Fir Avenue, Fergus Falls, MN March 25, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, March 25, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present. Approval of Agenda Chairman Johnson called for approval of the March 25, 2014 agenda. Motion by Froemming, second by Lindquist, ·and unanimously carried to approve the Board of Commissioners agenda of March 25, 2014 with the following additions: • 10:00 a.m. -Westridge Mall Tax Court Judgment Discussion • Several Meeting Updates Consent Agenda Motion by Huebsch, second by Froemming, and unanimously carried to approve the Consent Agenda items as follows: A. Absentee Ballot Board Appointments Administrator Updates Larry Krohn, County Administrator, reported on John Dinsmore's mobility assignment with the State of Minnesota Department of Human Services. Mr. Dinsmore will maintain the Community Services Director portion of his County position and Deb Sjostrom, Human Services Supervisor, will be promoted to County Human Services Director on an interim basis starting April 1, 2014. Mr. Krnhn reported that surrounding counties are discussing the most efficient way to assist each other during interim periods when key employees are being replaced. The counties will explore the need for a multi-county Human Services Regional Director position. Administrators from the counties will put together a committee to develop a process and identify a facilitator. Commissioner Huebsch expressed an interest in serving on this committee. Years of Service Awards Chairman Johnson expressed appreciation to employees and thanked them for their dedicated service throughout the past years. Mr, Johnson and Employees' Committee President, Heather Brandborg presented "Years of Service Awards" to recognize individual County employees who have completed from 5 to 45 years of service with Otter Tail County. OTC Board of Commissioners' Minutes March 25, 2014 Page 2 Recess & Reconvene At 9:50 a.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners to personally visit with employees accepting "Years of Service" awards. The Board of Commissioners meeting was reconvened at 10:07 a.m. Westridge Mall Tax Court Discussion Doug Walvatne, Assessor, reported that the Judgment on the Westridge Mall Court Petition has been received. The Judgment was not a favorable ruling for Otter Tail County. Mr. Walvatne provided a synopsis of events in the case. During the court proceedings on November 5, 2013, three years of court petitions were considered for taxes payable 2010, 2011, and 2012. Each side completed their assessment and presented their respective position/case. The Court Decision significantly reduced the valuation of the Westridge Mall property for each petitioned year. Lengthy discussion took place regarding various assessment methods that can be used when valuation is determined, future valuation, and possibility to appeal the decision. A Closed Session on this topic will be scheduled during the next regular County Board meeting. County Ditch #4 Order Authorizing Work Motion by Huebsch, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Order Authorizing Work in County Ditch #4 as presented by the County Attorney. Safe Communities Coalition Diane Thorson, Public Health Director, and Jane Patrick, Safe Communities Coordinator, requested funding, not to exceed $5,000, for a Safe Rides Program entitled Joyride. The program has operated in the Ottertail, Battle Lake and Perham areas to provide safe rides home for those who have been drinking alcohol and to minimize the impact of impaired traffic accidents. Motion by Rogness, second by Huebsch, and unanimously carried to authorize the Otter Tail County Public Health Department to enter into a contract with Anderson Bus Company for the Joyride program for a one time allocation not to exceed $5,000 to be used to pilot whether this type of program can be self-sustaining through donations and fees charged for riding the bus. Authority for funding was cited under Minnesota Statues Chapter 145A, Subd. 3. Public Health Contract Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a MN Department of Health Project Agreement for a program directed to reduce families' need for future services, especially for parents with premature infants or other physical risk factors associated with learning and development. Effective, April 1, 2014, MDH provides Otter Tail County $3,814.00 for the program. Buffer for Public Waters Program After meeting with the Public Works Committee, Brad Mergens and Darren Newville, SWCD Managers, submitted a written proposal for the Otter Tail County Buffer Initiative Implementation schedule. The purpose of the initiative is to assist landowners and the County to move to 100% compliance with State and County shoreland rules as noted in Section IV.4.B. on page 17 of the Otter Tail County Shoreland Management Ordinance (8/1113). Phase 1 is a three year plan with an anticipated start date of April 1, 2014. All landowners will receive a personalized letter, fact sheet, and assistance to enroll their property. In an effort to continue protecting Otter Tail County's most precious resource, a motion was offered by Huebsch, seconded by Rogness, and unanimously carried to approve the Buffer Initiative program and schedule as presented by the SWCDs. OTC Board of Commissioners' Minutes March 25, 2014 Page 3 Natural Gas Resources Initiative Commissioner Rogness reported that there is a group of local officials and business owners looking at the resources associated with the natural gas infrastructure and its inefficient sizing. The Mayor of Fergus Falls has asked Commissioner Rogness to serve on this committee. Motion by Huebsch, second by Froemming, and unanimously carried to appoint Commissioner Lee Rogness to this Natural Gas Resources Initiative. Recess & Reconvene At 10:49 a.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 10:53 a.m. Land Records Software and Software Platforms Brian Armstrong, Land Services Director, briefed the Board regarding new software platforms that are available for electronic recording of documents in the Recorder's office. Funding for the new software will come from the Otter Tail County Technology Fund. Mr. Armstrong is also reviewing document recording trends. Child Protection Annual Report Tamra Jokela, Human Services Supervisor, introduced Child Protection staff. She presented statistics on the number of Child Protection and Child Welfare services/cases for FY2013 along with the Specialty Programs provided during that same time period. Lengthy discussion followed regarding Children's mental health issues and challenges to service these children. Ms. Jokela indicated that Otter Tail County needs additional foster care homes. Commissioners suggested public education regarding the need and the role/expectations of foster care homes and sharing of positive, successful foster care outcomes. CHILD ABUSE PREVENTION PROCLAMATION Otter Tail County Resolution No. 2014 -22 WHEREAS, child abuse prevention is a community problem and finding solutions depends on involvement among people throughout the community; and WHEREAS, the effects of child abuse are felt by whole communities and need to be addressed by the entire community; and WHEREAS, effective child abuse prevention succeeds because of partnerships created between parents, practitioners, schools, faith communities, healthcare organizations, law enforcement agencies, and the business community; and WHEREAS, family serving, youth-focused prevention programs offer positive alternatives for young people and encourage parents and youth to develop strong ties to their communities; and WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention within the community, and be involved in supporting parents to raise their children in a safe, nurturing society; and NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby proclaims April 2014 as Child Abuse Prevention Month in Otter Tail County, and call upon all citizens, community agencies, religious organizations, medical facilities, and businesses to increase their participation in efforts to prevent child abuse and neglect, thereby strengthening the communities in which we live. OTC Board of Commissioners' Minutes March 25, 2014 Page 4 Upon a motion by Commissioner Rogness, seconded by Commissioner Lindquist, the Otter Tail County Board of Commissioners adopts the foregoing resolution by a unanimous vote this 25th day of March 2014. Recess & Reconvene At 11 :20 a.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners and reconvened the meeting at the Otter Tail County Courthouse at 11 :30 a.m. for a tour of the Phase 2 Courthouse Remodel project. Chairman Johnson recessed the meeting at 12:15 p.m. and reconvened at the Government Services Center at 12:50 p.m. Art Sculpture on Roundabout on Tower Road Gordon Hydukovich, Community Development Director, presented an art sculpture submitted by Ann Klefstad for the Tower Road Roundabout. Motion by Huebsch, second by Froemming, and unanimously carried to approve installation, subject to proper engineering, of the art sculpture as submitted. This allows the committee working on this project to begin fund raising to pay for the art work. Computer Purchase Sheriff Brian Schlueter requested lease or purchase of eighteen new Toughbook laptop computers for the patrol vehicles because Microsoft XP is no longer a supported operating system. Motion by Huebsch, second by Froemming, and unanimously carried to purchase eighteen laptop computers for the Sheriffs Office from CDW-G of Illinois at a cost of $64,329.48 from the County's Capital Improvement Fund. Productive Alternatives. Inc. Pursuant to due call and notice thereof, a regular or special meeting of the Board of Commissioners of Otter Tail County, Minnesota, was duly held at the Commissioners Room, Government Services Center, Fergus Falls, Minnesota on Tuesday, March 25, 2014. The following members were present: Commissioners Huebsch, Rogness, Lindquist, Froemming, and Johnson; and the following were absent: None Member Douglas Huebsch introduced the following resolution and moved its adoption: RESOLUTION NO. 2014 -23 RESOLUTION GIVING CONSENT TO THE ISSUANCE OF A COMMUNITY SERVICES REVENUE NOTE UNDER MINNESOTA STATUTES, SECTIONS 469.152 THROUGH 469.1655 (PRODUCTIVE ALTERNATIVES, INC. PROJECT) The motion for the adoption of the foregoing resolution was duly seconded by member John Lindquist, and after full discussion thereof and upon vote being taken thereon, the following voted in favor thereof: Commissioners Huebsch, Rogness, Lindquist, Froemming, and Johnson and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. OTC Board of Commissioners' Minutes March 25, 2014 Page 5 BE IT RESOLVED, by the Board of Commissioners (the "Board") of Otter Tail County, Minnesota (the "County") as follows: Section 1. General Recitals. The purpose of Minnesota Statutes, Sections 469.152 through 469.1655, as amended, (the "Act"), is among other things, to promote the welfare of the State of Minnesota (the "State") by the active attraction and encouragement and development of economically sound industry and commerce to prevent so far as possible the emergence of blighted and marginal lands and areas of chronic unemployment. Section 2. Description of the Project. Productive Alternatives, Inc. (the "Borrower"), a Minnesota nonprofit corporation and organization described in Section 501 (c)(3) of the Internal Revenue Code of 1986, as amended (the "Code"), has proposed that the City of Fergus Falls, Minnesota (the "Issuer'' or "Fergus Falls" issue a revenue note under the Act, in one or more series, in an aggregate amount not to exceed $2,000,000 (the "Note") to finance a project which consists of (i) refunding the outstanding principal balance of the Health Care Facilities Revenue Note, Series 2005 (Productive alternatives, Inc. Project) (the "Series 2005 Note") issued by Otter Tail County, Minnesota for the Borrower, to finance the construction and equipping of , and refinancing of, certain facilities owned and operated by the Borrower located at 1011 and 1017 North Tower Road in Fergus Falls; (ii) financing the costs of expansion, equipping and furnishing of the Borrower's facilities located as 1205 North Tower Road in Fergus Falls, and (iii) refinancing various outstanding debts of the Borrower which financed (a) the acquisition and remodeling of the Borrower's offices and program space for the vocational services and other programs operated in Borrower's facility located at 802 Jenny Avenue in the City of Perham, Minnesota, (b) remodeling of a building for use as office space and construction of garage stalls at the Borrower's facility located as 1205 North Tower Road in Fergus Falls, and (c) the acquisition of community development facilities and the acquisition of equipment at the Borrower's facilities located as 1205 North Tower Road and 1011 North Tower Road in Fergus Falls (collectively, the "Project"). The Project is owned and operated by the Borrower. Section 3. Representations Made by the Borrower. The Borrower has agreed to pay any and all costs incurred by the County in connection with the issuance of the Note. Section 4. Consent to Issuance of the Note. Minnesota Statutes §471.656, Subd. 2(2) provides that in order to refinance the Series 2005 Note, the consent of the County is required. Pursuant to such statute, the Board of Commissioners hereby consents to the issuance of the Note by the Issuer to refund the Series 2005 Note. Nelson titled "Beauty Beach on Otter Tail Lake First Addition" located in Section 13, Amor Township, Otter Tail Lake (56-242). AIS Task Force Bill Kalar, Land & Resource Director, submitted the March 2014 minutes of the Aquatic Invasive Species (AIS) Task Force and reviewed the proposed budget. He reported that two I-LIDS (cameras) will be acquired by the Ottertail Lake Association to be used at the lake's launches. Details will be worked out and DNR permits will be acquired. OTC Board of Commissioners' Minutes March 25, 2014 Page 6 Sanitation Code Adoption Discussion Mr. Kalar discussed the public concerns that were expressed at the recent Public Hearing March 11, 2014. Language changes were recommended by the Board to address the concerns. Mr. Kalar will return to the Board April 1, 2014 with a final draft of the proposed Otter Tail County Sanitation Code. Crop Show Participation Motion by Huebsch, second by Froemming, and unanimously carried to authorize Commissioners' attendance at the 2014 Crop Show Bois de Sioux Watershed District Pat Haney, property owner in the BdSWD, encouraged Commissioners to attend the public hearing for the Bois de Sioux Watershed District Water Management Plan Amendment on April 9, 2014 at 5:30 p.m. at the American Legion in Wheaton, MN. He indicated that the water plan can be amended every ten years. He expressed some concern with proposed impoundments and the cost to property owners in the district. Motion by Rogness, second by Froemming, and unanimously carried to authorize Commissioner Lindquist and/or other County Commissioners to attend this meeting to represent Otter Tail County. Highway Project Bid Awards Rick West, Public Works Director, provided a document titled "Otter Tail County 2014 Highway Projects". He reviewed the following bid summaries and recommendations for three projects. Motion by Froemming, second by Rogness, and unanimously carried to award the following projects to the low bidders: Project Low Bidder Proiect Bid Amount S.P. 056-070-010 & 011 and MN Project No. HSIP 5614 (094); Installation of Chevrons & Traffic Marking Service, Inc. $91,920.00 Enhanced Intersection Signage & Pavement Maple Lake, MN Markings C.P. 14128B & Etc, CH 128 & CH 145 Mark Sand & Gravel Co. $757,140.80 Overlav Ferqus Falls, MN S.A.P. 056-650-007, Reconstruction of CSAH Minnerath Construction Co., Inc. 987,760.54 50/CSAH 67 Cold Sorina, MN By consensus, Commissioners indicated that C.P. 14: 1128, Overlay CH 112 (from CSAH 15 to CSAH 1) 2014 proposed highway project will be deferred at this time and will not be bid out with the other listed projects. Recess & Reconvene At 2:40 p.m., Chairman Johnson recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 2:45 p.m. County Board Room Technology Discussion took place regarding the County Board room and the possibility to add some technology to assist the public in viewing plats and other documents. County Ditch #70 Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute the County Ditch #70 Order for Preliminary Hearing on Improvement Petition as submitted by the County Attorney.
