Call to Order
The Otter Tail County Board of Commissioners convened at 8:30 a.m. on Tuesday, June 2, 2015, at the
Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness,
and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present.
Approval of Agenda
Chairman Lindquist called for approval of the June 2, 2015, agenda. Motion by Froemming, second by
Johnson, and unanimously carried to approve the Board of Commissioners agenda of June 2, 2015, with the
addition of a Joint Powers Agreement to be submitted by County Sheriff Brian Schlueter.
Consent Agenda
Motion by Johnson, second by Froemming, and unanimously carried to approve Consent Agenda items as
follows:
1. May 26, 2015 Board of Commissioners' Meeting minutes, approved with
corrections noted.
2. Warrants/Bills for June 2, 2015 (Exhibit A)

Otter Tail County Resolution No. 2015 -36
Commissioner Johnson offered the following and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits
for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, the VFW Post 5252, Pelican Rapids, MN, has made an application to the Gambling Control
Board for the purpose of conducting lawful gambling at Zorbaz on Pelican Lake, located at 51709 County
Highway 9 in Scambler Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial
premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners
approving the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by the VFW Post p252, Pelican Rapids, MN, at Zorbaz on Pelican Lake, located at 51709
County Highway 9 in Scambler Township of Otter Tail County.

NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the VFW Post 5252, Pelican Rapids, MN, at Zorbaz on Pelican
Lake, located at 51709 County Highway 9 in Scambler Township of Otter Tail County, provided the applicant
meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Scambler by sending them a copy of this resolution.
Commissioner Froemming seconded the motion, and upon being put to a vote, was unanimously carried.

West Central Minnesota Drug & Violent Crimes Task Force Joint Powers Agreement
Motion by Huebsch, second by Rogness, and unanimously carried to approve of the Amended West Central
Minnesota Drug & Violent Crimes Task Force Joint Powers Agreement as presented by County Sheriff
Schlueter.
PROCUREMENT OF THE PREPAID MEDICAL ASSISTANCE PROGRAM
Otter Tail County Resolution No. 2015 -37
Commissioner Johnson offered the following and moved its adoption:
WHEREAS, the Minnesota Department of Human Services has published a Request For Proposals to
provide health care services to recipients of Medical Assistance and MinnesotaCare in 87 Minnesota
counties including Otter Tail County; and
WHEREAS, the Minnesota Department of Human Services has requested County evaluations and
recommendations regarding the RFP proposals from each respective county; and
WHEREAS, Blue Plus, HealthPartners, Medica and UCare submitted proposals to provide managed health
care services in Otter Tail County; and
WHEREAS, representatives of Otter Tail County Human Services and Public Health Departments have
reviewed and evaluated the proposals; and
WHEREAS, Blue Plus, Medica and UCare have submitted proposals suitable to meet our needs.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
supports the recommendation of Otter Tail County Human Services and Public Health Departments
approving Blue Plus, Medica and UCare as Managed Care Organizations (MCO) providing managed health
care service in Otter Tail County.

MACSSA Legislative Update
Deb Sjostrom, Human Services Director, submitted the Minnesota Association of County Social Services
Administrator's (MACSSA) Legislative Update dated May 19, 2015. Ms. Sjostrom briefed the Board on bills
that were passed including legislation for additional funding in child protection services and chemical and
mental health services. She also reported that the CARE facility in Fergus Falls, MN, will not be closed, but
will be reduced from a 32-bed facility to a 16-bed facility and further discussions will be held to determine
how best to repurpose the remaining area of the facility. Discussions regarding long-term planning for the
CARE facility will also continue and Commissioner Rogness will participate in that process. Ms. Sjostrom
also discussed legislation that was passed for simplification of public assistance programs to make public
assistance benefits more streamlined.
SPEED ZONE STUDY REQUEST
Otter Tail County Resolution No. 2015 -38
Commissioner Rogness offered the following and moved its adoption:
WHEREAS, the City of Fergus Falls and Otter Tail County have discussed and mutually agreed that a speed
zone study in this area of Fergus Falls would be beneficial in this area, and
WHEREAS, the City of Fergus Falls and Otter Tail County are requesting that the County of Otter Tail take
such action as may be necessary in order to pursue a reduced speed limit on the segment of Alcott Avenue
(County State Aid Highway 1 & County State Aid Highway 15) from 1-94 to Martin Street, and Tower Road
(County State Aid Highway 1) from Lincoln Avenue to 1-94, and
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be
studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if
any.
BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal
speed zone if the findings of the traffic study are supportive.
Commissioner Johnson seconded the resolution and, upon being put to vote, the resolution was
unanimously adopted this 2nd day of June, 2015.

MINNESOTA DEPARTMENT OF TRANSPORTATION AGENCY AGREEMENT NO. 1000667
Otter Tail County Resolution No. 2015 -39
Commissioner Froemming offered the following and moved its adoption:
BE IT RESOLVED, that pursuant to Minnesota Statutes Section 161.36, the Commissioner of Transportation
be appointed as Agent of Otter Tail County to accept as its agent, federal aid funds which may be made
available for eligible transportation related projects.
BE IT FURTHER RESOLVED, the County Board Chair and the County Board Clerk are hereby authorized
and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the
Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set
forth and contained in "Minnesota Department of Transportation Agency Agreement No. 1000667", a copy of
which said agreement was before the County Board and which is made a part hereof by reference.
Commissioner Johnson seconded the resolution and, upon being put to vote, the resolution was
unanimously adopted this 2nd day of June, 2015.

Board of Appeal and Equalization
Wayne Stein, County Auditor-Treasurer, presented the Board of Appeal and Equalization schedule for
Monday, June 15, 2015, and indicated that the schedule was up-to-date but additions may be included prior
to the hearing date.
Sale of Parcel No. 33-000-05-0022-001
Motion by Rogness, second by Froemming, and unanimously carried to accept the bid of Rodney and
Marsha Vandermay in the amount of $22,000 for the purchase of Parcel No. 33-000-05-0022-001, in which
the legal description is as follows: All that part of the Northeast Quarter of Section 5, Township 136 North
Range 37 West described as follows: Beginning at a point South 89 Degrees 2' West 500 feet; and South
46 Degrees 57' West 345 feet from the Northeast corner of Section 5, Township 136 North Range 37 West:
thence South 11 Degrees 29' East for a distance of 162 feet; thence South 85 Degrees 57' West for a

TAX FORFEITED LAND CLASSIFICATION PROCEDURE
Otter Tail County Resolution No. 2015 -40
Commissioner Huebsch offered the following and moved its adoption:
WHEREAS, Minnesota Statute 282.01 Subdivision 1 was amended in 2010 to provide two
options/procedures for the classification and reclassification of tax forfeited lands,
WHEREAS, Minnesota Statute 282.01 Subdivision 1 Paragraphs (b), (c), and (d) describe the option
commonly known as the "TAX-FORFEITED LAND CLASSIFICATION MEETING" procedures,
WHEREAS, Minnesota Statute 282.01 Subdivision 1 Paragraphs (g), (h), and (i) describe the only option
that existed (commonly known as "CLASSIFICATION INFORMATION GATHERING" procedures) prior to
Minnesota Statute 282.01 being amended in 2010, and

WHEREAS, Minnesota Statute 282.01 Subdivision 1 Paragraph (f) provides counties with the opportunity to
elect by resolution the use of the classification and reclassification procedures as provided in Minnesota
Statute 282.01 Subdivision 1 Paragraphs (g), (h), and (i) instead of the procedures provided in paragraphs
(b), (c), and (d).
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners elects to use
the classification and reclassification procedures provided in Minnesota Statute 282.01 Subdivision 1
Paragraphs (g), (h), and (i); and
BE IT FURTHER RESOLVED, that the County's election made under the provision of Minnesota Statute
282.01 Subdivision 1 Paragraph (f) will remain in effective for a minimum of five years from the adoption
date of this resolution.
Commissioner Froemming seconded the resolution and, upon being put to vote, the resolution was

Otter Tall County Resolution No. 2015 -41
Commissioner Johnson offered the following and moved its adoption:
WHEREAS, Minnesota Statute 282.01 Subdivision 1 Paragraph (e) allows for the grouping of several tracts
into one larger tract when it is deemed advantageous for the sale of the tax-forfeited land,
WHEREAS, Otter Tail County has the following six substandard lots which do not meet the requirement of
Minnesota Statute 394.36,

WHEREAS, the Otter Tail County Board of Commissioners deems the grouping of the parcels to be
advantageous for the sale of the above referenced tax-forfeited lands.

CLASSIFICATION OF TAX FORFEITED LANDS AND
REQUEST FOR DNR APPROVAL AND LEGISLATIVE SUPPORT
Otter Tail County Resolution No. 2015-42
Commissioner Johnson offered the following and moved its adoption:
WHEREAS, The County Board of Commissioners of the County of Otter Tail, State of Minnesota, desires to
offer for public sale, government acquisition (public use or purpose) and/or private sale to adjacent owners
certain parcels of land that have forfeited to the State of Minnesota for non-payment of taxes, and
WHEREAS, said parcels of land have been considered and/or viewed by the County Board of
Commissioners and have been classified as non-conservation lands as provided for in Minnesota Statutes
282.01, subject to review and approval by town board and the governing body of the municipality where the
tax-forfeited lands are located.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby certify
that all parcels of land in Exhibit A -Township Parcels and Exhibit B -City Parcels (on file with the County
Auditor) have been considered and/or viewed and comply with the provisions of Minnesota Statutes 85.012,
92.461, 282.01, Subd. 8, 282.018 and other statutes that require the withholding of tax-forfeited lands from
sale. The County Board of Commissioners hereby certifies that the East and West Otter Tail County Soil
and Water Conservation office of the district in which the properties are located will review Exhibits A and B
and will identify any and all non-forested marginal lands and wetlands.
BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners hereby respectfully
request approval from the Minnesota Department of Natural Resources for the public sale, government
acquisition (public use or purpose) and/or private sale to adjacent owners of said lands identified in Exhibits
A and B and furthermore respectfully request the Minnesota Department of Natural Resources review and
consider the tax-forfeited lands identified in Exhibit C (on file with the County Auditor) for special legislative
approval.
Commissioner Froemming seconded the resolution and, upon being put to vote, the resolution was
unanimously adopted this 2nd day of June, 2015.
