Fir Avenue, Fergus Falls, MN October 28, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, October 28, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the October 28, 2014 agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of October 28, 2014, with one addition to the Consent Agenda. Consent Agenda Motion by Rogness, second by Lindquist, and unanimously carried to approve Consent Agenda items as follows: 1. October 14, 2014, Board of Commissioners Meeting Minutes 2. Warrants/Bills for October 28, 2014 (Attachment A) 3. Human Services Bills & Claims 4. Approve Tobacco Licenses for the Following Establishments: DJ's Powerhouse, Zorbaz on Pelican, Elizabeth General Store & Lakeland General Store 5. Approve Payment to Sanford Clinic Fargo Region, in the amount of $1,166.20 under M.S. 609.35 6. Approve an Excluded Gambling Permit for the Boys & Girls Club Re-Use- It Thrift Store for an Event at The Cactus located in Perham Township Approval of Wetland/Habitat Easement Motion by Huebsch, second by Rogness, and unanimously carried to certify the following U.S. Fish and Wildlife Service waterfowl and habitat protection easements: Swanson, Christopher C. Waterfowl Easement T. 134 N. R. 42W. 5th P.M. Section 2, Government Lot 3, S½NE¼, NW¼SE¼, S½SE¼ EXCEPT the East 1,980 feet of the S½SE¼. Lee, David W. Wildlife Habitat Protection Easement T. 132 N. R. 42W. 5th P.M. Section 33, part of the NE¼NW¼, NW¼NE¼ to be determined by a survey. Perham Resource Recovery Facility Update Commissioner Huebsch reported that the second boiler at the PRRF had to shut down and the contractors are working to solve the issue. The liquidated damages will pay for the lost revenue while the burner is shut down. Commissioner Lindquist spoke in favor of finding a process that removes all the metal out of the ash to make the ash marketable instead of putting it in landfills. OTC Board of Commissioners' Minutes October 28, 2014 Page 2 Public Health Grant Agreement Motion by Rogness, second by Huebsch, and unanimously carried to authorize appropriate County Officials signatures to execute a Grant Project Agreement between the Minnesota Department of Health and Otter Tail County Public Health for $3,000 to be used towards a pilot project to train paramedics and reduce unnecessary visits to Emergency Rooms. Public Health Annual Report Diane Thorson, Public Health Director, presented a document titled "Otter Tail 2013 Local Public Health Act Performance Measures" from the Minnesota Department of Health (MOH). The report aims to enable community health boards to compare capacity and services with CHBs of similar size as well as with the State as a whole. Ms. Thorson reviewed Otter Tail County data and performance measures in the report. The report shows compliance with rules, regulations, and standards as mandated by the State and areas where there are gaps in public health services. Otter Tail County has improved significantly with these measurement standards from the previous report. Recess & Reconvene At 10:20 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:26 a.m. Tax Abatement Request The Auditor and Assessor met with the Board to discuss a request for Tax Abatement going back to 2002 from Wade and Hollie Mills. Auditor, Wayne Stein, explained that the County did not have a survey of the resort and without a survey, land descriptions can be confusing. Mr. Mills had been paying taxes on a parcel next to his resort in error. He received tax abatement for current year and one previous year (2014 and 2013). Commissioner Rogness questioned why the County could not abate the tax as requested. County Officials indicated that State law may not allow going back more than two years. Discussion was tabled for further information on State law. Emergency Management Performance Grant Patrick Waletzko, Emergency Manager, requested approval of the Emergency Management Performance Grant. The dollars will be used for the Code Red program, public education and awareness, and weather radios in public buildings. Discussion took place regarding the best technology for weather notification. Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute the EMPG Grant Agreement (A-EMPG-2014-OTTERCO-00059), in the amount of $30,000.00, between the Minnesota Department of Public Safety and Otter Tail County. 60-Bed Chemical Dependency Facility Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute Amendment No. 1 to Sublease No. 11464-S between the State of Minnesota OHS and the County of Otter Tail for work on the 60-Bed CD Building as presented. Otter Tail County will pay for the work and be reimbursed by the State of Minnesota. Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Building Contract between Comstock Construction, Inc. of Minnesota and the County of Otter Tail for work to be completed at the 60-Bed CD Facility not to exceed total cost of $18,065.00. This motion is conditioned upon the State of Minnesota being responsible for payment of change orders on the project. Forgiveness of Tax Penalty OTC Board of Commissioners' Minutes October 28, 2014 Page 3 Because this request for forgiveness of tax penalty meets the criteria under the County guidelines, a motion was offered by Huebsch, seconded by Rogness, and unanimously carried to approve forgiveness of tax penalty, in the amount of $24.10, for the following parcels owned by Dale Jokela: 76000080030001, 73000080003005, & 40000070058000. ADOPTION MONTH NOVEMBER 2014 Otter Tail County Resolution No. 2014 -51 WHEREAS, the family, serving as the primary source of love, identity, self-esteem and support, is the very foundation of our communities, our state, and our Country; and WHEREAS, adoption gives children who have been orphaned, abandoned, or abused a precious second chance at happiness, a chance to love and be loved and to reach their full potential in a secure, supportive environment; and WHEREAS, as of September 1, 2013, there are 889 children under state guardianship, many waiting to be adopted into a family; and WHEREAS, the majority of the families seeking children for adoption are pursuing the adoption of younger children. In 2013, of the children waiting to be adopted in the State of Minnesota, 33% were 12-18 years old; 30% were 6-11 years old; 37% were under 6 years old. The Majority of children who come under the Guardianship of the Commissioner of Human Services have been abused or neglected and have mental health issues; and WHEREAS, there is a continued need for an increased number of families in the State of Minnesota and in Otter Tail County who will adopt older children with special needs; and WHEREAS, both the public and private sectors are working together as a "team" to find adoptive homes for the children throughout the counties and the State of Minnesota. NOW, THEREFORE, we, The Otter Tail County Board of Commissioners as the Otter Tail County Human Services Board, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim November as Adoption Month in Otter Tail County. In honor of this event, we encourage community agencies, religious organizations, businesses and others to celebrate adoption, honor families that grow through adoption, further an awareness of the changes and issues in adoption, and focus attention on those children who live in the shadow of an uncertain future while they await permanent families. Upon the motion of Commissioner Lindquist, seconded by Commissioner Rogness, and passed on a 5-0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. Adopted at Fergus Falls, Minnesota, this 28th day of October, 2014 OTC Board of Commissioners' Minutes October 28, 2014 Page4 AMC Health & Human Services Polley Committee Update Deb Sjostrom, Interim Human Services Director, briefed the Board on the Association of Minnesota Counties Health and Human Services Committee priority items for 2015. Ms. Sjostrom and commissioners discussed Administrative Simplification and County representation on the MNsure Board as Otter Tail County priority items. Registered Land Survey No. 19 Motion by Huebsch, second by Froemming, and unanimously carried to approve Registered Land Survey No. 19, which consists of 3 residential back lots all in excess of 5 acres in size, located in Section 30 and 31 of Corliss Township across from Pine Lake (56-130). Conditional Use Application MCMK Properties: Michele Brandt Motion by Huebsch, second by Froemming, and carried with Johnson abstaining, to approve the Conditional Use Permit request of MCMK Properties to relocate the road as presented for reasons as cited by the Planning Commission. The proposal is located in Pelican Lake Park 1st Addn Lot 1 & E 50' of Blk Res & Pt of GL 6, Section 5 of Dunn Township; Pelican Lake (56-786), GD. Recess & Reconvene At 11 :09 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 11 :17 a.m. Tax Abatement Request David Hauser, County Attorney cited M.S. 375.192 which allows abatement of taxes for the current year and two prior years only for clerical error or failure to file based upon the hardship of the individual. Clerical error was defined as a data entry error. After careful research and to observe state law, Commissioner Rogness offered a motion, seconded by Lindquist and unanimously carried, to deny the abatement request of Wade and Hollie Mills because the maximum abatement has been provided. Highway Contracts Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and Central Specialties, Inc. of Alexandria, MN, for Shoulder Base Aggregate Class 1 Material Crushing. Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and Landwehr Construction, Inc. of St. Cloud, MN, for the Erosion Control Project on C.H. 114. Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and Barry Construction, Inc. of Fergus Falls, MN, for the C.H. 110 Culvert Replacement Project. Highway Construction Project Motion by Huebsch, second by Rogness, and unanimously carried to authorize Anderson Bros Construction Co. of Brainerd, MN, to complete an emergency, temporary rip rap project on CSAH 34 west of Perham to protect the recent grade raise because of flooding in the area. Electronic Signatures with the State of MN Motion by Froemming, second by Rogness, and unanimously carried to authorize Mike Hanan, Solid Waste Director, and Wayne Stein, Auditor, to register for authorization to approve and sign contracts with the State of Minnesota through their new SWIFT Statewide Integrated Financial Tool. This process will allow electronic signatures. OTC Board of Commissioners' Minutes October 28, 2014 Page 5 Notice from Environmental Quality Board Rick West, Public Works Director, reported that the EQB has contacted Otter Tail County. The EQB reported that a valid citizen's petition has been filed requesting an Environmental Assessment Worksheet (EAW) for the Pelican Rapids to Perham multi-use trail proposal. Motion by Huebsch, second by Froemming, and unanimously carried to appoint Rick West as the County's contact person with the EQB regarding the proposed trail plan. It was noted that there is not a proposed project at this time. Adjournment At 11 :45 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners adjourned.
