Fir Avenue, Fergus Falls, MN May 5, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, May 5, 2015, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present. Approval of Agenda Chairman Lindquist called for approval of the May 5, 2015 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of May 5, 2015 with the following additions: Electronic Plat Book Discussion Buffalo-Red River Watershed District Report Consent Agenda Motion by Huebsch, second by Froemming, and unanimously carried to approve Consent Agenda items as follows: 1. April 28, 2015 Board of Commissioners' Meeting minutes 2. Warrants/Bills for May 5, 2015 (Exhibit A) 3. Approve Exempt Permit Application from St. James Catholic Church for a July 26, 2015 Event 4. Approve Application to Conduct Excluded Bingo from St. James Catholic Church for a July 26, 2015 Event 5. Approve On/Off Sale 3.2 Malt Liquor License for Heisler's Country Pub for 7/1/15-6/30/16 Remodeling Project -Detention Facility Facilities Operations Manager, Terry Hoff reported that two bids were received on the relocation of the Nurse's Office and Employee Lunchroom in the Detention Facility. The bids included the Base Bid and three alternates. Mr. Hoff reviewed the recommended bid from Vercon, Inc. at a total project cost of $183,770. Motion by Huebsch, second by Rogness and carried, with Johnson opposed, to award the Nurse's Office and Employee Lunchroom remodel project in the Detention Facility to the low bidder, Vercon, Inc. at an estimated cost of $183,770. These project expenses will be paid out of the Capital Improvement Fund with $52,270 levied in CY2016 to be paid back to the Capital Improvement Fund. The motion also included approval of an Otter Tail County Owner's Representative for the project at a cost not to exceed $17,000. Recess & Reconvene At 9:50 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 9:56 a.m. Historical Society Report Otter Tail County Historical Society Executive Director, Chris Schuelke discussed the importance of preserving history and provided several documents. He updated the Board on upcoming activities, current exhibits, research and education. CY2018 will be the 150th year celebration for Otter Tail County which was organized in 1868. There will be a County committee for the celebration and Mr. Schuelke will be asking for County support. Discussion took place regarding financing, the future need for a larger museum building and other historical interests in the County including the Prospect House and Fort Juleson. Zoo Run Representatives of the Prometheus Motorcycle Club requested approval for the 30th Annual Zoo Run event scheduled June 25th through June 28th of 2015. All proceeds from the motorcycle ride event are given to the Chahinkapa Park Zoo in Wahpeton, ND. Motion by Huebsch, second by Johnson, and unanimously carried to waive the Otter Tail County Shows and Exhibitions Ordinance for this charity event subject to organizers providing security, adequate portable facilities, insurance, and notification to law enforcement regarding the event which has been past practice. Digital Plat Book Motion by Rogness, second by Huebsch, and unanimously carried to approve a $10.00 fee for digital Otter Tail County Plat Books available on flash drive. Recess & Reconvene At 10:20 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 10:28 a.m. Little McDonald Paul & Kerbs EAW Review Land and Resource Director, Bill Kalar submitted a document titled LMKP LID EAW Public Comments Summary dated April 30, 2015. There were 107 timely responses to the Environmental Assessment Worksheet. The two concerns repeated most often were increased high water downstream that could cause shoreline erosion and/or flooding and the potential spread of Aquatic Invasive Species (AIS), specifically zebra mussels. Mr. Kalar stated that the MN Department of Natural Resources (DNR)'s comments indicate that the EAW is incomplete specifically because it does not address potential impacts downstream. The County Board, as the Responsible Government Unit (RGU), must make a decision on the need for an Environmental Impact Statement (EIS) by May 15, 2015. If the RGU finds that an EIS is needed, it is a positive declaration and if the RGU finds that an EIS is not needed, it is a negative declaration. County Attorney David Hauser submitted the EQB guideline which discusses the factors to be considered. If it is decided that additional information is needed, the deadline can be postponed for 30 days. Mr. Hauser referred to MN Rule 4410.170. He stated that all issues raised in the EAW comment period must be addressed. Discussion followed. Commissioners indicated that an Operating Plan is needed to respond to the concerns. The environmental impact of not authorizing an outlet project must also be addressed. Chairman Lindquist requested that this EAW review continue at the next regular County Board meeting. The proposers will submit additional information prior to the meeting. Recess & Reconvene At 11 :17 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 11 :24 a.m. Bid Award -MN Project No. HSIP 5615(195) After previously advertising for bids for S.P. 056-070-015, 016, 017, and 018, bids were opened on April 8, 2015 at the GSC in Fergus Falls, MN. Motion by Huebsch, second by Johnson, and unanimously carried to award the Paved Shoulders and Rumble Strips project to the low bidder, Knife River Materials of Bemidji, MN, at the bid amount of $1,479,547.85 as recommended by the Public Works Director. Bid Award -C.P. 15:CS After previously advertising for bids for C.P. 15:CS, bids were opened on April 29, 2015 at the GSC in Fergus Falls, MN. Motion by Rogness, second by Johnson, and unanimously carried to award the 2015 County Wide Crack Sealing project to the low bidder, Finn Ice, LLC of Dassel, MN at the bid amount of $42,234.50 as recommended by the Public Works Director. OTC Board of Commissioners' Minutes May5,2015 Page 3 Right-of-Way Acquisition -S.A.P. 056-609-005 Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement between the County of Otter Tail and Evergreen Land Services Co. of Eagan, MN, at the low quote of $92,500.00 for the CSAH 9 Reconstruction from South Pelican Drive to the North County Line as recommended by the Public Works Director. County Transportation Plan Motion by Rogness, second by Johnson, and unanimously carried to extend the SRF Consulting Group completion date of the Otter Tail County Transportation Plan to August 15, 2015 due to increased scope of work. Highway Contract-C.P. 15:TM, C.P. 15:208TM & C.P. 15:310TM Motion by Johnson, second by Froemming, and unanimously carried authorize the appropriate County Officials' signatures to execute a Highway Maintenance Contract between the County of Otter Tail and Traffic Marking Service, Inc. of Maple Lake, MN, for traffic marking services in Otter Tail County, The City of Fergus Falls and Wilkin County. County Road Ditch Cleaning Motion by Rogness, second by Johnson, and unanimously carried to confirm that the Public Works Division/Highway Department is authorized to make decisions regarding County highway ditch cleaning requests. Federal Boat Safety Patrol Grant Agreement Motion by Froemming, second by Johnson, and unanimously carried to approve the 2015 State of Minnesota Federal Boating Safety Patrol Grant Agreement as submitted. This grant provides Otter Tail County $11,375.00 for overtime boat and water patrol beginning May 8, 2015 through September 7, 2015. Adjournment At 12:08 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners adjourned until the next County Board meeting at 9:30 a.m. on Tuesday, May 12, 2015.
