Fir Avenue, Fergus Falls, MN May 6, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, May 6, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the May 6, 2014 agenda. Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of May 6, 2014 with the following additions: • West Central Minnesota Housing Summit • Bois de Sioux Watershed District Representation Consent Agenda Motion by Lindquist, second by Huebsch, and unanimously carried to approve Consent Agenda items as follows: A. PROCLAMATION In Support of OTC Board of Commissioners' Minutes May 6, 2014 Page 3 "NATIONAL DRUG COURT MONTH" Otter Tall County Resolution No. 2014 -33 Commissioner Froemming offered the following and moved its adoption: WHEREAS, This year marks the 251" Anniversary of the nation's first Drug Court, and WHEREAS, Over the past twenty-five years Drug Courts have served over 1.4 million Individuals; and WHEREAS, Drug Courts are now recognized as the most successful criminal justice intervention in our nation's history; and WHEREAS, Drug Courts save up to $27 for every $1 invested and produce up to $13,000 for every individual they serve; and WHEREAS, 75% of Drug Court graduates will never see another pair of handcuffs; and WHEREAS, Drug Courts significantly improve substance-abuse treatment outcomes, substantially reduce drug abuse and crime, and do so at less expense than any other justice strategy; and WHEREAS, Drug Courts facilitate community-wide partnerships, bringing together public safety and public health professionals in the fight against drug abuse and criminality; and WHEREAS, There are now 2,840 Drug Courts nationwide; and WHEREAS, Drug Courts are the cornerstone of criminal justice reform sweeping the nation; and WHEREAS, the extraordinary expansion of Drug Courts and the principles and practices 25 years ago has helped cause 40 years of escalating prison populations lo decline; and WHEREAS, Drug Courts demonstrate that when one person rises out of drugs and crime, we ALL RISE; and WHEREAS, the time has come to put a Drug Court within reach of every eligible person in need. WHEREAS, Otter Tail County has joined in the support of "Drug Courts" by implementing the DWI Court, March 2008. THEREFORE, BE IT RESOLVED, that Otter Tail County declares that a "Drug Court Month" be established during the Month of May, 2014, recognizing the significant contributions Drug Courts have made over the past 25 years toward reducing substance abuse, crime, and recidivism while saving valuable resources. Motion by Lindquist, second by Froemming, and unanimously carried to authorize Commissioners to attend a Housing Summit Friday, May 9, 2014 at the Bigwood Event Center in Fergus Falls. Motion by Huebsch, second by Lindquist, and unanimously carried ta authorize Commissioners to attend the Safe Communities Coalition luncheon on May 14, 2014 and/or the BCBS Technical Urbanism project seminar also an May 14, 2014, at the Bigwood Event Center in Fergus Falls. Bois de Sioux Watershed District Representation Commissioner Lindquist indicated that he has been unable ta recruit a representative far Otter Tail County for an upcoming vacancy on the Bois de Sioux Watershed District. David Hauser, County Attorney referred to M.S. 103D, which requires advertisement far the open seat. A letter will also be sent to residents in the District to solicit a representative. Bid Award-S.P. 056-070-012 & 013: MN Project No. HSIP 6614(1131 After previously advertising for bids for Otter Tail County Paved Shoulders and Rumble Strips, the bids were opened at 1 :00 p.m. on March 19, 2014. Motion by Rogness, second by Huebsch, and unanimously carried to award this project to the low bidder, Anderson Brothers Construction Campany of Brainerd, MN in the bid amount of $621,445.00. Bid Award -S.P, 056-601-057: MN Project No. STPM 6614(0891 After previously advertising far bids for the CSAH 1 Overlay project starting at CSAH 35 and running east to CSAH 45 near Phelps Mill, the bids were opened at 1:00 p.m. on March 19, 2014. Motion by Rogness, second by Froemming, and unanimously carried to award this project to the low bidder, Mark Sand & Gravel Co. of Fergus Falls, MN in the bid amount of $921,774.81. Agreement for S.A.P. 056-608-026 Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement for Repair and Replacement of .CSAH No. 8 from Coney St. north to Highway 80. This is a joint project with the City of Perham. Maintenance Cooperative Agreement between Otter Tall County and MN DNR Central Lakes State Trail Maintenance Otter Tall County Resolution No. 2014. 32 Upon a motion by Rogness, seconded by Froemming and unanimously carried, the following resolution was adopted: WHEREAS, pursuant to Minnesota Statutes 85.015, sub. 23 and 471.59 the State is empowered to engage such assistance as deemed necessary and the State is in need of routine maintenance services on the Central Lakes Trail in Otter Tail County, AND WHEREAS, Otter Tail County is agreeable to provide the routine maintenance services as described in the Maintenance Cooperative Agreement for an annual rate of $1,100.00 per mile. BE IT RESOLVED, that Otter Tail County will provide the maintenance services as per the Maintenance Cooperative Agreement expiring December 31, 2014 at the annual rate of $1,100.0Q_per mile on the Central Lakes Trail. · · · · , · · · · OTC Board of Commissioners' Minutes May 6, 2014 Page 5 BE IT FURTHER RESOLVED, the County Board Chair and The County Board Clerk are hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the MN Commissioner of Natural Resources prescribing the terms and conditions of same Maintenance Cooperative Agreement for the routine maintenance of the Central Lakes Trail expiring December 31, 2014. Adopted at Fergus Falls, Minnesota, this 5th day of May, 2014. OF COMMISSIONERS RESOLUTION DESIGNATING COUNTY STATE AID HIGHWAY LOCATION County Highway No, 145 Otter Tall County Resolution No. 2014 • 31 Upon a motion by Froemming, seconded by Huebsch and unanimously carried, the following resolution was adopted: WHEREAS, it appears to the County Board of Commissioners of the County of Otter Tail that the highway right of way required for County Highway No. 145 should be accurately described and located by a highway right of way plat. NOW, THEREFORE, BE IT RESOLVED by the County Board of Commissioners of the County of Otter Tail that the Board of County Commissioners for the County of Otter Tait is hereby designating the definite location of County Highway No. 145 from County State Aid Highway No. 72 Northerly in Government Lots 1, 2, 3, 4 and the Northwest Quarter of the Northeast Quarter, Section 32, Township 134 North, Range 40 West of the 5th Principal Meridian as shown on the 2 pages of OTTER TAIL COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 21. Discussion followed. The next step In developing the Transportation Plan is for the consultant to provide a briefing on the entire process. Mr. West reported that the Herbicides purchased under State Bid Contract #44522 previously awarded to Crop Production Services, Inc. and Prochem, LLC has been extended for another year to April 30, 2015. The Board of Commissioners meeting was reconvened at 10:34 a.m. County Drainage Systems County Ditch #4: Motion by Rogness, second by Froemming, and unanimously carried to authorize the Ditch Inspector to remove beavers and beaver dam In County Ditch 4 in Section 28 of Elmo Township. The cost will be paid out of the County Ditch 4 Maintenance Fund. · · County Ditch #16 & Ditch #52: Kevin Fellbaum, County Ditch Inspector, briefed the Board on the situation in County Ditch #16 relative to a proposed rock weir for fish passage and work already completed in Ditch #52 to prevent flooding on County Road 47. County Ditch #70: Mr. Fellbaum provided pictures of a plugged outlet/culvert in County Ditch #70 that continues to become plugged and needs to be repaired/replaced, County Ditch #25: Mr. Fellbaum presented quotations from Blake Carlson of WSN Engineering for work in County Ditch #25. Discussion followed. Motion by Huebsch, second by Rogness, and unanimously carried to accept Quote #3 from Widseth Smith Nolting, to survey all, draft profiles and cross-sections and redetermine the original ditch grade at a cost not to exceed $32,000 as presented. Motion by Lindquist, second by Froemming, and unanimously carried to remove two beaver dams in Ditch #25; one north of Engstrom Beach Road and one south of Archie Lake. Recess & Reconvene At 10:58 a.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners for a short break, The Board of Commissioners meeting was reconvened at 11 :08 a,m, Consultant Agreement for Food. Lodging and Pool Licensing Motion by Huebsch, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Consultant Agreement between the County of Otter Tail and Tech Tronix of Fergus Falls, MN. The purpose of the Contract is to develop the required documentation for Otter Tail County to obtain a delegation agreement from the Minnesota Department of Health (DOH) for the Drinking Water and Food Safety Program at an hourly rate of $50.00 not to exceed $30,000 for the ,project. . The Board of Commissioners meeting was reconvened at 1 :01 p.m. OTC Board of Commissioners' Minutes May 6, 2014 Page 7 County Ditch #70 Continued Discussion Houston Engineer Jeff Langen, indicated that most of the questions after the Preliminary Public Hearing, involved the DNR's environmental issues expressed in their letter and whether or not an Environmental Assessment Worksheet (EAW) will be required. Lengthy discussion took place about an EAW, the permitting process, and total benefits of the ditch. Motion by Rogness, second by Lindquist, and unanimously carried to proceed with the Ditch #70 Improvement project subject to the petitioners providing adequate additional funding. The County Attorney will work with the Engineer to draft an Order to proceed with the project and return to the County Board. Adjournment At 2:02 p.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners adjourned for additional committee meetings. The next County Board meeting is scheduled at 9:30 a.m. on Tuesday, May 13, 2014.
