Fir Avenue, Fergus Falls, MN September 16, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, September 16, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the September 16, 2014 agenda. Motion by Rogness, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of September 16, 2014 with the following additions: • Solid Waste Market Price Resolution • Public Works Committee at 3:00 p.m. regarding Highway Items Consent Agenda Motion by Lindquist, second by Rogness, and unanimously carried to approve Consent Agenda items as follows: 1. September 9, 2014, Board of Commissioners Meeting Minutes 2. Warrants/Bills for September 16, 2014 Community Paramedic Project Diane Thorson, Public Health Director, explained the Community Paramedic Program as a new type of health service. This is an emerging profession to extend services at lower costs than the way existing services are delivered. This type of programming could extend to dental practitioners and community health workers. Ms. Thorson spoke with Lake Region HealthCare and Ringdahl Ambulance for their interest in partnering with Public Health to begin this program. She submitted a grant application for the program in the amount of $25,000 and has pledged $5,000 for the establishment of a program in 2015. MINNESOTA DNR PARKS & TRAILS LEGACY GRANT PROGRAM Otter Tail County Resolution No. 2014 -46 WHEREAS, the County of Otter Tail supports the grant application made to the Minnesota Department of Natural Resources for the Parks and Trails Legacy Grant Program. The application is to construct one and one third (1.33) miles of paved trail for the Perham to Pelican Rapids Regional Trail. The Trail system is located within Otter Tail County, and WHEREAS, the County of Otter Tail recognizes that it has secured $50,000 in non-state cash matching funds for this project. NOW, THEREFORE, BE IT RESOLVED, if the County of Otter Tail is awarded a grant by the Minnesota Department of Natural Resources, the County of Otter Tail agrees to accept the grant award, and may enter into an agreement with the State of Minnesota for the above referenced project. The County of Otter Tail will comply with all applicable laws, environmental requirements and regulations as stated in the grant agreement, and OTC Board of Commissioners' Minutes September 16, 2014 Page 2 BE IT FURTHER RESOLVED, the Otter Tail County Board of Commissioners names the fiscal agent for the County of Otter Tail for this project as: Richard West, County Engineer & Public Works Director Otter Tail County, 505 South Court Street, Fergus Falls, MN 56537 BE IT FURTHER RESOLVED, the County of Otter Tail hereby assures the Perham to Pelican Rapids Regional Trail will be maintained for a period of no less than 20 years and land acquisitions will require a perpetual easement for recreational trail purposes. Upon the motion of Commissioner Huebsch, seconded by Commissioner Johnson, and passed on a 5-0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. Highway Project Contracts Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Highway Department projects: CSAH 52 Culvert Replacement -Landwehr Construction, Inc. of St. Cloud, MN CSAH 53 Culvert Replacement -Landwehr Construction, Inc. of St. Cloud, MN C.P. 14:SALT-Sand Storage Building at Hwy Garage 1 -Greystone Construction of Shakopee, MN Long Term Sustainability Plan The Public Works Director reported that the University of Minnesota Center for Changing Landscapes is not in the position to spearhead a long term sustainability land use plan for Otter Tail County as had been previously discussed. Lengthy discussion took place regarding current land use regulations that include a large part of the County under the Shoreland Management Ordinance as well as other regulations. In addition, the County is working on a Master Transportation Plan and Trails Plan which could become a part of a long term sustainability plan in the future. MARKET PRICE FOR THE SOLID WASTE MANAGEMENT TAX Otter Tail County Resolution No. 2014 -47 WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market price if the political subdivision: Subsidizes the cost of service at a facility. WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market price amount identified through this resolution. WHEREAS, the market price is identified in state statutes as the "lowest price available in the area". OTC Board of Commissioners' Minutes September 16, 2014 Page 3 Q WHEREAS, Otter Tail County has performed research to identify the lowest price available in the area; THEREFORE, the County of Otter Tail declares a market price of $64.48 per ton for a facility, based on a tipping fee amount of $35.59 per ton at the Dakota Landfill and an additional contracted transportation cost of $28.89 per ton. 0 0 Upon the motion of Commissioner Froemming, seconded by Commissioner Rogness, and passed on a 5-0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. Adopted at Fergus Falls, Minnesota, this 16th day of September, 2014 Dated: ---"O"-''f..,l~a~~,.,,_I '~"~---OF COMMISSIONERS Recess & Reconvene Al 10:24 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:29 a.m. Planning Commission Recommendations Preliminary Plat "Recreational Retreat", Dave Wenzel: Motion by Huebsch, second by Froemming, and unanimously carried to approve the Preliminary Plat titled "Recreational Retreat" consisting of five non-residential, non-riparian lots with conditions as recommended by the Planning Commission. The Preliminary Plat is located in Pt of GL 3 & SE¼ NW¼, Section 3 of Edna Township; Little McDonald Lake (56-328), GD. Conditional Use Permit -Kimp's Kamp. John Kimple: Motion by Froemming, second by Rogness and unanimously carried to approve a Conditional Use Permit for several projects at Kimp's Kamp resort with conditions as recommended by the Planning Commission. The proposal is located in Yaquina Bay Lots 1-13 Blk 1, Lots 1-3 Blk 2, Lots 4 & 5 Blk 2, 7.80 AC strip adj to Lots 1-13 Blk 1 & Lots 1-3 Blk 2, Section 8 of Dead Lake Township; Dead Lake (56-383), NE. Conditional Use Permit -Jamie & Maria Peterson: Motion by Lindquist, second by Froemming, and unanimously carried to approve a Conditional Use Permit for construction of retaining walls with a condition as recommended by the Planning Commission. The project is located in National Community Service Camp Lot 5 & 58 and vacated road & adj alley, Section 13 of Dora Township; West McDonald Lake (56-386), RD. Conditional Use Permit-Covenant Capital LLC, Darrin Trites: Discussion took place regarding the language in the Planning Commission recommendation to deny a multiple family rental business in a single family residential home. Neighbor, Steve Zimmerman, provided the commissioners with his explanation of what has occurred at the rental home and expressed his opinion that any rental (even to single families) is a commercial venture. The County Attorney indicated that Otter Tail County's zoning under the Shoreland Management Ordinance prohibits multi-family rentals in a single family residential classification. Motion by Lindquist, second by Froemming, and unanimously carried to deny a Conditional Use Permit for a multiple family rental business (commercial use) because it is incompatible with the existing single family residential nature of the area. OTC Board of Commissioners' Minutes September 16, 2014 Page4 Conditional Use Permit-MCMK Properties, Michele Brandt: Motion by Rogness, second by Lindquist, and carried with Johnson abstaining, to table the Conditional Use Permit request of MCMK Properties to relocate a road until the October Planning Commission meeting (10108/14) because there was confusion with the date and time for the Planning Commission to hear this request. Applicant, Michele Brandt, agreed to waive the 60 day rule. Property owners affected by this request will be notified of the rescheduled hearing date. County Ditch #25 Motion by Huebsch, second by Lindquist, and unanimously carried to authorize Brady Merz to replace a culvert within Branch 1 of County Ditch #25 in Section 25 of Dora Township as presented by the County Ditch Inspector. Mr. Merz will pay for all expenses to install the culvert. Red Horse Ranch Classification Discussion Doug Walvatne, Assessor, provided a fact sheet titled "Assessment Facts for the Red Horse Ranch Property" and briefed the County Board regarding the process of valuation for the Red Horse Ranch property and arena. He included guidelines for ·c_lassifying this type of property and a summary classification letter from the Minnesota Department of Revenue. Lengthy discussion took place regarding the difficulty of finding similar properties for valuation, a new proposed agritourism classification, and looking at how other events are valued for taxation in other counties; e.g. Wee Fest in Becker County. Meeting with Legislators The County Board and Division Directors met with local legislators, Representative Steve Green and Senator Bill lngebrigtsen, from 11 :30 a.m. to 1 :30 p.m. in the Otter Tail Lake room at the Government Services Center in Fergus Falls. The following were the discussion items: 0 1. How money is determined to be distributed in a Bonding Bill -how does Otter Tail County get their Q fair share? 2. Transportation funding, where are we, and what we need: a. increase in existing gas tax, and b. legislation to allow all counties to impose their own gas tax that stays in the county. 3. Changing State Statue so an individual who owns property in a Watershed District can serve on the WO Board even if their residence is outside of the District. 4. Help with the LMKP LID project. The State of MN is allocating 40 million dollars for floods and parts of Otter Tail County have been flooding over time and Otter Tail County is receiving no help. Consideration of Tax Abatement Policy Modification At 1 :30 p.m., upon completion of the Legislator's meeting, Chairman Johnson declared the Board of Commissioners' meeting recessed for an Internal Services Committee. At 2:05 p.m., Chairman Johnson declared the Board of Commissioners' meeting reconvened with Commissioners Rogness, Lindquist, Froemming, and Johnson present. Commissioner Huebsch was absent. Wayne Stein, County Auditor and Kelcey Klemm and Chuck Johnson, Perham City Officials, explained the current economic development financing options. They indicated that, due to State regulations, there is a void between the high income and low income levels in providing affordable housing. Commissioner Rogness, supporting continued discussion regarding this topic, offered a motion to set a Public Hearing for tax modification for Grow Perham, LLC at 11 :00 a.m. on Tuesday, September 30, 2014, at the Government Services Center in Fergus Falls, MN. The motion was seconded by Commissioner Lindquist and passed on a 4-0 vote with Commissioner Huebsch absent. Recess & Reconvene Chairman Johnson recessed the meeting of the Board of Commissioners at 2:27 p.m. and reconvened the meeting at 2:30 p.m. 0 OTC Board of Commissioners' Minutes September 16, 2014 Page 5 0 AudioNisual Options for County Board Room 0 0 Jeremy Kirt, MARCO Representative and Tim Brand, IT Director, provided two proposals for an audio/visual upgrade in the County Board room at the Government Services Center. Motion by Rogness, second by Huebsch, and unanimously carried to move forward with an AudioNisual project for the County Board room subject to alterations as advised by the AudioNisual Project Ad Hoc Committee. Adjournment At 3:06 p.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners adjourned.
