Fir Avenue, Fergus Falls, MN May 12, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, May 12, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present. Approval of Agenda Chairman Lindquist called for approval of the May 12, 2015 agenda. Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of May 12, 2015 with the following addition: Report on Meeting at M State Regarding Agriculture Consent Agenda Motion by Froemming, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: 1. May 5, 2015 Board of Commissioners' Meeting minutes 2. Warrants/Bills for May 12, 2015 (Exhibit A) 3. Human Services Bills & Claims 4. Approve the Following License Applications: --On Sale Wine for Big Chief Inc. for 7/1/15-6/30/16 --On/Off Sale 3.2 Malt Liquor for Big Chief Inc. for 7/1/15-6/30/16 --On Sale Wine for Ten Mile Lake Resort, Inc. for 7/1/15-6/30/16 --On/Off Sale 3.2 Malt Liquor for Ten Mile Lake Resort, Inc. for 7/1/15-6/30/16 Meeting at M State in Fergus Falls Commissioner Rogness briefed the Board on a recent meeting at Minnesota State Community and Technical College-Fergus Falls that included an emphasis in looking for opportunities of educational needs in agricultural business careers. Commissioner Rogness will request that officials from M State meet with the County Board for a report as opportunities are researched and identified. U.S. Fish & Wildlife Service Wetland Easements USFWS Representatives appeared before the Board and requested certification of two habitat easements and one waterfowl easement. Documentation was previously submitted regarding the easements. Motion by Rogness, second by Huebsch, and unanimously carried to approve certification for the USFWS to secure the following habitat and waterfowl easements: Hintermeister, Dwight A.: T. 132N., R. 42 W., 5th P.M. Section 12, N ½NW¼ EXCEPT that part of the Northeast Quarter of the Northwest Quarter (NE¼NW¼) described as follows: Beginning at a point on the North line of said Section 12 located North 89 degrees 55 minutes 20 seconds East 1,896.46 feet from the Northwest section corner thereof; thence South 00 degrees 04 minutes 40 seconds East 227.50 feet; thence North 89 degrees 55 minutes 20 seconds East 190.00 feet; thence North 00 degrees 04 minutes 40 seconds West 227 .50 feet to the said section line; thence South 89 degrees 55 minutes 20 seconds West 190.00 feet to the point of beginning; AND Section 12. Road Ditch Cleanings Motion by Rogness, second by Huebsch, and unanimously carried to authorize a road ditch clean out application submitted by Donald Miller along CSAH 61 from the Oakwood Golf Course sign South approximately 150' as recommended by the Public Works Director and contingent upon approval of the County's Wetland Conservation Act (YI/CA) Inspector. Motion by Rogness, second by Huebsch, and unanimously carried to authorize a road ditch clean out application submitted by Kurt Erlandson along County Highway 112 from the driveway at Station 103+11 easterly as staked and recommended by the Public Works Director. The project is also contingent upon approval of the County's Wetland Conservation Act (YI/CA) Inspector. RESOLUTION DESIGNATING COUNTY STATE AID HIGHWAY LOCATION COUNTY STATE AID HIGHWAY NO. 9 Otter Tail County Resolution No. 2015 -34 Upon a motion by Johnson, second by Froemming, and unanimously carried, the following resolution was adopted: WHEREAS, it appears to the County Board of Commissioners of the County of Otter Tail that the highway right of way required for County State Aid Highway No. 9 under Project No. SAP. 056-609-005 should be accurately described and located by a highway right of way plat. NOW, THEREFORE, BE IT RESOLVED, by the County Board of Commissioners of the County of Otter Tail that the Board of County Commissioners for the County of Otter Tail is hereby designating the definite location of County State Aid Highway No. 9 in Sections 1, 2 and the North Half of Section 11, all in Township 137 North, Range 43 West of the 5th Principal Meridian, as shown on the 7 pages of OTTER TAIL COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 26. Letter of Complaint OTC Board of Commissioners' Minutes May 12, 2015 Page 3 Commissioners forwarded a letter of concern about medical care at the Otter Tail County Detention Facility to the County Attorney, Sheriff, Jail Administrator and County Administrator. Recess & Reconvene At 10:18-a.m.; Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a.committee meeting. The Board of Commissioners meeting was reconvened at 10:40 a.m. Owner's Representative Agreement for Permitting County Attorney David Hauser, Land & Resource Director Bill Kalar, and the Board discussed the option of allowing an Owner's Representative Agreement to facilitate the permit process from the Land & Resource Department. Lengthy discussion took place. Commissioner Johnson submitted an example of a document that was not an original signed agreement but a photocopy of the original. Mr. Kalar indicated that would be accepted in his office. Conditional Use Permit -Heisler's Country Store Chad Canton spoke with the Board regarding the condition of installing a fence along the highways at the Heisler Country Store location. He indicated that has cleaned up the area and plans to keep an appealing property. Discussion took place regarding other repair shops in the area that are not required to fence their business and the downside of hiding his business behind a fence. Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use Permit to operate a vehicle repair shop as presented and to accept the site storage plan as submitted by the Applicant and dated April 28, 2015 which includes location for a maximum of twenty vehicles. The project is located in the NE¼NW¼ ex trs & GL 3 (66.05 AC), Section 35 of Candor Township; Loon Lake (56-523), RD. Little McDonald. Paul & Kerbs LID Environmental Assessment Review Mr. Hauser submitted a draft Environmental Impact Statement (EIS) Negative Declaration with sections identified that needed more information. The Negative Declaration could be a Positive Declaration to require an EIS if the missing information cannot be provided. A Memorandum from Moore Engineering, Inc. dated May 7, 2015 in response to the Minnesota Department of Natural Resources (DNR) comments was submitted. A draft Operation & Maintenance Plan for the LMKP LID-OLD LID Pump Station outlet to Otter Tail River dated May 7, 2015 was submitted by the Proposers. Mr. Kalar reviewed the responses to the DNR comments which addressed downstream water levels, Aquatic Invasive Species, ice safety, when the pump can operate, and downstream native mussels. Discussion continued with the Board completing the missing information throughout the draft EIS document. Several questions were asked by the public regarding times of operation of the pump and the AIS filtering process. Responses were provided. A motion was offered by Johnson and seconded by Huebsch to proceed with a Negative EIS Declaration in the matter of the Proposal of Little McDonald, Kerbs, and Paul Lakes Improvement District to use the Otter Tail River as an Outlet. The Chair called for a roll call vote as follows: Board of County Commissioners Doug Huebsch Roger Froemming Wayne Johnson Lee Rogness John Lindquist YEA X X X X X NAY ABSENT ABSTAIN Motion by Johnson, second by Rogness, and unanimously carried to direct that the findings of fact and conclusions of law be prepared by the County Attorney and presented at the May 26, 2015 County Board meeting. OTC Board of Commissioners' Minutes May 12, 2015 Page4 Recess & Reconvene At 12:02 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for lunch break. The Board of Commissioners meeting was reconvened at 1 :00 p.m. Insurance Committee Meeting Update Insurance Committee Members reviewed a report from the Insurance Committee meeting held May 7, 2015. Discussion took place regarding various aspects of concern regarding the County's health insurance and benefit package. Motion by Johnson, second by Froemming, and unanimously carried to move this topic to the Internal Services Committee for further research and discussion. Office Space for Tourism & Economic Development Director Nicole Hansen, Human Resources Director provided information on a reconfiguration of office space within the Administrator's office to allow for the Tourism and Economic Development Director as well as an additional work station. The reconfiguration is within budget. Adjournment At 1 :33 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners adjourned until the next County Board meeting at 9:30 a.m. on Tuesday,.May 26, 2015.
