Fir Avenue, Fergus Falls, MN April 14, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. on Tuesday, April 14, 2015, at the Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chairman; Lee Rogness, Vice-Chair; Wayne Johnson and Roger Froemming present. Commissioner Doug Huebsch was absent. Approval of Agenda Chairman Lindquist called for approval of the April 14, 2015 agenda. Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of April 14, 2015 with the following modifications: 10:45 a.m. -Cancel Revised Property Tax Abatement Discussion 10:45 a.m. -Plat Books Discussion Additions to the Consent Agenda Consent Agenda Motion by Johnson, second by Rogness, and unanimously carried to approve Consent Agenda items as follows: 1. April 7, 2015 Board of Commissioners' Meeting minutes 2. Warrants/Bills for April 14, 2015 (Exhibit A) 3. Human Services Bills & Claims 4. Adult MH Grant Award -Gull Harbor IRT 5. Approval for Out-of-State Travel for the County Investigator to Attend The United Council on Welfare Fraud 6. Approval of Exempt Permit Application for an Event on 08/30/2015 At Finn Creek Open Air Museum 7. Approval of Credit Card for Social Worker Krista Fix at a 30-Day Limit of $750.00 8. Approval of Tobacco License for Pelican Hills Seasonal Park, Inc. 9. Approval of Amendment No. 1 to the DWI Court Agreement Tourism and Economic Development Director Human Resources Director Nicole Hansen presented the Tourism and Economic Development Director job posting and briefed the Board on the application and interview process. Burial Policy Commissioner Lee Rogness submitted correspondence received regarding the Otter Tail County Burial and Disposition Policy. The information will be forwarded to the County Attorney for his review and report back to the Board at their next regular County Board meeting. Recess & Reconvene At 9:40 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 9:48 a.m. OTC Board of Commissioners' Minutes April 14, 2015 Page 2 Otter Tail County Flexible Benefits Plan Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate county officials signatures to execute the Flexible Benefits Plan Document effective January 1, 2015 as presented. Homestead At Ottertail Campgrounds Greg Swandberg, owner of The Homestead At Ottertail, requested that the fee for a variance from the recreational camping unit definition in the Shoreland Management Ordinance (SMO) be waived. The need for a variance is due to an unintended consequence of an Ordinance change. Discussion followed. Motion by Rogness, second by Johnson, and unanimously carried to waive $454.00 of the $500.00 Variance Application fee for The Homestead At Ottertail. The recording fee for the variance in the amount of $46.00 will apply. Commissioners requested that the notice to the public regarding this Variance Application clearly state the purpose for the variance relating to the size of recreational camping units i.e. park models. Bid Award -S.A.P. 056-608-026 After previously advertising for bids for Reconstruction of CSAH No. 8 in Perham with Street & Utility Improvements, bids were opened March 25, 2015. Motion by Rogness, second by Froemming, and unanimously carried to award S.A.P. 056-608-026 to Kuechle Underground, Inc. of Kimball, MN as the low bidder in the amount of $4,358,978.80. The County cost share of this project is $1,377,541.55. Bid Award -C.P. 15:TM After previously advertising for bids for the 2015 County Wide Traffic Marking project, bids were opened April 8, 2015. Motion by Froemming, second by Johnson, and unanimously carried to award C.P. 15:TM to Traffic Marking Service, Inc. of Maple Lake, MN as the low bidder in the amount of $290,367.91. County Highway Right-of-Way Weed Control Quotations were received for the County Weed Control Project for 2015. Motion by Rogness, second by Froemming, and unanimously carried to award the Right-of-Way Weed Control project to L&M Road Services LLC of Lake Park, MN with the low quote of $34,500.00. Appropriate weed control data should be available to the County. Public Works Director Rick West indicated that the arrangement with control of noxious weeds throughout the County by the Soil & Water Conservation Districts is working well especially in the area of education to the public. Highway Department Contract Approval Motion by Froemming, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between the County of Otter Tail and Central Specialties, Inc. of Alexandria, MN for Aggregate Surfacing Class 1 Shouldering Material. This contract is contingent upon the approval of the County Attorney. Erosion Restoration Project Mr. West briefed the Board on an EOT Soil & Water Conservation District (SWCD) Erosion Restoration project planned for right-of-way on County Road 51. Motion by Rogness, second by Johnson, and unanimously carried to approve Right-of-Way Restoration on the eastern side of CSAH No. 51 north of Perham along Little Pine Lake. About one acre of upland on the west shore of Little Pine Lake will be restored to upland prairie wildflowers and grasses. Estimated cost of the project is $11,823.00 with 75% covered by the SWCD and 25% by Otter Tail County. Adult Mental Health Local Advisory Committee Update Co-Chairs Luanne Hansen and Fonda Knudsen discussed the following goals of the Adult MH LAC; 1) to continue supporting the jail system's mental health needs, 2) gain support and partnership of the faith community, and 3) looking at co-occurring mental health issues. Public information regarding co-occurring MH issues will be presented at 6:30 p.m. on May 7, 2015 at M State in Fergus Falls. They indicated that the committee will need additional dollars for continued support and education in this area. OTC Board of Commissioners' Minutes April 14, 2015 Page 3 MAY IS MENTAL HEAL TH MONTH PROCLAMATION Otter Tail County Resolution No. 2015 -26 Upon a motion by Froemming, seconded by Rogness, and unanimously carried, the following resolution was adopted: WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and indispensable to personal well-being, family and interpersonal relationships, and contributes to community and society; and WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five Americans every year, regardless of age, gender, race, ethnicity, religion or economic status; and WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most mental disorders and the efficacy of mental health treatments are well documented; and WHEREAS, Otter Tail County has made a commitment to community-based systems of mental health care for all residents and has appointed Local Mental Health Advisory Committee for children and adults. WHEREAS, the guiding principles of community mental health care have always been comprehensiveness, cost-efficiency, effective management and high-quality and consumer responsive services, and these principles are now being adopted by private and public healthcare payers; and WHEREAS, the National Mental Health Association, the National Council for Community Behavioral Healthcare and their national partners, the National Alliance for the Mentally Ill and their local affiliates observe Mental Health Month every May to raise awareness and understanding of mental health and illness; THEREFORE, we, The Otter Tail County Board of Commissioners, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim May 2015 Mental Health Month in Otter Tail County. As County Commissioners of Otter Tail County we call all citizens, government agencies, public and private institutions, business and schools to recommit our community to increasing awareness and understanding of mental illness and the need for appropriate and accessible services for all people with mental illness. Adopted this 1 th day By: Mental Health Initiative Update Human Services Supervisor Margaret Williams submitted a handout titled "BCOW Adult Mental Health Initiative Annual Report for 2014". The Becker Clay Otter Tail Wilkin (BCOW) Mental Health Initiative 2014 budget was reported as $1,682,953.00. The State budget will be reduced 9% and an additional 4% will be provided to the White Earth Nation. The reported programs include aftercare, housing, crisis, social clubs, and jail projects. Ms. Williams reported that BCOW is using the recent assessment for budgeting and planning mental health services. The State is moving towards 24/7 crisis service. OTC Board of Commissioners' Minutes April 14, 2015 Page 4 Human Services Positions County Administrator Larry Krohn reported that Deb Sjostrom has accepted the Human Services Director position and John Dinsmore is moving to a Community Services Director position overseeing Otter Tail and Becker counties. Plat Book Discussion Land Services Director Brian Armstrong provided flash drives to commissioners containing the Otter Tail County Plat Book. Lengthy discussion took place regarding how to make the Plat Book available to the public and in what format. Mr. Armstrong will take the discussion to the Land Services Committee and return to the County Board for a final decision. Ditch Viewer Motion by Johnson, second by Froemming, and unanimously carried to appoint Jeff Wiebe as an Otter Tail County Ditch Viewer. County Drainage Systems Ditch #36: Motion by Froemming, second by Rogness, and unanimously carried to authorize Jeff Worner to construct a bridge over County Ditch #36 on his property to provide ATV access to a 40 acre parcel in Section 6 of Elmo Township. Mr. Worner will be responsible for all expenses for the project. Ditch #63: Ditch Inspector Kevin Fellbaum reported that the project requested by Lee Uhlig in County Ditch #63 will not be completed this year. The cost of the project is quite high and the work completed on the Altner Lake Outlet and the tile outlet under the railroad tracks may correct Mr. Uhlig's high water problems. County Ditch #30: Mr. Fellbaum reported that a property owner in St. Olaf Township reported problems with a tile that is part of County Ditch #30 but the affected property is part of the County Ditch 70 watershed. The property owner is paying assessments into the County Ditch 70 fund. Mr. Fellbaum reported problems with water flow in Ditch #30 due to changes made by the U.S. Fish and Wildlife Service. Motion by Johnson, second by Rogness, and unanimously carried to authorize Brian Fronning to install tile to drain into a nearby wetland as presented by the Ditch Inspector. Expenses of the project will be Mr. Fronning's responsibility. Commissioners requested that the Ditch Inspector review the Ditch #70 redetermination and talk with the Fish and Wildlife Service about the drainage issues in this area. County Ditch #41/65: Discussion took place regarding the recent Ditch #41 /65 public meeting. Due to the statutory requirements for the Drainage Authority to keep ditch systems flowing, a motion was offered by Froemming, seconded by Johnson, and unanimously carried to proceed with a clean out between Henry Lake and Windy Lake as recommended by the Ditch Inspector. A letter will be provided to the resident' opposed to the clean out including any applicable options. City of Fergus Falls Landfill Permit Motion by Rogness, second by Johnson, and unanimously carried to grant an extension of the City of Fergus Falls Landfill permit to July 31, 2015. Commissioners requested that the Solid Waste Director communicate the need for better protection around the landfill. OTC Board of Commissioners' Minutes April 14, 2015 Page 5 County Administrator Performance Evaluation Motion by Rogness, second by Froemming, and unanimously carried to approve a favorable performance evaluation for County Administrator Larry Krohn as reviewed by the County Board on April 7, 2015. Adjournment At 11 :50 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners adjourned until the next County Board meeting at 9:30 a.m. on Tuesday, April 28, 2015.
