Fir Avenue, Fergus Falls, MN March 11, 2014 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 11, 2014 at the Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming, Vice-Chairman; John Lindquist, and Lee Rogness present. Commissioner Huebsch was absent. Approval of Agenda Chairman Johnson called for approval of the March 11, 2014 agenda. Motion by Rogness, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of March 11, 2014 with the following additions to the Consent agenda: • Approval of 2014 Tobacco License for Thumper Pond Resort LLC • Human Services Bills and Claims Consent Agenda Motion by Froemming, second by Lindquist, and unanimously carried to approve the Consent Agenda items as follows: A. March 4, 2014 Board of Commissioners' Minutes with clerical change as discussed B. Warrants/Bills for March 11, 2014 (Attachment A) C. Nine-month On-Sale Liquor License for The Peak Supper Club D. 2014 Tobacco License for Pelican Hills RV Park E. 2014 Tobacco License for Thumper Pond Resort, LLC F. Human Services Bills and Claims Fraud Prevention Investigation Training Motion by Lindquist, second by Rogness and unanimously carried to approve Commissioners attendance to one of the two sessions of the Fraud Prevention Investigation Training on Monday, March 31, 2014. Recess & Reconvene At 9:40 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:45 a.m. Backhoe Purchase from State Contract Motion by Froemming, second by Lindquist and motion carried with Rogness abstaining to authorize the Solid Waste Department to purchase a new 2014 John Deere 31 OSK Backhoe for the Henning Transfer Station through the State Contract. The cost of the Backhoe is $85,648.00. RDO Equipment Co. will be the delivery dealer for the equipment. Final Payment Motion by Lindquist, second by Froemming and unanimously carried to authorize the appropriate county officials signatures on the Final Payment to the City of Fergus Falls for Otter Tail County's share of the cost of the Main Extension to the County Transfer Station on Airport Drive. Recess & Reconvene At 9:54 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:00 a.m. OTC Board of Commissioners' Minutes March 11, 2014 Page 2 Public Hearing for Revisions to the Otter Tail County Sanitation Code Commissioner Johnson called to order the Public Hearing for the revisions to the Otter Tail County Sanitation Code. Bill Kalar reviewed his discussion with the Minnesota Pollution Control Agency (MPCA) regarding the proposed revisions to the Sanitation Code. The MPCA requested that on page 3 under 80.1500 subp. A (1) the term Designated Registered be change to the Certified. All other changes suggested by the MPCA are clerical changes. Commissioner Johnson opened up the meeting for Public comment. Comments are summarized as follows: Public Hearing for Sanitation Code: Milt Paulson, owner Paulson Land Company of Battle Lake: • Concerned that the language "The buyer shall provide a currently valid Compliance Inspection to the seller at or before the closing date." on page 3 Subp. A Point of Sale Compliance Inspection Paragraph A (1) would take away any negotiating room regarding the sale of the property as far as who pays for the inspection. Linda Stoll, Coldwell Banker Offices: • Also concerned with "the Buyer shall" language. Chuck Moe, Girard Township, East Battle Lake: • Did not see a provision for an appeal of the judgment of the inspectors. Denise Gubrud, Inspector from Land and Resource Management: • Question on Page 4 Pump Tank "alarm device must be electronic". It was clarified that this was only for Pump tanks not holding tanks. • Page 5, last paragraph, a question on why the setback would be reduced to 5 feet on substandard lots. Melvin McGowan, retired System Installer: • Question on the wording of "3 working days" in the last paragraph of the document. Chairman Johnson thanked the public for their comments and closed the Public Hearing at 10:45 a.m. County City Agreement Motion by Rogness, Second by Lindquist and unanimously carried to approve the Agreement with the City of Fergus Falls for Reconstruction of CSAH No. 27 and Overlay of Fir Avenue. Highway/Road Tour Commissioners scheduled a road tour on Friday, May 2, 2014 beginning at 8:30 a.m. at the Government Services Center in Fergus Falls. Adjournment At 10:59 a.m., Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners adjourned for committee meetings. The next County Board meeting is scheduled at 9:30 a.m. on Tuesday, March 25, 2014.
