commission minutes. The proposal is located on Lot 2 Block 1
Jamielind Shores, Section 29 of Edna Township; McDonald Lake (56-386), RD.

Conditional Use Permit-Sunshine Villa/Kathleen J. Clemens and Kermit & Inez Line:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to subdivide Lot #16 and permanently attach the SEL Y portion to Lot #5 as presented. The project is
located in Sunshine Villa CIC #32 -Unit #5 & Int in Out Lot A and Unit #16 & Int in Out Lot A, Section 23 of
Pine Lake Township; Big Pine Lake (56-130), GD.
Conditional Use Permit -Nancv J. Aldrich Tst/Charles & Nancv Aldrich:
Motion by Johnson, second by Rogness, and unanimously carried to approve a Conditional Use Permit to
build one retaining wall (reduced from the original request) to be located at approximately the 98' elevation
as presented in a revised drawing and stabilization plan that has been submitted to the Land & Resource
Management Office. The project is located on Lot 16 Blk 1 Otter Tail Lake View Heights, Section 29 of
Ottertail Township; Otter Tail Lake (56-242), GD.
Conditional Use Permit -Ace Brandt:
Motion by Johnson, second by Rogness, and unanimously carried to approve a Conditional Use Permit for
topographical alterations for a new entry road with conditions as recommended by the Planning
Commission. The project is located in Tract A of Registered Land Survey #14, Section 11 of Scambler
Township; Pelican Lake (56-786), GD.
OCTA Snowmobile Trail Grant-In-Aid Permit
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a revised Grant-In-Aid Permit for the Otter Country Trail Association
Snowmobile Club.
Water Management District Agreement
Land & Resource Director Bill Kalar reviewed an agreement between Otter Tail County and the Otter Tail
Lakes Water Management District dated May 13, 2015 regarding inspections of Sewage Systems within
the District.
AIS Task Force
Motion by Johnson, second by Rogness, and unanimously carried to approve all expenditures
recommended by the Aquatic Invasive Species Task Force documented in the AIS Task Force Minutes
dated June 8, 2015.
Legislative Session Report
MICA Executive Director Keith Carlson and Human Services Liaison Nancy Silesky, briefed the Board and
submitted documents regarding the 2015 Legislative Session. They highlighted the big issues discussed
during the legislative session and provided a preview of what to expect in the next session. As the various
MICA committees meet this fall, County officials can bring issues to MICA to prepare for legislative action.
Recess & Reconvene
At 12:10 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for lunch break. The Board of Commissioners meeting was reconvened at 1 :11 p.m.
MoebiuslHanson Wetland Conservation Act Appeal
County Attorney David Hauser reported that the MoebiuslHanson WCA Appeal Hearing scheduled with the
County Board at 1 :00 p.m. today was canceled by Attorney Gary Leistico (representing Moebius/Hanson).
Mr. Hauser anticipates that a new application will be submitted in this case. If this WCA Appeal needs to
be heard by the Board, Mr. Leistico will reschedule for a future date.
County Road 28

Commissioner Wayne Johnson reported that the County is replacing a bridge with three box culverts on
CR 28. The MN Department of Natural Resources (DNR) would like to include a water trail access with the
project. It seems the best way to accomplish the water trail access would be across land owned by the US
Fish and Wildlife Service on the south side of the project. The MN DNR may be planning to obtain an
easement from a private landowner on the north side of the project which would be an unnecessary cost to
taxpayers. Chairman Lindquist will refer this issue and the issues surrounding PIL T (payment in lieu of
taxes) to the Otter Tail Conservation Committee.

At 1 :23 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The Board of Commissioners meeting was reconvened at 1 :44 p.m.
Employee Interchange Agreement
Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Employee Interchange Agreement between Otter Tail County and the
MN Department of Health (DOH) for a Sanitarian Position effective from July 1, 2015 through
December 31, 2015.
New Life Communications Invoice
County Attorney David Hauser briefed the Board on an invoice from New Life Communications, in the
amount of $60, 173.16 for work authorized by the State of Minnesota.
Drainage Systems
County Ditch #70:
Ditch Inspector Kevin Fellbaum reported that all permits have been received to move forward with the
proposed Ditch #70 Improvement project. Chairman Lindquist scheduled a Ditch #70 Public Information
meeting at 7 p.m. on Monday, July 20, 2015, at the Government Services Center in Fergus Falls, MN.
Chris Steffan requested that the Engineer language for this project refers to the current outlet as an outlet
so that it can be used as an overflow after the new outlet is constructed. Commissioners indicated that his
is a reasonable request and would ensure that no one closes off the outlet in the future.
County Ditch #25:
Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Engineering Agreement between the County of Otter Tail and Widseth
Smith Nolting & Associates for information regarding the outlet of Big McDonald Lake with cost not to
exceed $3,500.

At 2:15 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for a short break. The Board of Commissioners meeting was reconvened at 2:19 p.m.
LMKP/Devils Lake Outlet Project Update
Public Works Director Rick West and LMKP/Devils Lake Improvement District representatives met with the
Board and reviewed the project as it relates to the approved grant funding from the State of MN. The
original application was executed by the LMKP LID and will need to be modified so the County is the
applicant for the project. The County will incur the costs for the project and be reimbursed as work is
completed. The County Attorney will draft an agreement between Otter Tail County and the LMKP/Devils
LIDs prior to the approval of the Resolution with the State of MN. The County can levy ad valorem taxes
for the project if it exceeds 10 million dollars which is where the funding would come from if the grant from
the State was not received.

Otter Tail County Resolution No. 2015 -44
A motion was offered by Froemming, seconded by Huebsch, and unanimously carried to approve the
following resolution:
IT IS RESOLVED that Otter Tail County enter into Mn/DOT Agreement No. 1000351 with the State of
Minnesota, Department of Transportation for the following purposes:
To provide for payment by the State to the County of the State's share of the costs of the safety
lighting construction and other associated construction to be performed at 21 locations that
intersect with Trunk Highways and County Roads under State Project No. 8824-124.
IT IS FURTHER RESOLVED that John Lindquist, County Board Chair and Larry Krohn, County Board
Clerk are authorized to execute the Agreement and any amendments to the Agreement.

A motion was offered by Huebsch, seconded by Johnson, and unanimously carried to approve the
following resolution:
IT IS RESOLVED that Otter Tail County enter into Mn/DOT Agreement No. 1000572 with the State of
Minnesota, Department of Transportation for the following purposes:
. To provide for payment by the State to the County for the use and maintenance of County State
Aid Highway No. 9, County State Aid Highway No. 21, County State Aid Highway No. 24, County
State Aid Highway No. 41, County State Aid Highway No. 35, County State Aid Highway No. 52
and County State Aid Highway No. 67 as a detour route during the contract construction to be
performed upon, along and adjacent to Trunk Highway No. 108 from Otter Tail County State
Highway No. 21 to the City of Henning under State Project No. 8408-44 (T.H. 108=181).
IT IS FURTHER RESOLVED that John Lindquist, County Board Chair and the Larry Krohn, County

Motion by Johnson, second by Huebsch, and unanimously carried to approve the appropriate County

A motion was offered by Johnson, seconded by Froemming, and unanimously carried to approve the
following resolution:
BE IT RESOLVED that the County of Otter Tail as lead applicant, has the authority to act as legal public
sponsor for the application described in the Request for Designation as a Regional Park or Trail in Greater
Minnesota.
BE IT FURTHER RESOLVED that as lead applicant we are fully aware of the information provided in the
application and associated responsibilities, including long-term commitments as defined in the application
and related master plan and supporting information as submitted.
BE IT FURTHER RESOLVED that, should Perham to Pelican Rapids Regional Trail receive formal
designation as a Regional park or trail in Greater Minnesota by the Commission, that as the lead applicant
have the legal authority to enter into formal designation and funding agreements with the Commission for
the referenced park or trail.
BE IT FURTHER RESOLVED that as the listed applicant, certify that we will comply with all applicable
laws and regulations associated with regional designation and any future grant funding for the respective
portions of any project.
