Fir Avenue, Fergus Falls, MN April 1, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, April 1, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the April 1, 2014 agenda. Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of April 1, 2014 with the following modifications: • 11 :50 a.m. -Internal Services Committee (Building) Canceled • 1 :30 p.m. -Public Works Committee (Phelps Mill) • Sheriffs Office Toughbook Computers • Review of Perham Resource Recovery Board Meeting Consent Agenda Motion by Huebsch, second by Froemming, and unanimously carried to approve the Consent Agenda items as follows: A. March 25, 2014 Board of Commissioners' Minutes B. Warrants/Bills for April 1, 2014 (Attachment A) C. Final Payment to AAA Striping Service for S.P. 088-070-034, HSIP 8813 (234) D. Authorization to Sign Otter Tail County Audit Engagement Letter E. Approval of LG220 Application for Exempt Permit for Pheasants Forever F. Surveyor's Certificate of Correction to the Plat of Robinson's Addition U.S. Fish & Wildlife Service Wetland Easements USFWS Representatives appeared before the Board and requested certification of several waterfowl easements. Documentation was previously submitted regarding the easements. Motion by Huebsch, second by Froemming, and unanimously carried to approve certification for the USFWS to secure the following waterfowl easements: Sean P. Abernathy: T. 131N. R.39W. 5th P.M. Section 12, the South Half of the Northwest Quarter S½NW¼), according to the United States Government survey thereof. EXCEPT That part of the Southeast Quarter of the Northwest Quarter (SE¼NW¼) described as follows: The South 510.00 feet of the East 641.00 feet (as measured along and parallel with the East and South lines of said SE¼NW¼). Computer Purchase Motion by Huebsch, second by Froemming, and unanimously carried to authorize purchase of two additional Toughbook laptop computers for the Sheriff's office patrol vehicles from CDW-G. The purchase of eighteen toughbook laptops was authorized at the March 25, 2014 County Board meeting. All expenses will be paid from the Capital Improvement Fund. Perham Resource Recovery Facility {PRRF) Update Commissioner Huebsch reported on the most recent PRRF Board meeting. He indicated that the new equipment is being tested and burning very efficiently. The new facility will be running at full capacity very soon. HIPAA Privacy and Security Policies Diane Thorson, Public Health Director, briefed the Board regarding Otter Tail County's proposed Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security Policies. Ms. Thorson plans to request approval of the final policies April 22, 2014. Public Health Contract The Minnesota Department of Health (DOH) has released funding for costs incurred to train staff for NFP and HFA Family Home Visiting programs. Motion by Lindquist. second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between MNDOH and County of Otter Tail for costs to train staff for Family Home Visiting programs. Training is scheduled for the end of April 2014. OTC Board of Commissioners' Minutes April 1, 2014 Page 3 Otter Tail County Sanitation Code Bill Kalar, Land & Resource Director, presented the final Otter Tail County Sanitation Code and requested adoption of the Code. Motion by Rogness, second by Huebsch, and unanimously carried to adopt the Otter Tail County Sanitation Code for Subsurface Sewage Treatment Systems incorporating by reference Minnesota Rules Chapters 7080, 7081, and 7082 with some local modifications effective April 15, 2014. A summary of the adoption of the Sanitation Code will be published in the daily, local newspaper on or before April 15, 2014 with the full version of the Sanitation Code available on the County's website. OTTER COUNTRY TRAIL ASSOCIATION (OCTA) GRANT-IN-AID FUNDING Otter Tail County Resolution No. 2014 -24 Commissioner Rogness offered the following and moved its adoption: WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED, that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for the Otter Country Trail Association Snowmobile Club for the 2014-2015 snowmobile season and proposed extensions of Grant-In-Aid Trails with the aforementioned condition. Commissioner Lindquist seconded the resolution and, upon being put to vote, the resolution was unanimously adopted this 1st day of April, 2014 Dated: 11:,,~:1 8, 2 .. 1'{ F COMMISSIONERS Attest: k~ -d L:arry K hn, Clerk Final Plat Extension Motion by Froemming, second by Huebsch, and unanimously carried to approve a one year extension to May 14, 2015 for filing the Final Plat of Daniel and Jane Wood titled "Cross Point Addition", which is part of the Cross Point Resort on Lida Lake (56-747). Recess & Reconvene At 10:04 a.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The Board of Commissioners meeting was reconvened at 10:09 a.m. Ditch #28 and #15 Redetermination Kevin Fellbaum, Ditch Inspector, provided maps of Ditch #28 and Ditch #15 including the original benefited areas of each ditch. Mr. Fellbaum requested approval to redetermine the benefits on these ditches and consider combining them because they flow together. Motion by Huebsch, second by Lindquist, and unanimously carried to redetermine the benefits on County Ditch #28 and County Ditch #15 and consider combining the ditches. The County Attorney will prepare an Order to proceed with the redeterminations. OTC Board of Commissioners' Minutes April 1, 2014 Page 4 Ditch Redetermination and Inspection Schedule Mr. Fellbaum submitted a proposed schedule and priority list for redetermination of benefits for specific county ditches and a ditch inspection schedule from CY2014 through CY2017. A map was provided which breaks out the inspection schedule into five different sections. Twelve ditches will be inspected each year to meet a five-year rotating inspection requirement under Minnesota Statute. Red River Watershed Management Board Conference Mr. Fellbaum reported on a recent RRWMB conference. The Red River Basin is pressing for a 20% reduction of flow during peak flow times so they are asking watersheds to store water in the spring. Discussion took place regarding who pays for the storage of the water which should include those benefited downstream. Mr. Fellbaum's report indicated that while water quantity is the current topic, water quality will be an issue in the future. Proposed Salt Storage Building Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between Braun lntertec and the County of Otter Tail for completion of a geotechnical evaluation for the proposed salt storage building at the County Highway 1 garage location. Seasonal Highway Supplies Bid Awards After previously advertising for the 2014 Seasonal Highway Supplies, bids were opened March 26, 2014. The Public Works Director submitted a bid summary and recommendation for award of the Seasonal Supplies. Mr. West spoke about the value of developing a Transportation Plan prior to increasing levy dollars for road preservation in Otter Tail County. Discussion followed. Motion by Rogness, second by Lindquist, and unanimously carried to authorize SRF Consulting to proceed with developing an Otter Tail County Comprehensive Transportation Plan. Westridqe Mall Tax Court Decision David Hauser, County Attorney, briefed the County Board on how tax appeals move through the court system. He indicated that appeals on tax court decisions go directly to the Supreme Court. Attorney, Ryan Cheshire and Auditor, Wayne Stein discussed the Westridge Mall Court case and the financial impact to the various local government entities for Calendar Years 2010, 2011, and 2012. Closed to the Public At 11 :23 a.m., Chairman Johnson declared the Board of Commissioners meeting closed to the public to discuss Attorney-Client privilege strategies regarding the Westridge Mall Tax Appeals. The closed session is authorized under Attorney-Client privilege, M.S. §13D.05, Subd. 3(b). Present were all five seated Commissioners; County Attorney; Assistant County Attorney, Ryan Cheshire; City of Fergus Falls Representatives, Mark Sievert and Bill Sonmor; Assessor, Doug Walvatne; Auditor, Wayne Stein; Land Services Director, Brian Armstrong; the County Administrator; and Board Secretary. Adjournment At 12:15 p.m., Chairman Johnson declared the Closed Session complete and with no additional agenda items to consider, declared the meeting of the Otter Tail County Board of Commissioners adjourned for committee meetings.
