Fir Avenue, Fergus Falls, MN May 13, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, May 13, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the May 13, 2014 agenda. Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of May 13, 2014 with. the following additions: • Library Funding Discussion • Sheriffs Department Retirement Presentation • Additional Auditor Agenda Items Consent Agenda . Motion by Froemming, second by Lindquist, and unanimously carried to approve Consent Agenda items except for 2.5, CSAH 36 Culvert Replacement contracts and bonds. Consent Agenda item 2.5 will be considered during the Public Works Director time frame. Consent Agenda approved as follows: 1. May 6, 2014 Eloard of Commissioners' Minutes 2. Warrants/Bills for May 13, 2014 (Attachment A) 3. Fiscal Host Lease Agreement for PurchasE! of Vehicles for the WC Narcotics Task Force 4. Request for Approval to Commute with Vehicles for SAP 056-650-007, SP 056-601-057 & CP 14:128B & Etc. 5. Human Services Bills & Claims Retirement Recognition Motion by Rogness, second by Froemming, and unanimously.carried to authorize Commissioner Lindquist to recognize Lieutenant Matthew McGuire on behalf of the County Board during his retirement appreciation event May 31, 2014. Library Funding Discussion Commissioners and the County Administrator discussed Viking Library and local library funding and the various funding sources. West Central Regional Juvenile Center Chuck Kitzman, Probation Director, briefed the Board on the April 17, 2014 WCRJC Board meeting. He reported that CY2013 was a good year for the facility financially because of non-member usage. CY2013 revenues over expenditures were reported as $137,770.26. A portion of these dollars will be paid back to Clay County under a repayment agreement. Discussion took place about starting .a reserve fund and/or reducing the operation per diems. By consensus, Commissioners encouraged the WCRJC Advisory Board to use some of the additional dollars to reduce per di ems slightly which could give the facility a competitive edge In attracting additional clients. Mr. Kitzman reminded commissioners that Benson Psychological is sponsoring a seminar on "Treating the Juvenile Who has Sexually Offended" June 12, 2014 at the Bigwood Event Center in Fergus Falls. OTC Board of Commissioners' Minutes May 13, 2014 Page 2 County Drainage System #70 Order David Hauser, County Attorney, opened discussion regarding additional information needed to complete the Findings of Fact and Order for the Ditch #70 proposed improvement project. Lengthy discussion took place regarding the Environmental Assessment Worksheet (EAW) and the amount of the additional bond required to proceed with the project. Public Hearing for Amendments to the Comprehensive Local Water Management Plan At 10:00 a.m., Chairman Johnson opened the Public Hearing to receive comment on proposed Amendments to the Otter Tail County Local Water Management Plan (LWMP), Representatives from West and East Soil and Water _Conservation Districts (SWCD) and Bill Kalar, Land & Resource Director; presented the proposed amendments in summary format and provided the complete Water Plan. The Water Plan is a 10-year plan with a requirement to update the plan every 5 years. Two informational meetings were held (one in Fergus Falls and one in Perham) to provide education and accept public comment. Discussion took place regarding th!J proposed changes, the estimated cost for various projects, the grant funding process, and how the Water Plan assists with grant funding and prioritizing projects. Motion by Lindquist, second by Froemming, and unanimously carried to approve the proposed Amendments to the Otter Tail County Local Water Management Plan with a suggested addition for pollinators under the Wildlife Section. The updated Water Plan will be sent to the MN Board of Water and Soil Resources (BWSR) for their Committee's review and comment with final approval of the Amendments expected September 2014. Recess & Reconvene At 10:20 a.m., Chairman Johnson closed the Public Hearing and recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 10:28 a.m. · Credit Card Approval Motion by Rogness, second by Lindquist, and unanimously carried to amend the previous approval to issue a credit card to Brenda K. Shoemaker, Assessor's Administrative Supervisor, to allow a 30 day limit of $500.00 rather than $250,00, Liquor License Applications Motion by Froemming, second by Lindquist, and unanimously carried to approve the following Liquor License Applications: *Joseph Hilber, dba Lida Greens . On-Sale 3.2 Malt Liquor Bruce Allen Finkelson, dba Clear Lake Resort "Chad & Amanda Weller, Renewal of Consumption & Display Permit On-Sale Liquor License until 06/30/14 dba Firehouse Bar & Grille Inc 'subject to review of the Sheriffs and County Attorney's Offices .. subject to review of the Sheriffs and County Attorney's Offices and submission of insurance certificate Sale of Tax-Forfeited Property Motion by Huebsch, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following documents subject to the review of the County Attorney: • Quit Claim Deed Between the County of Otter Tail & State of Minnesota dated May 13, 2014 for the unplatted portion of Government Lot 4, Section 9, Township 136 North, Range 38 West, Otter Tail County, Minnesota, lying north and east of an existing Township Road • Affidavit of Landowner dated May 13, 2014 OTC Board of Commissioners' Minutes May 13, 2014 Page 3 Lake Region Healthcare Meeting Motion by Froemming, second by Lindquist, and unanimously carried to authorize Commissioners to attend the Neighborhood meeting at Lake Region Healthcare at 5:30 p.m. May 19, 2014. Dog Bite Hearing Jessica Metzger, Public Health Nurse, reported that the dog, Jack, owned by William Roach has bitten twice. The Otter Tail County Animal Health and Control Ordinance mandates that a hearing be held to determine how to deal wijh the dog to ensure the protection of the public. Jessica Metzger was placed under oath and testified that Mr. Roach could not attend the hearing and did not request a different time for the hearing. Ms. Metzger testified that the facts, as submitted to the Board in writing, are accurate. Motion by Froemming, second by Lindquist, and unanimously carried to approve the proposed settlement as submitted by the Public Health Department with all directives in the settlement completed within ten working days of the receipt of the letter/settlement. The County Attorney will draft findings and an Order for the default hearing. Contract Approval for CSAH 36 Culvert Project Motion by Rogness, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Contract between the County of Otter Tail and Landwehr Construction, Inc. of St. Cloud for the CSAH 36 Culvert Replacement project in Government Lot 1, Section 26 of Hobart Township east of Vergas, MN. Engineering Services for CSAH 52 Culvert Motion by Lindquist, second by Rogness, and unanimously ·carried to authorize the appropriate County Officials' signatures to execute an Agreement between the County of Otter Tail and KLJ, Inc. for hydraulic analysis of the CSAH 52 culvert approximately 800' east of the Leaf River crossing intersection on CSAH 52. Speed Zone Study Request A segment of CSAH No. 61 In the City of Perham, MN , Otter Tail County Resolution No. 2014 -34 Motion by Huebsch, seconded by Froemming, and unanimously carried to adopt the following resolution: WHEREAS, the City of Perham has requested that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on the segment of County State Aid Highway No. 51 from the intersection of County State Aid Highway No. 80 (Main Street) east than north approximately 1.30 miles to 450th Street, AND WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by· the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive . . Motion by Rogness, second by Lindquist, and unanimously carried to award this joint project between the County of Otter Tail and City of Fergus Falls to the low bidder, Mark Sand & Gravel Co., in the amount of $1,936,034.44 contingent upon the approval of the City of Fergus Falls. The project Includes a reconstruction on County Highway 27 from Cle_veland north to Woodland Heights Addition and a mill and overlay on Fir Avenue from County Highway 1 by the YMCA west to Casey's. S.A.P. 056-621-025 & Etc: After previously advertising for bids for work on CSAH 21, CH 144 & CH 120, bids were opened May 7, 2014. Motion by Lindquist, second by Rogness, and unanimously carried to award this project to Mark Sand & Gravel Co. of Fergus Falls, MN, as the low bidder in the amount of $1,507,973.03. S.A.P. 056-603-009 & Etc: After previously advertising for bids for the County Wide Seal Coat project, bids were opened May 7, 2014. Motion by Huebsch, second by Froemming, and unanimously carried to award this project to Asphalt Surface Technologies Corporation (ASTECH) of St. Cloud as the low bidder in the amount of $1,122,649.56 as recommended by the Public Works Director. S.P. 056-070-014: MN HS/P 5614(153): After previously advertising for bids for the Rural Intersection Lighting project, bids were opened May 7, 2014. Motion by Froemming, second by Lindquist, and unanimously carried to award this project to Otter Electric LLC, of Fergus Falls, MN as the low bidder in the amount of $176,527.40 as recommended by the Public Works Director: C.P.14:TM: After previously advertising for bids for the 2014 County Wide Traffic Marking project, bids were opened May 7, 2014. Motion by Huebsch, second by Rogness, and unanimously carried to award this project to Traffic Marking Service, Inc. of Maple Lake, MN in the amount of $261,709.01 as recommended by the Public Works Director. Recess & Reconvene At 11 :26 a.m., Chairman Johnson closed the Public Hearing and recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board .of Commissioners meeting was reconvened at 11 :33 a.m. Chemical Dependency/Detox Annual Report Deb Sjostrom, Interim Human Services Director and Margaret Williams, Human Services Supervisor: presented the CD Annual Report 2013 Overview. The report included a listing of current staff members in the unit and statistical information. Discussion took place on the various CO treatment funding mechanisms, cost of treatment, and theoretical result of the expansion of Medical Assistance and the Affordability Care Act (ACA). Human Services Staffing OTC Board of Commissioners' Minutes May 13, 2014 Page 5 Deb Sjostrom presented a Hiring Request form to fill three (3) full time employee (FTE) Lead Worker positions. Lengthy discussion followed. Motion by Rogness, second by Lindquist, and unanimously carried to authorize the Human Services Director to fill, by promotion, a Disability Services Waiver Lead Worker position on a trial basis. The Lead Worker position will be approximately 50% case management and 50% program and process work. The additional time needed for case management will be contracted by an outside provider. This may require a meeting with the union to develop a Memorandum of Understanding because this is a new position filled by promotion. Adjournment At 12:02 p.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners adjourned. The next County Board meeting is scheduled at 9:30 a.m. on Tuesday, May 20, 2014.
