Fir Avenue, Fergus Falls, MN February 24, 2015 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:32 a.m. on Tuesday, February 24, 2015, at the Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chairman; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. Approval of Agenda Chairman Lindquist called for approval of the February 24, 2015 agenda. Motion by Rogness, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of February 24, 2015. Consent Agenda Motion by Rogness, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: 1. February 10, 2015, Board of Commissioners Meeting Minutes 2. Warrants/Bills for February 24, 2015 (Exhibit A) 3. Human Services Bills & Claims 4. Master List of Program Contracts (informational only) 5. County Board of Appeal and Equalization Training Opportunities 6. LG220 Application for Exempt Permit 7. Approval of Final Payment to Mark Sand & Gravel Co. for C.P. 14:1288 Probation Office 2014 Annual Report Chuck Kitzman, Probation Office Director, provided the Probation 2014 Annual Report and the 2015 Program Overview to the Board of Commissioners. A summary of the report was discussed and trends for juvenile and adult offenders were highlighted. Commissioners also discussed various components of the report including theft trends and restitution as well as how theft affects the businesses and economics of the County; the DWI Court program; juvenile out-of-home placement costs and programming available for juveniles both while in their home or in a facility; probation supervision fees; and annual intake numbers. BATTLE LAKE HOTEL PROJECT TAX ABATEMENT REQUEST Otter Tail County Resolution No. 2015 -13 Motion by Huebsch, second by Johnson, and unanimously carried t_o adopt the following resolution: Battle Lake Hotel Project Tax Abatement WHEREAS, Minnesota Statutes, Sections 469.1812 through 469.1815, both inclusive (the "Act"), authorize the County of Otter Tail, Minnesota (the "County"), upon satisfaction of certain conditions, to grant an abatement of all or a part of the taxes levied by the County on certain property; and WHEREAS, the County has received a request, from Battle Lake Hotel Partners, LLC (the "Company") a Minnesota Corporation, whose mailing address is 102 Glenhaven Drive, Battle Lake, Minnesota 56515, owning property located in the County, that the County grant an abatement of property taxes on the following parcels, owned by the Company: 63-000-50-0004-005 63-000-50-0004-011 OTC Board of Commissioners' Minutes February 24, 2015 Page 2 WHEREAS, the Act requires the County to hold a Public Hearing prior to adoption of a resolution granting any property tax abatements. NOW, THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners as follows: 1. A Public Hearing on the consideration of granting a property tax abatement to the Company as requested will be held at the time and place set forth in the Notice of Hearing. 2. The County Auditor -Treasurer is hereby authorized and directed to cause notice of said Hearing to be given one publication in a newspaper of general circulation in the County at least ten (10) days but not more than thirty (30) days before the Hearing. The newspaper must be one of general interest and readership in the County, and must be published at least once per week. Adopted at Fergus Falls, Minnesota, this 24th day of February 2015. OTT Lindquist, Chair Petition to Name a Lake Commissioners acknowledged receiving a Petition to Name a Lake pursuant to M.S. 83A.04 -83A.07. The request is to name an unnamed lake "Brickyard Lake." This lake is located in Everts Township. County Attorney David Hauser discussed that Petitioner is to provide a bond to cover reasonable expenses incurred by the County for the proceeding. After the bond is provided, this can return to the Board of Commissioners for scheduling a hearing on the petition. Order for Petition to Name an Unnamed Lake County Attorney David Hauser discussed that the Petitioner will be notified that a bond is required to cover reasonable expense incurred by the County for the proceeding. At that time, the Board of Commissioners must schedule a hearing on the petition. Recess & Reconvene At 11 :15 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 11 :27 a.m. C.A.R.E. Discussion with State of Minnesota Deb Sjostrom, Interim Human Services Director, provided information regarding the closure of C.A.R.E. facilities throughout the State of Minnesota as recommended by Governor Dayton. Commissioners discussed the need for a transitional plan over a longer period of time to move the services from the County to private facilities. A meeting with State officials including Anne Barry, Deputy Commissioner of Direct Care and Treatment, and Wade Brost, Interim Executive Director, will be scheduled to take place on March 31, 2015, at 1 :00 p.m. Social Worker Positions Motion by Huebsch, second by Rogness, and i.maniinously carried to authorize hiring three social worker positions as·presented by Nicole Hansen, Human Resources Director. The three positions will include a Long-Term Care Social Worker, a Licensing/Adoption Social Worker and Developmental Disabilities Case Manager. Deb Sjostrom, Interim Human Services Director, discussed that adding these social worker positions to the Human Services staff will .meet the needs of the clients and community, and also discussed reimbursement for some of the costs of the positions. OTC Board of Commissioners' Minutes February 24, 2015 Page 3 CY2015 Adult Mental Health Grants Motion by Rogness, second by Johnson and unanimously carried to adopt the CY2015 Adult Mental Health Grants agreement as presented by Deb Sjostrom, Interim Human Services Director. County Ditch 25 Engineer's Repair Report -Phase 2 Kevin Fellbaum, Ditch Inspector, and Blake Carlson ofWidseth, Smith & Nolting, presented the Engineer's Repair Report for Phase 2 of County Ditch 25. Maps regarding Phase 2 were provided and discussed by the Commissioners. Motion by Huebsch, second by Johnson, and unanimously carried that a report, which includes recommendations for repairs to County Ditch 25, is submitted for further action at the Board of Commissioners Meeting on March 24, 2015. The report is also to be provided to the Lakes Improvement District Board and other interested parties prior to the meeting. Ditch 41/65 Petition & Request to Set Hearing Date A petition was submitted by Marylee Legried for removal of property parcel R40000060043000 in Newton Township from a drainage system in accordance with Minn. Stat.§ 103E.805. Motion by Johnson, second by Froemming and unanimously carried to set a hearing for this petition on April 6, 2015, at 7:00 p.m., at the New York Mills Office in New York Mills, Minnesota. Recess & Reconvene At 12:06 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break and a committee meeting. The meeting was reconvened at 1 :22 p.m. Phase #2 Courthouse Remodeling Project Motion by Johnson, second by Rogness and unanimously carried to approve the Certificate of Completion of Phase #2 Courthouse Remodeling Project as presented by Terry Hoff, Physical Plant Manager. · 2015 Boat and Water Grant Motion by Huebsch, second by Froemming and unanimously carried to approve the 2015 Annual County Boat and Water Safety Grant Agreement for $44,648.00 as presented by Chief Deputy Stacy Paulseth, Sheriffs Office. High-Water Damage at Little McDonald, Kerbs, Paul and Devils Lakes Motion by Rogness, second by Froemming and unanimously carried for Commissioners Johnson and Huebsch to testify at the capitol regarding the Lake Improvement District project involving lakes including Little McDonald, Kerbs, Paul and Devils to address ongoing flooding and high water damage. EQUITABLE COST SHARING FOR PUBLICLY OWNED NURSING FACILITIES (ECPN) COLLABORATIVE AGREEMENTS Otter Tail County Resolution No. 2015-14 Motion by Johnson, second by Huebsch and carried three to one with Froemming opposed, to adopt the following resolution (Commissioner Rogness abstained from voting): WHEREAS, the Minnesota legisl?ture authorized equitable cost-sharing for publicly owned nursing facilities (hereafter referred to as ECPN)·programs; and WHEREAS, the ECPN legislation enables nursing facilities owned by non-state governmental entities to benefit from increased payment rates consisting of a subsidy from the government owner that has a federal match; and OTC Board of Commissioners' Minutes February 24, 2015 Page 4 WHEREAS, Minnesota Statutes 256B.441 allows a nursing facility which "is owned or whose license is held by a city, county, or hospital district to apply for a higher payment rate under this section if the local governmental entity agrees to pay a specified portion of the nonfederal share of medical assistance costs; and WHEREAS, As of January 22, 2015, there were 367 Medicaid (MA)-certified and state-licensed nursing facilities in Minnesota with a total of 29,570 active beds; and WHEREAS, the average statewide occupancy rate for nursing facilities was 89.4 percent and that the average number of MA recipients served in nursing facilities during fiscal year 2013 was 16,308; and WHEREAS, Minnesota's rate equalization law, which prohibits nursing facilities that participate in the MA program from charging private pay residents more than MA residents; and WHEREAS, the ECPN designation would allow this Collaborative to submit facility based MA rate increase requests to the Minnesota Department of Human Services; and WHEREAS, Otter Tail County and the participating nursing facilities that comprise this Collaborative would develop the necessary legal documentation that would delineate the fiscal, legal and maintenance obligations of each party, including the parameters of a monthly lease agreement paid by the participating nursing facilities to Otter Tail County; and WHEREAS, such agreements will enable the nursing facilities participating in this Collaborative to increase their MA and private pay rates it charges to nursing facility residents and, in turn, increase pay/benefits to direct care staff; and WHEREAS, such agreements would help .address multiple challenges currently faced.by nursing facilities, including: (a) reduce staff turnover, (b) provide a more competitive wage and benefit package to direct care staff, and (c) improve the quality of services to people in need of residential nursing facility services; and WHEREAS, the State of Minnesota's Department of Human Services will. closely scrutinize these types of agreements/payments to assure "reasonableness" before ECPN designation is approved; and NOW, THEREFORE, BE IT RESOVLVED, that the Otter Tail County Board of Commissioners recognizes and supports the development of ECPN collaborative agreements with eligible nursing facilities and encourages the submission of ECPN documentation to the State of Minnesota's Department of Human Services on or before June 30, 2015. The meeting was reconvened at 2:18 p.m. OTC Board of Commissioners' Minutes February 24, 2015 Page 5 County Board Room Technology Tim Brand, IT Director, discussed computers and monitors that would be used by Commissioners for viewing information as presented during Board meetings. Using a stand-alone monitor would be a screen that would only allow the information presented to be viewed. The computer would require accessing the website to view the information being presented. Motion by Huebsch and second by Froemming, and unanimously approved for Commissioners Rogness and Johnson to work with the IT Department to determine appropriate technology to be used by the Commissioners for viewing information presented during Board meetings. Right-of-Way Acquisition, Evergreen Land Services, SAP 056-638-007 Motion by Johnson, second by Rogness and unanimously carried to approve of the Right of Way Acquisition Quotation Summary and Recommendation for Award to Evergreen Land Services Co., in the amount of $121,275.00 for Right-of-Way Acquisition Services for improvements to CSAH 38, SAP 056- 638-007, as presented by Rick West, Public Works Director. Approval for Out-of-State Travel Motion by Johnson, second by Rogness and unanimously carried for Gordon Cline, Engineering Technician 111, to attend an out-of-state conference for specialized training in La Crosse, WI, on or about March 11, 2015.
